The decision, about the guardianship of an elderly woman named Rebecca who has Alzheimer s dementia, for the first time established that someone can be appointed to assist the person facing impairment instead of taking control of all their decision making. When someone with a disability was brought to the attention of social workers until now it would lead to a court-appointed guardian coming in and taking control, making decisions about her life, says Mickey Schindler, the director of Yad Riva Legal Aid to the Elderly, which is part of Yad Sarah. This recent court ruling is a trailblazing decision, the Jerusalem Post said. And Schindler says that it will eventually lead to a fundamental shift in the way Israeli courts address the needs of the disabled. Guardianship sounds like a wonderful social concept, but many times it intrudes on someone s liberty, says Schindler. Sometimes it is needed, but many times you can use a different model. Someone who knows what he wants to do but has difficulty executing it doesn t necessarily need guardianship. The research shows that it is infantilizing. And that has many negative emotional implications. Instead the new supportive, rather than directive, approach, means that the court-designated person a close friend, in Rebecca s case is appointed to assist, rather than supplant, the disabled person s decision-making. You can see that a move is starting. It will make an enormous difference in the lives of the disabled. It s a concept widely integrated into education and social services in the U.S., where today children with physical and some cognitive impairments are integrated into regular schools, assisted by aides and whatever supports they need, rather than segregated in separate institutions. The idea is that the person has capacity, so instead of putting him away in a separate school you are having him live his life with help, (continued on page 6)

Report from the Executive Director 2Inside Yad Sarah Fall Dear Friends, There s so much about Yad Sarah that represents Israel at its very best the collective effort to help others to make home care simpler, easier, more comfortable and the ingenuity to find new ways to support individuals and families and reassure them that help is available, and they are not struggling alone. In this issue of Inside Yad Sarah, we bring you a look at some of the innovative work by professionals and volunteers. Meet Dr. Tamar Kartin-Gabbay, director of Yad Sarah s Geriatric Dental Clinic. Read about the vital work of the clinic s mobile unit, and the training course for Dental Assistants, meeting the need for qualified staff sensitive to the needs of older patients, and facilitating employment opportunities and income for women that will have a direct and positive impact on their families. Most of us are not familiar with the laws for guardianship until it affects us or someone we love. Dr. Mickey Schindler, the director of Yad Riva, a legal services program for the elderly at Yad Sarah, is working on changing the way guardianships are handled in Israel. Mickey sees this as having broad implications for thousands of frail elders and people with special needs. Kadima (onward), Mickey! On a recent trip to Israel, I was delighted to represent all of you our donors and friends at Yad Sarah s multi-service center in Modiin, expanded and funded with the help of friends in the USA. Under the leadership of volunteer branch manager, Eli Rosenberg, the branch continues to thrive in its new, larger facility, ensuring that wheelchairs and breast milk pumps, oxygen concentrators and walkers, are available to all who are in need. I was particularly impressed with a pilot program pairing equipment repair volunteers with young adults with special needs, enabling them to learn new practical skills while helping others. The volunteers provide the young people with a convivial and supportive atmosphere social contact that is indeed life-enriching. And no less important, the parent of one young man came to meet him at the end of the session; she is so appreciative that her son has something meaningful to do among people who genuinely like him and care about his progress. A typical morning at Yad Sarah s branch in Netanya... Father and son come to Netanya from Hadera looking for an appropriate walker to assist a grandfather recovering from surgery. Like Modiin, the Netanya branch has also outgrown its space. Yad Sarah plans to add a floor to its existing building, redesign the space to better accommodate its busy Lending Service and its growing Day Rehabilitation Center. The volunteers were upbeat and warm as they helped a steady stream of clients with varying needs: a young mother with an infant requested a breast milk pump, a sad but determined father needed an infusion pump stand for his seriously ill 12-year-old daughter, a family seeking a specific walker to assist an aging parent s recuperation. It was refreshing to see that one of the volunteers, an older retired man, was completely fluent in the mechanics of a breast milk pump! At the branch at Rambam Hospital in Haifa, the volunteers work in tight quarters. There are no plans to expand it is a resource for hospital patients upon discharge and there is adequate space to address the home care issues presented. A young father returned a breast milk pump, sheepishly admitting that they had kept it for 3 years! The volunteers were overjoyed to learn that the family had added 3 sons during this period, putting the equipment to very good use! I observed the weary wife of a 63 year old man hospitalized with kidney failure, diabetes requesting a wheelchair to take home to Karmiel. The volunteers listened carefully to the report of her husband s illness, gently suggesting other items that may make things easier when he returns home. They also let her know that when the wheelchair is no longer needed, she may return it at the branch in her neighborhood, enabling her to focus on caring for her family. Before she left the branch, she sighed audibly and said, thank you, you really helped me. Though she addressed this comment to the volunteers, it was really meant for all of you. Thank you again for helping to make all this vital and compassionate work possible. 4 N ow Esther can smile, says Dr. Tamar Kartin-Gabbay, director of Yad Sarah s Dental Clinic. She was suffering from pain. Now she has teeth. Dr. Karin-Gabbay was referring to Esther H., an 80-year-old woman who lives in a Jerusalem old age home and has few resources. Coping with diabetes and struggling with the recent below knee amputation of her leg, Esther began to suffer from debilitating mouth pain. She was referred to Yad Sarah s Dental Clinic. After examining her, a Yad Sarah dentist realized that Esther needed multiple teeth extracted, several root canals and dentures. Initially Esther came to Yad Sarah s clinic at its Jerusalem headquarters accompanied by her elderly sister. For subsequent visits, Yad Sarah s mobile dental clinic performed Esther s treatments at her senior residence. The Mobile Dental Clinics make it possible for older adults with mobility issues to receive excellent care. Some 1,500 elderly, impoverished patients come to Yad Sarah s headquarters dental clinic each year, said Dr. Kartin-Gabbay. Another 500 are served by Yad Sarah s mobile dental clinic in Jerusalem, 250 in the mobile dental clinic that serves northern Israel, and 150 through the van which treats patients in the Beersheva area. The mobile dental clinics are specialized Yad Sarah vans outfitted with everything the dentist might need, including a mobile X-ray machine. The mobile dental clinic vans travel throughout their respective areas to treat Yad Sarah s Geriatric Dental Clinic: Volunteer Dentists Make Housecalls people suffering with oral ailments who are homebound due to illness or disability. Unlike in a dental office, where the patient sits in a special reclining chair that the dentist can raise and lower as needed, and special lights to see into the patient s mouth, the dentist treats people on the sofa or their bed. The Mobile Dental Clinics make it possible for older adults with mobility issues to receive excellent care both in emergency situations and as ongoing treatment. In Jerusalem alone there are 17 volunteer dentists, each of whom works once a week for as many as six hours at a time. Specialists such as oral surgeons and periodontists also volunteer on a part-time basis, as needed. The Dental Clinic operates with just three paid staff members in addition to Dr. Kartin-Gabbay. Dr. Kartin-Gabbay recalled another recent patient a blind woman in her 60s who counts herself as a breast cancer survivor among a number of other medical challenges. She couldn t afford the new set of dentures she needed, even at Yad Sarah s much-reduced rate. A Jerusalem oral surgeon offered to donate two implants to Yad Sarah patients, and the clinic sent her. Today she told me she got money [for her dental treatment] and she wants to donate it to tzedaka, to treat other patients. And for another recent patient, the improvement in his dental health has enabled him to consider new opportunities. Impoverished and nearly toothless, Dr. Karin-Gabbay said, he said he d been going without teeth or dentures for 10 years. We finished his dentures just a month ago. When we gave him the set of dentures he said, great, now I can get a shidduch! 4Inside Yad Sarah Fall 2015 Filling in the Gaps in Israel s North The mobile dental clinic in the Krayot region the area north of Haifa that includes Kiryat Motzkin, Kiryat Haim, Kiryat Yam, Kiryat Shmuel and Kiryat Ata is served by a mobile dental clinic operated by volunteer dentists who make home visits to provide care. The coordinator of the Krayot mobile dental clinic, Reuven Levin, is a retired volunteer who worked for many years as a social worker for the Ministry of Social Welfare. A disabled veteran, Levin has a particular interest in serving the elderly and disabled. He volunteers twice a week for the regional Moked Lekashish, the area s social welfare referral unit for the elderly, and in addition, he makes himself available 24/6 to take calls for dental care referrals. People who need our services know they can call me anytime for help, Levin says. He coordinates the work of the volunteer dentists and any necessary follow-up for patients, and provides a compassionate ear to those who need it. In one recent case that demonstrated the extent of the commitment on the part of the Yad Sarah team, A. S., a 71-year-old man who is blind and physically disabled, was referred by the social welfare referral unit in Kiryat Haim, complaining of severe dental pain and an inability to chew. The volunteer dentist, Dr. Kerem, visited A., who lives alone and has no close family, and saw that he had neglected dental hygiene and care for many years, and was in urgent need of extensive care. Levin, the volunteer clinic coordinator, made arrangements for a series of surgeries in local clinics, providing Yad Sarah volunteers to help A. with his transportation and his follow-up care at home. In the end, A. had to have 13 teeth pulled, Levin recalled. And then Dr. Kerem provided him with the oral prosthetics that he needed in order to be able to chew again. He made sure A. could lead a more productive and pain-free life. Levin is sure that with the necessary support, the Krayot mobile clinic could be serving many more people in need. We need more resources for outreach, and we need to cover expenses for dental equipment and travel, he says. While everyone we treat is asked to pay something toward their care, there are many patients who cannot afford to cover costs. Also, we ask Holocaust survivors for just 20% of our typical rates. So there is a real, ongoing need for outside support for the clinic.

5 Dental Assistant Training Program The Geriatric Dental clinic has launched a unique, new vocational project for Ultra-Orthodox (Haredi) women in Jerusalem to provide them with a valuable professional skill and the opportunity to help support their families. The Dental Assistants Program offers Haredi women of all ages the chance to gain valuable skills that can ensure employment for years to come, and earn income to help support their families. For many of the participants, this is an opportunity to engage in a secular, professional environment for the first time in their lives and will help fill a desperate and growing need for income and opportunity among a large section of the Haredi community that lives in poverty. The year-long program, now in its second year, has a current capacity to train up to 20 Haredi women and provide work placements for all graduates due to the great demand in the work force for dental assistants. Edna Tsiony, the founder of the Dental Hygienist program at Hebrew University-Hadassah Hospital in Jerusalem, was tapped to lead the new training program at Yad Sarah. She had recently retired from her position as head of the Hadassah program, a post she held for 38 years, and was seeking a way to make a difference as a volunteer at Yad Sarah. Together with a colleague, Edna offers a ten-month course of 24 hours of study each week, including clinical work both at Yad Sarah s dental clinic, which has four dental stations, and at other dental clinics around Jerusalem. Participants also do a clinical rotation at a Jerusalem free clinic for children to gain experience working with children. These women are working for the first time in their lives, Edna says. Until now, they lived very isolated lives within their own communities. But they love to learn, and they want to earn money and give their families more opportunities. They are very motivated and work hard in order to succeed. At the conclusion of the ten-month program, the students must pass course exams before going on to take national certification tests from the Ministry of Health. In the first program cohort, 100% of the participants passed the certification and were assisted by Edna in finding jobs. Edna Tsiony typifies the extraordinary dedication of Yad Sarah volunteers. When she finishes providing three intensive days of training each week, she stays on one or two evenings to volunteer in the Yad Sarah dental clinic, as a dental hygienist for elderly and low-income patients. She has even been known to feed and care for the baby of a course participant during a final exam, to make sure that the mother could complete her course requirements. I believe program participants must make arrangements for their children during course time, in order to foster an atmosphere that promotes learning and professionalism, she says. When her medical doctor informed social services that Rebecca has dementia, her social worker contacted Yad Riva, which filed the court case with the help of a Bar Ilan University legal clinic. Yad Riva, an arm of Yad Sarah, works with over 30 Israeli social service agencies, assisting their clients with legal information about the rights of the elderly. This new ruling achieved by Yad Riva s lawsuit fits perfectly into Yad Sarah s mission of helping those with special needs remain as independent as possible. We re having an impact on thousands and thousands of elderly people and younger people with disabilities. Rebecca, who has no family in Israel, remains able to live independently, taking care of most of her daily needs and expressing and executing her wishes. She does, however, require help remembering shortterm information, like daily money management. The idea is that someone will help her, if she takes out money they will write it down and help her keep track, Schindler says. Before the court ruling, typically an organization would be appointed as guardian for someone in Rebecca s position, and in a short time transfer her to an old age home because that would be the only way they could keep an eye on her, says Schindler. Rebecca was terrified of that. She may forget that she told you a story already, but Rebecca knows what she wants, she knows what movies she likes to see, where she wants to go, he says. While the Haifa Family Court decision doesn t change the guardianship law itself, it has already been used as precedent in rulings by other courts, says Schindler. A court in northern Israel recently appointed someone to assist, rather than take over, the care of a younger man with mental disabilities, for instance. You can see that a move is starting. It will make an enormous difference in the lives of the disabled, Schindler says. We re having an impact on thousands and thousands of elderly people and younger people with disabilities. Schindler hopes that eventually, the guardianship law, which dates from 1962, will be changed to reflect this new approach. For the next three to four years, he hopes to conduct a pilot study, in coordination with social services, medical doctors and the courts, tracking each case based on this new model to measure its effectiveness. But that takes funding, which Yad Riva and Yad Sarah must now raise. We need funding for it because this is just the beginning. I m in this field 16 years already it s probably the most important case we have had, Schindler says. This is the beginning of a big climb. It s an enormous step but we still have a long road to go. It s a bit like history changing, says Schindler. It may take a few years to be widely implemented, but it s a complete change of concept. How Does This Compare to the USA? Inside Yad Sarah Fall In contrast to Israeli law, the parameters of guardianships in the USA are state specific, said Sara E. Meyers, a White Plains, New York elderlaw attorney. In other states guardianships may be called limited conservatorships, or guardianships. Many of the states are moving away from the one size fits all to a situational determination of capacity. People under conservatorship are entitled to live in the least restrictive environment as a matter of law. In New York, Ms. Meyers explained, you can have a guardian of the person or of the property or both, assisting people in need with financial management and/or health care decision making. A guardian may be appointed for a specific limited purpose, for example, to transfer property or make a gift of assets. Ms. Meyers said that she thinks a limited, structured role for a guardian makes sense as guardianship can limit a person s autonomy while making sure his assets and his person is protected. Stuart D. Zimring, an Encino, California elderlaw attorney and a past-president of National Association of Elderlaw Attorneys, added that we start with the presumption that everyone has capacity. He said that California Probate Code states that a person who has a mental or physical disorder may still be capable of contracting, conveying, marrying, making medical decisions, executing wills or trusts and performing other actions. In California, Mr. Zimring has represented people who, because of dementia, a stroke or other illness, were no longer capable of understanding financial decisions. But, he added, they still knew that they owed their rent and needed to shop at the grocery store. In that case, a conservator was appointed by the court for financial management with instructions to pay the ward an allowance. That is the core philosophy, Mr. Zimring added, people under conservatorship are entitled to live in the least restrictive environment as a matter of law.
