Students who decide to leave HCC Housing before the end of the term must petition for contract release and must meet one of the following conditions in order for their petition to be approved: 1) Official withdrawal from school or transfer. 2) Official graduation from Hibbing Community College. 3) Student legally marries. 4) Doctor approved medical condition. I understand that Hibbing Community College reserves the following rights: (a) the right of re-entry. HCC may terminate a housing contract with an individual or exclude that individual from the premises for a breach of any term, condition or regulation of the housing contract. (b) The right to inspect/show an apartment. HCC reserves the right to enter an apartment at any reasonable hour to inspect and make necessary repairs or alterations, or to investigate suspected policy violation. (c) The right to assign roommates. HCC reserves the right to assign students to apartments, in its sole discretion. (d) Hibbing Community College reserves the right to deny or cancel a residence hall contract to an individual whose conduct and/or criminal record indicates an actual or perceived threat or danger to the Hibbing Community College community, including students, faculty, and staff. (e) Hibbing Community College may relocate any resident without cause or prior notice for health and safety reasons or to protect Hibbing Community College property, restore operations, or meet the needs of the Hibbing Community College community or its individuals. 5 Terms of agreement TERMS: This contract coincides with the academic calendar year. Both fall and spring semesters are included in the academic year. This contract commences the Saturday before the Fall semester begins and terminates the Friday of finals week of Spring semester. It shall be automatically renewed from semester to semester. College housing will be closed during semester/holiday breaks and all residents are required to vacate. PAYMENT: FALL SEMESTER RATE 2015 SPRING SEMESTER RATE 2016 Single Room - $ Single Room - $ Double Room - $ Double Room - $ If available, payment for occupancy prior to the Saturday before Fall Semester and after the Friday of finals week in Spring semester will be pro-rated to $18/day for a double and $21/day for a single room. Please make checks payable to Hibbing Community College. The fall semester payment schedule is as follows: A $250 security deposit must be submitted with the completed contract application. Fall semester payment will charged at $1, double bedroom and $ single due at checkin. If a student is using financial aid or needs to set up a payment plan, student should contact the HCC Business Office at (218) , Bldg M, Room 125 to make the appropriate arrangements. Single rooms are limited and requests will be honored based on availability of rooms. Late payments will be given a 30-day termination of Housing Contract notice. If payment is not received within 30 days, residents will need to vacate the premises and account will be submitted to a collection agency. Students will be responsible for the entire semester payment and all collection agency fees. The spring semester payment schedule is as follows: Spring semester payment will be charged at $1,570 double bedroom and $ single. If a student is using financial aid or needs to set up a payment plan, student should contact the HCC Business Office at (218) , Bldg M, Room 125 to make the appropriate arrangements. Single rooms are limited and requests will be honored based on availability of rooms Late payments will be given a 30-day termination of Housing Contract notice. If payment is not received within 30 days, residents will need to vacate the premises and account will be submitted to a collection agency. Students will be responsible for the entire semester payment and all collection agency fees. Exception: If a student has been awarded sufficient financial aid to cover tuition, fees, books and housing payment, the student may elect to have housing payment deducted from financial aid, pending approval of Director of Residential Life. DEPOSIT: A security deposit in the amount of $ shall be paid at the time of execution of this contract to be held by Hibbing Community College (HCC). This entire deposit will be forfeited if this contract is canceled on or after July 1st for fall semester or December 1st for spring semester entry. The $250 deposit is held as a security deposit and will be refunded, without interest, after a student completes the

6 check out process for the academic year. Deposit will be refunded, provided no damage has been done, check out procedures are followed, and the student has a zero balance on their HCC account. In the event that the unit is damaged or not properly cleaned, costs will be assessed to the student accordingly. Resident(s) shall remain liable for the full amount of any of the foregoing costs with the deposit to be applied against the total due. If the student vacates HCC Housing for any reason before the end of the academic year, the $250 deposit will be forfeited. Resident(s) consent to forfeit their entire security deposit if they vacate prior to the expiration of the contract. Student agrees to pay a fee of $20 for each check returned for non-payment by Student s bank for any reason. When students occupy a double bedroom, and one student moves out of the bedroom, the remaining student may be required to move. Depending on availability, the remaining student may request to pay a single room rate and remain in the bedroom. Hibbing Community College reserves the right to take charges and payment from financial aid, including work-study payments, received by the student. Students will pay by the semester from personal or financial aid funds, if qualified. The security deposit and semester payment is required before the contract becomes effective (exceptions will be made for residents qualified for financial aid funds). Arrangements for telephone service are the responsibility of the student. OCCUPANCY: Student(s) shall comply with all written rules and regulations established by Hibbing Community College and stated in the HCC Housing Manual and Student Handbook. All expenses for maintenance and damage due to the student(s) neglect or carelessness shall be paid for by the student(s) within fifteen (15) days of billing in order to maintain the security deposit at required amount. Student(s) should promptly notify the Housing Director, in writing, of any defects or issues related to the housing unit. Student(s) may not assign any part of the premises without prior written consent of Hibbing Community College. Student(s) shall maintain the apartment and housing property in a clean and neat manner and shall not disturb the occupancy of other student(s) or violate any public law, regulation or ordinance. Students and/or guests shall not make or permit noises or acts that will disturb the rights or comfort of neighbors. Courtesy hours are in effect 24 hours of every day, seven days a week. Please refer to the HCC Housing Manual and Student Handbook for all written rules and regulations. Violation of these rules may result in sanctions pursuant to the student code of conduct and/or housing handbook, including termination of the agreements. Violation of any rule is just cause for termination of Housing Contract. Student(s) consent the property is to be used for residential housing only. Student(s) consent to forfeit the entire security deposit if they vacate prior to the expiration of the contract. INSURANCE: Hibbing Community College is not responsible for damage or loss of your personal property unless caused by our negligence or willful misconduct. HCC is not liable for any personal injury to your family, guests or you caused by criminal acts of a third party, fire, acts of nature, bursting pipes, water, explosions, or other like causes. Please verify coverage under an existing homeowner s policy or consider purchasing your own insurance for protection against these and other possible problems. UTILITIES: HCC will supply the following utilities: wireless internet, electric, heat, water, sewer, and garbage collection. Residents are responsible for all other expenses, including telephone and cable television. APPEALS PROCEDURE FOR TERMINATION OF HOUSING CONTRACT: Please refer to the HCC Housing Manual and Student Handbook.

7 COLLECTION POLICY: Hibbing Community College will use a collection agency to collect any/all unpaid account balances which may include housing fees, damages, and/or other unfulfilled financial obligations. RIGHT OF ENTRY: Hibbing Community College reserves the right to enter student(s) apartments without prior notice to provide emergency or routine maintenance, to inspect fire hazards or safety-related conditions, to investigate a disturbance, to protect the health and well- being of an individual or to investigate a possible violation of campus housing policies. Hibbing Community College and the student(s) hereof agree to the terms and provisions and conditions of this housing contract. The student(s) and Hibbing Community College hereby acknowledge that they have received a copy of this contract and they will adhere to policies in the contract, HCC Housing Manual, and Student Handbook. Cancellation and Termination: (please read entire section) a) Prior to the agreement period: A written request for a cancellation of this agreement by the student which is received and approved by the Department of Residential Life postmarked on or before July 1, 2016, for Fall Semester will result in a refund of the housing deposit. A student signing an agreement beginning with the 2017 Spring Semester will have until December 1, 2016, to request the cancellation and refund of the housing deposit. A request after these dates will result in the forfeiture of the housing deposit by the student. Should the agreement be signed after July 1, 2016 (for Fall) and December 1, 2016 (for Spring) and the student decides to cancel, the student will forfeit the housing deposit. b) Graduate, non-enrollment, student teaching, internship, marriage: The student may request cancellation of this agreement for Spring without forfeiture of the housing deposit for reasons of non-enrollment, non-admission, student teaching, internship, study abroad, military service, serious health or medical concerns, graduation, or marriage, by filing a written request with the Department of Residential Life by December 1, Students who are academically suspended/dismissed from Hibbing Community College will not be eligible to receive their housing deposit. c) Withdrawal From Hibbing Community College: If the student withdraws from Hibbing Community College during the term of this agreement, the student will forfeit the housing deposit and will only be refunded if documented withdraw date allows a refund.
