4 NO COFFEE NO COOKIES NO CANDY NO COPIES From the Desk of the President William Steffener Most human beings have an almost infinite capacity for taking things for granted. - Aldou.s Huxley So many things in life we take for granted without a second thought until it s no longer there and then we feel its loss. It s at that moment that we start to appreciate what we once had at our fingertips. Sometimes, with a great deal of effort or an expression of gratitude, we have the ability to regain that which was lost. But more often than not, it is simply gone. Just think of the family, friends, colleagues, material things and life s necessities that we each take for granted every day. For instance, I spent most of my youth taking my parents for granted like most kids and never realized how much they did for me. It was not until I went off to college that I began to notice how much my parents provided for me, from emotional support, financial support, advice giving and just simply being there. For years, decades, I would leave our family home and never think twice about it not being there to come home to. This is a place I grew up in, did countless chores around, laughed in, and survived countless adolescent turmoils in. This was my home, until the homestead had to be sold. It is now a home to a new family. The home I once knew is nothing more than a collection of memories to reminisce over. In this day and age, the thing taken for granted could also be your phone. I never used to think this 4 Snohomish County Bar News - JUNE 2013 until some smart person thought it would be a good idea to invent a smart phone. Now, I store my appointments, contacts, GPS system, , and even apps to occupy my mind with silly games I used to play with real playing cards or board games. Think about it for a moment what do you take for granted everyday? In your personal life? In your daily practice? Sometimes, it s been there for so long that you may not even know you might be in jeopardy of losing it! The Bar Association is at the heart of our legal community and provides countless benefits that we take for granted in the day to day operations of each of our practices. For some, it is the on-the-go office that makes our lives and our practice of law run more smoothly. It also ensures that the business of law for the judges, commissioners, lawyers and general public runs with efficiency. The copy machine alone saves time and money for all by providing a place to make the countless number of copies of orders in between hearings and not clog up the already busy calendars with continuances to provide opposing counsel with copies of pleadings and discovery. Not to mention our copier saving the Clerk s office and Law Library s copy machines from unbelievable wear and tear maintenance. Pro Se litigants and the general public can receive directions, referrals to lawyers, and advice which saves the Courts and Judges from wasting time on unnecessary pleadings and litigation. Let s not forget about those last minute faxes and frantic telephone calls to clients and office staff that save the day or case. A simple conversation over a cup of coffee and a sugar cookie can sometimes mean the difference between a long drawn out battle in the courtroom and a mutually satisfying settlement or plea bargain. Unfortunately, the Bar Association s place in the center of the courthouse is not a guarantee. Our Bar office and our Association s tenancy, though it may seem like we have simply always been and always will be present there, is not considered to be ESSENTIAL to the efficient running of the courthouse. The planning has begun with the architects to secure placement for those essential tenants. The displacement of the Bar office is a very real possibility at this point. Take a moment or two to reflect. How often do you utilize the simple services of the Bar Association s office? How often have you worked out the details of litigation with opposing counsel in the office or in the hallway just outside? How often have you been ordered to make a copy of an order by a judge or commissioner for a client or pro se litigant in a case and stepped through the threshold of the office? How ESSENTIAL do you view the Bar office to the running of your business and practice of law in Snohomish County? I encourage you to take the time to reflect and put your reflections into words. Please take the time to write a letter to Presiding Judge Downes and stop taking the Bar office for granted. You can provide your letters and s to Joyce Wood at joycew@snobar.org or drop them off at the Bar office while you are in the courthouse! We will be collecting your correspondence. Remember, we are lawyers and we advocate for others on a daily basis, so let s advocate for our Association when we most need it! J
5 Major Overhaul The Lawyer s Road Review by Pete Patterson Here is a logic question you may have encountered on the LSAT: All machines wear out, even when properly cared for. The Subaru is a machine. Its owner follows the maintenance scheduled but drives the living hell out of it. Therefore, the Subaru wears out. True or False? I was on the side of False until I saw the temperature gauge creeping up a few weekends ago. I got home, looked at the coolant reservoir and saw she was dry. I crept to the auto parts store, bought some coolant, waited for the next morning and added a gallon or two and headed for Good Old Boy Mechanics in Everett. The report late that day: The head gasket had failed and she was bleeding coolant. Subaru has a horizontal H-4 configuration of its engines which means to do the job they have to take out the engine. Kind of like a heart transplant. Here are some other logic questions: Mechanics have specialized knowledge. Lawyers have specialized knowledge. Specialized knowledge is expensive. Therefore, both lawyers and mechanics are expensive to hire. Oh, how True. Specialized knowledge leads to assumptions about how things will turn out in any transaction or conflict. Things never turn out exactly as one would expect even with specialized knowledge. Therefore, those with specialized knowledge cannot tell the future. True. I get the car back as Good Old Boys tell me the noise I hear in the power steering unit will abate in approximately a week. Upon entering the car, the smell of Kingsford Charcoal Briquette lighter fluid one associates with Memorial Day overwhelms the driver and he rolls down the windows. The key is turned and a whirring sound one associates with a rehabbed engine greets the ears, but this is quickly overwhelmed with the sound of the power steering unit as I leave the parking space. The moan in the unit, which still persists at this late date, might remind the Brethren of the criminal defense bar of the sound his client makes when the jury returns with a conviction on the third strike. Occasionally, the steering wheel jitters and grabs like a suspect just apprehended. This is all at 114,000 miles. I would trade it in but there are other major overhauls underway and time is at a premium. Both my uncle David Patterson and my Dad, Mark T. Patterson Sr., have undergone knee surgery this spring and each have varying degrees of issues at this point. Then, I am overhauling my practice. I leave the building I have been working in for the past 29 years June 1st. I have accepted an offer to join the partnership at the 100 year old firm of Newton Kight as of that date. The irony is the building Dad practiced in since 1980 and I practiced in since 1984 was originally built as a private residence of the founder of Newton Kight, Henry Newton s uncle, Clifford Newton in I am happy to report Newton Kight operates much better and with greater longevity than my Subaru, and I pray for the same staying power for my father and uncle. Spearheaded by Judge George Bowden, this was the first time in the entire state history that a Bench achieved 100% participation in LAW Fund s Campaign. On behalf of LAW Fund, I again want to take this opportunity to thank the Bench and Judge Bowden and say how much we appreciate the Bench s support and commitment to the Campaign for Equal Justice, both past and present. I also want to take this opportunity to say THANK YOU to all the lawyers and judges in Snohomish County who participated in last year s Campaign. The final tally for the 2012 Campaign for Equal Justice from Snohomish County was 439 individuals contributing, with a total of $46,207 raised. Our total percentage of the legal community that participated in the 2012 Campaign was 31%. Snohomish County had the 4 th highest rate of participation in the state. Statewide, the Campaign raised $1.4 million in This was almost an increase of $100,000 from And, most recently, the Campaign raised over $40,000 in the May 15 th Seattle Foundation s GiveBIG day of fundraising. All donations made on May 15 th will receive a pro-rated portion of matching funds pooled from the Seattle Foundation and other community partners. So, we are well on our way for the 2013 Campaign for Equal Justice. At the Bar Dinner, we heard how your funds helped Snohomish County Legal Services (SCLS) this past year, provide legal assistance to a nonprofit agency fight an unlawful eviction process. This agency, Millennium Ministries, helps homeless women and their children by providing housing and case management services. Your contributions helped the Housing Justice Project (run by SCLS) and its volunteer attorney negotiate with the landlord to allow a smooth and seamless transition of the shelter and these families to another location. Because the legal assistance was provided pro bono, Millennium Ministries did not have to spend precious resources on legal fees, but was able to use its money to continue to provide shelter, food and assistance to its clients.
