THE J.M. COHEN MODEL Millions of dollars are lost every year on workers compensation subrogation claims that are never pursued. We specialize in identifying these files, securing the cooperation of the injured party, and obtaining significant recoveries. Through the use of our time-tested model we have secured over one million dollars in workers compensation subrogation recoveries in the past two years. Our model is focused on three key factors; early intervention and investigation, securing cooperation from injured workers, and aggressive litigation of claims. Early Intervention and Investigation Prompt investigation is the key to successful subrogation recoveries. Immediate action after the first report of an accident is essential to secure evidence, identify witnesses and parties, and document the loss location. Our new loss department, in conjunction with our nationwide network of experts, has the resources in place to immediately and effectively respond to new losses. Securing Cooperation Workers compensation subrogation claims can only succeed with the cooperation of the injured worker. Often times injured workers blame themselves for their work related accidents. Most injured workers do not understand the law, and do not think about third party liability. This usually results in injured workers making the choice not to pursue a claim, which in many jurisdictions bars the carrier from recovery. Millions of dollars are left on the table every year when these claims are not pursued. Through our model we take the time to inform injured workers about their rights and any potentially liable third parties. Once workers learn there may be a viable claim, they are eager to pursue the same, thereby opening the door for the recovery of the workers compensation lien. Aggressive Litigation While the vast majority of our cases settle, every case is handled from day one as if it will go to trial. Our team has years of experience litigating complex subrogation matters. Through the careful selection of experts, rigorous cross examination of opposing parties, and the use of technology, we have secured significant settlements on even the most difficult cases. When a matter does proceed to trial we have the experience and technology necessary to efficiently and cost effectively present the best case possible. Eearly Intervention Securing Cooperation Aggresive Litigation

OUR FIRM Forward Thinking Representation What is Forward Thinking Representation? Focusing on the evolving use of technology, alternative means of resolving claims, social responsibility, and exceptional customer service. With these guiding principles in mind J.M. COHEN, LLC is at the forefront of the practice of law. Use of Technology We use the latest technology in handling all aspects of our clients cases, including, maintaining paperless electronic files with offsite backup, e-filing documents in state and federal court, using e-mail as the primary means of correspondence with clients and opposing counsel, using video depositions and video conferencing to reduce travel time and expenses, and presenting cases at arbitration and trial using the latest software to make evidence and testimony easier for jurors to understand. These steps promote optimum efficiency, and most importantly, lead to reduced costs for our clients. Social Responsibility As a member of the broader legal community, our firm is focused on promoting the rule of law, and helping those who are unable to afford legal services. We are involved in all aspects of our community, from performing pro bono work to volunteering with the Advancing Civics Education program through the Philadelphia Bar Association. These relationships are not only good for the community, but good for our clients. Customer Service Above all else, it is our mission to respond to our clients requests immediately and effectively. We are available to our clients 24 hours a day, 7 days a week via our new loss line at (215) 557-4470. Service Area Our firm regularly handles cases in the following states. Alternative Dispute Resolution While we prepare every case as though it will go to trial, there are often more costeffective means of resolving cases. As a standard practice our firm looks at alternative methods of resolving differences between our clients and their adversaries. By finding alternatives to the litigation process we can often save our clients time and money, while still achieving the best possible results.

REPRESENTATIVE CASES Industrial Products Liability Our firm specializes in litigating cases against manufacturers of defective products. While most products on the market are safe, many are designed and manufactured in such a way that even responsible users get hurt. This is especially true with industrial machinery. Industrial accidents tend to be far more serious because of the size and power of industrial machinery and equipment.

Our firm has extensive scientific and technical experience investigating accidents involving machinery and equipment, and we have a nationwide network of experts in multiple disciplines who can immediately respond to an accident scene and perform a thorough investigation. Our extensive knowledge of the safety features, codes, and standards which apply to industrial machinery, often allow us to identify defects that others may miss. Our firm has extensive experience handling cases involving the following equipment: Forklifts Manlifts Presses Conveyors Ladders Scaffolds Shredders Chippers Hoppers HVAC Systems Electrical Equipment Trucking Accidents Trucking accidents cause thousands of work related injuries each year. Large commercial trucks and trailers are far more complicated than passenger vehicles. Their braking systems alone require frequent inspections and adjustment to ensure safe operation. Our firm has significant experience investigating all types of trucking accidents, including brake failures, rollovers, fires, and tire failures. Our firm also has experience in truck cab crashworthiness claims, where the cab structure has collapsed and entrapped the occupants. Maritime Accidents Our firm has substantial experience handling property damage and injury claims arising from the loading and unloading of cargo, stevedoring operations, longshore operations, and the transport of intermodal cargo containers by sea and land. The loading and unloading of modern container ships and bulk freighters can be very dangerous. Cranes, winches, pulleys and other equipment often cause serious injuries such as fractures and amputations. Third party claims, including those against the vessel itself, are often overlooked. Our firm specializes in identifying and pursuing these claims to maximize recovery. Construction Accidents Construction site accidents happen every day, often resulting in catastrophic injuries. Our firm has an in depth understanding of OSHA regulations and accepted workplace safety standards. We can immediately ascertain third party liability, and have significant experience pursuing constructions accident claims, including claims against general contractors.
