Q: What is a Written List of Providers? A: The Written List of Providers is a separate form that is subject to the same initial timing requirements as the Loan Estimate. This is where the lender must name providers for the services consumers are allowed to shop for. For a service a consumer CAN shop for, the lender must identify at least one provider and include a statement that the consumer may opt for a different provider if they so choose. The consumer will receive a form that lists the service (i.e., pest inspection fee), at least one company that provides the service, the estimated cost and full contact information. Q: Loan Estimate Re-Disclosure A: There are fee tolerances that can trigger the requirement to re-disclose the Loan Estimate; these rules are very similar to the Good Faith Estimate rules currently in existence. A: In technical terms, a revision to the Closing Disclosure is a re-disclosure. There are three circumstances which require a revised Closing Disclosure to make sure all the terms are accurately changed and a new three-business-day waiting period (six business days if mailed) is given. The circumstances are: The disclosed APR becomes inaccurate The loan product changes A prepayment penalty is added No other changes require a new waiting period. However, the consumer has the right to inspect the Closing Disclosure a business day before closing. Q: Does re-disclosure correct fee tolerance violations?
A: No. the Closing Disclosure needs to be as accurate as possible before being issued because re-disclosing does NOT cure fee tolerance violations. The lender must review terms with the consumer before the Closing Disclosure is sent. Tolerance calculations are compared to the final Loan Estimate. Q: Can there be a re-disclosure after closing? A: Yes. There are circumstances that require revisions and corrections to the Closing Disclosure. Revisions include: The Closing Disclosure provided at closing becomes inaccurate and it results in a change to an amount paid by the consumer A refund is given for tolerance violations A non-numerical clerical error is discovered Q: How long does the lender have to cure tolerance violations? A: Sixty days. If amounts paid by the consumer at closing exceed the amounts disclosed on the final Loan Estimate beyond the applicable tolerance threshold the lender must refund the excess to the consumer within 60 days of closing.
