1 Copyright Guidelines for Ara Institute of Canterbury tutors In order to comply with our legal obligations and to ensure that we are operating to a high ethical standard, Ara is committed to avoiding breaches of copyright. Copyright issues may arise around course materials made available through Moodle. These guidelines are to help you address the most common copyright issues yourself. If your copyright concern is not addressed here, contact Cathy Peck at cathy.peck@cpit.ac.nz. 2 General guidelines: Moodle vs. web These rules apply to items accessible in Moodle or given to students- i.e. the rules are much more restrictive if what you re doing will be accessible to the public. Print vs. electronic resources Print and electronic resources are both covered by copyright law. The CLNZ Education Licence allows participating educational institutions to do some additional things with print sources. Although using information and images from the web is often more convenient, we are considerably more restricted with what we can legally do with electronic sources. When in doubt, check the copyright statement Almost all books and websites will have a copyright or terms of use statement. This document sets out whether we can use something in Moodle. If it includes statement such as All rights reserved, or You may not transmit it or store it in any other website or other form of electronic retrieval system, then you will need to receive permission from the copyright holder to put it in Te Kete. Please see the Ara website copyright statement as an example. Linking vs. adding to Te Kete Often, copyright issues can be avoided by adding a link to the item to Moodle. You should check that the website doesn t prohibit this behaviour, but most sites don t mind linking. When we copy an item into Te Kete, it counts as storing in an electronic retrieval system, which most copyright statements do prohibit. If we add a link to Moodle, it simply acts as a signpost to the content in its original location, so this issue is avoided. Slideshows that accompany a textbook Short answer: You need to seek permission from the publisher to upload slideshows to Te Kete/Moodle, and send the permission to library@ara.ac.nz. Many publishers make slides to accompany their textbooks, and they make these available to tutors. However, they expect tutors to present the slides in class, and we usually need to seek permission to reproduce them on Te Kete or Moodle. Contact the publisher s representative and request permission from them, and send the permission you get to library@ara.ac.nz. You will normally need to provide: Course code; number of students in the course; whether the textbook that the slideshow accompanies is a recommended or required reading for the course.
3 Copying text from print sources like books, journals, magazines and newspapers Short answer: Ask your librarian to do this. Scans (up to 10% or one chapter) from print sources are permissible, but because we have to ensure that authors receive credit for their work that we re using, you should always arrange to have these items added via your Information Librarian. You should provide details of the print book/journal and the page range. Contact the library if you re not certain who to speak to. Using images from print sources such as books in presentations or in Moodle It s acceptable to use images from books in your courses, provided that you surround the image (including any captions) with a box ( frame ) and include an APA reference to the source, including the page reference. For example: Robins, G. (2008). The art of ancient Egypt. (revised ed., pp. 146). Cambridge, MA: Harvard University Press. Using ejournal articles Short answer: Use links to all articles, rather than saving a pdf and uploading it. You should always provide a link to the article in an Ara database. This ensures that our access is legal- compared to sometimes-illegally provided articles found through Google.
4 Using electronic images in presentations or in Moodle Short answer: You can use images that aren t licensed, but you have to put them in a frame/box, and include the author of the image, the date of download, and the source URL. You also have to delete it when it s no longer being used. For images from the internet, we can copy and use them in course materials such as slideshows. However, there are tight restrictions on what we need to do to stay copyright compliant: Put the image in a frame wherever you use it, to keep it distinct from your own work. Include a credit to the author, if known. Provide the URL source of the image. Give the date you downloaded the image. Delete the image when it s not being used in courses anymore. If the image you want to use is available for licensed use then you must comply with the terms of the license to use the image. In the case of Dilbert cartoons, for example, you can t use the images without paying their licensing fees. This example is for an unlicensed image from the internet: Source: Wild in Art webpage. 5 Copying text from websites Short answer: You can copy content from web pages if you don t make any changes, you credit the author, and you delete the copy when it s not being used. You can copy material from web pages, for example into word documents, with some conditions: You can t make any changes (no adapted from ) You need to include the source and author, and the date it was copied, in the copied version. When the material is no longer in use, it must be deleted. For example: Driver stopped with spikes in rural Canterbury after 45 minute police pursuit Police used spikes to stop a driver who led police on a 45 minute pursuit. The driver of the red Toyota was caught in rural Canterbury, more than 80km from where the pursuit started in Christchurch. He failed to stop for police for a traffic offence in Middleton about 9.45am. Numerous police cars pursued the red Toyota as it headed south, out of the city. Some officers tried to block the car. Witnesses described seeing six to 15 police cars chasing the driver at high speed in Wharenui Rd, Riccarton, and in Springs Rd in Hornby. At 9.55am, the spokesman said the pursuit was headed towards Lincoln. The chase then went through Leeston. Police used spikes to stop the car in Main Rakaia Rd, off State Highway 1, at Bankside, about 10.30am. A police spokesman said the driver had been caught. By: Brittany Mann.
