AGREEING TO THE TERMS AND CONDITIONS 1.1 By registering on or ("Website") and confirming that you agree to be bound by the terms and conditions, you will have entered into a legally binding agreement, which incorporates these general terms and conditions ("General Terms and Conditions") and the following specific terms and conditions ("Specific Terms and Conditions"): the Privacy Policy, the Specific Terms and Conditions of netx Betting Limited, Malta, (the General Terms and Conditions and the Specific Terms and Conditions are together referred to as the "Terms and Conditions"). 1.2 Please note that the General Terms and Conditions shall prevail in the event of any conflict between these General Terms and Conditions and any of the Specific Terms and Conditions These Terms and Conditions have been prepared in various languages other than English. PARTIES 2.1 The Terms and Conditions between you and the following parties govern your use of the services on the following sections of the Website ("Services"): netx Betting Ltd (netx), a company registered in Malta on 30/06/2005 under the laws of Malta; registration number: C 36534; registered address: The Marine Business Centre, Level 2, Abate Rigord Street, Ta Xbiex XBX 1127, Malta. netx is connected with the offers on and netx is operating under a Class 2 license issued and regulated by the Lotteries & Gaming Authority of Malta ( The license was issued on 30/03/2006, with a license number MGA/CL2/222/2005. The license was extended for another 5 (five) years on the by the Lottery and Gaming Authority Malta in respect of services on all parts of the website that are not mentioned at any point in the following paragraphs, among others your use of the website account, the payment methods, and the user management and user support. 2.2 The Services relate to netx Betting companies. 2.3 The contractual relationship between the registered player and netx is governed by these Terms and Conditions and by the Laws of Malta. 3. CHANGES TO THE AGREEMENT 3.1 These Terms and Conditions govern your use of the Services and the Website and supersede any and all prior agreements between you and us in respect of the same. 3.2 NetX reserves the right to modify these terms of use and publish the new version on the web portal. When a major change is carried out on the terms and conditions the player will be requested to accept the new terms and conditions before proceeding. Should the player, due to any possible changes, not wish to continue using the services of NetX anymore, he can withdraw all available funds and close his account. Once accepted, the new terms and conditions will come into effect from thereon. 4. REGISTERING WITH AND OPENING YOUR BETTING ACCOUNT 4.1 To use our range of Services you need to personally open an account with us ("Betting Account"). You can open your Betting Account by going to "Registration on the Website and following the instructions. You may only have one account per household with netx and shall only use the Services using such single account.

3 4.2 When you open your Betting Account you will be asked to provide personal information, including but not limited to your first and last name, address, , gender and birth date. You shall ensure that the details provided at registration are accurate and kept up to date. You can change the details you provide at registration at any time by editing your Betting Account preferences. For further information about the collection and use of your personal information, please refer to our Privacy Policy. 4.3 You should prevent selling or transferring accounts from other players. In addition to this, you should prevent transferring funds among other players. 5. USERNAME AND PASSWORD 5.1 When you open your Betting Account you will be able to choose a unique username and password. After opening your Betting Account, you must keep the username and password secret. We recommend you to use a password of a minimum length of six characters, which is made up of upper and lower case alphabetical characters and numbers or other special characters (e.g. Azbp1-22). We also recommend that you regularly change the password (at least every four weeks). 5.2 All transactions where your username and password have been entered correctly will be regarded as valid, whether or not authorised by you, and we shall not be liable for any claims in the event that you disclose them to anyone intentionally or unintentionally or have done so in the past. It is your sole responsibility to maintain the confidentiality of your username and password and that you are responsible for all activity that occurs under your username and password. You should notify us immediately of any unauthorised use of your password and any breach of security as soon as you become aware of it. The same obligation applies if there is a risk of unauthorised use. 5.3 If you lose or forget your username or password please follow the password recovery instructions on the Website or contact our Customer Services using the details on the Website. 6. ELIGIBILITY, VERIFICATION AND MONEY LAUNDERING REQUIREMENTS 6.1 You must be at least 18 years old to be eligible to use the Website and/or the Services and by registering your Betting Account you confirm you are aged 18 or older. Underage gambling is against the law; minors are thus excluded from participating in our offers. 6.2 Access to certain Services on the Website may not be legal for some or all residents of or persons present in certain countries. We do not intend that the Website and Services be used by persons in countries in which such activities are illegal. The Website does not constitute an offer, solicitation or invitation by us for the use of or subscription to betting or other services in any jurisdiction in which such activities are prohibited by law. Players from USA are not accepted. 6.3 It is your responsibility to determine the law that applies in the location in which you are present. You should ensure that you are acting legally in that jurisdiction when subscribing as

4 our customer and/or betting on or through the Website. 6.4 We accept no liability if use of the Website or participation in the Services is in contravention of the law of your home country. However, if at any time we believe your use/participation is in contravention of such law, we shall be entitled to exclude you from participating and suspend your Betting Account at any time as we see fit. 6.5 By agreeing to these Terms and Conditions you authorise us to check the details you provide when registering your Betting Account or changing your Betting Account details. In particular we may verify that you are over 18 years old, that you are resident in the country you say you are a resident in and/or that you are the owner of the sums that you deposit in your Betting Account. Whilst we are verifying your details you will not be permitted to deposit any money or participate in our fee-based Services until the verification has been satisfactorily completed. If we are unable to confirm that you are aged 18 or over within 72 (seventy-two) hours of your Betting Account being opened and money deposited, the Betting Account will be suspended temporarily. No further gambling will be permitted until age verification has been successfully completed. We have the right to ask you for suitable proof for the verification of the submitted customer details, e.g. a copy of a valid photo ID card. 6.6 A record of this search may be retained and this information may be used in the future by other companies within our group of companies who provide the Services. Any such company shall be fully aware of its obligations to keep your details confidential as required by data protection regulations and will always act in accordance with these provisions. For further information about the collection and use of your personal information, please refer to our Privacy Policy. 6.7 We retain the right to void any transactions or suspend your Betting Account temporarily where you have provided incorrect details. All stakes or bets made will be returned to you and any winnings accrued at such time shall be forfeited by you. When your account is temporarily suspended, you can no longer log in and are thus not able to deposit or withdraw money, nor can you place bets. The account remains in existence and can be freed up by our customer support team. Kindly contact customer support in order to do so. 6.8 We reserve the right to refuse/close a player account. Contractual obligations already made with the player will be honoured except for instances where NetX is required by law to suspend/cancel all gaming activity of a specific player. 6.9 In case of blocked/closed/excluded accounts the player can recover his funds by ing customer support. 7. PAYMENT, WITHDRAWALS AND DEPOSITS 7.1 You may make deposits into your betting account via credit card, via our appointed external electronic payment service, C4U. 7.2 We will credit your betting account with your winnings and deposits. We are not a bank, and monies deposited with us are kept in a normal bank account in the name of netx Betting Limited. We offer no special protection for the monies paid into your betting account in the event of our insolvency, and these funds are not subject to special trust arrangements. Credit on your account will not accrue interest.

5 7.3 You must ensure that all deposits to your betting account come from an account for which you are a named account holder. Deposits are made for a particular purpose, represent discount payments for future stakes and can therefore not be transferred to another bank account. 7.4 If you deposit an amount via credit card or other electronic payment processes, your betting account is first credited with the amount. Placed bets are then charged to the betting account. With regards to credit card transactions, the services offered by netx Betting are carried out by the payment service provider C4U Malta Limited, Block B Suite 2, 178 Skyway Offices, Marina Street, Pieta PTA9042, Malta. We reserve the right to carry out transactions, if necessary, through other payment service providers. Online deposits are made using a credit card by entering your credit card details and your 3DSecure security code if available (verified by Visa, MastercardSecure). We reserve the right to limit the maximum amount that can be deposited each week. 7.5 Whenever possible withdrawals are always transferred to the same account used to deposit. Where this is not possible, funds will be transferred to an account in the name of the player and evidence may be requested to prove ownership of the account. We will process your withdrawal request on normal working days within 24 hours of receiving it and will credit to you the money as soon as all the verifications have taken place. 7.6 If you transfer your balance to a bank account outside the EU or want to make a transfer from such a bank account, we reserve the right to charge you the transaction costs incurred. We also reserve the right to charge you the bank and collection fees if direct debits are not paid or payments are returned. We also reserve the right to pass on third party fees and other costs for incorrect postings caused by you. 7.7 You hereby acknowledge that it is a legal requirement for netx Betting to verify your identity when requesting withdrawals amounting over 2, Notwithstanding other rights and legal means we can at any time offset a credit balance on your gaming account with a sum that you owe us. 7.9 You are responsible for the notification of your gains and losses if such notification is required in the legislation or by the financial authorities of your country. 8. USE OF THE SERVICES 8.1 We reserve the right to suspend, modify, remove and/or add to any Service or to the Website in our sole discretion with immediate effect and without notice. 8.2 We will not tolerate fraudulent or other criminal activities. If, in our reasonable determination, you are found to have attempted to defraud us, any other user of any of the Services or any person in any way, including but not limited to payment fraud, or if we suspect you of fraudulent payment, including use of stolen credit cards, or any other fraudulent activity or prohibited transaction (including but not limited to money laundering), we reserve the right to suspend temporarily and/or close completely your Betting Account, withhold any or all winnings and share information (together with your identity) with the police and other such appropriate authorities. 6 8.3 All transactions are checked for possible money laundering activity. Any suspicious activity on an account could lead to the player being reported to the relevant authorities and freezing of the funds and could also lead to the closure of the account and confiscation of the funds. 8.4 You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material, which is malicious or technologically harmful. You must not attempt to gain unauthorised access to: the Website; the servers on which the Website are stored; or any server, computer or database connected to the Website or used to provide the Services We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, we may terminate your use of the Services. 8.5 netx Betting prohibits player collusion and use of devices or programs which distort normal game play (such as Robots). 8.6 If an account remains inactive for a period of 30 months or more, netx Betting is obliged to report such accounts to the Lotteries and Gaming Authority, in accordance with the Remote Gaming Regulations. We reserve the right to charge an admin fee, if your account remains inactive for more than 18 months. You will be informed by electronic mail before any admin fee will be charged. If netx Betting is unable to refund the funds to the player, we will transfer any outstanding balances to the care of the Lotteries and Gaming Authority. 9. INTELLECTUAL PROPERTY 9.1 All intellectual property rights in the Website and all material and/or content made available by us via the Services shall remain at all times our property or the property of our licensors. 9.2 The names, images and logos identifying us, companies in the group, our partners or third parties and our/their products and services contained on the Website or in the Services are proprietary marks and may not be reproduced or otherwise used without express permission. 9.3 Nothing contained in these Terms and Conditions shall be construed as conferring by implication any licence or right to use any trade mark, patent, design right or copyright that belongs to us or any third party. 10. CONTACTING 10.1 If you have a complaint or any enquiries or otherwise need to contact us in any way, you can do so by or post using the contact details found on our Website. Your complaint will be escalated to management and we endeavour to handle it within 48 hours of receipt. CANCELLATION AND TERMINATION 11.1 Once you submit a transaction using the Services, you will not be able to cancel or reverse the transaction We reserve the right, in our absolute discretion and in relation to your Betting Account to terminate these Terms and Conditions, withhold your Betting Account balance, suspend your Betting Account temporarily, close your Betting Account and/or recover from such Betting Account the amount of any affected pay-outs, bonuses and winnings if: you are in breach of an important provision of these Terms and Conditions; we become aware that you have used or attempted to use the Services for the purposes of fraud, collusion or unlawful or improper activity; we become aware through an official source that you have played at any other online gambling site or services and, in connection with the same, are suspected of fraud, collusion (including in relation to charge-backs) or unlawful or improper activity; you become bankrupt, if you do not make payment of a court judgment on time, if you make an arrangement with your creditors, or if any of your assets are the subject of any form of seizure or if analogous proceedings are brought in relation to you anywhere in the world Subject to paragraph 11.5, you are entitled to close your Betting Account and terminate these Terms and Conditions on notice to us by or post using the details on the Website. We will respond within a reasonable time. You remain responsible for activities using your Betting Account until it is closed Subject to paragraph 11.5, we are entitled to close your Betting Account and terminate these Terms and Conditions on notice by us to the address provided by you in relation to your Betting Account With the exception of termination in accordance with paragraph 11.2 (which shall be immediate), termination shall be effective from the date on which all outstanding bets made by you via your Betting Account are settled. 12. LIMITATIONS AND EXCLUSIONS 12.1 Nothing in these Terms and Conditions is intended to exclude or limit our liability for fraud or for death or personal injury resulting from our negligence. Nothing in these Terms and Conditions affects your statutory rights (statutory rights include, for example, that we will provide the Website and the Services to a reasonable standard and within a reasonable time) Except under paragraph 12.1 above and save in respect of any winnings lawfully due to

8 you in accordance with these Terms and Conditions, our maximum liability to you under these Terms and Conditions in relation any one incident or series of related incidents is limited to the greater of: (a) stakes paid by you during the six month period prior to any claim; or (b) two thousand Euros ( 2,000), whereby the higher amount is decisive Subject always to paragraphs 12.1 and 12.3 above, we will not be liable under these Terms and Conditions for any loss that could not have been reasonably expected by you and us at the time of you register or at the time you enter into a transaction for Services, such as any loss of income, business or profits or any information which is lost or corrupted. EVENTS OUTSIDE OUR CONTROL 13.1 We are not responsible for any events beyond our reasonable control. Such events might include network failures, war, terrorist activity, riots, malicious damage, fire, flood, storm, nuclear accident, inflation, depreciation of money or compliance with any new law or governmental order, rule, regulation or direction We may also suspend or cancel the Services and the Website or any part of the Services or Website if, despite making reasonable efforts to do so, we are not able to provide that part of the Services or Website to you as a result of events beyond our reasonable control.

9 However, if we cancel all or any part of the Services or Website because of one of these events, we may refund any charges, which you paid in advance for any part of the Services, which you could not receive. 14. GOVERNING LAW AND JURISDICTION 14.1 These terms and conditions are governed by the laws of Malta. 18. Special Terms and Conditions of Business of netx Betting Version Last Updated 15/09/2011 (all prior versions are invalid) The business relationship between the client and the betting company is a relationship of mutual trust. The variety of the options available makes rules necessary in the interests of the legal security of both parties. I. General 1. Once you have finished betting, your choices are forwarded to us, the betting operator netx Betting Limited, The Marine Business Centre, Level 2, Abate Rigord Street, Ta Xbiex XBX1127, Malta and are retained by us as bookmaker. The bet is exclusive between us (netx Betting Limited, Malta) and yourself. 2. Every bet placed is based on the General Terms and Conditions and also on the Special Terms and Conditions. By placing the bet, you as the bettor declare that you are aware of these betting conditions and acknowledge their application to the bet. 3. We are entitled to pass on the bet at any time. This does not affect our relationship with you. For bets which are placed to be passed on, the "General Terms and Conditions of Business" of the corresponding racing clubs and betting companies apply in their respective current version. The bookmaker or the betting company is only the authorised representative of the Totalisator organisation. He acts in his own name. The bet is passed on to the Totalisator. The liability of the bookmaker or betting company who passes on a bet and of their appointees is excluded insofar as there is no charge of malicious intent or gross negligence. 4. We are entitled to decline to accept individual bets, to limit the amount of the stakes for bets, and to raise or lower the maximum payout. 5. By placing the bet, the bettor declares that he has no knowledge of the outcome of the race. 6. Odds can be changed retrospectively in the event of obvious errors, such as having a horse quoted to win at 13.0 instead of NetX endeavours to make no mistakes during the odds publication; if any mistake is inadvertently done, NetX reserves the right to modify the odds even once the event has finished (when applicable). II. Types of bet The following types of bets can be placed. In addition to that, other bets can also be placed by special agreement. The conditions and quotation calculation for these will be announced in the additional regulations to these betting

11 regulations. For all types of bets, it is a prerequisite for an entitlement to winnings that the horse or horses tipped do not run "without bets". In the case of a "dead heat", the quotations in the types of bet affected are divided. a) Individual bets 1. Win bets are won when the tipped horse is listed as first by the Totalisator. 2. Place bets are won when the tipped horse is listed by the Totalisator as first or second, or as first, second or third. Beyond third place, all place bets are lost even if the Totalisator lists a fourth place quotation. For place bets, there are no stable bets. 3. Ita bets are won when the tipped horse is listed by the Totalisator as second and the number of starters was at least four. The calculation of Ita bets is made on the basis of the second place odds. For two place quotations: second place quotation x 2, for three place quotations: second place quotation x 2.5. For a race where the quotation of the straight dual forecast is lower than the Ita bet quotation, the straight dual forecast quotation is used as the Ita quotation. In races where less than two horses finish, all Ita bets are lost. For Ita bets, there are no stable bets. For repayment of the place bets on the Totalisator, Ita bets made with the bookmaker are calculated on the basis of the place quotation 10 for Trita bets are won when the tipped horse is listed by the totalisator as third and in Germany the number of starters was at least seven, or at other racecourses when the number of starters was at least eight. The calculation of the Trita quotation is based on the third place quotation. The Trita quotation is 2.5 times the third place quotation. For a race where the quotation of the treble bet is lower than the Trita quotation, the treble bet quotation is used as the Ita quotation. In races where less than three horses finish, all Trita bets are lost. For Trita bets, there are no stable bets. For repayment of the place bets on the totalisator, Trita bets made with the bookmaker are calculated on the basis of the place quotation 10 for Stable bets are bets where two or more horses of a particular stable (e.g. same owner) are running in a race. The totalisator only gives one quotation for all horses of this stable ( stable quotation ). Stable bets can only be placed on French and Italian racecourses as win bets. On American racecourses, the stable quotation is also applied for other types of bets. In a stable bet, where one horse of a stable does not run, the stake on that horse is repaid. 6. Straight dual forecasts are won when the two horses tipped are listed by the totalisator as first and second. The exact order of finishing the race applies. Where one of the horses tipped does not run, the bet is open and the stake is repaid. For a race where less than two horses finish, all straight dual forecasts are lost, unless there is a quotation for straight dual forecasts on the totalisator. For dual forecasts, there are no stable bets.

12 7. Dual forecasts are won when the two horses tipped are listed by the totalisator as first and second, irrespective of the order. Where one of the horses tipped does not run, the bet is open and the stake is repaid. For a race where less than two horses finish, all dual forecasts are lost, unless there is a quotation for dual forecasts on the totalisator. For dual forecasts bets, there are no stable bets. 8. Placed dual forecasts are won when the two horses tipped are listed by the totalisator as first and second, first and third, or second and third, irrespective of the order. Where one of the horses tipped does not run, the bet is open and the stake is repaid. For a race where less than three horses finish, all placed dual forecasts are lost, unless there is a quotation for placed dual forecasts on the totalisator. Where there are less than eight starters in a race, placed dual forecast bets are repaid, unless there is a quotation for placed dual forecasts on the totalisator. For placed dual forecasts, there are no stable bets. Placed dual forecast bets can only be placed on French racecourses. 9. Tricast bets are won when the three horses tipped are listed by the totalisator as first, second and third. The exact order of finishing the race applies. Where one of the horses tipped does not run, the bet is open and the stake is repaid. Where there are no tricast bets on the totalisator in a race, the stake is to be repaid. In races where less than three horses finish, the bookmaker follows the ruling of the totalisator. 10. Trio Ordre bets are won when the three horses tipped are listed by the totalisator as first, second and third. The exact order of finishing the race applies. Where one of the horses tipped does not run, the bet is open and the stake is to be repaid. Calculation of Trio Ordre quotations are calculated on the basis of win and place quotations, as follows. Trio Ordre quotation = win quotation x second place quotation x third place quotation, divided by 15. If a stable horse has won and the win quotation is less than the first place quotation, 2.5 times the first place quotation will be applied as the win quotation. Is the Trio Ordre quotation lower than the trio quotation, the following applies: Trio quotation x 1,1 = Trio Ordre quotation. Positions after the comma will be rounded. Is the Trio quotation 150:10 or lower, the calculated Trio Ordre quotation will be limited to the 7 fold of the Trio quotation payable at the totalisator. Example: Trio Quotation = 85 for 10, bookmaker pays 85 times 7= 595 for 10 as a maximum Trio Ordre quotation. Is the calculated Trio Ordre quotation higher, there will be a reduction accordingly. If the totalisator refunds the win bets, the bookmaker will subsequently calculate the Trio Ordre tips on the basis tote win quotation 11 for 10, if the place bets will be refunded too, otherwise 10 for 10. If the French totalisator refunds the place bets, the bookmaker calculates the Trio Ordre bets on the basis tote place quotation, i.e quotation 10 for 10. In races where less than three horses finish, all trio ordrebets are lost. For trio ordre bets, there are no stable bets. 11. Trio bets are won when the three horses tipped are listed by the totalisator as first, second and third, irrespective of the order. Where one of the horses tipped does not run, the bet is open and the stake is to be repaid. Where the trio quotation is calculated on the French totalisator, the payout of the trio bet follows the trio quotation. Where the trio bet on the totalisator is not won, the bookmaker pays the calculated trio quotation for the

13 correctly forecast bet up to a maximum of : 10. Irrespective of any special regulations at the totalisator (e.g. payment on the first two horses) all other bets with the bookmaker are lost. For a race where less than three horses finish, all trio forecasts are lost, unless there is a quotation for trio forecasts on the French totalisator. For trio bets, there are no stable bets. 12. Treble bets In treble bets, the bet is on which horses win in the three races on one racing day specially identified for this purpose in the racing programme. The bet is won when the winners of the three races are correctly forecast. The payout is the totalisator quotation. If one of the horses tipped does not run, the treble bet is treated as a win accumulator bet. 13. Combination bets are individual bets described in abbreviated form. 14. Special bets For special bets the listed conditions apply. The conditions for these will be announced in due course. Trainer Champion Evaluated are the number of wins for a trainer at a selected meeting. In the event of points being equal, the number of second places is taken into account. If the points are still equal, the number of third places is taken into account. If points are still equal when the third places are taken into account, the assessment is treated as a "dead heat". The fixed quotations are divided correspondingly. The official totalisator quotation is determinative. The rates are without obligation. If a trainer who is not listed under trainer champions is to be tipped, the stable quotation "All Others" always applies, which is then paid out. All horses of the respective trainer within the specified period that are entitled to start are assessed. If a trainer stable completely drops out for any reason, the bets placed on this trainer count as lost and are not repaid. The payout limit is 5,000. Jockey champion Evaluated are the number of wins for a jockey at a selected meeting. In the event of points being equal, the number of second places is taken into account. If the points are still equal, the number of third places is taken into account. If points are still equal when the third places are taken into account, the assessment is treated as a "dead heat". The fixed quotations are divided correspondingly. The official totalisator quotation is determinative. The rates are without obligation. If a jockey who is not listed under jockey champions is to be tipped, the stable quotation "All Others" always applies, which is then paid out. All rides of the respective jockey within the specified period are assessed. If a jockey drops out of this assessment due to illness or to not making his rides, the bets placed on this jockey count as lost and are not repaid. The payout limit is 5,000. b) Accumulator bets These are bets, which include the agreement that the available money is used wholly or in part - including remaining or partial amounts - on subsequent races. Even in the case of rescheduling or splitting of races, and if the bets were erroneously recorded in the wrong temporal sequence, the accumulator

14 bets are calculated in the order in which they are written. In the case of different types of bet, type of bet is calculated on type of bet, i.e., win on win, place on place etc. For accumulator bets, amounts below 1.00 are also allocated up to the amount of the accumulator. If two or more horses run in a race as a result of double nomination, the horse that was registered first counts for the calculation of the win bet. Place bets are allocated as written. For bets, which cover wholly or partly differing bet types, races or locations with different maximum payouts, the lowest maximum payout is deemed to be agreed. c) "Fixed bets" A bet for which the payout rate is set by the bookmaker or the betting company when the bet is placed and is recorded on the bet is considered to be a "fixed bet". It is established in advance what the better receives in the event that he wins. A "fixed bet" can also be placed for races in different locations and on different days. The "fixed bet" follows the totalisator: that is, the entitlement to winnings is determined by the race results according to which the totalisator calculates quotations and pays out. Where the bets are paid back on the totalisator for technical reasons, or no totalisator bets are taken, fixed rates retain their validity as long as an official race result is determined. This is then determinative for paying out. Horses which go to the start "without bets" according to the race order are not taken into account in placing, and the stakes are forfeited. The "fixed bet" includes the risk that it is lost if the horse concerned does not run, starts "without bets" or was not entitled to start. For cancelled races, the bet is still valid if the race is held later. Otherwise stakes are paid back. "Fixed place bets" are lost beyond second place if the totalisator does not pay out beyond second place. All "fixed bets" are lost beyond third place. For "fixed bets", there are no stable bets. For "dead heats", the quotations are split accordingly. If a horse covers the course alone, the better receives a payout of half of the quotation. With fixed bets, the betting company reserves the right to restrict the deposit and withdrawal limits. If the limits of the fixed bets are exceeded, we reserve the right to withdraw overpaid amounts. III. Betting account, placing the bet 1. As a matter of principle, it is only permitted to maintain one account per name and associated address. We reserve the right to cancel doubled accounts. 2. A personal betting account is set up for the client when he first registers which is carried without charge by us, and is from this point in time registered under the client number assigned exclusively for the respective client. 3. We guarantee you as our client to keep your name and other data confidential within the framework of the legal requirements. In particular, the name of the client will not be disclosed without his permission. 4. You declare yourself in agreement that your personal data can be stored by us within the framework of recording of bets placed for as long as is necessary to complete the settlement of the relationship with you.

15 5. The betting account is exclusively held as a credit account. Should it result in a negative balance, we are entitled to claim the difference. As long as the betting account has a negative balance, we are entitled to prohibit the participation in our offers. 6. By placing the bet, you are deemed to have acknowledged the Terms and Conditions of Business in the version applicable at the time as a component of the bet. 7. By placing the bet, you further declare that you are at least 18 years of age and that you are contractually capable. 8. The bookmaker or betting company can refuse to accept bets without giving reasons and can determine a maximum stake or maximum winnings. 9. The bet is deemed to be placed in the following circumstances. Internet: Bets are deemed to be accepted by us through the Internet as soon as our computer confirms the bet with the client. Bets placed over the Internet are accepted until immediately before the start of the sporting event. The information of the betting office applies for the start of the race. The confirmation of our computer is only given until immediately before the start of the sporting event, whereby the time setting of our computer is determinative. The time stored in the computer system at the time of accepting the bet is deemed to be the time of acceptance. Where the time of acceptance is later than the effective start time (not the planned start time), the bet is not valid. It is treated as a non-runner and the stake is repaid. The effective start time is the time published in the racing newspapers after the race. 10. Bets already made and accepted cannot be reversed or altered by the client. The time printed on the bet transfer confirmation or the online confirmation of the bookmaker is deemed to be the time of acceptance. Where the time of acceptance is later than the effective start time, the bet is not valid. It is treated as a non-starter and the stake is repaid. The effective start time is the time published in the racing newspapers after the race. An example: The actual start time is 17:33 If the acceptance time of the bet is 17:34 the bet is not valid. If the acceptance time of the bet is 17:33 or earlier, the bet is legally valid. 11. Where the bet is submitted after the beginning of the race or contrary to the terms and conditions of business, the bet is invalid and the stake will be repaid after taking into consideration a possible claim for damages by us. If bets are placed with illegally obtained money, the resulting winnings are invalid and are treated as cancellations, are not paid out, and if need be reversed. 12. By placing the bet, you as the client declare that you have no knowledge of the outcome of the race and that you have not in any way manipulated the outcome of the race. Should this nevertheless be the case, we reserve the right to require the return of any winnings and to claim further compensation for damages. 13. Bets on behalf of third parties will not be accepted. Bets on events in which you are directly or indirectly involved are not permitted. In the case of suspicion of

16 infringements, we reserve the right to exclude you from the bet and to refuse to pay out winnings or to refund stakes and to require further compensation for damages. 14. In the event of fraud or an attempt at fraud, the client is immediately excluded, and any credit, which may remain after taking account of the expenses incurred by us (e.g. processing fee of 10% of the credit) and of any damage caused by the client is paid out. 15. The bookmaker or the betting company also passes on bets to partners abroad. 16. Credit bets are not possible and are not valid. IV. Betting stakes 1. Each client determines his own stakes, taking account of the minimum and maximum stakes. However, we reserve the right to limit in particular cases the stakes for certain clients. 2. The minimum stake per bet is Where the client pays in, it is necessary that his betting account held with the bookmaker or the betting company holds a credit from which the stake can be booked. In the case of bank money transfers, banking hours must be taken into account by the client. This is particularly important on weekends. Bank transfers can only be credited to the betting account of the client when the corresponding amount has been credited to the account of the betting company. V. Evaluation 1. The official race results of the totalisators assigned to the race always form the basis for the evaluation of the race and thus for the outcome of the bet. 2. The number recorded with the bet indicates the name of the horse. Where a horse runs twice on the same day, all bets apply only for the first start insofar as the running is not prescribed. Where number and name of horse are specified when the bet is placed, the name of the horse is determinative. 3. When a cancelled race is run again on the same day, the bet is valid for this race. Where a race is postponed to another racing day, all bets for this race are open. Stakes will be repaid. VI. Determination of winnings / paying out a) General 1. Won bets are paid out taking account of the maximum payment per bet and the maximum payment per race. The official totalisator result is determinative for the coming into being of the entitlement to winnings and for the calculation of them. The paying out of the bets is according to the totalisator of the respective race course. It is

17 at the bookmakers discretion also to offer betting on foreign events where no race information such as starter boxes, starting times or results will be published on the Info service. He can offer at its discretion solid bets and bet types, which can be made according to his state of knowledge at the local race track tote. In GB, payment is according to the SPs (see VII. paying out, b)). 2. The payout of the winnings can be postponed until the appearance of the official race report. 3. If one of the following bet types is not covered on the totalisator, the bookmaker pays, irrespective of any special regulation on the totalisator (e.g. arbitrary sequence) for the correctly forecast bets, the substitute quotations in accordance with the following tables, taking into account the respective maximum payment per bet and the maximum payment per race. All other bets with us are lost. Paying out in "GB" races follows the bookmaker closing prices, which are converted into quotations for 10 (SP), whereby the figures after the decimal place are dropped. For "dead heats", stakes and winnings are split accordingly. Where no SPs are announced in a race, all stakes for all types of bet are paid back. There are no stable bets in "GB". 2. Reduction of quotations Where a horse is withdrawn at the start in a "GB" race, the starting prices (SPs) are reduced accordingly, whereby the figures after the decimal point are dropped. The reduced quotations are used in all quotations calculated from the SPs. The announcement in the SIS system is determinative for the reduction of the quotation. Only the winnings portion is reduced, and not the stake. 3. The paying out of the place bets in "GB" is according to the win closing prices (SP) and are paid: for 4-7 horses 1/4 of the odds (two places) and for 8 or more horses 1/5 of the odds (three places). For 16 and more horses 1/5 of the odds (four places). Place accumulator bets are not offered and if announced by the system, treated as 1 (repaid). 4. When a favourite is placed in a race (quotation under 20 for 10), there are special place quotations: for 4 to 7 horses ¼ of the odds (two places) for 8 or more horses 1/10 of the odds (three places) for 16 or more horses 1/10 of the odds (four places) In GB the fourth place where more than 16 horses are racing will only be paid out, if the race is a handicap race and the SIS-system announces a win closing price for the 4 th place. All places beyond fourth place are lost, even when a fifth win closing price is announced in the SIS text system. In the case of a "dead heat", corresponding splitting takes place. Where the first or second place quotation for a race is higher than the straight dual forecast quotation, the straight dual forecast quotation is used for the

19 corresponding place quotation for paying out. Where the third place quotation for a race is higher than the tricast quotation, the tricast quotation is used for the corresponding place quotation for paying out. 5. Straight dual forecasts for "GB" races (from three starters) For straight dual forecasts, the quotations of the English bookmakers (CSF) are used for paying out. Where there is no CSF quotation for a race or there are less than three starters, all stakes are repaid. Where one of the horses tipped does not run, the stake is open and is repaid. In races where only one horse finishes, the procedures of the English bookmakers are applied (see SIS text system). 6. Tricast bets for "GB" races (from seven starters) The calculation of tricast bets is based on the SPs of the English bookmakers, which are converted into German quotations for a stake of 10, with the decimal places being dropped. Where only two SPs are announced, the corresponding last show quotation (contingent quotation) is used. The SPs for the second and third places are only calculated to the following values: for 5-6 starters 150; 7-9 starters 250; starters 350; more than 12 starters 500. The calculation is made according to the following formula: tricast quotation = SP1x(1:(((1:SP2):(0,1-1:SP1))x((1:SP3):(0,11-1:SP1-1:SP2)))). Where less than nine horses run in a race, the tricast quotation is limited to x times the straight dual forecast quotation, where x is the number of horses which ran. The tricast quotation calculated in this way applies for a stake of 10. In the case of a "dead heat", the corresponding SP quotations are used for calculating the different sequences. Where less than four horses start in a race (for Ireland, six horses), all tricast bets for the race are repaid, unless a tricast quote is published in the English SIS text system. For tricast bets placed with the bookmaker for "GB", the quotations calculated according to the formula specified above apply, unless a TC is announced in the SIS system. In this case, the tricast quotation is used for paying out for the tricast bet. Where one of the horses tipped does not run, the bet is open and the stake is to be repaid. For races where less than three horses finish, the straight dual forecast quotation is used for paying out. In races where only one horse finishes, the win bet is paid out. In races where no horse finishes, stakes are repaid. c) Regulations for provincial locations abroad Provincial locations abroad are racecourses for the meetings of which no results are published in the German information service (DATEK). For these racecourses, only bets which can be made at the local racecourse totalisator are accepted. Bets accepted in error contrary to this are invalid.
