PLEASE NOTE: All successful bidders purchasing used school buses must contact the local depot in order to make arrangements for removal.

5 Schedule A Page 5 THIS AGREEMENT made this day of, 2013 BETWEEN: AND The of Prince Edward Island A body corporate, duly incorporated under the School Act, R.P.E.I. 2012(2 nd ), c.23,s.1; of (Hereinafter called the Purchaser ) WHEREAS the School Board wishes to sell a used school bus to the Purchaser; AND WHEREAS it is necessary that certain alternations be made to the bus so that it will no longer be identifiable as a school bus; WITNESSETH that in consideration of these premises and of the mutual covenants and agreements herein, and of the sum of five dollars and other good and valuable consideration now paid by the Purchaser to the School Board, the parties agree as follows: 1. The School Board agrees to sell the Purchaser, school bus No. Year Serial Number, with the flashing lights removed, for the sum of $ provided that the terms of this Agreement are fulfilled by the Purchaser. Please Note: Your total bid price must include a 14% allocation for HST. 2. The Purchaser of a mobile bus agrees that the bus; (a) in shall be repainted entirely to a color other than school bus yellow, before it is registered as a motor vehicle; and (b) shall be registered with the Highway Safety Division of the Department of Transportation and Public Works within 90 days of the Purchaser taking possession of the bus. 3. The Purchased of an immobile bus; (a) shall prove prior possession of a building permit issued by the community in which the bus is to be located; and (b) agree to repaint the entire bus to a color other than school bus yellow within 90 days of taking possession of it. 4. Paragraphs 2 and 3 do not apply to a school bus that is sold to a purchaser for scrap. 5. The parties hereby agree that if the Purchaser fails to fulfill the conditions set out in paragraph 2 or 3, the School Board may enter the Purchaser s premises, take possession of the bus and remove it. 6. In the event that the School Board takes possession of the bus under paragraph 5, the parties agree that the purchase price shall be forfeited to the School Board as liquidated damages for breach of this Agreement.
