4 From the Desk of the Past-President Elizabeth Fraser I woke up this morning to a loud ping! coming from my kitchen. Since my cooking skills are extremely minimal and seldom used, I felt pretty sure that it wasn t one of the cooking appliances. When I went to check it out I was excited to see that it was an invitation on my ipad to play the next Scrabble word with Neuroticknitter, aka my sister Kristin. I was introduced to Words with Friends, internet Scrabble, by my brother-in-law a few weeks ago. My sisters and I were outrageously fortunate and received ipads from our mother for Christmas. My brother-inlaw used my sister s to start up Scrabble games with each of us. I played with him for two weeks before I realized it wasn t my sister. I don t think I said anything too awkward. Currently I have games going with both of my sisters, my brotherin-law and my mother. It s a nice treat to be playing a game with each of my family members even though most of them live in Houston, Texas. I ve lived away from home since I was seventeen, when I travelled across the country for college. In the 30 years since then, times have changed greatly. I remember when a Sunday phone call with family was special. You set aside a specific time to call. You were very conscious of how much time your call lasted because it was so expensive. While it was nice to hear their voices on those phone calls, it was also sad, because it reminded you of how far away they were, that they were separate from your daily life. They were part of your life, but not necessarily part of your community. I ve been thinking a lot about community lately and how technology really can be an incredible tool for community building and maintenance. I am amazed when I look at the technology in my life: my computer, my smart phone, my ipad. I am very attached to all of them and enjoy the convenience, knowledge and entertainment they afford me. I enjoy watching a movie while looking up arcane facts about it. Wikipedia and the Internet Movie Database (IMDB) are favorites for this. I can do most of my banking and bill paying on-line now which saves a lot of time, mileage and stamps. Even shopping on-line has become normal. For me though, the very best part of all this technology is how it shrinks the miles between me and my loved ones. With s and even more so with texts, I can feel like my sister is in the next room (a real room, not just a virtual room). I can take a picture of the scarf I ve just knitted and send it to my mom to immediately hear her ooohs and aaaahs. I can play a board game with them even though thousands of miles separate us. We all know that technology is a doubleedged sword. It has as much potential to separate and isolate us and it does to draw us together. Sometimes it feels like the efficiency of the computer just creates the capacity to do more work, rather than to enjoy more leisure. Sometimes it gets so crazy that you feel you have to apologize for taking a break, because you aren t being productive. My New Year s wish for everyone is that you take a break. Reconnect. Remember you are an important part of our community. And if you have any ideas of what to do with the darn X tile, let me know. 5 The Lawyer s Road Review by Pete Patterson Out of Focus For Christmas 2010 my daughter was flying home from Syracuse where she is taking her masters in government. I thought it would be a nice gift to arrange for a rental car for her during the two weeks she was home. The trouble however is she is not yet 25, and the rental companies won t allow even the best and the brightest 23 year old to drive their cars. So, I surrendered the keys to my Subaru Outback to Rachel, and left the lot driving an ice blue Ford Focus. I suppose I could say I have known a father s sacrifice before. Whitman College is not cheap, and now I have agreed to help with Syracuse. No amount money, no sizable checks, no forgone pleasures on my end prepared me for the sacrifice of driving the Ford Focus for two weeks this winter. The car has good acceleration, and feels like a solid car on the freeway. I have had the experience of being in subcompact cars that did not feel as if there was a car around the people inside, rather more like we were in some kind of Zeppelin or airship, lighter than air. In the Focus one senses safety. Still it got about 30 mpg, except the Wednesday I encountered snow in south county. Just in case you wonder, the two wheel drive is a noticeable step down from the control of the vehicle I enjoy with an all wheel drive Subaru, a car my wife has nicknamed The Ruckus. She was not so charitable speaking about the Ford. Most notable for this couple was the ride. Taut is a generous term. Harsh is more accurate. By Christmas Eve we were referring to it as the Vile Ford Focus and trying not to think about the fact we live in a city that puts trendy streetcars and fancy tunnels ahead of ordinary street maintenance. The road feel has a bone grinding quality to it. Teeth chatter as one thumps from pothole to pothole in Seattle. The seat adjusts, but I really can t say the lever really does much in terms of placement of the driver. The seat goes back and forth of course, but as for the rest, the lever just sort of moves the seat vertically and closer to the dash, which is really too close already. I got into the back seat and by golly my legs fit, but much like the front seat, I rather felt like a match in a book of matches, just enough room there to be housed. In the Subaru I have the latitude to twist myself and place my hat in the back seat. Not in the Focus. Instead, we are packed in, perhaps like the first astronauts of the Mercury space program without the glamour. Instead, driving the Focus is much like driving a phone booth. Upon emerging we are stunned to see this is not a Smart Car. All of this scrimping on Ford s interior is done of course to provide the owner with a spacious trunk into which luggage easily is stowed. But then that would presume one would want to drive a long distance in this vile beast Ford apparently sells regularly to persons evidently younger than I, and more likely to not discriminate on the basis of the ride. I suspect were I twenty-two rather than fifty-two I would be delighted with the car. It does have a sporty appearance, and James Bond actually drove one in the film Casino Royale, but not very far. In the film he shortly wins the Aston Martin he drove in Goldfinger in a poker game, and we never see the Ford Focus again. I think that is for the best. 7 Collab Orate The Middleton Family Collaborative Divorce: A One Year Monthly Serial By Brad Lancaster, brad@lancasterlawoffice.com Twelfth Segment: Hither Reginald Coccyx, software magnate, rings up Hannibal Zazie s office. Hannibal s assistant, Mamie, interrupts to report Reginald s summons for an immediate face-to-face. Mamie grouses, I know Coccyx is stupendously rich, but his burps become your emergencies. Hannibal grunts and schedules Reginald for the next hour. Hannibal calls the hapless bumpee client to reschedule. Reginald parks his Jaguar across two spaces. Peons do not ding his doors. He breezes past Mamie into Hannibal s private office. Hannibal, my man, Reginald beams. Reg, Hannibal notes flatly, peering over his reading glasses, What god awful mess have you made now? Reginald says, Trading up, Hannibal. Moving on. Hannibal complains, Again? Reginald flickers an eyebrow, I surely hope that prenuptial you foisted on me stands up. Hannibal grunts dismissively. Reginald pours himself a glass of Hannibal s Highland Park, a pricey bottle reserved for Reginald. Whiskey waft penetrates the office. It is drinkin time in New Orleans, Reginald murmurs. Hannibal answers, We are not in New Orleans. Reginald waves as he sips. Hannibal squints, Your Lucy is the loveliest, most faithful creature on God s good earth, Reginald. Educated, cultivated, and plainly sweet. What seems to be the problem? Reginald drops his eyes in faux shame, Boredom, Hannibal. Cursed sameness. I need my variety, to which she objects. And her daddy. Reginald snorts, We must make a bit of an example of Miss Lucy, Hannibal. She fluffs about her rights and all. That sort of thing is bad precedent for my future Mrs. Coccyxes. Hannibal rolls his eyes. Reginald commands, Wave your baton, Hannibal-- hide and seek, floods of interrogatories, evasive depositions, hunting a friendly judge. Spend her prenup money in gobs, and rely on the pay-your-own-fees clause in the prenup. When she gets pallid from blood loss, she will cave. Miss Lucy needs to learn humility. Reginald objects, But if you tell Lucy what I have, she will want more. Then you could give her more, Hannibal grumbled, or you could stick with the prenup terms. Either is honorable. But screwing Lucy I won t help you do that. Reginald flusters, But screwing is exactly what we did to Mrs. Coccyxes one through four. Hannibal nods, Reginald, do you want to be loved for something more than your damnable assets? Reginald s eyebrows leap, You are disparaging my inestimable personality and cheery persona. Hannibal smiles, No, Reginald. We are both scoundrels, sometimes wicked, frequently besotted. Collaboration helps them make peace YMCA MOCK TRIAL ATTORNEY VOLUNTEERS NEEDED The 2011 Snohomish County Mock Trial Competition will be held on Saturday, February 26, 2010 at the Denney Juvenile Justice Center in Everett. Six teams from four local high schools will be competing. Attorneys are needed to help score the competition. A panel of three attorneys observes each trial, fills out score sheets, and provides helpful criticism at the conclusion of the trial. Volunteers are provided with information on how to score the trials. There will be three rounds of trials, beginning at 8:30 a.m., 11:30 a.m. and 2:30 p.m. Volunteers are asked to arrive about 30 minutes before the round. 11 ADR Bar Section on its way! There was excitement and good attendance at the first organizational meeting of the Alternative Dispute Resolution section. All attendees were very interested and supportive of formation of a new local bar section for ADR. In addition to those with a family law practice emphasis, many were interested in exploring a more active local presence of ADR in real property, commercial, PI, probate and guardianship, and other areas of civil practice. It will take several months to go through the process of formation of an official SCBA Section. In the meantime, the group wants to continue meeting to brainstorm ideas and solidify plans. Development of an online list of ADR section members with their experience and qualifications is likely to be a first priority. The section can serve as a communication conduit between the bar and public regarding ADR options. Liaison functions with Snohomish County Legal Services, Snohomish County Dispute Resolution Center, and other entities likely will be explored. The next meeting of those interested in the ADR section is February 16, 2011 in the Robert J. Drewel Building, 6th floor, meeting room #6A04. See you there! 17 Dear Snohomish County Attorneys, We are writing to tell you about an exciting new program being launched by the Washington State Bar Association the statewide Moderate Means Program (formerly known as GAAP). The Program is a partnership between WSBA and Washington s three law schools: Seattle University School of Law, the University of Washington, and Gonzaga University School of Law. The Program is a statewide reduced-fee lawyer referral service designed to help bring greater access to justice for people of moderate means those who are within percent of the federal poverty level. This Program involves private attorneys who agree to provide representation to individuals who do not qualify for pro bono services but who cannot afford to pay a private attorney. After clients are screened, they are referred to attorneys who have signed up to be a Moderate Means Program Attorney based on the attorney s geographic area and identified areas of practice. Attorneys agree to take direct representation cases in various areas of the law, including family law, at a reduced hourly rate. Other than the reduced rate, representation of these clients is the same as representation of any other non-moderate Means Program client. WSBA is recruiting attorneys to participate in the statewide Moderate Means Program. Participation is open to all active WSBA members, and offers the following benefits: It is a wonderful opportunity to provide public service and help close the access to justice gap in Washington State. You can obtain free referrals to help build your client base. Free or low-cost online training will be available, so you can learn new skills and expand your practice areas.
