4 From the Desk of the President William Steffener If you are given only one opportunity to speak, be certain your voice is heard. ~Elizabeth Gilbert, American Author Day in and day out, we counsel our clients and appear in court before elected officials who are sworn to uphold the law and pass judgment based upon the facts before them and the current state of the law. We advocate for our clients. We live, breathe, argue, and strive to make sure that certain concepts about our form of government and judiciary live up to these concepts on a daily basis; access to justice; due process and the opportunity to be heard; equality & fairness; checks and balances within government; and justice these are just a few of the goals of our society that are written into our statutes, constitutions and provide a foundation for our government and judicial system. This is why we have the check on the judiciary of requiring elections, so the voting public can have a fair opportunity to have their voice heard. In any job that one may have, there are almost always performance reviews. These reviews are done to allow the employer to make an informed decision regarding their employee s work and determine if they should retain their job, receive a promotion, etc. It also informs the employee what they are doing right and gives them direction on the things that they could improve on. The American 4 Snohomish County Bar News - SEPTEMBER 2013 Bar Association (ABA) has indicated that judicial evaluation programs improve the performance of individual judges and the judiciary as a whole and provide the public with a basis to make informed decisions, which ultimately improves the practice of law and the public s perception of our judicial system and the legal profession. (ABA - February 2005). Judicial evaluations tend to be anonymous in nature which gives those practicing before the Bench the opportunity to be completely candid and allows the judge to receive honest and constructive information to help them improve. In Snohomish County, we have not had a contested election for a judicial seat in some time and the last time a judicial evaluation was done was in With that in mind and with the goal to provide information to the Bench for self-improvement and inform the attorneys appearing before them as well as the public on how the Bench is doing, the Snohomish County Bar Association will be conducting a judicial performance evaluation for all Superior, District, and Municipal court judges this year. A Judicial Evaluation Committee was convened and reviewed the previous form used back in The committee made sure to review academic studies, evaluation forms utilized in other jurisdictions and approved by the ABA. The committee and the Board of Trustees also made it a point to communicate with, advise, and provide for an opportunity for feedback from the Bench through the Superior and District Court presiding judges in Snohomish County. One of the most important civic duties we have is the right to vote this represents our right to have an opportunity to be heard by our various branches of government. We fight for this right to be heard every day. We may grumble about decisions made by the judges we appear in front of or how they treat our clients and the attorneys, but how can we expect the Bench to know this or improve if we do not provide to them the constructive information necessary to bring about change. The Bench makes decisions on a regular basis by applying the law to the facts presented to them. If the facts are unknown though, their actions, decisions, and presentation will most certainly be stilted. The Snohomish County Bar Association will be circulating the judicial performance evaluation forms in the October edition of the newsletter. Please remember to complete it and make sure your voice is heard! You can only vote for a particular judge if you have actually appeared before them and we need at least 30 responses in order to publish the result for any particular judge. The last time evaluations were conducted, the Bar Association did not receive a healthy participation in it and a lack of participation this time will be taken into consideration when determining whether to continue in the practice. I am a firm believer in the people. If given the truth, they can be depended upon to meet any national crisis. The great point is to bring them the real facts. ~ Abraham Lincoln

5 The Lawyer s Road Review by Pete Patterson Bond, James Bond Summers in London seem to always feature that gritty diesel smell and taste in the mouth that is just more pronounced there than any other large European city. Forgetting the taste for a moment and checking my watch, I folded the copy of the Financial Times I had been reading, checked my watch again and dodged the black taxis as I crossed the street to the Oxford Club for lunch. My host, a graduate of the University, had learned I would be in town and graciously proposed we meet. My father had always maintained one must be prepared with coat and tie when travelling in Europe, lest one not be admitted to such a place as the Oxford Club. I am happy to report he was correct. There still are places other than a courtroom where attire counts. Unexpectedly, we were joined by several members of Her Majesty s Government, including the Head of MI-6, referred to as M, we were seated together. After a discussion concerning my professional background, (which felt more like I was on the stand and this was more of an examination) I was engaged to represent one of their agents, namely Bond, James Bond. My client has a License to Kill, which has its legal precedent in the Letter of Marque and Reprisal. This is more or less a grant of authority by a sovereign to a private person, usually the owner of an armed vessel to commit what would otherwise be piracy or murder. The concept dates back to 1205 and was first granted in England, but is also featured in the American Constitution at Article One, Section 8 clause 11 granting authority to Congress to issue the Letter. And so it is Mr. Bond travels the globe doing the work of Her Majesty that she would rather not know about. While the license allows for what would otherwise be homicide, what about assaults that are not with clear intent to kill? Wouldn t he have criminal and civil liability say for just a maiming or ordinary assault? What about trespass or burglary? The License says nothing about this. Then of course, there are all those dodgy paternity suits Mr. Bond seems to leave in his wake, all over the globe. I mean really, 007, how do you have time for all these relations? The primary defense is jurisdictional. Often the plaintiff has a hard time showing just where the acts that lead to the suit took place, and rarely is jurisdiction acquired by presence of the agent. And a good thing too, the support obligations alone presently take a full percent of Her Majesty s defense budget. This certainly is interesting work. I could make a regular practice of it.
