COPOW, Colorado Phone Wagering, is a service of Racing Associates of Colorado Ltd. d/b/a Arapahoe Park, and Mile High Kennel Club, Inc.d/b/a Mile High Racing and Entertainment. COPOW is a pari-mutuel electronic wagering entity authorized by the Colorado Racing Commission ( Commission ). Authorized account wagering centers are located at Arapahoe Park, 26000 E. Quincy Avenue, Aurora, Colorado 80016; Havana Park, 10750 E. Iliff Avenue, Aurora, Colorado 80014; and Mile High Racing, 6200 Dahlia Street, Commerce City, Colorado 80022. It is your responsibility to familiarize yourself with the terms upon which your payments are accepted. A copy of the Commission Rules governing the conduct of account wagering is attached hereto and incorporated herein by reference. USE OF THE ELECTRONIC WAGERING SITE DENOTES YOUR AGREEMENT OF THE TERMS AND CONDITIONS OF THIS AGREEMENT. COPOW Account Wagering Restrictions and Requirements The following restrictions as approved by the Commission apply to all participants in COPOW s account wagering and electronic system: The account holder must be a natural person 18 years of age or older. Applicant must be a resident of the State of Colorado. Applicants are limited to one account per state or federal identifying number. All applicants are subject to an independent, identity verification service contracted by COPOW to verify identity, age and residency. Accounts are non-transferable. Applicants must complete the Commission approved application and provide the following: a copy of a Colorado Driver s License or ID card, a copy of a Social Security card, a signed W2G form, and such additional documents as may be necessary to verify identity. Applications are available in all racing programs and wagering centers, online at www.mihiracing.com and in person at Havana Park and Mile High Racing. Applications may be submitted in person at Mile High Racing or Havana Park, or mailed to 10750 E. Iliff Ave. Aurora, CO 80014. COPOW reserves the right to refuse any applicant based on business judgment. Applications must be funded initially with a minimum of $20.00. Funding may be cash or through OTBPAY. 1
Account holders must choose an identification name or number and a unique PIN. Security questions will also be assigned to account holders and designated answers may be requested at any time prior to submitting any transaction. All wagers processed with the account ID and the unique PIN are the responsibility of the COPOW account holder. Any liability incurred by a breach of the account holder s unique account name and password, chosen and safeguarded by the account holder, shall be the responsibility of the account holder. All wagers placed through COPOW are recorded, kept for 90 days and may be monitored. All wagers placed through COPOW s account wagering system are deemed simulcast wagers and are subject to Colorado law. All wagers placed through COPOW s system are commingled with the track s pools and COPOW pays track prices. All winning transactions are credited to the account holder s account upon the race being deemed official and prices being displayed at the host track, unless the winning wager meets the IRS reporting regulations, or is subject to the Colorado Intercept Program. The signed W2G authorizes COPOW to submit to the IRS all wagers that meet the IRS regulations of reporting if the wagers meet the threshold odds of 300 to 1 or greater or $600.00. Additionally, wager with winnings of more than$5000.00 is subject to a withholding of 25% federal and 4.5% State (subject to change). All winnings subject to the IRS taxation regulations are additionally subject to the Colorado Intercept Program. Each winning wager that meets the IRS reporting regulations must also be submitted to the State of Colorado database detailing parents that have not met the court-ordered child support payments. If the winning ticket belongs to an account that also matches identification in the Colorado database the winnings will be withheld to the liability amount or any part thereof. Wagers cannot be cancelled by the account holder at the phone wager phone number. Wagers must be cancelled by the Player s Service Representative at 1-877-406-0396. Disputes and complaints are all handled by the Player s Service Representative. Withdrawals can be handled in person at Havana Park or through the mail with the withdrawal slip provided upon account activation. All accounts can be closed at any time in person at Havana Park 10750 E. Iliff Ave. Aurora, CO, by calling the Player s Service Representative at 1-877-406-0396 during regular business hours, or a letter of intent to close an account can be mailed to the above address and identification termination procedures will begin upon receipt of said letter. Identification to close an account must be same as provided upon opening account. Funds remaining in accounts will be transferred in accordance with law. COPOW reserves the right to terminate any account at any time for any reason. COPOW will keep such information confidential in a manner consistent with Commission Rules. 2

COPOW is committed to delivering you the most satisfying electronic wagering experience possible. We have teamed up with the best horse and greyhound track racing has to offer. The great horse content includes Churchill Downs, Gulfstream Park and Santa Anita along with their year round counterparts. Then we have chosen smaller horse tracks that pack a big bang and big payoffs, to round out our exclusive lineup. We offer this venue 7 days per week from 9 am through 8 pm Sunday through Thursday and 9 am through 10 pm Friday and Saturdays; although please note COPOW reserves the right to modify the times and days of operation at any time. Don t forget the BIG RACES and RACE DAYS COPOW will provide wagering on all prestigious US races including but not limited to: the Kentucky Derby, the Preakness Stakes, the Belmont, and the Breeder s Cup, additionally don t forget the Big Stakes Quarter Horse Races. Remember to wager early on these Big races as there is always more demand than opportunity (all signals are subject to simulcast contract agreements). The Greyhound side of wagering showcases racing from Palm Beach, Mardi Gras, Bluffs Run and Wheeling. The Night of Stars and other Stakes races are also available. COPOW has the racing you want to play and will stand out as the preferred account wagering choice. How much does it cost to use COPOW? NOTHING! There are no fees to use COPOW. However, in order to open an account you must make a minimum $20 deposit. If an account has no activity for a period of six months there will be a charge of $5.00 per month as an account maintenance fee. How do I open an account with COPOW? Hours are 9:00 am to 8:00 pm Mountain Sunday through Thursday and 9:00 am to 10:00 pm Friday and Saturdays. Are there any restrictions on COPOW? Yes. You must be at least 18 years of age and be a Colorado resident and meet the requirements of the Commission. COPOW reserves the right to deny the request to open an account or to close an account for any reason. 3
How do I place wagers? COPOW players may also use the following phone number to place wagers, check on account status or access Player Services, 1-877-406-0396 9:00 a.m. through 8:00 p.m. and 10:00 p.m. on Fridays and Saturdays. COPOW employs privacy and protection methods in accordance with Colorado law. COPOW accounts may only be accessed by the registered account holder using their unique, valid login information (username, password, etc.) The maximum wagering amount allowed is $2,500 (US) per transaction. The maximum show wager amount is $1,000 (US). The wagering amounts are also dependent on the host racetrack, Arapahoe Park and Mile High Racing and Entertainment policies and the Commission Rules. All wagers are commingled with wagering pools at the host racetrack and will be subject to host racetrack restrictions. Wagers will only be accepted that do not exceed the current balance of players' respective wagering account. All approved wagers will be withdrawn from the account holder's wagering account prior to submission of wager. Winning wagers will be credited to account holders Arapahoe Park account upon posting of official results by the respective host racetrack. If for some reason we are unable to commingle your wager with the host racetrack wagering pool, your wager will be refunded to your account. Requested wagers that are unsuccessful, ineffective or non-permissible for any reason (including any and all track errors, tote malfunction, communications failures, and et. al.) will be canceled and the full wagered amount will be refunded to COPOW player account. How long does it take to set up an account? Once your application is accepted and your identification, age and residency has been verified, and you have deposited funds through one of the available methods, you are ready to play. DEPOSITS AND WITHDRAWALS: Deposits may be made with cash at the Havana Park branch, or checks may be mailed to: COPOW at Havana Park 10750 E. Iliff Ave. Aurora, CO 80014 Attn: Player Service Representative. Bettors will also be able make deposits INSTANTLY into their Capital Bets account with OTBPay soon! Withdrawals may be made at Havana Park during normal business hours. Only the account holder may withdraw from the account with 2 forms of ID. You may also mail a completed withdrawal slip to the above address, and a check will be mailed to your home. WAGERING When do wagers need to be placed? Wagers can be placed up to post time. Note that some tracks now close wagering earlier. To avoid being shut out due to delays over the Internet, we recommend that wagers be placed as early as possible. 4
What types of wagers are accepted? We support nearly all wager types offered by our member tracks. The wagering menu will virtually mirror the tracks' wagering menus. Are transactions confidential? All wagers and transactions are confidential in accordance with Commission Rules. How is my wagering dollar distributed? Because all wagers are incorporated into the host track's wagering pools, the horsemen, the state and the racetracks share in the revenue. What tracks are available on Arapahoe Park? A monthly calendar is available at all OTB sites listing which horse and dog track signals are available each day. The calendars are also available at www.mihiracing.com Is it possible to cancel wagers? Yes, but all cancellations must be done by the Player Service Representatives, not the Phone Specialists. The Player Service Representative will have the final determination as to whether the wager may be canceled. Any wager that has the potential to alter odds will be subject to a phone call to the host track for permission and notification. The Player Service Representative is available at 1-877-406-0396 What are the pre-defined limits for wager cancellations? COPOW account holders may request to cancel up to a maximum of ten (10) wagers per week. In addition, a maximum wager limit amount of $200.00 will be strictly enforced. Are current odds available and how up-to-date are they? Yes. Odds are broadcast directly from our member racetracks and updated every sixty (60) seconds. What happens to my wager when a horse has been scratched that is part of my wager? COPOW will provide refunds or assign other horses in accordance with the member track's policies for handling scratches. Are current odds available and how up-to-date are they? Yes. Odds are broadcast directly from our member racetracks and updated every sixty (90) seconds. 5
What happens to my wager when a horse has been scratched that is part of my wager? COPOW follows the rules in the jurisdiction where the host track is located. The decision of the host track is final. In many jurisdictions the following rules apply: Single Race Wagers: Win - Place - Show: If the runner scratches, then the money will be refunded after the race goes official. Exacta: If one or more of your selected horses are scratched, you will receive a refund for the wager(s) involving the scratched horse(s). Trifecta: If one or more of your selected horses are scratched, you will receive a refund for the wager(s) involving the scratched horse(s). Superfecta: If one or more of your selected horses is scratched, you will receive a refund for the wager(s) involving the scratched horse(s). Super Hi-5: If one or more of your selected horses is scratched, you will receive a refund for the wager(s) involving the scratched horse(s) Multiple Race Wagers: Daily Double: If you selected the winner of the first leg and the selected horse in the second leg is scratched, you will receive a consolation double payout. Pick 3: At most tracks, if the Player's horse is scratched BEFORE the first leg is run, the Player will receive a refund. If your wager is still live going into the second or third leg and the selected horse is scratched, you will receive a consolation payoff provided that your wager wins the other two legs. Pick N: At most tracks, if the Player's horse is scratched in ANY LEG, the Player will receive the post time favorite as a substitute for each scratched runner in each leg. If you have the post time favorite included in your wager and have more than one horse included in that leg, and one or more of the selected horses are scratched, you will receive the post time favorite for each horse that scratched. In other words, you may have placed the wager only once using the post time favorite, but if any number of your other selections in that leg is scratched, you will receive the post time favorite for each horse scratched in lieu of the horse(s) in his wager. If I have a COPOW account can I wager via telephone? Yes. Players may place wagers by phone by calling 1-888-77COPOW (1-888-772-6769) 9:00 a.m. to 5:00 p.m. Mountain Sunday through Thursday and 9:00 a.m. through 7:00 p.m. Friday and Saturday. Phone wagering is available with a live operator. Do you offer wagering and program information on Harness racing as well as Thoroughbred racing? Yes. We offer Harness, Quarter Horse and Thoroughbred program information for the tracks covered. Please check our Calendar for available tracks. 6
How to Place a Wager Once you have an active account with a minimum of $20.00 you are ready to wager. 1. State which TRACK you wish to bet on. 2. State which RACE you wish to bet on. 3. State the AMOUNT of the wager. 4. State which POOL you wish to wager into. 5. State if you wish a straight WAGER TYPE or a wheel or a box wager. 6. Name the RUNNERS you wish to wager upon. 7. The phone specialist will repeat back all of the above information and how much the bet costs. 8. You must say I ACCEPT. 9. An example: the phone specialist will say Arapahoe Park, Race 3, $1.00 trifecta wheel 1 with the 23 with the 23, $2.00 Do you accept this bet? The patron must reply I accept before the wager is entered into the system 10. At the end of the wagering transaction the phone specialist will state the total amount of money spent and again the patron must state I ACCEPT to end the call. Is video streaming available? Yes. Video streaming for live racing is available for many tracks. Sign on to with your account number and password at copow.mihiracing.com You will get better video streaming when using Windows Media Player 9 or better which requires Windows 98 SE or later version operating system and Internet Explorer 6.0. Windows XP users will use Media Player 10 or 11 Series. Older operating systems may use Windows Media 7. Video speed is available up to 300 kbps for those with high speed (DSL or Cable) internet access. Those with phone line modem connections (56k) may or may not get video but often will get audio only because of the slower speed. **IMPORTANT: YOU MUST HAVE POPUP BLOCKERS DISABLED TO VIEW LIVE VIDEO. Dish Network offers a Race Track Network station for a nominal additional cost that covers all greyhound signals and most horse track signals in real time. *PLEASE NOTE ALL COMPUTERS, NETWORKS AND ISP PROVIDERS ARE NOT THE SAME AND THE LIVE VIDEO STREAMING MAY IN FACT BE DELAYED BY A SHORT PERIOD OF TIME. In order to view Race Replays, Players can use the following video players: Windows Media player on Windows OS Real Player Media player on Windows OS Flip4mac Media Player on Mac OS Some players may experience difficulties with Real Player on a Windows OS due to Windows Media Player typically being defaulted as the player for these file types. 7
