5 COMPANY HISTORY The roots of Hermes Nursery run deep in America s heartland. The business was founded in 1965 by local legend John T. Hermes. Originally from Ponca City, OK, growing up on a farm with humble means, John T. felt drawn to return to his roots in agribusiness. John T. began growing trees and shrubs in 1985 as a natural extension of his lawn and landscape business. At that time, it was difficult for him to find quality plant material convenient to the greater Kansas City area, so he decided to grow his own nursery stock. Through the late 80s and early 90s, Hermes Nursery continued to acquire land, refine its growing practices, and expand the organization. Good news travels fast, and others around town began expressing interest in the great plant material being grown at Hermes Nursery. This led to the creation of the Landscape Distribution Center in In 1997, the family tradition continued when John T. retired and his son, Dalton, took over the reigns. Under Dalton s leadership, Hermes Nursery has continued to stay focused on its mission to pursue beauty with a passion and grow the finest trees available. Innovative ideas sometimes happen long before they become standard practice. One example is Dalton s early decision to focus on growing native tree and plant varieties. Plants that are native to our area are naturally resilient, with hardier root systems that require less water, thereby ensuring higher transplant survivability rates. 6 TERMS AND CONDITIONS TERMS a Prepaid: Orders must be paid at the time of purchase until such time as an approved Hermes Credit Account has been established. Terms are cash, company check, bank wire transfer, MasterCard, Visa and Discover. Customer will be subject to a $50.00 return check charge. a COD: Orders must be paid in full when picking up plants or upon job site delivery. a Credit: Hermes Credit Account terms are Net 30 days from the invoice date. Applications for credit can be mailed or faxed upon request. Please allow up to 20 days for credit application processing. a Preferred Credit: At the sole discretion of Hermes Nursery s Division Manager, customers may receive extended credit beyond their approved credit limit, provided the account is in good standing and Preliminary Lien Notice procedures are followed. a Preliminary Lien Notice: For the benefit of the Purchaser and Hermes Nursery, Inc., we will request the following information be provided on all Hermes Credit Account purchases: Job name and address, Contractor s name and address. a Deposits: A deposit will be required to hold plant material longer than 30 days. a Delinquent Accounts: Accounts unpaid 31 days after invoice date are considered past due. Invoices unpaid for 60+ days are considered delinquent and may lose their purchasing privileges and possible revocation of their credit limit until such time as the account is in good standing. A late charge of 2% per month (24% per annum) will be charged on all past due accounts. WARRANTY & LOSS We warrant that our stock is sold true to its name. This express warranty is our only warranty and shall exclude all implied warranties, including merchantability, fitness and quality. In no event shall we be liable for consequential damages for breach of this warranty or for any amount exceeding the purchase price of the plants. CLAIMS All claims against material picked up must be made before the plants leave our nursery. Shipped material must be inspected upon arrival and all claims made in writing within three (3) business days. Hermes Nursery, Inc. does not recognize claims in excess of purchase price and will not be liable for consequential damages for which a claim is made. We will accept no returns. CONSET TO JURISDICTION AND VENUE Any action for claims or obligations arising out of or to enforce the terms and conditions of purchase set forth above must be brought in the District Court of Johnson County, Kansas, which will have personam jurisdiction over the parties and venue of the action. In the event of default, it is agreed that the Purchaser will pay all costs and expenses, including reasonable attorney s fees incurred by Hermes Nursery, Inc., in collecting Purchasers account. ACCEPTANCE OF TERMS By submission of an order to purchase, you agree to the terms and conditions set forth above and further agree that any provisions printed or otherwise contained in your purchase order, which are inconsistent with or in addition to the terms and conditions set forth above shall have no force or effect. 4

Excellent street tree. 3 3 ½ 4 Skyline Locust - Gleditsia triacanthos Skyline Height: Foliage: Dark green, fine textured Spread: Fall: Golden yellow Shape: Broadly pyramidal Develops a strong, sturdy trunk and shapely crown. Essentially thornless and seedless. Locusts are good lawn trees, as they cast light shade. Very cold hardy. 3 3 ½ 4 16

19 SHADE TREES MAPLE Armstrong Maple - Acer x freemanii Armstrong Height: Foliage: Green with silver underside Spread: Fall: Yellow Shape: Columnar A fast growing hybrid of Silver and Red Maples, this is a distinctly upright tree with silver-gray bark. Adaptable to a wide range of soils and climates. Tolerates heat and partial shade. 3 3 ½ Autumn Blaze Maple - Acer x freemanii Autumn Blaze Height: Foliage: Rich green, deeply lobed Spread: Fall: Orange red Shape: Dense oval head A fast growing hybrid of Silver and Red Maples with drought tolerance and the ability to grow in most soils. Beautiful fall color and form. Strong branching. 3 3 ½ 4 Emerald Queen Norway Maple - Acer platanoides Emerald Queen Height: Foliage: Dark, glossy green, leathery Spread: Fall: Bright yellow Shape: Upright, broadly oval Very rapid grower with a straight trunk and good ascending branching. Provides dense shade. This top-rated Norway Maple cultivar does very well in urban areas. 3 3 ½ 4 17

20 SHADE TREES Green Mountain Sugar Maple - Acer saccharum Green Mountain Height: Foliage: Dark green Spread: Fall: Orange scarlet Shape: Upright, oval A heat tolerant selection with thick, waxy dark green foliage. Retains full color in dry, windy summer weather. Does best in well drained soils. 3 3 ½ Legacy Maple - Acer saccharum Legacy Height: Foliage: Dark green Spread: Fall: Orange-Yellow Shape: Upright, oval Legacy appears to be the best of the new, drought resistant cultivars. Leaves hold late, some into winter, with fall color starting in early November and fading by late November. 3 3 ½ 4 October Glory Maple - Acer rubrum October Glory Height: Foliage: Glossy, medium green Spread: Fall: Deep red to reddish-purple Shape: Broadly oval to round This is the last of the Red Maple cultivars to color in the fall. Winter hardy to Zone 4B, this is a good choice for areas with mild winters and hot summers. 3 3 ½ 4 18

21 SHADE TREES Red Sunset Maple - Acer rubrum Red Sunset Height: Foliage: Bright green Spread: Fall: Brilliant red Shape: Upright, dense A Red Maple selection with a long-lasting display of excellent fall color. Good branching structure. Excellent street and lawn tree. 3 3 ½ 4 Royal Red Norway Maple - Acer platanoides Royal Red Height: 40 Foliage: Deep purplish-red Spread: 30 Fall: Yellow Shape: Oval With good maroon leaf color retention through the summer, this Norway Maple cultivar is similar to Crimson King, but with slower growth and better cold hardiness. 3 3 ½ OAK Bur Oak - Quercus macrocarpa Height: Foliage: Dark green above, grayish beneath Spread: Fall: Yellowish-brown to purple Shape: Rounded, open Majestic appearance. Interesting in winter due to corky bark. Tolerates both wet and dry sites; also tolerant of alkaline soil. Adapts well to urban settings. 3 3 ½ Indicates Native Plant Variety 19

22 SHADE TREES Northern Red Oak - Quercus rubra Height: Foliage: Glossy, dark green Spread: Fall: Red to reddish brown Shape: Rounded A fast growing Oak with thick, shiny summer foliage. Good street or landscape tree. Leaves hang on into winter. Produces heavy crop of 1 acorns every 3-5 years. 3 3 ½ 4 Pin Oak - Quercus palustris Height: Foliage: Dark green Spread: Fall: Red Shape: Broad, pyramidal This widely used shade tree is one of the faster growing Oaks. Prefers moist, rich, acidic, well-drained soil. Leaves hang on into winter. Produces crop of 1/ acorns at 1-2 year intervals. 3 3 ½ 4 Regal Prince Oak - Quercus robur x bicolor Long Height: Foliage: Bold dark green Spread: Fall: Yellow Shape: Upright, oval The branch structure is much stronger and consistently fuller than other columnar cultivars of Oaks. The foliage is glossy bright green on the top and a soft light green color on the underside, giving the leaves a nice two tone color contrast. The foliage is very mildew resistant. Indicates Native Plant Variety 20

23 SHADE TREES Shingle Oak - Quercus imbricaria Height: Foliage: Shiny, dark green Spread: Fall: Yellow-brown to russet Shape: Oval-rounded This native to the central United States is a valuable street tree. Tolerates dry soils. Produces moderate crop of 5/8 acorns at 2-4 year intervals. 3 3 ½ 4 Swamp White Oak - Quercus bicolor Height: Foliage: Dark green above, felty white beneath Spread: Fall: Yellowish-brown to red Shape: Broad, rounded A beautiful native with textured, dark green leaves, this tree will grow in wet soils. Bark exfoliates on younger trees. Produces heavy crop of 1 acorns at 3-5 year intervals. 3 3 ½ 4 White Oak - Quercus alba Height: Foliage: Medium green Spread: Fall: Red to reddish purple Shape: Broad, rounded Native to the eastern United States, this majestic tree is durable and long-lived. Prefers acidic soils. 3 3 ½ 4 Indicates Native Plant Variety 21

Adapts to poor soil conditions, heat, and drought. Resistant to anthracnose. A rapidly growing tree for parks, golf courses and campuses. 3 3 ½ 4 SWEETGUM Sweetgum - Liquidamber styraciflua Height: Foliage: Dark green Spread: Fall: Orange, red, purple Shape: Pyramidal, rounded Deep, glossy green star-shaped leaves mark the Sweetgum. The shape is pyramidal, becoming more rounded with age. Avoid polluted sites. TULIPTREE Tuliptree - Liriodendron tulipifera Height: Foliage: Bright green Spread: Fall: Yellow Shape: Oval, rounded A fast growing, large tree with tulip-shaped flowers on higher wood in spring. Needs supplemental water in times of drought. 3 3 ½ 4 Indicates Native Plant Variety 22

A very hardy tree with vigorous upright growth. Plant in well-drained soil. 1 ½ 1 ¾ 3 3½ Indicates Native Plant Variety 25

28 ORNAMENTAL TREES CRABAPPLE Centurion Crabapple - Malus Centurion Height: Flower: Rose-red Spread: Fruit: Large, glossy, cherry-red, persistent, 3/8 Shape: Narrow, upright Vigorous, upright branching habit. Leaves reddish in spring turning bronze-green in summer. Glowing red fruits are very showy for months. Highly resistant to disease. Excellent tree for street planting and landscape use. 1 ½ 1 ¾ 3 Indian Magic Crabapple (Multi-Stem) - Malus Indian Magic Height: Flower: Bright pink Spread: 20 Fruit: Red orange berries Deep pink flowers emerge from red buds on this rounded tree.
