2 1. Short title and application Punjab Agro Industries Corporation Ltd. RECRUITMENT AND PROMOTION RULES 1. These rules may be called the Punjab Agro Industries Corporation Limited Recruitment & Promotion Rules, They shall apply to all workmen and officers of PAIC unless the context otherwise requires, whether at the commencement of these rules or they are in service or employed in future. 2 Amendment or modifications. These rules may be amended or modified from time to time in accordance with the decision of the Management. 3. Definition. a) Chairman means the Chairman of the Corporation. b) Employer means the Managing Director/Chief Executive of the Corporation or any one duly authorized by the Corporation to act on its behalf. c) Appendix means an appendix to these rules. d) Management means the Managing Director or Director or any officer of the Corporation to act on their behalf and or on behalf of the Corporation. e) General means the category of employees working in Marketing, Personnel & Administration, Secretariat, Procurement, Contract Farming, Projects, Co-ordination Divisions etc. who have been recruited in General cadre with relevant qualifications and may be working in other divisions depending upon the necessity/availability of officers/officials. f) Accounts means officers/officials dealing/working in Accounts Division who have been recruited in Accounts cadre with relevant qualifications and may be working in other divisions depending upon the necessity/availability of officers/officials. g) Technical means the officials dealing in technical matters of work requiring special skill. h) Management Cadre means officers working in the Corporation. i) Recognized` University or Institute means:- i) any university or institute incorporated by law in India; ii) any other university or institute which is recognized by the Government for the purposes of these rules. j). Qualification means the basic qualification of education as well as professional. k) Departmental means the officers/officials already working in the Corporation.
3 2 l) Direct Appointment means the officers/officials recruited for sanctioned posts against an advertisement. m) Management Trainee means trainee engaged for one year period in the first instance, extendable at the discretion of the Management. n) Recruiting Authority means a committee constituted by the Board of Directors of the Corporation. 4. Number and character of post The service shall comprise the posts specified in Appendix A. 5. Nationality domicile and character of candidates appointed to service. 1) No candidate shall be appointed to the service unless he is:- a) a citizen of India; b) a citizen of Nepal; or c) a subject of Bhutan: or d) a Tibetan refugee who came over to India before 1 st January, 1962 with the intention of permanently settling in India; or e) a person of Indian origin who migrated from Pakistan, Burma, Sri Lanka, Kenya, Uganda and the East African countries of Tanzania (formerly Tanganuyika and Zanzibar), Zambia, Malawi, Zaire, Ethiopia and Vietnam with the intention of permanently settling in India. Provided the candidates to any of the categories (b), (c), (d) and (e) shall be a person in whose favour a certificate of eligibility has been issued by the Government of Punjab, Department of Home. 2) No person shall be recruited to the service by direct appointment unless he produces:- i) a certificate of character from the principal academic officer of the university, college, school or institute last attended, if any, and similar certificates from two responsible persons not being his relatives, who are well acquainted with him in his private life and are unconnected with his university, college, school or institute. ii) iii) an affidavit to the effect that he was never convicted for any criminal offence and that he was never dismissed or removed from service of any State Government, Government of India or any public sector undertaking. Unless he is declared medically fit by the Authorized Medical Attendant of the Corporation or Civil Surgeon.
4 6. Age Limit. 3 The upper age limit for direct for various posts shall be as per instructions issued by Punjab Government from time to time. 7. Recruiting Authority: Recruiting Authority means a committee constituted by the Board of Directors of the Corporation or as per instructions of the Punjab Government issued from time to time. 8. Disqualifications: No person:- a) who has entered into or contracted a marriage with a person having a spouse living or; b) who having a spouse living has entered into or contracted a marriage with any person shall be 9. Classification:- appointed to the service:- Provided that if the Corporation is satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are grounds for so doing, may exempt any person from the operation of this rule. There will be four cadres below the level of Managers as under:- 1. General 2. Accounts 3. Technical 4. Stenographers From the level of Managers upto Assistant General Manager, there will be three cadres as under:- 1. General 2. Accounts 3. Private Secretary 10. Method of : a) Direct: Recruitment will be made through out-sourcing agency or as per Government instructions/approval. b) Departmental Promotion: Besides the direct, the vacancies shall be filled by making departmental promotions on seniority-cum-merit in different cadres.
5 4 Provided that if no suitable candidate is available for appointment by promotion to the post in the service, such post shall be filled in by direct or by transfer or by deputation as the appointing authority may decide in this behalf. The qualifications/experience for appointment by transfer, deputation shall be the same as prescribed for direct. All appointments by promotion to the service shall be made by selection on the basis of seniority-cum-merit. Qualification, percentage fixed for direct and departmental promotions is given in Appendix B Reservations: As per Government instructions issued from time to time. Minimum experience for promotion: For departmental promotions, qualification & experience required is as mentioned at Appendix- B. MANAGEMENT TRAINEES: In connection with the direct appointment to the post of Managers (freshers) would be designated as Management Trainee for one year and will be paid a stipend of basic pay. The allowance can be increased at the sole discretion of the management particularly in respect of those candidates who are already drawing higher pay. 11. Probation of persons appointed to service : The persons so appointed to the service shall remain on probation as under:- i) Officials below Managers shall be on probation for a period of six months in first instance extendable upto eighteen months. ii) Above Managers shall be on probation for a period of one year in the first instance and extendable one year more. PROVIDED THAT: a) any period, after such appointment, spent on deputation on a corresponding or a higher post shall count towards the period of probation. b) In the case of appointment by transfer, any period of work in equivalent or higher rank, prior to appointment to the service may in the discretion of the appointing authority be allowed to count towards the period of probation.
6 5 c) any period of officiating appointment to the Service shall be reckoned as period spent on probation, but no person who has so officiated shall, on the completion of the prescribed period of probation be entitled to be confirmed unless he is appointed against a permanent vacancy and d) any period of leave not exceeding six months during or at the end of probation shall be counted towards the period of probation. 2. If, in the opinion of the appointing authority the work or conduct of a person during the period of probation is not found satisfactory, or if has failed to pass the prescribed departmental examination within a period not exceeding two years from the date of appointment, it may, a) if such person is recruited by direct appointment, dispense with his services or revert him to a post which he held lien prior to his appointment to the service by direct appointment, and b) if such person is recruited otherwise:- deal with him in such other manner as the terms and condition of his previous appointment permit 4. On the completion of the period of probation of a person the appointing authority may; i) confirm such person from the date of his appointment if appointed against a permanent vacancy or ii) confirm such person from the date from which a permanent vacancy occurs if appointed against a temporary vacancy. 12. Seniority Lists : There will be a separate seniority list upto the level of Executive viz Technical, General and Accounts. The posts of Managers from Executive-I by promotion shall be filled by taking 60% from general category and 40% from technical category of Executives. However, for the post of Manager (Accounts) all the promotions shall be made from Executive (Accounts). 13. Discipline, Penalties and Appeals : The employees so appointed by direct or department promotion shall be liable to disciplinary action as per the provisions of the certified Standing Orders of the Corporation and as per Punjab Civil Service Rules. 14. The /promotions already made will not be disturbed with this policy coming in force.
