2 ELIGIBILITY GUIDELINES DWELLING AGE: Up to 35 years old. Exception: Older dwellings will be considered eligible if plumbing, heating, and wiring systems have been completely modernized. Evidence of modernization must be provided at the insured s elective expense. In no case should replacement cost exceed market value. VALUES: Form Minimum HO-3 $ 65,000 HO-4 $ 12,000 HO-6 $ 20,000 INSURANCE TO VALUE: 100% of the current replacement cost is required. DWELLING LOCATION: Dwellings located in Protection Class 2-7 are eligible. Also, dwellings located in Protection Class 8, 9 or 10 may be considered if the property qualifies for the suburban rating endorsement (form 189C). Dwelling located in designated brush areas may be considered for DIC only. Note: Please refer to zip code list on page iii for possible brush hazard areas. COVERAGE FORMS: HO-3, HO-4 and HO-6 are eligible. SECONDARY OR SEASONAL DWELLINGS: Secondary dwellings may be considered when the primary dwelling is insured with Tokio Marine. 3 ELIGIBILITY GUIDELINES PERSONAL ARTICLES FLOATER SCHEDULES: Maximum values per item - $5,000. (Exception: maximum per man s jewelry item is $2,500.) Maximum total schedule - $25,000. Higher amounts for individual items and/or total schedules may be considered if submitted unbound. Appraisals or bills of sale (both less than 1 year old) must be provided for all items valued at over $1,000. For items less than $1,000 a complete description must be provided, and valuation must be substantiated (e.g., catalogues). Information on safeguards should be provided for all submissions. MAINTENANCE: Dwellings and premises should be well maintained and free from unusual hazards. LOSSES: 1. No more than 1 loss in the last 3 years. 2. No on premises theft losses in the last 3 years. EARTHQUAKE ELIGIBILITY GUIDELINES: 1. Earthquake coverage cannot be endorsed onto an existing policy during an earthquake episode or for 10 days after said episode if the earthquake had a magnitude of 5.0 or greater. The affected area will be the county where the epicenter was located and the counties that immediately border it. 2. No coverage may be written during and for 10 days following an earthquake episode with a magnitude of 5.0 or greater. 4 ELIGIBILITY GUIDELINES BRUSH ELIGIBILITY GUIDELINES: 1. Closest flammable native growth at any point must be more than 500 feet away. If the risk is on a 30 or greater slope, it must be more than 1,000 feet away. 2. Dwelling must not have wood shingle or shake roof, or be located on a dead-end street if in an area exposed to native growth. 3. Access streets to the risk must be wide enough to permit emergency vehicles to pass with cars parked on both sides of the street. 4. The closest fire department must be within 3 miles and the closest hydrant must be within 500 feet. 5. There can be no prior brush fire/smoke damage. ELIGIBILITY A. HO-3 - A Homeowners Policy may be issued: 1. to the owner-occupant(s) of a dwelling which is used exclusively for private residential purposes (except as provided in General Rule 2.F.) and contains not more than 2 families and with not more than 1 boarder or roomer per family; or 2. to the purchaser-occupant(s) who has entered into a long-term installment contract for the purchase of the dwelling and who occupies the dwelling but to whom title does not pass from the seller until all the terms of the installment contract have been satisfied. The seller retains title until completion of the payments and in no way acts as a mortgagee. The seller s interest in the building and premises liability may be covered using Endorsement HO-41 - Additional Insured; or 3. to cover dwellings in course of construction provided the policy is issued only in the name of the intended owneroccupant(s) of the dwelling. FORM HO-4 - A Homeowners Policy may be issued only to: 1. the tenant(s) (non-owner) of a dwelling or an apartment situated in any building; or 2. the owner-occupant(s) of a dwelling, cooperative unit or of a building containing an apartment not otherwise eligible for a Homeowners Policy under General Rule 2.A. above. provided the residence premises occupied by the insured is used exclusively for residential purposes (except as provided in General Rule 2.F.) and is not occupied by more than one additional family or more than 1 boarder or roomer. C. When a 2-family dwelling is occupied by co-owners, each occupying distinct living quarters with separate entrances, a Homeowners Policy providing building coverage may be issued to only one of the co-owner occupants of the dwelling. The policy may be endorsed to cover the interest of the other co-owner(s) in the building and for premises liability. A separate Homeowners Policy Form HO-4 may be issued to co-owners occupying the other apartment in the dwelling. It is permissible to extend the Homeowners Policy, without additional premium charge, to cover the interest of a nonoccupant joint owner in the building and for premises liability. Use Endorsement HO-41 - Additional Insured D. FORM HO-6 - A Homeowners Policy may be issued to the owner of a condominium unit which is used exclusively for residential purposes (except as provided in General Rule 2.F.) and is not occupied by more than one additional family or more than 1 boarder or roomer. E. Subject to all other sections of this rule, a Homeowners Policy may be issued to cover a seasonal dwelling. F. Incidental office, professional, private school and studio occupancies are permitted provided; 1. the premises is occupied principally for dwelling purposes; and 2. there is no other business conducted on the premises G. A Homeowners Policy shall not be issued covering any property to which farm forms or rates apply under the rules of the Company. In no event shall a policy be issued to cover any property situated on premises used for farming purposes. Optional Section II liability coverage is available for certain farm liability exposures as specified in the Premium Section of this manual. H. A Homeowners Policy shall not be issued to cover any mobile home, trailer home, or house trailer. 3. MANDATORY COVERAGE A. It is mandatory that insurance be written for all coverages provided under both Sections I and II of the Homeowners Policy. B. Section II of the policy requires coverage for the following exposures. When such exposures exist, refer to the Premium Section of this manual. 1. All additional premises where the named insured or spouse maintain a residence other than business or farm properties; 2. All residence employees of the named insured or spouse not covered or not required to be covered by workers compensation insurance; and 3. Incidental office, professional, private school or studio occupancies by the insured on residential premises of the named insured. PERMITTED INCIDENTAL OCCUPANCIES When the insured maintains an incidental office, professional, private school or studio occupancy in the dwelling or in separate structure on the premises, as permitted in General Rule 2.F., refer to the Premium Section of this manual for policy writing instructions. 5. DEDUCTIBLES Deductible options are shown in the Premium Section of this manual. 6. OPTIONAL COVERAGES For optional Section I and II Coverages, refer to the Premium Section of this manual. 7. SECONDARY RESIDENCE PREMISES Homeowners Coverage on a secondary residence premises shall be provided under a separate policy. The rules of this manual apply except that Section II Coverage is not mandatory for the secondary residence policy when: a. we insure the initial and secondary residence; and b. the policy number of the initial residence is indicated on the policy covering the secondary residence. 8. MULTIPLE COMPANY INSURANCE Refer to Company. 9. CHANGE ENDORSEMENT Endorsement HO-45, Change Endorsement, provides the minimum information requirements for any endorsement or change that takes place during the term of the policy. This endorsement must be used or the equivalent information provided. Copies of endorsements used must accompany this endorsement or its equivalent. 10. POLICY PERIOD The Homeowners Policy may be written for a period of one year and may be extended for successive policy periods by extension certificate based upon the premiums, forms and endorsements then in effect for the Company. For maintaining common anniversary dates, a Homeowners Policy may be written for a period of less than one year on a pro rata basis. 11. RENEWAL PLAN A. A Homeowners Policy may be written under the Renewal Plan for a term of twelve months. The policy may be continued for successive term. The Homeowners Renewal Plan requires the use of: 1. the Homeowners Policy with HO-52, Renewal Plan Endorsement, attached; or 2. a special Homeowners Renewal Policy B. The continuation premium shall be based upon the premiums in effect on renewal date. The then current editions of the applicable forms and endorsements must be made a part of the policy. Additional premiums for policy changes occurring during the current policy terms shall be computed pro rata of the annual premium. C. Renewal Eligibility Guidelines* 1. 1 or more bodily injury liability losses over $20,000 within the past 3 years or more losses involving an animal in the insured s care custody or control within the past 3 years or more losses resulting from lack of maintenance of the premises where the hazard has not been corrected or more, on or off premises theft or burglary losses within the past 3 years. 5. Vacant or unoccupied buildings. *Note: Any exceptions to the Renewal Eligibility Guidelines will require sign off and documentation by the Underwriting Manager. 15 GENERAL RULES 12. OTHER INSURANCE Credit for existing insurance other than Multiple Company Insurance under General Rule 8. is not permitted. 13. CANCELLATION OR REDUCTIONS IN LIMITS OF LIABILITY OR COVERAGES It shall not be permissible to cancel any of the mandatory coverages in the policy unless the entire policy is cancelled. If insurance is cancelled or reduced at the request of either the insured or insurer, the earned premium shall be computed on a pro rata basis. 14. MANUAL PREMIUM REVISION A manual premium revision, meaning any revision of premium applicable to the Homeowners Program, shall be made in accordance with the following procedures: A. The effective date of such revision shall be as announced. B. The revision shall apply to any policy or endorsement in the manner outlined in the announcement of the revision. C. When an existing Homeowners Policy is endorsed to take advantage of a reduction in premium, the adjustment shall be made on a pro rata basis. D. Unless otherwise provided at the time the premium revision becomes effective, and except with respect to policies written subject to the Deferred Premium Payment Plan, the current forms and endorsements must apply to all items of the policy to which the premium revision applies. 15. TRANSFER OR ASSIGNMENT Subject to all the rules of this manual and any necessary adjustment of premium, a Homeowners Policy may be endorsed to effect: A. transfer to another location within the same state; or B. assignment from one insured to another in the event of transfer of title of the dwelling. 16. RESTRICTION OF INDIVIDUAL POLICIES If a Homeowners Policy would not be issued because of unusual circumstances or exposures, the named insured may request a restriction of the policy provided no reduction in the premium is allowed. Such requests shall be referred to the Company. 17. CONSTRUCTION DEFINITIONS A. Frame - exterior wall of wood or other combustible construction, including wood-iron clad, stucco on wood or plaster on combustible supports. B. Masonry - exterior walls constructed of masonry materials such as adobe, brick, concrete, gypsum block, hollow concrete block, stone, tile or similar materials and floors and roof of combustible construction (disregarding floors resting directly on the ground). C. Superior Construction 1. Non-Combustible - exterior walls and floors and roof constructed of, and supported by metal, asbestos, gypsum, or other non-combustible materials. 2. Masonry Non-Combustible - exterior walls constructed of masonry materials (as decried in B. above) and floors and roof of metal or other non-combustible materials. 3. Fire Resistive - exterior walls and floors and roof constructed of masonry or other fire resistive materials. Note: Mixed (Masonry/Frame) - a combination of both frame and masonry construction shall be classed and coded as frame when the exterior walls of frame construction (including gables) exceed 33 1/3% of the total exterior wall area; otherwise class and code as masonry. 16 GENERAL RULES 18. SEASONAL DWELLING DEFINITION A seasonal dwelling is a dwelling with continuous unoccupancy of three or more consecutive months during any one-year period. 19. SINGLE BUILDING DEFINITION All building or sections of buildings, which communicate through unprotected openings, shall be considered as a single building. Buildings, which are separated by space, shall be considered separate buildings. Buildings or sections of buildings, which are separated by an 8-inch masonry party wall which pierces or rises to the underside of the roof and which pierces or extends to the innerside of the exterior wall, shall be considered separate buildings. Communication between buildings with independent walls or through masonry party walls described above shall be protected by at least a Class A Fire Door installed in a masonry wall section. 20. DEFERRED PAYMENT PLAN Available for all forms except HO-4 in semiannual or quarterly installments. A $2 service charge for each payment applies. 21. 17 ADJUSTED BASE PREMIUM COMPUTATION 1. BASE PREMIUM From the Basic Annual Premium Chart, select the Base Premium for the Coverage Amount, Basic Premium Group and Form that applies. 2. SUPERIOR CONSTRUCTION - ALL FORMS The premium for an eligible dwelling of superior construction is computed by multiplying the masonry BASE PREMIUM for a comparable dwelling or apartment unit by a factor of.85. Refer to the Construction Definitions on page 4 for details. 3. TOWNHOUSE OR ROW HOUSE - ALL FORMS EXCEPT HO-4 AND 6 The premium for an eligible 1 or 2-family dwelling in a town or row house structure is computed by multiplying the BASE PREMIUM by the appropriate factor below. PROTECTIVE DEVICES - ALL FORMS Approved and properly maintained installations of burglar alarms, fire alarms and automatic sprinklers in the dwelling may be recognized for a premium credit - developed by applying the selected factors to the BASE PREMIUM. DEDUCTIBLES All Homeowners Policies are subject to a deductible applicable to loss from all Section I perils covered under the policy on an occurrence basis. Enter the deductible amount selected in the Deductible Declaration of the policy. When a separate deductible amount applies to a certain peril, such as windstorm or theft, also enter that deductible amount and peril in the Deductible Declaration of the policy. A. Basic Coverage - The form automatically provides $1,000 coverage at no additional premium charge. 23 OPTIONAL COVERAGE (SECTION I) 9. PERSONAL PROPERTY A. Increased Limit When the limit of liability for Coverage C is increased, the additional premium per $1,000 of insurance shall be $2. (Does not apply to the automatic Coverage C increase for Replacement Cost on Contents Coverage.) B. Increased Limits - Other Residences When the limit of liability of 10% of Coverage C at other residences is increased, the additional premium shall be $7 per $1,000 of insurance. Reduction in Limit The limit of liability for Coverage C may be reduced to an amount not less than 40% of the limit for Coverage A at a credit of $1 per $1,000 of insurance. Reduction in the limit of liability for Coverage C is not permitted when Endorsement HO-42 - Office, Professional, Private School or Studio Use is required. D. Increased Special Limits of Liability 1. Jewelry, Watches and Furs The special limit of liability of $2,500 for theft of jewelry, watches and furs is already included in the base price. 2. Money and Securities The special limit of $200 on money may be increased to $500. The $1,000 limit on securities may be increased to $2,000. The additional premium shall be developed as follows: Premium per $100 of Insurance Money Securities $6 $4 3. Silverware, Goldware and Pewterware The special limit of liability of $2,500 for loss by theft of silverware may be increased to a maximum of $10,000 in increments of $500. The additional premium shall be $3.25 for each $500 increase. 4. Firearms The special limit of liability of $2,000 for loss by theft of firearms may be increased to a maximum of $5,000 in increments of $100. The additional premium shall be $3 for each $100 increase. Use Endorsement HO-65 - Coverage C Increased Special Limits of Liability 10. RENTAL TO OTHERS - THEFT COVERAGE All Forms - When the policy is extended to cover loss by theft while the portion of the residence premises usually occupied by the insured is occasionally rented in whole or in part to others, or while there is rental to a roomer or boarder, the additional premium shall be $15. Use Endorsement HO-80 - Residence Rental Theft 11. BUSINESS PROPERTY The policy provides $2,500 coverage for business property on the residence premises. 12. LANDLORD S FURNISHINGS - ALL FORMS The policy may be extended to provide $1,000 coverage for landlord s furnishings in each apartment rented to others on the residence premises. The additional premium shall be $15 per policy for all units plus $2 per unit. The policy may be endorsed to provide a 5% discount to the premium developed for Personal Earthquake Coverage if the following conditions apply: 1. The dwelling was built prior to 1950, and 2. The following construction requirements are met: a. The dwelling is tied to the foundation, b. Cripple walls are braced with plywood or its equivalent, c. The hot water heater is secured to the building frame. B. The discount shall be developed by multiplying the premium developed under Rule 4. Personal Earthquake Coverage by ORDINANCE OR LAW COVERAGE A. Insures Coverage A and B against loss resulting from ordinance or laws regulating construction, repair or demolition of the insured property. B. This optional coverage is available for a charge of 10% of the Basic Premium. Use Endorsement HO COVERAGE ENHANCEMENT - FOR USE WITH HO-3 ONLY A. 31 OTHER RATING PROVISIONS 1. WAIVER OF PREMIUM When a policy is endorsed subsequent to the inception data, any additional or return premium of $3.00 or less may be waived. 2. WHOLE DOLLAR PREMIUM RULE All premiums shown on the policy and endorsements shall be rounded to the nearest whole dollar. A premium of fifty cents ($.50) or more shall be rounded to the next higher whole dollar. 3. SECONDARY RESIDENCE PREMISES When coverage is provided on the initial and secondary residence premises under separate policies in the same company, the basic premium for the secondary residence premises shall be reduced $28. Charge for an additional insured location under the policy covering the initial residence premises. A minimum annual premium of $50 shall be charged for each secondary residence premises regardless of the credit allowed. 4.
