3 CEPE Labelling Guide 11 th edition Part SPECIAL LABELLING REQUIREMENTS ARISING FROM OTHER EUROPEAN HARMONISED LEGISLATION 1.1 Biocidal Paints The Biocidal Products Directive 98/8/EC requires (Art. 20.3) additional labelling for paints claiming a biocidal effect. See Appendix Detergents (Cleaners) Detergents (Cleaners) sold to the general public require additional labelling informing the user on the composition to be given according to Annex VII of Regulation (EC) No 648/2004 on Detergents. See Appendix Decorative Paints and Vehicle Refinish Products Directive 2004/42/EC on VOC limits in Decorative Paints and Vehicle Refinish Products requires special labelling to inform users of the VOC content. See Appendix LABELLING REQUIRED BY NATIONAL LEGISLATION Some Member States have additional labelling requirements for preparations placed on the market in their territories:. for information on these please refer to guidance from the relevant national association(s). Unless the obligatory phrase applicable to category 1 or 2 Carcinogens, Mutagens or Toxic to reproduction applies (see Appendix 1.2, par. 1.5), use either L201 For professional use only or L202 This product is for the professional painting of vehicles only after reference to the manufacturer s data sheet The choice of phrase will be dependent on the space available. Source: Technical Committee Vehicle Refinishes (1997) 3.3 Water-borne printing inks containing aluminium pigments The EuPIA TC has agreed to use a group of phrases to address the potential risk of hydrogen forming that may lead to explosion of the packaging: L203 "Product may release hydrogen. Exercise caution when opening to allow pressure release. Avoid increased storage temperature. Do not mix with other ink waste". Source: EuPIA TC, October Coatings and printing inks with risk of spontaneous combustion Following consultation with relevant sector groups, TC-LSDS has agreed to recommend a phrase for use on the label of products which: - are classified under CLP as self-heating (H251/H252) and/or oxidising liquids (H271/H272), or

5 CEPE Labelling Guide 11 th edition Part contain more than 10% air drying (auto oxidising) oils or high oil content binders and give a positive result for spontaneous combustion in a test according to ASTM D6801. The following phrase may be applied at the discretion of the manufacturer, based on knowledge of the product (testing is not obligatory). It is recommended mainly for consumer products for which no safety data sheet is provided; for other products a plug-in phrase (Pi-029) is available for the SDS. L205 Risk of self-ignition of used cleaning rags, paper wipes etc. Contaminated materials should be soaked in water and placed in a closed metal container before disposal. 6 CEPE Labelling Guide 11 th edition Part 2 6 Appendix 2.1 LABELLING REQUIREMENTS FOR BIOCIDAL PAINTS In addition to the requirements for packaging and labelling set in the Dangerous Substances and Preparations Directives 67/548/EEC and 1999/45/EC and the CLP Regulation 1272/2008, the following additional labelling is required by the Article 20.3 of the Biocidal Products Directive 98/8/EC. Warning: This Appendix reflects the basic recommendation to CEPE members, noting the need to refer to specific Member States regulations which may differ from these recommendations. Note: Some requirements of this article (e.g. par. (f), (h)) are already covered by the labelling required by the Dangerous Preparations Directive 1999/45/EC or are irrelevant for biocidal paints (e.g. par (l) and part of (j)). 8 CEPE Labelling Guide 11 th edition Part 2 8 APPENDIX 2.2 LABELLING REQUIREMENTS FOR DETERGENTS (CLEANERS) In addition to the requirements for packaging and labelling set in the Dangerous Substances and Preparations Directives 67/548/EEC and 1999/45/EC and the CLP Regulation 1272/2008, the following additional labelling is required by Regulation (EC) No 648/2004 (as amended by Regulation (EC) No 907/2006 and Regulation (EC) No. 1336/2008) 2. A. For detergents sold to the general public: The name and trade name of the product The name, full address and telephone number of the party responsible for placing the product on the market The address, website, address, where available, and telephone number where the ingredients datasheet can be obtained The packaging of the product shall indicate the content, in accordance with the specifications provided for in Annex VII A. It shall also indicate instructions for use and special precautions, if required. The following weight percentage ranges: less than 5 %, 5 % or over but less than 15 %, 15 % or over but less than 30 %, 30 % and more, shall be used to indicate the content of the constituents listed below where they are added in a concentration above 0,2 % by weight: phosphates, phosphonates, anionic surfactants, cationic surfactants, amphoteric surfactants, non-ionic surfactants, oxygen-based bleaching agents, chlorine-based bleaching agents, EDTA and salts thereof, NTA (nitrilotriacetic acid) and salts thereof, phenols and halogenated phenols, paradichlorobenzene, aromatic hydrocarbons, aliphatic hydrocarbons, halogenated hydrocarbons, soap, zeolites, polycarboxylates. 2 Consolidated text available at:

9 CEPE Labelling Guide 11 th edition Part 2 9 The following classes of constituent, if added, shall be listed irrespective of their concentration: enzymes, disinfectants, optical brighteners, perfumes. If added, preservation agents shall be listed, irrespective of their concentration, using where possible the INCI 3 nomenclature. If added, as such, at concentrations exceeding 0,01 % by weight, the allergenic fragrances using where possible the INCI nomenclature. B. For detergents sold exclusively to professional users The above labelling requirements do not have to be fulfilled if the equivalent information is provided by means of technical data sheets, safety data sheets, or in a similar appropriate manner. 10 CEPE Labelling Guide 11 th edition Part 2 10 Appendix 2.3 LABELLING REQUIREMENT FOR DECORATIVE PAINTS AND VEHICLE REFINISH PRODUCTS 1. Decorative paints and varnishes in scope of Directive 2004/42/EC TC Deco has agreed to use a phrase to comply with the requirements of Directive 2004/42/EC for decorative coatings. 1.1 For products sold to the general public L150 a: EU limit value for this product (cat. A/w): y g/l. This product contains max z g/l VOC or b: EU limit value for [product name] (cat. A/w): y g/l. [Product name] contains max z g/l VOC where w refers to the categories a to l, y to the limit value for 2010 mentioned in Annex II, part A to Directive 2004/42/EC and z the maximum VOC content in g/l of ready for use product. CEPE recommends putting the labelling information inside the existing legal box as supplementary information referred to in Article 11.1 of Directive 1999/45/EC or Article 25.3 of Regulation 1272/2008 to ensure international harmonisation. If this legal box does not exist the information should be placed elsewhere on the label in a readable form. For those products sold in small packaging (<125 ml) where it is impossible to include the L150 a) or b) text as proposed above due to the lack of space on the label, the following code could be used: L150 c: 2004/42/IIA(w)(y)z indicating a product in subcategory w in Annex IIA, with an allowed limit of y g/l from and a maximum VOC content ready to use of z g/l of the labelled product. 1.2 For products exclusively sold to professional painters and not made available to the general public L201 For professional use only L150 c: as above 2004/42/IIA(w)(y)z

Vehicle refinishes TC Vehicle Refinishes has agreed to use a code to comply with the requirements of Directive 2004/42/EC for vehicle refinishes: L151: 2004/42/IIB(w)(x)z where w refers to the categories a to e, x to the allowed limit mentioned in Annex II, part B to Directive 2004/42/EC and z the maximum VOC content in g/l of ready for use product. (Except for subcategory (a) any water content of the product ready for use should be discounted). L151 is a product-related code which has to be explained in a Technical Data Sheet (TDS).
