1 DOMAIN NAME REGISTRATION Terms and Conditions These conditions explain our responsibilities to you and your responsibilities to us under the Domain Name Registration Services. By purchasing a Domain Name through Hotchilli, you agree to be bound by these conditions. Please read all these conditions carefully and if you have any questions please contact the Technical Support Team on support@hotchilli.com Definitions Conditions Domain Names Fees Lame Delegate Named Registry We/us/our You/your means these terms and conditions means any name(s) registered with a Named Registry by Us for use as part of any of your URLs means the fees payable by you to us for the Registration Services as specified at the time at: means the modification, suspension, cancellation and transfer of your Domain Name(s) is the relevant registry administrator responsible for administering you Domain Name(s) means Hotchilli Internet denotes you, the customer 1. Registration Services 1.1 Subject to these conditions, we will provide you with the Registration Services which shall commence when we submit your application for Domain Names registration to the Named Registry. 1.2 We shall, on any reasonable grounds refuse to commence the processing of any request for registration of a Domain Name. 1.3 Nothing in these Terms and Conditions obligates us to provide any other services in connection with your Domain Name(s) beyond that provided with the registration services. 1.4 You acknowledge that we cannot guarantee to provide you with the Domain Name(s) you request. You should not take any action in respect of any desired Domain Name(s) until you have been notified in writing that you re requested Domain Name(s) have been registered.

2 2. You re Agreement with the Named Registry 2.1 Along with agreeing to our Terms and Conditions you acknowledge that you have agreed with the Named Registry s Terms and Conditions. You must understand that you are creating a separate contractual agreement between yourself and the Named Registry, and that you are responsible for all fees, liability and obligations in connection with that relationship and not us. 2.2 When registering a Domain you will need to supply us with specific information and you agree: 2.3 For such details to be transmitted to the Named Registry (who may be based outside of the UK) for the purpose of registering your Domain Name(s) 2.4 To be listed as the registrant in connection with your Domain Name(s) by the named Registry. 2.5 For your registrant details being made publicly available by the named Registry 2.6 When required by the named Registry to be listed as the billing/administrative and technical point of contact in connection with your Domain Name(s) by the Named Registry. 2.7 In connection with your Domain Name(s) to authorise us to: 2.8 When required by the Named Registry to list ourselves as the billing and/or administrative and or technical point of contact. 2.9 When required by the Named Registry to delegate the Domain names to our name servers You also agree for us to take any actions we deem to be appropriate in these capacities. However upon termination of the Registration Services we may immediately cease acting in these capacities. 3. Transferring Domains in to Hotchilli 3.1 If you want to use a Domain Name under the Registrations Services that you have already registered with another provider, you must request that the original Domain Name Registrar change the name servers and contact details for the Domain Name(s) as designated by us, on your behalf. 3.2 If you choose to transfer a Domain from another provider, the fees payable to us do not include any outstanding or renewal fees charged to you by your prior provider or the named Registry. 4. Fees 4.1 You shall pay the fees as set out as set out at: Subscription to the Registration Services is charged to you every two years. These fees are non-refundable. When your Domain Name(s) are up for renewal we will endeavour to contact you to seek confirmation that your Domain Name(s) are to be renewed. If we do not get authorisation from you the Domains will not be renewed. We strongly recommend that you are aware of when the renewal dates are and to contact us if you have not heard from us three (3) weeks before your Domain Name(s) are due for renewal. 4.2 Hotchilli can not guarantee the renewal of any Domain Name once the renewal date has lapsed. 4.3 All payments shall be due to the Company net on presentation of invoice unless otherwise specified on the invoice at the Company's main office or at such other address as may from time to time be specified by the Company in writing.

3 4.4 Interest payable on demand whether before or after judgment shall accrue from day to day on overdue amounts at the rate of 4% above base rate + VAT if applicable. 4.5 All fees are subject to change from time to time in the event that the Carrier increases its fees to Hotchilli. Details of any such increase shall be posted in accordance with the process in paragraph Termination 5.1 You may terminate your registration services at any time by providing notice in writing. Please note that if any fees for the Registration Service are outstanding at date of termination and we are: 5.2 The billing contact, we may refuse to transfer your Domain Name or 5.3 Where we are not the billing contact we may refuse to provide any assistance for transfer of your Domain Name(s) 5.4 We may but have no duty to immediately terminate your Registration Services and remove any of your material, including your Domain Names from our Servers if: 5.5 Payment for your Registered Services have not been paid 5.6 In our reasonable opinion we conclude that you have engaged in illegal activities or have violated or threatened to violate the terms and conditions of any other agreement you may have with us, or have breached our AUP. Any termination under this agreement will take effect immediately. In the event that we terminate your registration Service in connection with this condition, you will not be entitled to a refund of any fees. 5.7 Either party shall be entitled to terminate your Registration Service upon written notice to the other party if either party becomes insolvent or ceases to trade or is made bankrupt, we shall not be held liable for any losses incurred by you as a result of such termination. 5.8 Upon termination of your Registration Services: 5.9 You will remain solely responsible for all ongoing fees charged by the Named Registry including but not limited to any registration and/or renewal fees Where we are the billing and/or technical point of contact, you will remain solely responsible for removing us the billing, technical point of contact and you will cease delegating you Domain Name(s) to our name servers in connection with your Domain Name(s) unless we notify you otherwise and We will not be responsible for forwarding any notices, s or other correspondence to you or to take any other actions in connection with your Domain name(s) When the Domain name(s) are up for renewal we will attempt to contact you. If we do not receive any notice back from you, this means that you are authorising us to Lame Delegate your Domain Name(s) Please note that if we do not receive clear instructions we may not be able to proceed with your termination request. 6. Support and Maintenance 6.1 You can request assistance by contacting our Support Team by logging in to the Total Control System or by phoning our Telephone Technical Support. Please note that calls made to this department are charged at 50p a minute and will terminate automatically after sixty (60) minutes. You must also understand that we cannot accept any liability for any loss (direct, indirect or consequential) or damage arising out of the giving of such assistance and advice.

4 6.2 You are responsible for providing us with any changes to the registrant and contact information held by ourselves and or the Named Registry. 6.3 The Registration Service is subject to change from time to time. If you find you cannot use any part of the Registration Service or where a failure, suspension or withdrawal of all or part of the Registration Service is beyond our reasonable control, compensation will not be payable. 7. Amendment of These Conditions 7.1 Hotchilli reserves the right to add and/or amend the conditions at any time. If we amend these conditions you will be notified by letter or advising of the changes thirty (30) days before the amendment is to take affect. If we have not received any communication back from you within this time you will be deemed to have accepted these changes. 8. Limitation of Liability 8.1 These conditions exclude us against all liability for any and all implied warranties, except those not excludable by law, express terms and any liability for tort (including negligence) or any other liability howsoever occasioned. 8.2 The Named Registry may in its sole discretion, reserve the right to refuse to approve the registration of your Domain Name(s) 8.3 Any Domain Name(s) registered by us on your behalf may be subsequently challenged and/or cancelled by persons other than us. 8.4 We accept no responsibility regarding Domain Name(s) disputes between you and any other persons. We shall take no part in any such dispute and must be resolved between the parties concerned. 8.5 We reserve the right to suspend or cancel the Domain Names or the Registration Services. 8.6 We are not liable and accept no responsibility for any dispute howsoever arising you may have with any third party due to your direct or indirect use of the Registration Services. 8.7 We shall endeavour to meet any dates agreed for the obtaining of Domain Name(s), but such a date shall be an estimate only and we accept no liability for failure to meet such dates. 8.8 You agree that your use of the Registration Services is at your sole risk. 9. Warranties 9.1 We make no warranty that the Registration Services will meet your requirements, that the Registration Services will be uninterrupted, timely, secure or error free or will operate as contemplated in these conditions, nor that defects, if any in the Registration Services will be corrected. 10. EXPENSES OF THE COMPANY 10.1 The Customer shall pay to the Company all costs and expenses (so that any legal fees shall be based on an indemnity basis) incurred by the Company in enforcing any of these Conditions, or exercising any of its other rights and remedies under the Agreement, including (without prejudice to the generality) all costs incurred in tracing the Customer in the event that legal processes cannot be enforced at the address last notified to the Company.

Law and Arbitration 11.1 This agreement is subject to the laws of England under the jurisdiction of the Courts of England and any alteration to part of the agreement shall not invalidate the remainder. This agreement incorporates the provisions for arbitration if any are available under any Code of Practice issued by the Network operator under the provision of its licence.
