THE J.M. COHEN MODEL Millions of dollars are lost every year on workers compensation subrogation claims that are never pursued. We specialize in identifying these files, securing the cooperation of the injured party, and obtaining significant recoveries. Through the use of our time-tested model we have secured over one million dollars in workers compensation subrogation recoveries in the past two years. Our model is focused on three key factors; early intervention and investigation, securing cooperation from injured workers, and aggressive litigation of claims. Early Intervention and Investigation Prompt investigation is the key to successful subrogation recoveries. Immediate action after the first report of an accident is essential to secure evidence, identify witnesses and parties, and document the loss location. Our new loss department, in conjunction with our nationwide network of experts, has the resources in place to immediately and effectively respond to new losses. Securing Cooperation Workers compensation subrogation claims can only succeed with the cooperation of the injured worker. Often times injured workers blame themselves for their work related accidents. Most injured workers do not understand the law, and do not think about third party liability. This usually results in injured workers making the choice not to pursue a claim, which in many jurisdictions bars the carrier from recovery. Millions of dollars are left on the table every year when these claims are not pursued. Through our model we take the time to inform injured workers about their rights and any potentially liable third parties. Once workers learn there may be a viable claim, they are eager to pursue the same, thereby opening the door for the recovery of the workers compensation lien. Aggressive Litigation While the vast majority of our cases settle, every case is handled from day one as if it will go to trial. Our team has years of experience litigating complex subrogation matters. Through the careful selection of experts, rigorous cross examination of opposing parties, and the use of technology, we have secured significant settlements on even the most difficult cases. When a matter does proceed to trial we have the experience and technology necessary to efficiently and cost effectively present the best case possible. Eearly Intervention Securing Cooperation Aggresive Litigation
