RISK MANAGEMENT & COMPLIANCE FRAMEWORK Leverage the Strength and Expertise of Elan As issuer and creditor, Elan retains primary responsibility to comply with federal laws and regulations governing a national banking association as well as requirements set forth by the OCC and CFPB. 1. Elan issues and is the creditor for all credit cards; 2. Elan provides materials, (e.g., marketing and disclosures) which are approved by its legal and compliance staff, to our clients; and 3. Elan provides training to clients to ensure they understand their program responsibilities. We have a comprehensive risk management and compliance framework, thorough policies and procedures, and independent validation processes to mitigate reputation risk. Elan focuses on cardmember service, transparent reporting, and compliant procedures that meet the spirit and expectations of the financial regulators. Regulatory compliance is guaranteed through the Elan Joint Marketing Agreement in addition to the privacy and confidentiality policies put into place to protect cardmembers.
