1 REFERENCE Workplace Health, Safety and Compensation Act (The Act) Occupational Health and Safety Act, Chapter 0-3 RSNL 1990 Occupational Health and Safety Regulations, 2009 POLICY STATEMENT TRAINING REQUIREMENTS APPROVAL OF TRAINING PROVIDERS/TRAINERS The Workplace Health, Safety and Compensation Commission (the Commission) has legislative responsibility to promote public awareness of workplace health and safety; educate employers, workers and other persons about workplace health and safety; develop standards for the certification of persons required to be certified under the Occupational Health and Safety Act; approve training programs for certification; and certify persons who meet the standards. The Commission will seek advice from subject matter experts in the development of certification standards. It will monitor training programs, as well as, training providers and trainers (where applicable) to ensure they meet or exceed these standards. The Commission will develop all certification standards with the advice from subject matter experts. It will monitor training programs and training providers and trainers (where applicable) to ensure they meet or exceed these standards. The Commission establishes criteria for the approval of providers and trainers (where applicable). Providers and trainers (where applicable) must be approved by the Commission to deliver certification training by completing the appropriate registration form. Where required, training providers must develop and submit training curriculum as prescribed in the applicable training standard for approval. The Commission may approve training providers if they satisfy criteria with respect to: 1. Competency and qualifications, 2. Delivery of certification training that meets prescribed training standards Page 1 of 5

health and safety; educate employers, workers and other persons about workplace health and safety; develop standards for the certification of persons required to be certified under the Occupational

2 3. Documentation, record keeping and adherence to administrative requirements of the Commission, 4. Maintaining program integrity and delivery. Where required, trainers must be approved and have the following prerequisites: 1. high school graduation or equivalent, 2. experience delivering training and knowledge of adult education principles, 3. knowledge, training and experience to be competent and qualified, as defined by the OH&S Regulations, in the use of safety equipment, systems and planning indicated in the certification training standard, 4. proficient knowledge of OH&S regulations and current industry standards specific to certification training standard, 5. OH&S education and training, and 6. approval by the Commission to deliver certification training. PROGRAM DELIVERY Program delivery, as indicated in applicable certification training standards, must include but is not limited to the following principles: 1. well-defined learning outcomes, based on accurate learning content, which are clearly addressed through course curriculum for the specific target audience, 2. compliance with adult learning principles and comprehension levels, 3. training session evaluation methods, Page 2 of 5

experience delivering training and knowledge of adult education principles, 3.

3 4. learning activities, both theoretical and practical that demonstrate participants subject matter comprehension, 5. quality, non-discriminatory teaching materials, aids and technical resources are available as required by certification training standard, 6. references to any teaching material used in the development of training curriculum, and written permission from the publisher in accordance with copyright requirements, for material taken directly from resources, 7. learning environment, such as classroom and class size conducive to participation and interaction among participants, 8. compliance with prescribed training session duration, 9. compliance with the minimum delivery of training sessions by training providers and trainers, 10. evaluation methods to measure participant s comprehension, 11. curriculum that adheres to the OH&S Act, and 12. changes made to the approved curriculum must be submitted and approved by the Commission. DOCUMENTATION AND ADMINISTRATION The Commission will monitor the effectiveness of training and training provider activities by any or all of the following: 1. reviewing participant evaluation forms, 2. receiving and responding to concerns, 3. reviewing administrative processes used by training providers and trainers, and Page 3 of 5

references to any teaching material used in the development of training curriculum, and written permission from the publisher in accordance with copyright requirements, for material taken directly

4 4. monitoring performance of training providers and trainers through the completion of random quality assurance audits, 5. or other appropriate means. MAINTAINING PROGRAM INTEGRITY AND DELIVERY Where required, the Commission will issue qualification certificates to participants and/or trainers of certification training standards. Training providers must maintain records of trainers and certification training programs as necessary by: 1. collecting and maintaining records of competent and qualified trainers according to trainers prerequisites, including their names and contact information. 2. issuing training certificates to participants and maintaining databases of persons who have been certified with the training provider. Records to be maintained include name of person, date of successful completion of certification training program, contact information and date of recertification. As necessary, recertification is required every three years from the date of initial certification date. It is the responsibility of the certificate holder to register and participate in applicable certification training programs every three years. 3. implementing internal auditing systems to ensure trainers are following the certification training standard. 4. maintaining a registry of training records and providing the Commission with the number of certification training programs taught, the number of participants in each session for each certified trainer, and the location of training programs by December 31 st of each year to maintain active training provider status. Training providers must maintain records of trainers and certification training programs as necessary by: 1.

5 5. providing the Commission with participants evaluations upon request to be used for data analysis and quality assurance purposes. 6. submitting any information regarding the certification training program to the Commission as a means of measuring the effectiveness of the Commission in meeting its objectives. 7. providing Commission-issued Certificate of Clearance. All training providers and trainers must adhere to certification training standards requirements. NON-COMPLIANCE The status of an approved training provider/trainer where applicable, may be revoked where the Commission finds there is failure to meet or maintain the certification training standards set by the Commission. In such cases, the individual(s) will be advised of noncompliance and will be given the opportunity to provide an explanation to the Commission before a decision is made to revoke certification.
