3 Background Historic practice of erecting public lighting on low voltage public electricity distribution network. ESB provides installation and maintenance/repair service for local authorities for these and other types of PL installations via a separate company within the ESB Group know as ESB Contracts. ESBC is a commercial company operating in the electrical contracting industry in competition with other companies The LV public distribution network is managed and operated by a different and separate company within ESB know as ESB Networks. ESBN s activities and revenues are dictated by CER based on legislation passed by the DAIL to implement Competition in Electricity Supply. ESBN has no statutory requirement to make the public electricity distribution network available to physically support public lighting equipment. 3

5 Background No existing agreement on ownership of assets No existing agreement covering the sharing of network ESBN responsible for provision of electricity connection L.A.s responsible for provision of lighting L.A.s wish to increase access for contractors on PL work Much of the LV network is over 50 years old and is at the end of its useful/economic life. Accordingly ESBN has no choice but to undertake refurbishment of LV networks for public safety and economic reasons. This will require replacement of poles on which PL equipment including control gear is currently mounted, retirement of switchwires, regularise interface arrangements and decisions on networks that are only for PL and therefore should not be refurbished by ESBN 5
6 Background Issue first raised at LA conference on UMS in Feb 2005 ESBN wrote to CCMA Transport Sub committee in May 2005 and LGMSB in September 2005 requesting the formation of a joint working group to address emerging issues. CER UMS Workshop in June 2005 set up industry group to look at all UMS issues. Following second meeting of this group in February 2006, LAs were requested to send reps to a Technical Workshop for discussion of safety and asset ownership & unbundling issues. This workshop took place in March 2006 and the agreed actions included the following Briefing on ESBN Safety Rules requirements for LA contractors/staff working in proximity of LV networks ESBN to draft Asset Ownership to Unbundling proposals LA reps to obtain agreement from CCMA to participate in joint investigations of work and cost involved in unbundling in two pilot locations 6
7 Background Unbundling proposals were presented formally to the Group in October. In order to obtain wider consultation. No mandated LA group has yet come forward to engage with ESBN on the issues. Current Ad Hoc arrangements need to be regularised in order for ESBN to ramp up LVR work from the second quarter of
8 No difficulty in principle! Access for PL Contractors? Requires agreement and implementation of asset unbundling proposals L.A. responsibility to develop safety management and training requirements etc for their contractors/staff. ESBN will provide input in relation to procedures and training required where L.A. s want contractor/staff to work on PL or other LA assets located in the vicinity of or on ESBN networks. 8

29 Public Lighting & ESBN LV Network(1) Key Points Transfer of ownership of PL (only) networks to LAs (approx. 9,000 poles) Continue to allow LAs to erect new or retain PL on existing OH networks subject to unbundling No extension of ESBN OH LV network purely to cater for PL No objection to LAs erecting wood poles and overhead conductors for their own OH PL installations which can be connected via aerials and interface Costs associated with retaining PL assets on ESBN networks, removal of switchwire, transfer of PL equipment and provision of interfaces (OH & UG), during refurbishment or other work carried out by either LA or ESBN, to be fully attributable to LAs. Installation of interface requirements at boundary points for all new or refurbished installations L.A. cost Cost recovery mechanism for ESBN unbundling work Interim control of system (incl. sw./w.) ESBN Access for PL Contr. Competency, training, approval & unbundling 29
30 Public Lighting & ESBN LV Network(3) Actions Brief LAs on safety, operational and ownership issues Formation of mandated LA group to engage with ESBN during March with a view to reaching agreement in April. In absence of agreement, ESBN will seek agreement with CER on basis for proceeding with LVR and future position on sharing of network. All future PL work to be consistent with safety and unbundling requirements. 30
