G.O.Ms.No.234, Finance (Pay Cell) Department, dated: G.O.Ms.No.123, Finance (Pay Cell) Department, dated: ORDER: In the Government Order first read above, among others, orders have been issued to the effect that employees shall be allowed to move on to Selection Grade / Special Grade on completion of 10 years of service in the Ordinary Grade post and to Special Grade on completion of 10 years in the Selection Grade post or 20 years of total service in a post. The pay of such employees who have moved to Selection Grade / Special Grade on or after shall be fixed on the date of award of Selection Grade / Special Grade by granting the benefit of one increment equal to three per cent of the basic pay including grade pay in the same Pay Band and Grade Pay in the revised scale of pay. 2) Several Associations have represented before the Pay Grievance Redressal Cell to revive the scheme of seperate scales of pay to Selection Grade / Special Grade holders as in the previous Pay Commission periods as there are no promotional chances for several posts and that as the employees awarded Selection Grade / Special Grade between and alone have been given the concession to opt to come over to revised scale of pay on the date of award of Selection Grade / Special Grade by foregoing the arrears to accrue the benefit of higher scales of pay consequent on the revision of the scale of pay of the respective Ordinary Grade post and thereby requested to rectify the anomaly in the total emoluments between those awarded Selection Grade / Special Grade prior to and after The Pay Grievance Redressal Cell constituted in the Government Order second read above did not favour granting the Pay Band and Grade Pay of the promotion post for Selection Grade / Special Grade since this would give uneven benefit to employees existing in the same pay scale in different departments with different hierarchical patterns. However, the Pay Grievance Redressal Committee, considering the longstanding service rendered by the /p.t.o./
2 --:2:-- employees and with the intention to recognise their service properly has recommended to grant an additional increment benefit (over and above the one increment already allowed) equivalent to 3% + 3% of basic pay (Pay + Grade pay) for award of Selection Grade / Special Grade in the revised scale of pay. 3) After careful examination, the Government has decided to implement the above recommendation of the Pay Grievance Redressal Cell. G.O.Ms.No.234, Finance (Pay Cell) Department, dated: Government Letter No /PC/09-1, Finance Department, dated: G.O.Ms.No.123, Finance (Pay Cell) Department, dated: ORDER: As per Rule 8(2) of the Tamil Nadu Revised Scales of Pay Rules, 2009 as notified in the Government Order first read above, the option shall be exercised by the employees to come over to the revised scales of pay within three months from the date of publication of the Rules / Notification. 2) As per the clarification issued in the Government letter second read above, employees have been permitted to exercise re-option within a period of three months from the date of issue of clarification or orders revising the scales of pay, grant of retrospective regularisation of services or grant of Selection Grade / Special Grade with retrospective effect as the case may be. Based on several representations made by individual employees / Employees Associations that several employees failed to accrue the full benefit of the Pay Commission revision due to exercising of the option date wrongly and deprived of the benefits. The Pay Grievance Redressal Cell has recommended that employees may be given final opportunity for exercising re-option as a one time measure in cases where option could not be exercised within the time limit due to the delayed reach of instructions issued by Government and also to cover the implementation of any of the recommendations of the Committee, the Government accepts and that such re-option should not be in any case lead to fixation of a lower pay than what has already been fixed. 3.) After careful examination, the Government has decided to implement the above recommendation of the Pay Grievance Redressal Cell. Accordingly, Government direct that in exercise of the powers conferred under Rule, 12 of the Tamil Nadu Revised Scales of Pay Rules, 2009, accord permission to the employees as a final opportunity for exercising re-option to come over to the revised scale of pay between and as a one time measure in cases where option could not be exercised within the time limit to the advantage of the individual employees. However, such re-option should not be in any case lead to fixation of lower pay than what has been fixed earlier. /p.t.o./

10 ABSTRACT Tamil Nadu Revised Scales of Pay Rules, 2009 Recommendations of the Pay Grievance Redressal Cell Dispensation of Higher Start of Pay for the posts of Junior Assistants / Typists and Record Clerks and protection of emoluments to the directly recruited Assistants / Accountants. G.O.Ms.No.321, Finance (Pay Cell) Department, dated: G.O.Ms.No.234, Finance (Pay Cell) Department, dated: Government Letter No / PC /09-1, Finance Department, dated: G.O.Ms.No.123, Finance (Pay Cell) Department, dated: ORDER: In the reference first read above, orders have been issued granting higher start of pay at two stages above the minimum of scale of pay of Rs to the Graduate Junior Assistants / Typists and in the case of Record Clerks with S.S.L.C. qualification they were granted higher start of pay at two stages above the minimum of the scale of pay of Rs Consequently on the adoption of the Tamil Nadu Revised Scales of Pay Rules, 2009 the above benefit of higher start of pay was continued in the revised pay structure based on the clarification issued in the reference third read above. 2) The Pay Grievance Redressal Cell constituted in the Government Order fourth read above has examined the scope of continuing the higher start of pay to the Graduate Junior Assistants / Typists and the Record Clerks with S.S.L.C. qualification in the light of the anomalies pointed out by the various service associations and the individual petitioners that the directly recruited Assistants / Accountants in the Tamil Nadu Ministerial Service happens to draw lesser emoluments when compared to the Junior Assistants with graduate qualification. For example, an Assistant on entry into service gets his pay fixed at the minimum of the time scale of pay of Rs Grade pay Rs.2800 at Rs.8000/- (Rs ), whereas a Junior Assistant with graduate qualification gets his pay fixed in the scale of pay of Rs Grade pay Rs.2400 at Rs.7600/- (Rs ) and consequent on sanction of higher start of pay at two increments (3% + 3% Rs Rs.230 = Rs.460) gets fixed at Rs.8060/- (Rs ) and there is a loss of Rs.60/- in emoluments to the directly recruited Assistants. /p.t.o./
11 --: 2 :-- 3) The Committee has recommended to compensate this difference of pay as Personal Pay for directly recruited Assistants in service at present. However, the Committee observed that the concession of higher start of pay for acquiring graduate qualification was introduced many years ago with the aim of incentivizing Junior Assistants / Typists to acquire higher qualification when most of them were appointed with the Minimum General Educational Qualification of S.S.L.C. In the present scenario where most of the recruits are Degree holders and even have Post Graduation / Professional qualification. In such a situation the higher start of pay granted to the Junior Assistants / Typists with a degree qualification is no longer warranted and the Committee therefore recommended for dispensation of the grant of higher start of pay to the Junior Assistants / Typists to be recruited in future for possession of degree qualification and also it will avoid unnecessary pay anomaly of the directly recruited Assistants. Likewise, the Committee also recommended to dispense the higher start of pay to the Record Clerks for possession of S.S.L.C. qualification. 4) The Government accordingly examined the above recommendations of the Pay Grievance Redressal Cell and decided to accept it. Accordingly, Government direct that the higher start of pay granted to the Junior Assistants / Typists for degree qualification shall be dispensed to the incumbents recruited in future with a view to avoid the pay anomaly between the Junior Assistants and the directly recruited Assistants and also considering the fact that the persons now recruited are Degree / Post Graduate /Professional Degree holders. Likewise, the higher start of pay granted to the Record Clerks shall also be dispensed with. However, considering the loss in emoluments between the Graduate Junior Assistants and the directly recruited Assistants, the Government recommends to compensate the difference of pay as Personal Pay to the directly recruited Assistants / Accountants in service and this concession shall not be applicable to future cases in view of the dispensation of higher start of pay to the Graduate Junior Assistants. 5) The compensation of the difference in pay as Personal Pay to directly recruited Assistants / Accountants shall take notional effect from with monetary benefit from Further, the orders of dispensation of higher start of pay to the Junior Assistants / Typists and Record Clerks shall also take effect from the same date. However, in cases where higher start of pay has already been granted between and the date of issue of order, such cases need not be effected any recovery. 14 2 Order twenty sixth read above (G.O.Ms.No.71, Finance (Pay Cell) Department, dated: ). The recommendations of the Pay Grievance Redressal Cell are extracted below:-- 1) (i) Based on the One Man Commission, 2010 recommendations the scale of pay of Assistant Engineers was revised from Rs Rs.4700 in Pay Band--2 to Rs Rs.5400 in Pay Band--3 and placed on par with the posts recruited through Group-I Service such as Deputy Collector, Assistant Director (Panchayats) and Deputy Superintendent of Police etc. As a result, the Deputy Collector, Assistant Director (Panchayats) and Deputy Superintendent of Police have also sought revision one level above the Assistant Engineer, Agricultural Officers etc. since they were all along one level above these categories in the pre-revised scales of pay. Likewise consequent on the changes in the scales of pay of promotion posts viz. Assistant Director of Agriculture and Deputy Director of Agriculture level led to shifting the scale of pay of Joint Director, Agriculture, Animal Husbandry and Fisheries from Rs G.P. Rs.7600 to Pay Band-4 Rs G.P. Rs This led to further horizontal relativity issues and hence was rightly reversed by the Government. (ii) In the case of Assistant Engineers, the One Man Commission considering that the posts of Assistant Engineers is filled by the direct recruitment through Tamil Nadu Public Service Commission and the prescribed qualification is B.E., they were placed with on par with professionally qualified Medical Personnel such as Assistant Surgeons and Assistant Medical Officers (Indian Medicine) at Rs G.P. Rs The One Man Commission has also observed that the Senior Draughting Officer with the qualification of either a Certificate or a Diploma which is a lower and feeder category post to Assistant Engineer (if the individual possesses a B.E. Degree) was at the same level as Assistant Engineer and considering it an anomaly placed the Assistant Engineer post on a higher scale of pay of Rs G.P. Rs This does not appear to be sound reasoning and the Government on reviewing the recommendations of One Man Commission found that the Assistant Engineers have erroneously been placed on par with Group-I posts which has led to revision of its first level and second level promotional posts of Assistant Executive Engineers and Executive Engineers to Rs G.P. Rs.6600 and Rs G.P. Rs The Government restored the scale of pay of Assistant Executive Engineers and Executive Engineers to their original level. However, the Assistant Engineers were granted a new scale of pay one level below the Group-I posts at Rs G.P. Rs.5100 reducing the Grade Pay of Rs.300/- and placing the post in the same Pay Band. (iii) Scale of pay of employees in each Pay Commission is based by and large on the parity with similar posts in the Government of India. In Government of India both the Junior Engineers and the Assistant Engineers are placed at the Section Level (Rs G.P. Rs.4600) and its promotional posts Assistant Executive Engineer (Rs G.P. Rs.5400) is placed at sub-divisional level. The comparison with Engineering Services of Central Government like the Railway Services of Engineers and Military Engineering Services is not appropriate considering the fact that these posts are directly recruited and trained for initial posting as Sub Divisional.../3/
15 3 Officers, whereas, in the State Government the initial posting is only as a Section Level Officer and only the next promotional post is Sub Divisional Officer. The appropriate comparison is with the Central Public Works Department where the post of Assistant Engineer are placed in the scale of pay of Rs G.P. Rs.4600 only. (iv) The comparison with Assistant Surgeon is also not appropriate as there is no equivalent of a Diploma holder in the Medical line. In the Engineering line, there is a separate category of Diploma holders, who as Junior Engineers also hold charge as Section Officers, like Assistant Engineers. The recommendation of the One Man Commission to place Assistant Engineers in Pay Band III opened up a huge differential with Junior Engineers which was strongly represented against and appears justified. Therefore, it is appropriate that the scale of pay of Assistant Engineers in State Government may be brought down to Pay Band--2 at Rs However, the Grade Pay of Rs.5100 already fixed in G.O.Ms.No.71, Finance (PC) Department, dated: , which is at a level above their counterparts in Government of India would be appropriate. It also maintains an appropriate difference of Rs.700/- in Grade Pay from Junior Engineers. The Committee also recommends that the excess payments made till the issue of revised orders may be waived and need not be recovered. 2) Consequent on the recommendation to place the Assistant Engineers in Pay Band II, the scale of pay of Block Development Officers, Tahsildars, Inspectors of Police and Forest Rangers which had been elevated from Rs G.P. Rs.4900 to Rs. + G.P. Rs.5100 in G.O.Ms.No.71, Finance (Pay Cell) Department dated: but which has not been implemented due to the Interim Stay granted by the Hon ble High Court on the operation of the Government Orders requires appropriate modification. Hence, the Committee recommends to place the Block Development Officers / Tahsildars, Inspectors of Police and Forest Rangers in Pay Band--II instead of Pay Band III at Rs G.P. Rs Rs.1000/- p.m. as a Special Compensatory Allowance for the arduous nature of their work. 3) Consequent on the downgradation of the scale of pay of Joint Directors of Animal Husbandry, Agriculture and Fisheries to Pay Band-3 at Rs G.P. Rs.7600, the requests of the District Revenue Officers, Deputy Secretaries to Government, Superintendent of Police, Joint Registrars and Joint Commissioners and Joint Directors of other departments to place them on Pay Band--4 at Rs G.P. Rs.8700 does not merit consideration. In respect of the Veterinary Assistant Surgeons / Research Assistants in Animal Husbandry Department and Joint Director / Principal and other Medical Officers of Indian Medicine and Homeopathy Department the applicable scales of pay have been recommended under their respective department. (2) After careful examination, the Government has decided to implement the above recommendations of the Pay Grievance Redressal Cell considering the level of Assistant Engineer in Central Public Works Department and the consequential changes made thereon by endorsing / modifying the scales of pay of certain categories ordered in the G.O.Ms.No.71, Finance (Pay Cell) Department, dated: read above.
