2 Policy: Auxiliary Law Enforcement Service of the City of Cape Town The Law Enforcement Auxiliary Officer programme under the direction of the Chief of the Law Enforcement Department will assist in the accomplishment of the Safety & Security Directorate s goals and objectives by augmenting the Department s resources, assisting the Department at special events and performing other assignments as directed by the Chief. The Law Enforcement Auxiliary Officer programme of the City of Cape Town is a volunteer based initiative. Authority The City of Cape Town Auxiliary Law Enforcement Service was established in terms of Council Resolution C39/10/12 of 31 October 2012 which gives the Chief of the Law Enforcement Department the authority to determine who may serve as Auxiliary Officers. Auxiliary Law Enforcement Officers are regarded as being in the employment of the City whilst on duty and thus have full Peace Officer status in terms of Section 334 of the Criminal Procedures Act, 1977 (Act 51 of 1977) when they are officially on duty. Appointment of Members Applicants should meet the following criteria in order to be considered for appointment as an Auxiliary Law Enforcement Officer : Be at least 21 years of age Preferably be in possession of a senior certificate Must be in good health and able to pass the prescribed physical assessment for Auxiliary Officers Must be of good character and have no criminal record or subjected to a pending criminal case Eager to serve his/her community in a volunteer capacity Meet any other relevant requirements contained in the City s policies pertaining to recruitment and selection. person may be appointed as an Auxiliary Law Enforcement Officer that is currently serving in the law enforcement environment (members of SAPS, Traffic Services, Metro Police etc.)

3 Applications for appointment of as members of the Auxiliary Law Enforcement Service are to be made by submission of the following, duly completed forms to the Office of the Chief: Application for appointment (Annexure A) Health Questionnaire (Annexure B) Indemnity form (Annexure C). Recruitment Recruitment of reservists will be in accordance to the City s stated principles of equity regarding demographics and gender. Recruitment drives will be focussed on active contributors to registered community based initiatives. Training Members of the Auxiliary Law Enforcement Service will be required to undergo all training courses prescribed for permanent members in terms of Government tice R209. Fully qualified Auxiliary members will also be required to attend additional or refresher training sessions as directed by the Chief. All training sessions will be provided after hours and over weekends. Newly appointed Auxiliary members will be placed on a three month probationary period during which they will work with permanent members of the City s Law Enforcement or Metro Police Departments. Duties of Auxiliary Law Enforcement Officers Auxiliary Law Enforcement Officers will be responsible for performing the same uniform patrol duties as full time officers. Auxiliary Officers will be utilized to enhance the law enforcement capacity of the City by: Taking part in the daily patrol operations of the Department Supporting registered neighbourhood watches in an effort to enhance their crime and disorder prevention capacity Supporting specialized law enforcement functions by direction of the Chief Perform emergency duties in the event of disasters and other emergency situations, by direction of the Chief

4 Attend monthly meetings as scheduled by the responsible official Each Auxiliary member shall devote a minimum of 16 hours per month to the functions of the Law Enforcement Department. This 16 hour minimum does not relieve the Auxiliary member from emergency duties. Each Auxiliary member shall submit a monthly attendance register indicating the number of hours worked and assignment details. Auxiliary members are subject to dismissal if no hours are worked I a three month period without the permission from the Chief. Chain of Command An Auxiliary member shall be considered to be performing service to the City after formally booking on duty according to a formal duty roster or when called to perform such duties by an official appointed to manage his/her activities. An Auxiliary member, while on active duty, will function through the chain of command of the Law Enforcement Department. Auxiliary members possess peace officer status via this chain of command, while on duty and do not possess such status when off duty. All Auxiliary members will serve under the supervision and/or direction of permanent members. An Auxiliary member shall, whilst officially on duty, submit him/herself to the provisions of the City s disciplinary code, but as amended in the Auxiliary Law Enforcement Standing Orders to recognise the special circumstances of their voluntary status vis a vis family responsibility, illness, leave of absence etc. An Auxiliary member on duty shall be identifiable as such by his/her insignia. Membership An Auxiliary member shall be entitled to the same degree of legal indemnity afforded to a permanent member acting in good faith and within the law while on duty. Auxiliary members will be covered by the City s Group Personal Accident Insurance for purposes of covering expenses relating to injuries on duty. An Auxiliary member rendering exemplary service shall be included for consideration in the periodic awards process designed to recognise service excellence or bravery.

5 An Auxiliary member shall carry his or her appointment card (as peace officer) at all times whilst on duty. Membership does not entitle an Auxiliary member to carry a firearm when on duty. The carrying of firearms depends on the member s level of competency as established through the completion of relevant training courses and the issuing of firearms is done on the discretion of the Chief. The Law Enforcement Auxiliary Officer programme of the City of Cape Town is a strictly volunteer initiative with no financial benefits attached to it. Auxiliary members will also have no employment expectations and serve at the discretion of the Chief. Conduct Auxiliary members will adhere to the same standards applicable to permanent members. All Auxiliary members will be required to ascribe to the Code of Conduct of the Auxiliary Law Enforcement Service of the City of Cape Town (Annexure D). Advancement in Rank Auxiliary members shall be considered for advancement in rank upon attaining the criteria laid down in the applicable standing orders, with the proviso that a volunteer peace officer shall not occupy a management role over permanent members. Prior learning and experience will be considered after an Auxiliary member has completed the first six month period of active duty. Such advancement in rank will be accommodated in accordance to the established Criteria for Advancement in Rank for Auxiliary Law Enforcement Officers based on Prior Learning and Experience. Uniform Auxiliary members of the Law Enforcement Department will adhere to the applicable standing orders in respect of Dress Code, Equipment and Grooming. Auxiliary members will wear standard City of Cape Town Law Enforcement Uniforms while on duty and any exceptions are subject to the prior approval of the Chief.

Performance of Duties We will be conscientious and diligent in the performance of our duties, while treating everyone who comes into our sphere of influence equally and with courtesy, consideration and dignity.

13 We will not allow our personal feelings, animosities or friendship to influence our official conduct and we will enforce the law appropriately and courteously, while striving to obtain maximum cooperation from the public. We are also responsible for continuous upgrading of our skills and will take every reasonable opportunity to enhance and improve our knowledge and competence. Confidentiality Information that comes into our possession will be treated as confidential. We will not use such information for personal benefit and will not divulge it to other parties except in the proper course of our law enforcement duty. We will also, similarly, respect as confidential, information about official policy and operations unless authorized to disclose it in the course of our duties. Sobriety and General Conduct While on duty we will be sober. We will not consume any intoxicating liquor when on duty or for a sufficient length of time before going on duty in our place of work. We will at all times project a professional image as benefits a member of this department. Lawful Orders We will obey all lawful orders and abide by the provisions of our Standing Orders, relevant policies as well as law. We will support our colleagues in the execution of their duties and oppose any improper behavior, reporting it where appropriate. Appearance Unless on duties which dictate otherwise We will be well turned out, clean and tidy whilst in uniform. We will maintain an acceptable level of fitness and continuously strive to improve our physical prowess. Politeness and Tolerance We will treat members of the public courteously and with respect, avoiding abusive or deriding attitudes or behavior.
