1 Online Payments Terms and Conditions These terms and conditions ( Online Terms ) and the Distance Selling Regulations ( DSRs ) apply to all purchases of goods and/or services ( products ) from Lincolnshire County Council (LCC), County Offices, Newland, Lincoln, LN1 1YL, UK made by you on this website. 1 Terms 1.1 By purchasing any products or services from LCC, you are agreeing to be bound by the Website Terms (see and these Online Terms. Where there is any inconsistency between the Online Terms and the Website Terms, the Online Terms shall prevail. 1.2 Nothing in the Online Terms affects your statutory rights as a consumer. 2 Access 2.1 Access is given to this Website in accordance with these Online Terms. 2.2 You will need to complete the registration process when first using the Online Payments facility. 2.3 You warrant that in using this website you will not impersonate any other person, or use a false name or, without proper authority, act for any other person or organisation. 3 Disclaimer 3.1 Whilst LCC makes every effort to maintain the accuracy of the information on this website, it disclaims any warranty or representation, express or implied, about accuracy, completeness or appropriateness for a particular purpose. 4 Users 4.1 The Online Payments facility is available to both UK residents and those living overseas, provided that they are registered users of the website ( Users ). 5 Eligibility 5.1 To be able to use the Online Payments facility on the website, Users need to hold a valid credit card/debit card (all major cards accepted apart from American Express and Diners). 6 Payments 6.1 All payments are subject to the following conditions: your payment will take a minimum of two UK working days for debit cards and three UK working days for credit cards to reach

2 our account (this includes time to verify your credit or debit card details with your card supplier, and for payment to be notified to LCC). LCC shall make reasonable efforts to ensure that requests for electronic debits involving credit or debit cards are processed in a timely manner. However, a number of factors, several of which are outside our control, may contribute to when the funds are received. 6.2 LCC cannot accept liability if payment is refused or declined by the credit or debit card supplier (due to the customer quoting incorrect card details or for other reasons). 6.3 Currencies: If you are purchasing from abroad you will be charged in your own currency and the banks will perform a currency conversion automatically so that we receive Sterling Pounds. If you wish to look at a currency converter there is one available at (for use as a general guideline only). 7 Confirmation of Payment 7.1 Confirmation of your payment will be displayed on your screen after you make the payment, once the payment has been authorised and accepted. You can print this out as confirmation of your payment. If an address has been provided, confirmation that your payment has been accepted will also be sent by . 8 Charges 8.1 Product prices and additional charges for postage and packing (where applicable) areas published on the website for the relevant products on the date of your order. 8.2 All product prices shown include UK value added tax (VAT). Where VAT (or any other relevant tax) is chargeable, these will be shown separately to the product price on the checkout order summary and receipt, and will be shown at the prevailing rate. This rate may change from time to time. 8.3 Where, for any reason, we have posted an incorrect price on the website, we are entitled to cancel your order and issue you with a refund for the amount you have paid, after which you can resubmit your order for the product at the correct price (see Refunds and Cancellation Policy below). 9 Delivery 9.1 Delivery timescales will be specified as part of the Online Payments product details. 10 Refunds and Cancellation Policy 10.1 Upon receipt of your order, LCC shall send you an acknowledgement/invoice by , and/or with delivery of the products if you have not supplied an address Where we are unable to supply the products you have ordered for any reason, we will issue you with a refund (including any postage & packing charge) within 30 days of your order, by crediting the card with which you paid for your order.

3 10.3 If the products which we deliver to you are not what you ordered or are damaged order effective in any way, we will either (at your request) refund you the amount you paid for the products (including any postage & packing charge), or replace the products you received with products which conform to the ones you ordered. You will need to return the original item before a refund can be issued, or a replacement sent to you. We will also refund the cost of return postage (by cheque) provided you supply a receipt Unless LCC agrees with you otherwise, you will not be able to cancel the permit request once the application has been submitted and payment has been received. 11 Fraud 11.1 We reserve the right to take legal action against those Users committing or attempting to commit online frauds. 12 Discretion to reject/hold payments 12.1 We reserve the right to refuse to process payments We may at our sole discretion do such checks as we may deem fit before processing a credit card payment or bank transfer from the User, for security reasons. As part of such checks, we may disclose personal data to third parties for the purpose of carrying out these security checks. In the event that we are not satisfied with the creditability of the User, we will have the right to reject the payment The User acknowledges and agrees that we will not be liable for any damages resulting from our decision not to process a payment made through our Online Payments facility. 13 Data Privacy Policy 13.1 We will treat all your personal details confidentially, and use them for processing your request, for statistical purposes to improve this website and its services to you, and to service the website You should be aware that if we are requested by the police, or any other regulatory or government authority investigating suspected illegal activities, to provide the details you have given us, we are entitled to do so We will keep your personal details on a secure server and we will comply with all applicable UK Data Protection and consumer legislation Card details are stored securely by our Payment Provider (Capita Software Services), thereby meeting the minimum banking regulation security requirements. Individual card details are not held on any server operated by LCC. 14 Indemnity 14.1 You agree to indemnify us against all claims, damages and expenses arising out of any breach of these Online Terms, and other liabilities arising out of your use of this website.

4 15 Reservations 15.1 We reserve the right to: - modify or withdraw all or any part of this website without notice, and you confirm that we will not be liable to you or any third party in these circumstances, - change any of these Online Terms, and that your continued use of the website following any changes shall be deemed to be acceptance of the changes, - refuse a transaction or service at any time and for any reason In any of the above circumstances, we will not be liable to you or to any third party. 16 Limitation of Liability 16.1 We will not be liable in contract, tort, or pre-contract representations (excluding - fraudulent or negligent misrepresentations) or otherwise, for any economic losses, - loss of goodwill or reputation, or special indirect losses incurred by you or any third party arising out of or in connection with the Online Terms Nothing in these Online Terms shall exclude or limit our liability for death or personal injury arising out of our negligence We will not be held responsible for any delay or failure to comply with our obligations under the Online Terms if the delay or failure arises from any cause which is beyond our reasonable control. 17 Law 17.1 These Terms & Conditions shall be governed by and construed in all respects in accordance with the law of England and Wales, and you and we irrevocably submit to the jurisdiction of the Courts of England and Wales. 18 Security 18.1 Your payment transaction will take place within a secure payment system. We use Secure Socket Layer (SSL) technology, a standard supported by most major Internet browsers. All of your personal card details are protected using 128-bit encryption, when transmitted over the Internet We will take all reasonable care to keep details of your requests and payment secure, but in the absence of any negligence by us, we cannot be held liable for any loss by you if a third party gains unauthorised access to any details you have provided to this website. 19 Complaints and Disputes
