4 arkansas legal leaders arkansas law 2013 From big business to abortion rights and personal liberties, here are some of the legal trends developing in The Natural State this year. Social media, abortion rights, a major oil spill, and the right to carry guns are all at the forefront of Arkansas legal scene, while the state s largest company and one of the biggest in the world continues to make legal news on a national scope. That company is Bentonville, Ark.-based Walmart, which, as the nation s largest retail chain and No. 1 employer of private-sector jobs, often finds itself the target and defender of lawsuits large and small. The parent company of more than 4,600 stores and clubs nationwide is perennially embroiled in disputes with cities and towns where it seeks to open, met with opposition from local small businesses and zoning regulations. As the employer of more than 1.4 million Americans in non-union jobs, Walmart also often finds itself the defendant in lawsuits involving job-related complaints, ranging from discrimination to harassment to safety issues. Walmart is currently headed back to the U.S. Supreme Court the site of its landmark 2011 victory in a class action brought by former employees where it will now defend itself against a woman who claims she was denied disability benefits after nearly 20 years at the company. Meanwhile, back at home in Russellville, Ark., a former Walmart employee has filed suit, alleging defamation, malicious prosecution, abuse of process and intentional inflict of emotional distress by the corporation. The Russellville Courier reports that Mai Sawada, a 22-year-old engineering student at Arkansas Tech University, was employed by Walmart over the course of eight months, beginning in late 2011, and was fired on July 6, 2012 after the company accused her of theft of property totaling more than $8,000. She was later terminated from a subsequent job at the university after news of her arrest was made public. The pending felony theft charges were cited as the reason for her dismissal, the lawsuit claims, and further notes that upon the discovery of surveillance video that actually cleared Sawada of any wrongdoing, Walmart dropped the charges against her. Sawada s lawsuit is seeking an undisclosed amount for defamation, actual expenses incurred, lost wages, inconvenience, and emotional distresses suffered by Plaintiff, as well as punitive damages, attorney s fees and costs associated with bringing this action. Another corporate giant facing legal issues in Arkansas is ExxonMobil, as two residents of Mayflower, Ark., have filed a federal lawsuit against the company in connection with a pipeline rupture and oil spill in their town. Kimla Greene and Kathryn Jane Chunn filed the suit a week after the spill, triggered by a rupture in Exxon s Pegasus pipeline. As of mid- May, cleanup crews were still working to mop oil off the streets of Mayflower, 25 miles northwest of Little Rock. Exxon crews were cleaning up the crude by pressure washing and absorbent pads, and by removing contaminated soil and vegetation. The plaintiffs are seeking compensation for a permanent decline in property values, according to media reports. The lawsuit is seeking more than $5 million in damages for the property owners affected. The pipeline, which carried crude oil from Illinois to the Gulf of Mexico area, has been shut down. Residents of the 22 homes affected were still out of their houses at the time of this report. Social Media Law As of April, Arkansas has a new social media privacy law, which prohibits an employer from requiring or requesting that a current or prospective employee do any of the following: Disclose his/her user name or password or a social media account; Add a co-worker as a friend or to the list of contacts associated with the account; Change his/her account privacy settings. Employers may not retaliate against employees or refuse to hire applicants who exercise their rights under this law. The law does make clear that there are certain actions it does not bar employers from taking. 5 current or prospective employees that is publicly available on the Internet. Also, the law specifies that social media accounts do not include accounts that are: Opened by an employee at the request of an employer; Provided to an employee by an employer (e.g., a company account or other software program owned or operated exclusively by an employer); The far-reaching impact of social media goes way beyond the workplace as the Arkansas Supreme Court discovered when it was forced in December to throw out a murder conviction. In the case of Erickson Dimas-Martinez, who was accused of robbing and killing a teenager, the defendant s lawyers discovered that one juror had been tweeting about the trial. In the most grievous breach, the individual announced that the jury had reached a verdict one hour before that news became public. The court cited juror misconduct when granting Dimas-Martinez, who had been sentenced to death, a new trial. Because of the very nature of Twitter as an online social media site, Juror 2 s tweets about the trial were very much public discussions, wrote Associate Justice Donald Corbin. Even if such discussions were one-sided, it is in no way appropriate for a juror to state musings, thoughts or other information about a case in such a public fashion. Corbin also recommended that the Arkansas Supreme Court Committee on Civil BLAIR & STROUD, ATTORNEYS AT LAW Civil litigation, CommeRCial litigation, business & CommeRCial Practice consider restricting jurors access to their mobile phones during a trial. Challenge to Abortion Rights Groups supporting the right to abortion filed suit in May challenging an Arkansas law that would ban most abortions after 12 weeks, seeking to block one of the nation s most restrictive abortion measures before it takes effect in July. The Arkansas Human Heartbeat Protection Act would ban most abortions at about 12 weeks of pregnancy, once a fetal heartbeat can be detected by a standard ultrasound. It includes exemptions for rape, incest, the life of the mother and major fetal conditions. Doctors who violate the law risk having their licenses revoked by the state Medical Board. The Arkansas lawsuit, filed in federal court by the Center for Reproductive Rights, the national American Civil Liberties Union and the ACLU s Arkansas chapter, asked for a temporary injunction against the law. It was filed on behalf of two Arkansas doctors who perform abortions. Aaron Sadler, spokesman for Arkansas Attorney General Dustin McDaniel, said the state had been expecting the lawsuit. It is our responsibility to defend state law, and we will do so in this litigation, he said. Planned Parenthood, which is the nation s largest abortion provider and operates clinics in Arkansas, fought the measure. Many cases handled on appeal have established new legal precedents. at risk, Jill June, chief executive of Planned Parenthood of the Heartland, told Reuters. A woman may need an abortion for many different reasons, and she should be trusted to make her own personal private medical decisions. Right to Carry In July, Arkansas will become the fifth state in the United States to allow Constitutional carry. Act 746, which was sponsored by Rep. Denny Altes of Fort Smith, cruised through the state government with only one nay vote in the legislature and it received Governor Mike Beebe s signature on April 4. Constitutional carry is when a state does not have any laws that limit a person s ability to carry a firearm, either openly or concealed. Essentially, the only justification a gun owner needs is the U.S. Constitution. Gun owners in most states have to carry with them a permit that proves they can legally carry firearms. In Constitutional carry states, the burden of proof falls on state prosecutors to prove that citizens are carrying a gun with the intent of committing a crime. This marks a major victory for gun rights advocates in the state, but lobbying group Arkansas Carry suggests that citizens consult a lawyer before carrying a handgun in public after the act takes effect. Being a new law, Act 746 is untested by the courts, and law enforcement officials are not completely aware of the implications as it pertains to the carry of handguns. 6 arkansas legal leaders LIABILITY FOR INJURIES DURING RECREATIONAL ACTIVITIES it IS DIFFICULT TO SUE A PERSON or company if you re injured in the process of a recreational activity. Liability regarding recreational activities isn t always as clear-cut as other types of personal injury lawsuits. When you sign up with a gym, you will be asked to sign a contract, agreeing to fees and rules. Most gym contracts include language stating that you will use their equipment and working out at your own risk. If your contract includes wording to this effect, you may not be able to sue the gym if you are hurt. Schools May Have Limited Liability Personal injury lawsuits related to school sports injuries can be problematic. If injury occurs because the equipment is faulty, such as football helmets, protective padding, or face guards, you could sue the manufacturer, but the school itself may not have any legal liability for this. Schools are typically required to provide only supervision and knowledgeable instruction to students involved in sporting activities. As long as coaches and teachers do these things, it may be difficult to prove negligence or liability. Theme Parks May Fight Back If you re hurt while at a theme park or amusement park, your odds of a successful lawsuit may depend on whether you can prove that some mechanical defect caused your injury. If you slip and fall, the park will probably allege that you were careless, just as a retail store would. Theme parks also defend a little harder against personal injury lawsuits, because they host millions of visitors annually. If the majority of those millions believe it s easy to sue parks and win, the parks might be overwhelmed with personal injury lawsuits. Because of this, theme park accidents are often settled out of court. The awards are usually not made public, because it might entice the public to sue. Resorts Must Post Warnings When you visit a resort, you might use their ski equipment, helmets for horseback riding, or canoes. Resorts are responsible for keeping this equipment in good working order. They should also post clear warnings when conditions are unsafe for engaging in certain recreational activities. 7 Rainwater, Holt & Sexton s Ripple Effect Integrity and Compassion Beyond the Courtroom cover SPOTLIGHT for law firm Rainwater, Holt & Sexton, P.A., helping people isn t restricted to assisting clients in the courtroom. While the firm s 18 attorneys and more than 75 staff members in four offices work every day to help injury victims, the community service they do outside of law is just as fulfilling. In 2010, the firm founded The Ripple Effect Award, an ongoing program that recognizes and shares the stories of local heroes who make positive differences in the community. The latest Ripple Effect Award recipient is Linda Craig, president of the Arkansas Chapter of Concerns of Police Survivors (COPS). The COPS organization is part of a national non-profit that provides resources to assist in rebuilding the lives of surviving families of law enforcement officers killed in the line of duty. Craig s husband, State Trooper Captain Thomas Allen Craig, was killed during an ice storm in Linda helps family members who have lost a loved one in the line of duty, and is on the list of first responders when an incident occurs, says firm partner Stephen Holt. She has become an angel of mercy to other families. Craig says that she was shocked when she learned she would be recognized as a Ripple Effect winner. The firm has a real heart for law enforcement, and has been so supportive of our organization. They always donate door prizes we can use for our fundraisers, help us out with legal questions, and they even gave us a generous donation, Craig says. The Ripple Effect is just one way that Rainwater, Holt & Sexton shows that the firm is behind the community. We try to look out into our community and find folks who are serving others, and Linda Craig is certainly an example of that, partner Bob Sexton says. She knows first-hand exactly the trauma that these families are going through and helps them in a personal way. Rainwater adds, Anyone who finds the strength to pick themselves up after a tragedy is courageous. Anyone who uses that tragedy to pick others up is heroic. Linda Craig is both. In addition to spotlighting members of the community through the Ripple Effect Award, the firm serves as an official sponsor of the Razorback Sports Network. We were all born and raised in Arkansas, and we are very proud to be part of the culture here, Holt explains. Razorback Sports are a big deal in our state, and we re happy to be part of the team. Believing in the value of sports, the firm uplifts young people by supporting Fellowship of Christian Athletes (FCA). Chuck Beale, Area Director of the Central Arkansas FCA, calls Rainwater, Holt & Sexton great encouragers. The firm has supported us financially, and helped us with so many of our programs, Beale notes. Due to their support, they have made it possible for Arkansas students to attend FCA camp, which makes a real difference in their lives. This summer, about 20 kids will be able to attend camp because of the kind support of the firm. Robert Upshaw, formerly with FCA and a previous Ripple Effect honoree, agrees. Rainwater, Holt & Sexton gives monthly to the ministry, and even donated their radio spots to us so that we could promote our events without having to incur a cost, Upshaw recalls. We ve been able to give many kids their very first personal copy of the Bible thanks to the firm s generosity. Perhaps some of the strongest advocates of Rainwater, Holt & Sexton are the firm s own staff. Employee Shelley Tinnon raised thousands for her daughter s team for the Arkansas Walk Now for Autism Speaks event and says that the firm s support made a big impact. 8 arkansas STARTING A BUSINESS: SELECTING A GOOD LAWYER legal leaders S TARTING A BUSINESS WITHOUT the advice of legal counsel could be one of the biggest mistakes you ever make. If you don t already have a lawyer representing your interests, a prime candidate to meet your needs would be a business lawyer with expertise on corporate matters and start-up ventures. This checklist will help you find such a lawyer. Now do some initial screening to narrow down your list to three or four prospective candidates: Look at the biographies and websites for the lawyers and their law firms. Does the lawyer appear to have expertise in forming business organizations (for example, corporations, partnerships, limited liability companies, sole proprietorships)? Does he or she profess to have expertise with start-up ventures? Look for a list of representative clients. Are they the types of clients that you would want your lawyer representing? Does the lawyer represent other businesses similar to yours? Search on the Internet under the name of the lawyer and his or her law firm. Can you find any articles, FAQs or other informational pieces that the lawyer has done that that give you a level of comfort? Ask other people if they have heard of the attorneys and what they think about them. Contact your state bar association or go to their website to find out if the lawyers on your list are in good standing. Check out any advertisements you can find on a lawyer. For example, is the lawyer listed in the yellow pages of your telephone directory? If so, do you find the listing tasteful? (Most attorneys are listed in the yellow pages, but it is not as common to see business attorneys place big advertisements there. You are more likely to find that they will advertise in trade publications specific to their areas of expertise, or they will try to get their name out by sponsoring charitable or community events.) Check out the archives of your local newspaper. Has there been any publicity about the lawyer or the cases that he or she has handled? Consider any special needs you have. For example, could you benefit from an attorney who speaks a language other than English? There are basically two types of business 8 Arkansas Legal Leaders lawyers: those who handle lawsuits (called business litigators) and those who primarily handle corporate and contract matters (called transactional lawyers). Some lawyers do both, but most of them tend to specialize in one area or the other. So if you are forming a new business, a lawyer who handles business transactions may be your best bet. If you are starting up a small business where the ownership will be closely held, the organizational issues may not be too complicated and a sole practitioner or a lawyer in general practice may do a very good job in representing your interests. But it s worthwhile to try to look to the future needs of your business as it continues to grow. For example, think about retaining a lawyer or a law firm with expertise in areas that may better cover all of your anticipated business needs. It may be a good idea to look at a full service firm that does both transactions and litigation. It would also be to your benefit to have access to lawyers with expertise in other law areas affecting your business (for example,labor or employment law, tax law, real estate law, banking and finance or intellectual property). You will probably want to hire a lawyer with at least a few years of experience. Look for lawyers that have experience in representing the type of business that you have or that you will be going into. Look to see if a lawyer is affiliated with associations that cater to legal issues affecting businesses. For example, most bar associations have sections in business law and other related categories. Having a lawyer who is involved in a chamber of commerce or other local organizations may also be a good sign, depending on the your legal needs. Unless there are special circumstances, you ll want to hire a lawyer who is licensed to practice law in your state and has an office located near your principal place of business. Special circumstances where you may have to go out of town would include a situation where local attorneys don t specialize in the area where you have legal needs, or where you re planning on expanding operations to another location. Before you hire a lawyer: Ask for references. Talk to people who could comment on the lawyer s skills and trustworthiness. Get a reference from a bank and from other lawyers. A business lawyer should also be able to give you the names of several CPAs as references. Find out if he or she has previously worked with venture capitalists or other financing sources. A great reference source for a good lawyer is word of mouth from other satisfied clients. After getting appropriate consents, lawyers will sometimes develop a list of representative clients that they ll use for marketing and promotioal purposes, and you might ask a lawyer if it would be okay to contact some of these clients. Ask about conflicts of interest. Does the layer represent any opposing parties? Does the lawyer represent any of your potential competitors? Ask for a copy of a firm brochure and promotional materials that the firm may have. Crosscheck these materials against your other sources and references. Ask to be provided with a copy of the lawyer s retainer agreement and have it explained to you before decide on retaining the lawyer or the lawyer s law firm. 10 arkansas legal leaders PREPAID DEBIT CARDS LARGELY UNREGULATED PREPAID DEBIT CARDS CAN be bought at stores and have money loaded onto them. The card can then be used to pay for a wide variety of services and purchases. In 2011, consumers loaded $83.3 billion onto these cards. By 2013, industry experts predict that the amount will be $201.9 billion. Consumers should be aware, however, that this fast-growing industry is almost entirely unregulated. The Unbanked and Underbanked At least 17 million adults do not have a checking or savings account. Another 43 million adults have a modest bank account, but rely heavily on alternative financial services such as checkcashing stores and payday loans. This leaves 60 million Americans operating outside the traditional banking system. New federal regulations have restricted traditional banks ability to collect fees on credit cards, regular debit cards, and overdraft services. As a result, banks are turning to the unregulated prepaid debit card industry to tap this large market and shore up revenues. Benefits and Risks of Prepaid Debit Cards Prepaid debit cards are safer than carrying cash, are accepted by merchants and ATMs, and anyone over the age of 18 can apply and be accepted regardless of their credit score. Paychecks and government benefits can also be directly deposited into the accounts for free. Despite these perks, the charges for using prepaid debit cards can far exceed the costs associated with use of regulated credit cards, checking accounts or other forms of payment. Prepaid debit cards often charge fees for activation, maintenance, cash withdrawal, balance-inquiries, reloading, customer service and even inactivity. Proposed Regulation of Prepaid Debit Cards Consumer advocacy groups question whether issuers of prepaid debit cards clearly explain all fees to their cardholders.
