2 Foreword Professor Dr. Christian Wolf Dear Friends, Welcome to the Law Faculty of the Leibniz University of Hanover. The Institute for Procedural Law and Attorney Regulations (IPA) and the Institue for International Law is honored to host the 4th Hanover Premoot and to continue a tradition. The Willem C. Vis Moot is designed to be an educational program with many facets of real Legal Profession in the form of a competition. Hopefully, this Premoot will similarly be an educational and beneficial experience for everyone. Therefore, all team-members and coaches are encouraged to watch other pleadings when not scheduled to argue or to arbitrate (and if not forbidden by the rules of the Willem C. Vis Moot). We hope that the day s events will allow not only teams to further refine their arguments and oral presentation but also to get in contact with each other. May the Hanover PreMoot be one herold for the spirit of the Willem C. Vis Moot in Hong Kong and Vienna. Like in the last years it is our aim to offer the best possible preparation for all the teams on their way to Hong Kong respectively Vienna. Thus, the Hanover PreMoot will not have a final ranking but all the arbitrators will score the teams after the pleading like in the actual competition. 4 4 The official program 4th Hanover PreMoot On thurdsday, 18th February: 7 pm The official welcoming reception in the Dachgeschoss (top floor) of the Conti High-rise on invitation of the Institute for Procedural Law and Attorneys Regulation (IPA) and Brinkmann.Weinkauf attorney at law, Hanover. On friday, 19th February: 9 am Registration with a small breakfast in the registration room (14th floor) on invitation of the Hanover Vis Moot Team at 9 am. The start of the first pleadings will be 9:30 am. The last pleading of the day will last until approximately 18:15 pm. After the last pleading on Friday everyone is invited to join the Hanover Vis Moot Team to the HBX (self-paying). In this traditional brewery we have reserved a room at 7 pm for all Participants of the PreMoot. Further information do you find in your conference binder. 5 Das FamFG in Münchener Qualität Der neue Band 4 Der Großkommentar zur ZPO ist mehr als ein Erläuterungswerk im herkömmlichen Sinne, denn er zeigt auch die rechtlichen Zusammenhänge der einzelnen Normen zur Durchsetzung des materiellen Rechts auf. 9 9 University of Basel Paloma Braun // After graduating from Gymnasium Leonhard Basel in 2007, Paloma went to a Soto-Zen-Buddhist monastery in Japan. She is now in her third semester of studies at the faculty of law of the University of Basel. Her interests are singing, acting and philosophy. Because of her enthusiasm for looking at issues from different perspectives and her special interest in private law she decided to participate in the Vis Moot. Yves Clerc // yves.clerc@stud.unibas.ch Yves Clerc graduated at the College Ste. Croix in Fribourg. He started his law studies in Basel in After having successfully accomplished an International Business Law class in the Notre-Dame Summer School Program in London, he decided to participate in the Willem C. Vis Moot Court. Dimitrij Euler // dimirtij@euler.ch After graduating IT-College in Zurich and the AME-school in Aarau, Dimitrij started studying law at the University of Basel in During his bachelor studies, he became particularly interested in International Private and Environmental Law. Apart from studying, Dimitrij worked for different implementations of major server application projects in the private economy as assistant. Besides German, he speaks French and English. Philip Hinsen // philip.hinsen@gmx.ch Philip graduated from the Gymnasium Bäumlihof in Basel in He has finished his Bachelor exams and studies in the third semester in the master studies at the faculty of law of the University of Basel. During his bachelor studies he worked as a junior assistant for Prof. Dr. Schwenzer and after his bachelor exams in a Swiss law firm in Zurich he has chosen to participate in the Vis Moot, because he is interested in international private law. Lorenz Lauer // lorenz_lauer@gmx.net Lorenz graduated from the Gymnasium in Basel in He has finished his third semester at the faculty of law of the University of Basel. He is a tutor in English and French and currently teaches two high school pupils. His interests are travelling, cooking and dancing. He has chosen to participate in the Vis Moot, because he is interested in meeting people from different countries all over the world and because of his profound interest in private law.

10 10 University of Bonn Nathalie Sameli // Nathalie Sameli completed her Master of Law in 2009, her Basic Studies in Psychology in 2004 and in Acting in Besides, she worked as a festival organizer, as a substitute teacher and in the official Swiss representation of the fair of Berlin. She speaks German, English, French, Italian, Brazilian as well as a little Spanish and Arabic. By her participation in this Moot Court, she hopes to gain practical experiences and to improve her legal English knowledge. Michelle Seiler // michelle.seiler@stud.unibas.ch After graduating from the Gymnasium Michelle spent half a year in Central London working as an au-pair. In the same year she started studying law in Basel and now finished the 3rd semester. Currently she is working as a deputy chef de bar. Michelle participates in the Vis. Moot because it is an outstanding opportunity to focus on international sales law and arbitration. Besides German, she speaks fluently French and English. Arne Katharina Ruhwinkel Arne graduated from school in June In October 2008 she moved to Bonn and started studying law at the Rheinische Friedrich-Wilhelms- Universität Bonn. During 11th grade Arne was an exchange student in Longmont, Colorado, USA. Arne s English is fluent. She also has basic knowledge in French and the qualification in Latin. In her spare time she enjoys reading as well as playing tennis. Jan-B. Fischer Jan-B. Fischer attended elementary school at the Goetheschule in Essen ( ). He was educated in Latin, English and Italian with the latter ones being partially specialised for business and economic fields. Jan did different internships, for instance in a tax accountancy (2006) and a forwarding company (2007/2008), gaining insight in both financial and legal issues, which led to his strong interest in law and jurisprudence. In October 2008 he started his studies at the University of Bonn. Moritz Müller-Leibenger Moritz Müller-Leibenger (20) is a law student in his third semester at the University of Bonn. He graduated with Abitur at the Gymnasium Rodenkirchen in Cologne. During high school he spent one year abroad at an American preparatory school where he became fluent in English. Furthermore, he has knowledge of Spanish and French. In his free time he likes to play tennis and guitar. Additionally Moritz participates in the management of a local political organisation.

11 11 Stefan Heise Stefan Heise`s interest in the law originates from his interest in effective ways of dispute resolution. He started his law degree studies in Bonn in the summer semester of 2008 after graduation and civil service. Stefan is interested in how the law can serve trade, to make it quicker and safer, as well as more profitable for the parties. In his spare time Stefan Heise likes to read or to play the guitar and piano in a band. He speaks English and Spanish fluently (both as part of his Leistungskurs ) and has basic knowledge in French (DELF 1) and Latin (Latinum). Rene Rosenau René Rosenau attended the bilingual (German-French) section of the Friedrich-Ebert-Gymnasium Bonn. He received not only the German Abitur in 2007 but also took the French Baccalauréat and a qualification in Latin. During his school time he had the opportunity to participate on several exchange projects: He went to Toulouse, Meudon and Montpellier in France, as well as to Australia. Rene started his law degree in April 2008 at the University of Bonn. Besides, he worked as a student assistant for the Institute of International Law under Prof. Dolzer Richard Hoyle Richard is currently studying Law during his Erasmus year at the University of Bonn. In the UK, he studies Law and German Law at Oxford University, where he received one of the top three marks in his first year exams. Last year, he represented Oxford in the Philip C Jessup International Law Moot, winning the best oralist award in the UK final. This summer, Richard worked for the British Institute of International and Comparative Law where he co-wrote a research paper for the Ministry of Justice entitled Alternative Dispute Resolution in Germany. He also interned at Debevoise & Plimpton LLP and Essex Court Chambers. Bucerius Law School unfortunately the data of the Bucerius Law School did not reach us in time...

12 12 University of Cologne Gregor Owsianowski (23) studies law in the 7th semester at the University of Cologne. He has passed his intermediate exam at the Ludwig-Maximilian University of Munich where he has also participated in the course Geschäftsplanung für Juristen (Business planning for lawyers) of the Entrepreneur Center. Beside his studies Gregor runs a catering-service. During his school time he spent a year at the Charlottetown Rural High School in Canada. Anna Lotte Böttcher (23) // otte.boettcher@gmx.net studies law in the 4th semester at the University of Cologne. Since March 2009 she works as a student assistant for Prof. Dr. Ehricke at the Institut für Energierecht (Institute for energy law). Following her graduation from Gymnasium she dedicated herself to a voluntary social year in Brazil and after that studied European Studies for one year at the University of Maastricht in the Netherlands. She gathered practical experience during a internship at the Landschaftsverband Rheinland. Anna Lotte fluently speaks English and Portuguese. She has a achieved the Latinum and good command of Spanish and basic command of French. Katharina Schesler (23) // katharina.schesler@gmx.net studies law in the 6th semester at the University of Cologne. She is a student assistant of PD Dr. Kay Windthorst at the Institut für Öffentliches Rechts und Verwaltungslehre (Institute for public law and administrative studies). In the winter term 2008/2009 she participated in the exchange program ERASMUS in Florence. Katharina has started her major studies specializing in international private law, economy and procedural law. She gathered practical experience during her internships at the law firm Studio Legale Nistri at Florence and the administration of the Bundesamt für Güterverkehr in Cologne. Katharina speaks English and Russian fluently. She also has a good command of Italian. Melanie Kaspers (22) // melaniekaspers@web.de studies law in the 5th semester at the University of Cologne. Additionally, she works for Prof. Dr. Berger LL.M. as a student assistant at the Institut für Bankrecht (Institute for Banking law) since February Melanie gathered practical experiences during two internships at the law firm Hecker, Werner, Himmelreich in Cologne as well as the administration of the Landtag (local parliament) of NRW in Duesseldorf. She fluently speaks English, has achieved the Latinum and has basic command on French and Spanish.

13 13 University of Geneva Jonas Freiherr Göler von Ravensburg // Mr. Göler von Ravensburg discovered his fascination for mooting while pleading in the European Law Moot Court for the University of Heidelberg, where he is a 3rd year student. Currently, he is doing a Certificate in Transnational Law at the University of Geneva. Prior to studying in Geneva, he interned in investment arbitration at Allen & Overy. He speaks German, English, French and Spanish. In his free time, he enjoys running, reading, and playing guitar in his rock band. Felix Lüth // felix@lueth-privat.com Mr. Lüth is currently doing a Certificate in Transnational Law at the University of Geneva. Prior to this, he particpated in the National Model United Nations conefernce in New York representing the Republic of South Africa as a member of the delegation of the University of Freiburg, where he is a 2nd year student. He speaks German, English, Latin (as far as people do nowadays) and is working hard on his French. In his free time, Felix enjoys among others playing soccer, travelling, reading, cooking and spending time with his friends. Marta Ksiazczak // mksiazczak@gmail.com Marta Ksiazczak discovered her fascination for international arbitration during her internship at L.O. Baptista Advogados in Sao Paulo. Currently, she does the last year of Master in Business Law at the University of Geneva. She has been working in the field of international finance for more then two years at Jabre Capital Partners SA. She speaks Polish, English, French, Portuguese and Russian. In her free time, she enjoys skiing, running, playing piano. She has strong interests for the international current affaires and for travelling. Tabea Bürgler // tabb@gmx.net Tabea Bürgler is currently completing a Masters degree in Law and a Certificate in Transnational Law at University of Geneva. She speaks German, English and French. In her free time, Tabea enjoys playing tennis, going horseback riding, dancing Flamenco and singing. Nazima Fayzibaeva // Nazima.fayzibaeva@bluewin.ch Nazima Fayzibaeva is going to finish her Master s in International and European Law at the University of Geneva and is happy to profit from the occasion of putting into work her acquired knowledge, given by the Moot. She speaks English French, Russian and Uzbek. During her free time she enjoys reading and travelling.

15 15 University of Giessen Andre Dalinger // Andre graduated from Nidda high school in June Since October 2007, he has been studying law at the Justus-Liebig-University Giessen. He speaks English fluently and has good knowledge of French and Russian. He also gained a qualification in Latin. By participating in the Vis Moot, he hopes to gain practical experience in arbitration, as well as to expand his knowledge of the English legal terminology. Furthermore, he is looking forward to meet people from foreign countries. Florian Henke // henke_florian@web.de Florian commenced to study law at Justus-Liebig-University in Giessen, Germany, in the summer of 2007 where he is currently doing his sixth semester. By participating in the Willem C. Vis International Commercial Arbitration Moot, Florian hopes to gain already during his time at university an insight into the work of internationally operating law firms and to learn about arbitration law in practice. With respect to his language skills, too, the Moot Court is a challenge for Florian which he is eager to face. Joana Silvestrin Zanon // joanazanon@gmail.com In 2006 Joana started studying Law at the Federal University of Rio Grande do Sul and Economics at the Pontifical Catholic University of Rio Grande do Sul, Brazil. She is currently undertaking a one year exchange program in the Justus-Liebig-University of Giessen, Germany. By participating in the Willem C. Vis Moot Court, she hopes to gain practical acknowledge on international law. Sabrina Hau // Sabrina110387@aol.com After graduating from Nidda high school, Sabrina started to study law at the Justus-Liebig-University in October During her time at high school, she participated in an exchange program with the USA, living in Clovis, California, for nearly one year and receiving her high school diploma from Clovis High. Participating in the Vis Moot gives her the opportunity to meet people from all over the world. Sabrina is looking forward to work in a team and hopes to additionally improve her language skills.

16 16 Miriam Schröter // Miriam was born on 15 January 1988 in Frankfurt/ Main. In the summer of 2007, she graduated from the high school. She started to study law at the Justus-Liebig-University in Giessen in October At the time of the XVII. Vis Moot 2009/10, she will be doing her fifth semester. She takes an interest in civil law. Miriam takes part in the William C. Vis. International Arbitration Moot because of the unique possibility to collect practical experience in arbitration. This challenge will open up new perspectives for her future. University of Hanover Carola Göhlich // Carola Göhlich is 21 years old and studies law at the University of Hanover in the third term. She speaks French and English fluently and spent 3 months in the US where she participated in a student exchange with Israel and France. Carola works as a student research assistant at the chair for Public Law, International and European Law. Moreover, she is the coach of a junior handball team and she is a voluntary tutor in youth camps in Germany and abroad. Carola is interested in politics and history. Hanna Mayer // hanna.mayer@vismoot.uni-hannover.de Hanna Mayer is a 20 years old student of law at the University of Hanover in the third term. She speaks English and French fluently and was awarded the Apollinaire Award of the Robert Bosch Foundation for extraordinary performance in the school leaving examination (Abitur). Hanna is working as a student research assistant at the Chair of Civil Law, German, European and International Civil Procedure. She likes sailing, visiting the opera and theatre acts, especially those of the Bregenz Festivals. Alexandra Ufer // alexandra.ufer@vismoot.uni-hannover.de Alexandra Ufer is 21 years old and studies law at the University of Hanover in the third term. She participated in a student exchange program with Bordeaux and stayed there for several weeks. Alexandra speaks English and French fluently and passed her tests on the Latinum certificate. Moreover, she successfully took part in a language course for academic English in London. In her free time, she is interested in theatre and art.

17 17 Mirko Widdascheck // Mirko Widdascheck is a 21 years old student. He studies Law at the University of Hanover in the third term. Before he commenced his studies, he spent 8 months in New Zealand to do Work and Travel. He speaks English, French and Latin and works as student research assistant at the chair for Public Law. Mirko took part in rhetorical seminars and loves to play cello. Alice Wolken // alice.wolken@vismoot.uni-hannover.de Alice is 20 years old and now in the third term of her studies. She spent 1 year in Mt. Pleasant, Michigan and was able to improve her English there. Alice voluntarily works for an animal shelter where she involved in the organization. Alice is also a member of the WWF Germany. She as a student research assistant at the chair for Public Law, International and European Law. In her spare time Alice loves to read modern English literature. University of Istanbul Güven Maviş He was born in Ankara on and currently studying at University of Istanbul, Faculty of Law. His aim to participate in VIS Moot Court is to improve his knowledge and experience in the area of International Commercial Arbitration. He spent one year of his law studies in Köln (Cologne) as an exchange student. The year on abroad contributed him a lot by improving his German skills and he also took part in European Law Moot Court lessons during his stay in Germany. At the same time he works in a major law firm Istanbul as an intern. Except from Turkish he speaks English, German and Georgian. Merve Evrim She was born on 4th August 1988 in Istanbul. Cem Topal He was born in Istanbul on 5 June He was graduated from English High School on He is studying law in University of Istanbul and is a second grade student. Besides Turkish he also speaks English. Batuhan Çağatay After graduating from high school at 2006, he started to Law School of Istanbul University. It is his last year at University. His aim to participate in Williem C. Vis International Commercial Arbitration Moot, he would like to improve his skills and knowledge about international law. He puts his focus on international economic law. Besides Turkish he also speaks English. University of Karkow Pawel Bukiel // bukiel.vismoot@gmail.com is studying law at the Jagiellonian University. He completed American Law Program organized jointly by the Jagiellonian University and the Columbus School of Law of The Catholic University of America. He is preparing his master thesis on intellectual property law. He is also interested in international commercial law. He has graduated from Webster Thomas High School in the US and intends to continue his education in US after obtaining a master degree in Poland. Maciej Durbas // maciej.d.durbas@gmail.com pursues his 4th year of law at the Jagiellonian University. Among his areas of interest are: theory of law, private law in comparative aspect and last but not least international commercial law and arbitration. He develops his knowledge on those branches of law by way of participation in students` associations. Maciej successfully completed the course on Introduction to French Law last year, and was granted a scholarship programme by the French government. Thanks to the scholarship, Maciej could study for a month in the beautiful city of Orleans.

19 19 Katarzyna Kempa // is a 5th-year law student at Jagiellonian University. She participates in the Moot for the second time. Kasia receives a scholarship of Św. Jan Kanty Foundation. She graduated from JU-CUA American Law Programme in She had an opportunity to improve her lawyering skills by way of internships in leading law firms. In the first semester of 2009/2010 academic year she is studying at University of Versailles. Kasia speaks fluent English and French. She is currently writing her thesis on international commercial arbitration in light of recent EU regulations. Magda Kofluk // magda.kofluk@gmail.com is in her 5th year of law studies at Jagiellonian University. She graduated from JU-CUA American Law Programme in She participated in Summer School on European Private Law at Salzburg University and The 2009 International Business and Trade Summer Law Program organized by Catholic University of America. After unforgettable experience of last year s Vis Moot she decided to participate in the competition again and is the captain of this year s team. She is also a member of European Youth Parliament and participated in number of sessions. Maciej Marek // maciej.marek@gmail.com is a fifth-year law student at the Jagiellonian University. He is particularly interested in private law matters, which includes civil law, civil procedure and intellectual property law. He is currently developing his legal skills working in the intellectual property department of a polish law firm. As a member of Jagiellonian University Faculty of Law educational society (TBSP) had a two-year experience in conducting classes on civil law. His legal interests also comprise criminology, commercial law, competition law, theory of law, and economical law analysis. Andrzej Olaś // jendrek.o@gmail.com is a fifth-year law student at the Jagiellonian University. His legal interests are focused on private law with a special emphasis on commercial law and civil procedure. He graduated from the JU-CUA School of American Law. Currently he works as an intern at one of the leading Polish law firms. Andrzej perceives his participation in the Willem C. Vis International Commercial Arbitration Moot as an inspiring challenge and a great opportunity to improve his lawyering skills.

20 20 Piotr Semeniuk // is a third year law student at Jagiellonian University. Last year he completed the American Law Program organized by his home university and the Catholic University of America. After graduation he sees himself as a socially engaged lawyer exploring undiscovered fields of litigation in mideastern Europe. Piotr took part in internships in the Polish Ministry of Foreign Affairs and in the Helsinki Foundation for Human Rights. He speaks fluent English and Russian. He obtained the highest business language certificate issued by the Russian Federation Chamber of Commerce. Basia Sobowska // bsobowska@gmail.com is a fifth-year law student at the Jagiellonian University. Her interests are focused on business international law, including commercial arbitration and commercial law. By way of international exchanges and an internship in the European Parliament Basia could confront her legal education with international standards. As an exchange student she spent last year at Katholieke Universeit Leuven in Belgium. She successfully represented the university in the Lachs Moot Court, where her team took 2nd place and won the price of best memorials. Apart from her studies Basia is currently gaining a valuable experience in one of the leading international law firms. Daniel Zatorski // daniel.zatorski@gmail.com is a 4th year Law and 3rd year American Studies student. Apart from international commercial law his main legal interests are focused on intellectual property and law & economics. His second faculty allows him to pursue his other hobby - American culture, including its legal aspects. Daniel participated in the JU-CUA American Law Program and completed it with an A- grade. He had an opportunity to broaden his knowledge of international commercial law during the Augsburg Summer Program in European and International Economic Law.
