3 1 Introduction In the international airfreight trade, goods are transported all over the world. Thousands of shipments are flown across the world daily for loading and unloading at numerous airports. Loading and unloading requires extensive and time-consuming administrative paperwork. In January 2004, the Sagitta Entry System (SBB) became operational for international maritime transport only. Over the past few years, the Vracht Inklarings Punt programma (Freight Clearing Point Programme or Vipprog) has been providing electronic support in the goods import process, particularly at Schiphol. However, the supplied information could be used to greater advantage in the subsequent customs procedures. The new SBB system marks an essential improvement in this process. The Vipprog electronic declaration authorisation is due to be replaced by the authorisation electronisch berichtenverkeer binnenkomende goederen and the authorisation Vergunning binnenbrengen, aanbrengen en elektronische summiere aangifte. Besides Schiphol Airport, there are other international airports where the freight can enter the Netherlands. SBB is to be used for the clearance of all airplanes and all airfreight in the Netherlands. The other airports concerned are: Rotterdam Airport Eindhoven Maastricht/Aachen Airport Eelde This brochure sets out more information about the Sagitta Entry system. 4 2 The Sagitta Entry system Customs first introduced its automated Sagitta Entry system on 1 January Initially, the system was used solely for maritime transport. In 2008 it will be extended to include air transport. The system is used for the processing of summary declarations for incoming vehicles and their cargo. The system supports the (mass) entry process of vehicles and goods at airports. Customs have formulated a number of basic principles for the development and use of Sagitta Entry: The information on the means of transport and goods must be supplied electronically by the declarant. The entry process and specific inspections for cross-border movements require the submission of (pre-arrival) information about the goods to be unloaded. This applies to both information about goods from outside the European Community, community goods, empty containers and goods to be re-exported from the Netherlands by different means of transport. Following the arrival of the plane, the status of the pre-arrival information supplied changes to a summary declaration by means of a declaration of responsibility. The declaration of responsibility is arranged for in the authorisation required for the use of SBB. The information supplied is reused where possible, subject to all relevant legal stipulations. Data do not need to be resubmitted for the summary declaration. If the declarant prefers to make the declaration in writing, the procedures will be delayed. The declarant lodging the declaration must report to the first customs office of entry and clear the vehicle and cargo. The written summary declaration will be processed upon entry of the means of transport. The selection of goods for inspection is then carried out manually. The declarant lodging the declaration will not be granted permission to unload until the selection process has been completed. Representation Under Community legislation, the summary declaration is lodged by the person who has entered the goods into the EC Customs territory. 3

5 For the entry of goods by air, this is the captain/airline. Alternatively, the person charged with the transport of goods after they have been entered may lodge the summary declaration. This legislation also stipulates that people can have themselves represented for the completion of the acts and formalities prescribed by customs law. Foreign airlines in particular are often unfamiliar with European and Dutch customs legislation and face problems fulfilling the prescribed acts and formalities. They may benefit from being represented by their airfreight handler in supplying the pre-arrival information and/or to file the summary declaration. 2.1 Changes in air transport Sagitta Entry will bring changes for the clearance of goods transported by air. These changes are set out over the next few paragraphs. Where necessary, differences with the current mode of operation are also specified. The new entry process comprises the following steps: 1 Notification of airplanes 2 Supply of pre-arrival information on the goods 3 Customs control selection 4 Report arrival airplane 5 Summary declaration These steps are explained below Notification of airplanes Before entry of an airplane, the declarant must report a visit number to Sagitta Entry. This is referred to as the Call Reference Number (CRN). The number comprises (up to 35 positions): indication of the airport (5 positions) identification of airline (3 positions) flight number (5 positions) date of arrival (6 positions) identification of arrival (A) 4

6 Example The CRN for KLM flight number 12345, arriving at Schiphol on 27 June 2007 is NLSPLKL_ A Customs use the CRN as the reference number for clearance. The pre-registration of the transport and the associated pre-arrival information of the goods must also refer to this reference number (see paragraph 2.1.2). The message 'Notification means of transport stay' comprises the following details: the airplane registration number the captain, crew and any passengers the air freight agent an identification of the airline (e.g. IATA code) the airport of (first) origin the airport of destination the journey overview the other transporters carrying freight on board, the so-called co-loaders the Expected Time of Arrival: ETA If changes need to be made to information already submitted, for example the expected time of arrival, the declarant must send an update message. This message mutates the original information held by Customs. In the event of a cancellation the declarant must cancel the pre-registration and pre-arrival information supplied Supply of pre-arrival information One of the main characteristics of SBB is the electronic supply of pre-arrival information for goods unloaded from airplanes at Dutch airports. The pre-arrival information comprises an electronic manifest, with information about the shipments onboard ((House) Air Way Bills). Most airlines already supply electronic manifests to Cargonaut before arrival of the airplane at Schiphol. Cargonaut in turn supplies this information to the Vipprog Customs system. The electronic supply of pre-arrival information does not yet take place at other airports. 5

7 The pre-arrival information must have been received by Customs at the Dutch airport at least 4 hours before arrival. If the journey between the airport of departure and the airport of destination is less than 4 hours, the information must be supplied no later than at the time of departure from the last airport. The pre-arrival information must contain the CRN as well as all other details that refer to the 'Notification means of transport stay' message. In addition to procedural information used to identify the sender of the message, information needs to be supplied on all goods to be unloaded. This includes: the Air Way Bill or House Air Way Bill numbers respectively (AWB/ HAWB numbers) the logistics chain a description of the goods and preferably the harmonised system code (HS code) the brands and numbers the gross weight the number of packages the handling code the type of ULD and the ULD number the empty packaging the goods Customs status information about re-export Air Way Bill or House Air Way Bill number (AWB number or HAWB number) SBB uses the AWB and HAWB numbers for the identification of the goods. Goods identification based on AWB is an internationally accepted standard in the airfreight industry. The underlying House Airway Bills (HAWB) with AWB are crucial for the correct selection of the goods inspected by Customs. A (H)AWB number comprises up to 17 positions. 6 Logistics chain The sound analysis, assessment and risk cover in international goods transport depends on the recognisability of the (individual) links in the logistics chain. It must comprise, for example, information about the consignor, the consignee and the notifier. The same applies for information about the origin of the goods.

8 Goods description and HS code The goods description may be brief, but must comprise at least a generally used trade name. Not permitted are meaningless descriptions such as 'consolidated goods', 'merchandise', 'freight of all kind', 'foodstuff' or 'groupage', unless the load is accompanied by a HAWB with a goods description. The specific description i.e. at the level of the HAWB of the goods reduces delays in the logistics process and reduces the number of shipments to be inspected. Preferably, the four-digit HS product code is included for veterinary and phytosanitary goods. Number of packages To determine the number of packages, the smallest packaging unit that can be seen must be specified. 10 crates with each 20 boxes must therefore be specified in the pre-arrival message as 200 boxes rather than 10 crates. Handling code The handling code is a code used to describe the handling during loading, transport and unloading the goods supplied. For example, Customs uses this code to prevent live animals from being scanned during inspection. ULD type and ULD number To be able to carry out the inspections, the ULD type and ULD number must be known. (ULD stands for Unit Loaded Device). A ULD may combine several shipments (consolidation). In that case, several AWBs refer to one ULD. Empty packaging Information is required for all goods to be unloaded. Empty packaging (ULDs, airplane plates and such) may be used as goods or as stowage materials. Empty packaging is classified as goods only if it is to be transported onward upon arrival. These goods must be identifiable by means of an AWB number. 7

9 Customs status goods The goods' Customs status must be reported in SBB for Customs supervision of the goods. SBB contains a field where a code can be entered to indicate if these goods are: community goods (code C) empty ULDs (code E) export goods (code X) Information re-export The pre-arrival information comprises a (separate) field for 'transhipment shipments'. Code '27' to be entered in this field is reserved exclusively for the direct re-export of shipments onto another plane. This code may not be used if the goods are given another customs approved treatment or use, for example placement under the Customs warehouse procedure or in the Schiphol free zone. 3 Customs Control Selection Based on the information supplied, Customs will timely indicate which load will be inspected. Customs will also specify the type of inspection, for example inspection by scan or a physical inspection. To some extent, selection in SBB is carried out as an automised procedure, which speeds up the logistics process. 8

10 4 Presentation of goods to Customs and summary declaration This chapter describes in greater detail the process of presentation of goods to Customs and summary declaration within SBB. Presentation of goods to Customs: Update notification means of transport stay The message 'Update notification means of transport stay 'is a key point in SBB. When the means of transport is reported, the messages 'Notification means of transport stay' and 'pre-arrival information for goods' are closed. The expected time of arrival is replaced by the actual time of arrival: ATA. The message is an update to the 'Notification means of transport stay' message. This update message specifies the actual time of arrival. Also, the number of crew and passengers may not be known until the actual arrival, for example. This information may then be included and sent in the same update message. This completes the formal notification of the goods. Summary declaration The pre-arrival information supplied may be changed to a summary declaration by means of a declaration of responsibility. This declaration of responsibility can be both unique and continuous. The holder of the authorisation uses a continuous declaration of responsibility to indicate that the information supplied by him may always serve as summary declaration. Holders of authorisation using a unique declaration of responsibility have to indicate for each 'Notification means of transport stay' and message 'pre-arrival information for goods' that this information may serve as summary declaration. For this, Customs must have received a separate message no later than 24 hours after arrival of the vehicle. Within a term of 20 days, the goods listed on the summary declaration must be assigned a customs approved treatment or use. 9

11 If following the arrival of the airplane the declarant receives information that changes the summary declaration, these changes may be made within the term specified. Examples include differences between the summary declaration and the goods presented to customs. These changes must be reported electronically by means of an update message. The handler may submit such message only if the airline has authorized him to do so. 5 More information To exchange electronic messages with Customs using SBB you need an authorisation electronisch berichtenverkeer binnenkomende goederen.
