RESOLUTION II 2015-003 A RESOLUTION CERTIFYING AN ADVISORY REFERENDUM QUESTION REGARDING THE LONGMEADOW TOLL WAY, AS APPROVED BY THE TOWNSHIP ELECTORS, AND DIRECTING THE DUNDEE TOWNSHIP CLERK TO

4 RESOLUTION # A RESOLUTION CERTIFYING AN ADVISORY REFERENDUM QUESTION REGARDING THE LONGMEADOW TOLL WAY, AS APPROVED BY THE TOWNSHIP ELECTORS, AND DIRECTING THE DUNDEE TOWNSHIP CLERK TO SUBMIT A BALLOT CERTIFICATION INCLUDING THIS ADVISORY QUESTION TO THE KANE COUNTY CLERK WHEREAS, Dundee Township (the "Township") is a unit of township government in Kane County, Illinois, operating under the Illinois Constitution seq.; and Township Code, 60 ILCS 111-1, et WHEREAS, Section of the Township Code (60 ILCS 1/30-205) provides that a majority of the Township electors present at an annual town meeting may authorize an advisory question of public policy to be placed on the ballot at the next regularly scheduled election in the Township, and it further requires the Township board to certify such advisory questions to the Township's local election official; WHEREAS, Section 28-5 of the Illinois Election Code (10 ILCS 5/28-5) provides that properly initiated advisory referenda may be presented to the voters of a political subdivision at any regular election, and that the local election official shall certify the public question to the appropriate election authority not less than 68 days before the election; WHEREAS, Section 1-3 of the Election Code (10 ILCS 5/1-3) provides that the Township clerk serves as the Township's "local election official," and that the Kane County clerk is the applicable "election authority" for the Township; WHEREAS, on February 23, 2015, the Dundee Township clerk received and filed a petition from Township electors (the "Petition") requesting consideration of an advisory referendum question during the annual town meeting to be held on April 14,2015, and the clerk thereafter included said referendum on the agenda for the annual town meeting;

5 WHEREAS, on April 14,2015, a majority of the electors present at the annual town meeting voted in favor of approving the advisory referendum question for submission to the Township voters on the ballot of the next regular election; WHEREAS, the advisory referendum set forth in the Petition and duly approved by a majority of the electors at the 2015 annual town meeting was as follows: Shall officials in municipalities in Dundee Township including Carpentersville, West Dundee, East Dundee, Sleepy Hollow, Algonquin, and Barrington Hills oppose the $100,000,000 YES NO Longmeadow Toll Way that bisects the Brunner publie forest preserve, due to air, noise, and water pollution and negative impacts to property values? WHEREAS, the next regular election to be held in the Township is the General Primary Election to be held on March 15,2016 (10 ILCS 5/2A-l.l(a»; WHEREAS, December 28,2015, is the latest date upon which the Township Board of Trustees may adopt this Resolution certifying the advisory referendum question to the local election official (the Township clerk) pursuant to 10 ILCS 5/28-2(c); and WHEREAS, January 7, 2016, is the latest date upon which the Township clerk must submit a certification of this advisory referendum question to the Kane County Clerk pursuant to 10 ILCS 5/28-5; NOW, THEREFORE, BE IT RESOLVED BY TilE TOWNSHIP BOARD OF DUNDEE TOWNSHIP AS FOLLOWS: SECTION I. Pursuant to authority granted in Section of the Illinois Township Code (60 ILCS 1/30-205) and Sections 28-2 and 28-5 of the Illinois Election Code (10 ILCS 5/28-2 and 28-5), the Township Board of Trustees hereby certifies the advisory referendum question that was approved by a majority of the electors present at the annual town meeting on April 14, 2015 (the "Referendum Question"), in substantially the following form: 2
