1 TEACHING STAFF COMPETITION LAW & REGULATED NETWORK INDUSTRIES LLM MODULE 2011/12 KING S COLLEGE LONDON Peter Alexiadis Module leader Peter is a partner of the Brussels office of the international law firm Gibson, Dunn & Crutcher LLP, and holds postgraduate legal qualifications from the Universities of London, Sydney and Thessaloniki. His practice specialises in all aspects of competition law, telecommunications/media/it ( TMT ) policy and regulation, and the licensing of intellectual property. He has acted as external counsel in some of the largest mergers in the TMT sector, has represented a range of clients on abuse of dominance actions in network industries, and also has broad experience in the application of State aids schemes in relation to network sectors. He is also well known for a number of landmark regulatory studies which he has conducted over the years for the European Commission on convergence and the current EU Regulatory Framework for electronic communications. He has also acted as an external legal consultant to the European Commission s Telecoms, Media & IT Unit at DG Competition for a period of three years, and was one of a handful of European legal experts invited to speak at the joint hearings in May 2002 of the FTC and DoJ on the interface between antitrust and intellectual property. Peter has been the EU Affairs correspondent for the European Intellectual Property Review and the Utilities Law Review for many years. He has consistently been listed as a leading international practitioner by peer review publications in competition law and communications law (e.g., Chambers, Global Counsel, Who s Who, European Legal Experts, Legal 500), and was named as one of The American Lawyer s "Star Laterals of the Year" for 2003 when joining Gibson Dunn. Dr. Christopher Townley Module leader Chris joined King s College London as a lecturer in He received his BA in Law from Durham University, an LLM from the College of Europe, Bruges and a Ph.D. from the European University Institute, Florence (Article 81 EC Treaty: putting public policy in its place). Previously, Chris worked as a solicitor at Clifford Chance LLP and then a Principal Case Officer at The Office of Fair Trading. Since joining King's, Chris has provided teaching and/ or advice to several bodies, including The Egyptian Competition Authority, The National Boadcasting and Telecommunications Commission (Thailand), The NHS, the Office of Fair Trading, Ofcom and The Pakistan Competition Commission. Chris research interests lie in the relationship between competition law, particularly European competition law and other public policy areas, such an environmental or cultural policy. He has recently started two new research projects, one examining European competition law from the perspective of legal and moral theory; the other discusses the Development of Policy within the European Competition Network.
2 GUEST LECTURERS Ross Biggam After studying law at Exeter and Saarbrücken, Ross Biggam worked as Legal Adviser to the House of Lords EU Select Committee before joining ITV, the leading television channel in the UK, where he ended up as Head of European Affairs. In April 2000, he moved to Brussels to become Director General of the Association of Commercial Television in Europe (ACT) which represents the interests of the commercial broadcasting sector in Europe. Formed in 1989, the ACT has thirty-one member companies licensed in 30 different European countries and distributed across 45 European markets and beyond. The ACT members operate several hundred free-to-air and pay-tv channels and distribute many more channels and new services, encompassing several business models: free-to-air broadcasters and pay-tv players, digital platform operators and multimedia groups. Kevin Coates Kevin Coates is a competition lawyer and head of unit working in the Directorate General for Competition of the European Commission. For the last few years he has worked directly for the Director General, advising him on policy and communications issues. Before that he handled competition cases in the telecoms and media sectors. Before joining the Commission he was European Counsel for AOL Europe, responsible for antitrust and regulatory issues for AOL subsidiary companies in the UK, Germany, France and the Netherlands. A law graduate of Cambridge University and the College of Europe, he qualified as a solicitor with the law firm Lovells in London and Brussels. He is the author of Competition Law and Regulation of Technology Markets (OUP 2011) and co-author of the Communications and Intellectual Property chapters in Faull & Nikpay's EC Law of Competition. He is a frequent speaker at conferences on a range of competition law topics. 2
3 Benoit Durand Benoît Durand is a partner at RBB Economics, which he joined in Benoît has extensive experience in competition economics; particularly in applying quantitative techniques in the context of competition law investigation. Prior to joining RBB, he was Director of Economic Analysis at the UK s Competition Commission. Before that he was also a member of the Chief Economist s Office at the Directorate General for Competition at the European Commission. He was previously based in Washington DC, USA, where he worked in private practice. Benoît received his Ph.D. in economics from Boston College, USA. Benoît has given oral evidence before the European Commission, the OFT and the French Competition Authority. He has also advised the Competition Commission of Singapore on various investigations. He speaks regularly at competition policy conferences and has published articles on competition economics issues. He also teaches a course on competition economics at HEC, Paris. Per Hellström Per Hellström leads the European Commission's Antitrust Unit dealing with Information Technology, Internet and Consumer Electronics. This Unit was in charge of the landmark antitrust decision in the Microsoft case of March Mr. Hellström led the investigation against Intel Corporation, which was concluded by a prohibition decision in May 2009, and was also in charge of the Rambus case and the Microsoft tying case, both of which were concluded by Commitment decisions at the end of He is now leading the Commission's investigation of Google. Mr. Hellström was previously a member of the Legal Service of the European Commission, providing legal advice in the area of mergers and antitrust, as well as representing the Commission before the Community Courts in cases such as Microsoft and GE/Honeywell. Per has a law degree from the University of Lund in Sweden, and an LLM from the London School of Economics. 3
4 Lars Kjølbye Lars Kjølbye has practiced in Brussels since He is a partner in the Covington & Burling's Brussels office, with broad experience in EU competition law. His practice focuses on complex cases in the areas of abuse of dominance, restrictive practices, and merger control. He has extensive experience across a number of industry sectors including software, electronics, energy, aviation, pharmaceuticals, telecommunications, media, banking, sports, and consumer products. Prior to that, Lars spent ten years at the European Commission s Competition Directorate General ( DG Competition ) including heading the energy and environment antitrust unit from 2006 to Under Lar s leadership, the Unit undertook a comprehensive inquiry of European gas and electricity markets and contributed extensively to the Commission s proposals for a third energy liberalisation package. The Unit also prosecuted several important abuse of dominance cases under Article 102 TFEU addressing issues raised in the sector inquiry. Leigh Hancher Leigh Hancher works as Of Counsel for Allen & Overy. She specialises in European and Dutch law relating to network sectors including gas, electricity, telecoms, transport, post and water. Her expertise is primarily in the field of interaction between the disciplines of competition law and sector-specific regulation, with a particular emphasis on access pricing and conditions, State aid and cross-subsidisation. She writes and lectures regularly on these subjects. Leigh has regularly assisted major clients on competition and regulatory issues at national and international level, especially on major cross-border interconnector projects and in the preparation of applications for regulatory and/or competition clearance for such projects at European and national level. She has advised major clients in the LNG sector. She has regularly acted as adviser to the European Commission and the European Parliament on energy law issues. Leigh is also a Professor of European law at the University of Tilburg and was a member of the Scientific Council for Government Policy in the Netherlands. 4
5 Tom Kiedrowski Tom joined Ofwat in February He plays a key role in working to achieve Ofwat's aim of harnessing markets where they will benefit consumers and provide sustainable water. Tom manages a team responsible for reform at the level of abstractions, wholesale and retail. He has led also led Ofwat s work on the BIS Competition Regime Review. Tom was part of the BIS team that developed the Principles for Economic Regulation. He previously worked at Ofcom, where he was involved in a number of high profile projects, including the Telecom Strategic Review and the functional separation of BT, the future of termination pricing and its alternatives, net neutrality and the review of the EU electronic communications regulatory framework. Before that, he was the Regulatory Affairs Manager for the European Competitive Telecommunications Association (ECTA) in Brussels and had a variety of roles at BT plc. Paul McGeown Paul McGeown is a competition partner in Wilson Sonini s recently-opened Brussels office. He has more than 15 years experience in private practice, advising clients in a variety of industries on merger control, antitrust and State aid cases before the European Commission and the UK Office of Fair Trading. Between 1999 and 2001 he also worked as in-house global competition counsel for a major Paris-based engineering company. For over a decade, Paul has counselled airlines in the Air France-KLM group on competition matters: on mergers and acquisitions, on partnerships with carriers in the SkyTeam alliance and with third carriers, on drafting self-assessments and on Article 102 compliance matters. He has also advised regional airports in disputes with low-cost carriers. 5
6 Robert O'Donoghue Robert O'Donoghue is a senior junior with extensive experience of all aspects of EU and Competition Law. He has appeared in numerous cases in the UK courts (both general and specialist), as well as the General Court (previously the CFI) and the ECJ. His EU and Competition Law practice includes advisory work on European and UK competition rules and he has extensive experience proceedings before the European Commission and the Office of Fair Trading, including cartels, mergers, and abuse of dominance proceedings. He has a particular interest in utility regulation (telecoms, energy, water) under both EU and UK laws. His practice also includes extensive experience in EU law matters more generally, including free movement cases, public procurement, intellectual property, conflict of laws, pharmaceutical regulation, and state aid. Clients include public and private companies, trade associations, and government departments. Robert has published, spoken, and taught extensively on EU and competition laws. In 2011 he was listed (while also being the youngest nominee and only practising barrister to feature) in the GCR Report on 'Who's Who of Competition Lawyers & Economists 2011'. He spent 10 years working in Brussels between for Brick Court Chambers, DG Competition, and Cleary Gottlieb Steen & Hamilton LLP. He is also the co-author of The Law and Economics of Article 82 EC, Hart Publishing, Jorge Padilla Dr. Jorge Padilla is a Senior Managing Director and Head of Compass Lexecon Europe. Previously the European Chief Executive Officer at LECG, Dr. Padilla advises clients on a variety of competition policy and intellectual property issues, covering a wide range of industries, including electricity, entertainment, media, retailing, technology, telecommunications and transport. He has advised on various cases and given expert testimony before the Cypriot, Dutch, French, German, Irish, Italian, Portuguese, Spanish, and UK competition authorities, as well as in cases before the European Commission. Dr. Padilla has also submitted written testimony to the European Court of First Instance and the UK Competition Appeals Tribunal in State aid, cartel, merger control and abuse of dominance cases. He has also given expert testimony in various civil litigation (damages) and international arbitration cases. Dr. Padilla earned M Phil and D Phil degrees in economics from the University of Oxford. He is a research fellow of the Centre for Economic Policy Research (CEPR, London) and the Centro de Estudios Monetarios y Financieros (CEMFI), and is or has been member of the editorial boards of Competition Policy International, the Review of Economic Studies, the Spanish Economic Review and Investigaciones Económicas (which he directed for more than three years). He has written several papers on competition policy and industrial organization in many of the world s leading antitrust law and economics journals. He is also co-author of The Law and Economics of Article 82 EC, Hart Publishing,
7 Wim Vandenberghe Wim Vandenberghe is a Counsel to the Brussels office of Dechert LLP, and has extensive experience in energy, competition and EU law in general. He advises on the full range of energy law matters, including regulatory and compliance counseling (grid access and use, unbundling, tariffs, investment structuring, licences, retail, security of supply, etc.), fossil fuels and renewable energy contracts & projects, as well as climate change and emissions trading matters. He has also advised extensively on competition and State aid law issues in the energy sector. Wim further provides guidance on EU general law, with particular emphasis on internal market law and product regulation. Wim is a graduate from the K.U.Leuven, where he received his LL.B. degree and where he is appointed as a voluntary scientific scholar at the Law Faculty. He obtained his LL.M degree at the Edinburgh University and at the Centre for Energy, Petroleum and Mineral Law and Policy in Dundee. Between 2002 and 2004, he was a research fellow at Edinburgh Law School. He also served as a part-time legal expert to the Office of the Federal Minister of Energy of Belgium from 2006 to 2007, advising the Minister on the GdF/SUEZ merger. David Wood David Wood is a Partner in the Brussels office of Gibson, Dunn & Crutcher LLP. His practice encompasses the full range of antitrust issues, including cartels, merger control, abuse of dominance, restrictive agreements, sector inquiries and private enforcement. He has particular experience with cases involving abusive pricing and refusals to supply by dominant undertakings, as well as the establishment of joint dominance and network-related issues. He has strong sectoral expertise in the financial services and media/high-tech sectors, and is also experienced in the pharmaceutical, chemical, software, consumer electronics and transport sectors. Prior to joining Gibson Dunn, Mr. Wood spent 10 years (from 1992) at the antitrust enforcement division of the European Commission (DG Competition), including positions as Head of the Financial Services Unit and Acting Head of the Media Unit. During his time at the Commission he was responsible for the teams involved in some of the most hard-fought cartel cases and some of the most high-profile and complex media, transport and financial services cases. He was also a member of the Commission working groups responsible for a member of significant developments in EU antitrust policy and appeared regularly before the European Courts of Justice. 7
