DISCIPLINARY PROCEEDINGS Time Began: 8:05a.m. EST MOTION FOR FINAL ORDER BY HEARING NOT INVOLVING DISPUTED ISSUES OF MATERIAL FACT Tab 1 Stephen Burleson, PT23208 (PCP Petraglia, Bumgarner, Hughes) Dr. Petraglia was recused due to participation in the Probable Cause Panel. Ms. Sykes summarized the case for the Board. Respondent was charged with the following violations: Count I: Section 486.125(1)(b), 486.125(1)(k), 456.072(1)(h) and 456.072(1)(m), Florida Statutes (2005-2007) by obtaining a physical therapist license by fraudulent misrepresentation when Respondent answered no to the criminal history question on each application and/or failed to update applications when the applications were pending before the Department, when Respondent knew prior to submitting the applications for licensure and/or while the applications were pending for licensure that he had entered a plea of nolo contendere on December 6, 2005 to Driving Under the Influence. Count II: Section 486.125(1)(k) and 456.072(1)(z), Florida Statutes (2005-2007) by failing to notify the Board and Department of his pleas of nolo contendere to Driving Under the Influence on December 6, 2005 and Domestic Battery on May 23, 2008. MOTION: Mr. Lohr made a motion to find that the Respondent was properly served and has requested an informal hearing. The motion was seconded by Dr. Quillen and carried 4/0. MOTION: Mr. Lohr made a motion to adopt the findings of fact as set forth in the Administrative Complaint. The motion was seconded by Dr. Quillen and carried 4/0. MOTION: Mr. Lohr made a motion to adopt the conclusions of law as set forth in the Administrative Complaint and find that this constitutes a violation of the Chapters 486 and 456, Florida Statutes. The motion was seconded by Dr. Quillen and carried 4/0. MOTION: After discussion, Mr. Lohr made a motion to impose the following penalties: Reprimand. Fine of $1,500.00 within thirty (30) days. Suspension until Respondent obtains a PRN evaluation and PRN deems that he is safe to practice. In the event that PRN recommends a monitoring contract, Respondent is required to comply with those recommendations. Successful passage of the Laws and Rules exam within 180 days. The motion was seconded by Dr. Quillen and carried 4/0. MOTION: Mr. Lohr made a motion to access the costs of $898.46 to be paid within 30 days. MOTION FOR VOLUNTARY RELINQUISHMENT Tab 2 Rodney Ferrell, PTA21511 Case No. 2013-02964 (PCP Waived) Respondent was not present nor represented by legal counsel. Ms. Sykes summarized the case for the Board. Respondent was charged with the following violation: Section 486.125(1)(a)1(k), Florida Statutes, by being unable to practice physical therapy with reasonable skill and safety by reason of illness, or being terminated from a treatment program for impaired practitioners. MOTION: Dr. Petraglia made a motion to accept the Voluntary Relinquishment. The motion was seconded by Mr. Lohr and carried 5/0. Time Ended: 8:23a.m. Time Began: 8:23a.m. REQUEST FOR FORMAL MONITOR APPROVAL Tab 3 Matthew Williams, PTA21230 Respondent was not present. Diane Brawner was not present. Case No. 2012-04655: An Administrative Complaint (AC) was filed on October 16, 2012 against Mr. Williams for falsifying patient records and billing notes. Ms. Sykes summarized the case for the Board which consisted of 2 counts. COUNT I: Respondent violated Section 486.125(1)(b), Florida Statutes (2011) by committing fraud in the practice of physical therapy. COUNT II: Respondent violated Section 486.125(1)(k) and 456.072(1)(a), Florida Statutes (2011) by making misleading, deceptive, or fraudulent representations in the practice of physical therapy. Mr. Williams and the Department entered into a Settlement Agreement which required: Reprimand Appearance at the meeting which the Settlement Agreement is considered and the first meeting of Respondent s probationary period along with the proposed monitor Costs in the amount of $1,645.00 to be paid within 5 years of the Final Order date with a minimum amount of $329.00 due each year. $10,000.00 fine to be paid within 5 years of the Final Order date. Apply and register for the Florida Laws and Rules Exam within 90 days and obtain a passing score within 2 years of the Final Order date. Probation for a period of 2 years with indirect supervision by a Board approved monitor. Quarterly reports including: o Statement as to why the Respondent is on probation. o Description of practice location o Description of current practice o Statement of compliance o Relationship with monitor o Advising the Board of any problems o Addressing compliance with any restrictions or requirements imposed by Board Mr. Williams received temporary approval of his proposed monitor, Diane Brawner, from the Board Chair on February 22, 2013. Dr. Petraglia discussed her concerns with the request as the Settlement Agreement signed by the Respondent requires an appearance by both the Respondent and the proposed monitor. Dr. Petraglia was concerned with moving forward as neither party was present. MOTION: Due to the Respondent and Monitor s non-appearance at the required meeting, Dr. Petraglia made a motion to deny Ms. Diane Brawner, PT19432, as Mr. Williams monitor. The denial is based upon complying with Board Order and concerns with knowing her responsibilities. Mr. Williams shall cease practice immediately as the temporary approval of his monitor is void per the terms of his Settlement Agreement. The motion was seconded by Dr. Tasso and carried 5/0. This item was continued from the February 2013 board meeting. Mr. Hernandez De Armas has filed a petition for waiver of Rule 64B17-3.001, F.A.C. He is requesting a waiver from the education requirement(s) in regards to the deficiencies on his FCCPT evaluation in general and professional education. Based on his date of graduation, he is lacking 8.14 credits in general education and required course content. Per prior board approval, FCCPT evaluated Mr. Hernandez De Armas education on the documents submitted by him. Mr. Hernandez De Armas has submitted a written request to withdraw his application. Tab 6 Petronella Dorothea Van Der Merwe, PT by Endorsement Rule 64B17-3.003, FAC Ms. Van Der Merwe was present and sworn in by the court reporter. Ms. Van Der Merwe filed a petition for waiver of Rule 64B17-3.003, F.A.C. She is requesting a waiver from the education requirement(s) in regards to the deficiencies on her FCCPT evaluation. Based on her date of graduation, she is pending 9 hours of general education, including 1 course in Humanities, 1 course in Social Sciences and 1 course in Math. Ms. Van Der Merwe submitted an applicant copy of an evaluation completed by IERF in September, 2011. This evaluation states her education is equivalent to a U.S. Bachelor degree in Physical Therapy however the evaluation does not use the FSBPT Course Work Tool (CWT) which is required by Rule 64B17-3.001(3)(1)(c). Ms. Van Der Merwe was originally licensed in Florida on November 15, 1994. Her license became Null & Void on January 31, 1999 with no discipline history. At the time of her initial licensure, Florida did not require the use of the FSBPT CWT. MOTION: After discussion, Dr. Petraglia made a motion to grant the Petition for Variance or Waiver of Rule 64B17-3.003. The application for licensure is approved and she is certified to sit for the Florida Laws and Rules Exam. Upon a passing score on the exam shall be licensed. She is requesting a waiver from the education requirement(s) in regards to the deficiencies on her FCCPT evaluation in general education. Based on her date of graduation, she is lacking 9 hours of general education and the following course content: General Education Chemistry II with lab Physics I with lab Physics II with lab Biological Sciences In regards to her criminal history, Ms. Coltman was convicted of Obtaining Financial Advantage in September 2009 by the National Police of Australia. She was sentenced to pay restitution, fines and 2 years of good behavior. Due to difficulties obtaining a visa, Ms. Coltman is unable to enter the country until September, 2013. She has submitted a request to have the board rule on her petition and application in her absence. The Board discussed their concerns regarding the lack of evidence for the pending educational requirements. MOTION: After discussion, Dr. Petraglia made a motion to deny the petition. The motion was seconded by Dr. Quillen and carried 5/0. MOTION: Dr. Petraglia made a motion to deny the application for licensure as the applicant has not satisfied the requirements set forth in Rule 64B17-3.001. The motion was seconded by Mr. Lohr and carried 5/0. Tab 8 Hiren Patel, PT by Endorsement Rule 64B17-3.003, FAC Mr. Patel was present and sworn in by the court reporter. Mr. Patel has filed a petition for waiver of Rule 64B17-3.003, F.A.C. He is requesting a waiver from the education requirement(s) in regards to the deficiencies on his FCCPT evaluation in general education. Based on his date of graduation, he is lacking 24 hours of general education however all of the required content areas have been met. MOTION: After discussion, Mr. Lohr made a motion to deny the Petition for Variance or Waiver of Rule 64B17-3.003. The motion was seconded by Dr. Petraglia and carried 5/0. The application for licensure is approved and he is certified to sit for the Florida Laws and Rules Exam. Upon a passing score on the exam shall be licensed. Based on his date of graduation, he meets the credit requirements in professional education. He is lacking the following course content: Professional Education Related Professional Coursework Consultation, Screening and Delegation. MOTION: After discussion, Mr. Lohr made a motion to grant the Petition for Variance or Waiver of Rule 64B17-3.001 as the petitioner has proven substantial hardship in that the pending course was not offered during his PT program. The Board also feels that the Florida Laws and Rules Exam will capture a competence in the pending course. Mr. Jahns was asked to appear to discuss his criminal history. The board office received an anonymous tip from the public in regards to additional criminal history for Mr. Jahns. Board staff conducted a web search and found supporting documentation via public websites for arrests not disclosed on his application. Dr. Petraglia addressed this with Mr. Jahns. Ms. Clark asked Mr. Jahns how many DUI convictions he s received to which Mr. Jahns stated three. MOTION: After discussion, Mr. Lohr made a motion to approve the application for licensure and authorize Mr. Jahns to sit for the Florida Laws and Rules Exam. Upon successful completion of a PRN evaluation and compliance with their recommendation, licensure is granted. Applicant has 30 days to contact PRN, 90 days to schedule an evaluation and 120 days to comply or licensure is denied. Board staff is delegated to approve licensure once all terms are completed. Tab 22 CE@Renewal Presentation Ms. Garnet Nevels, Operations and Management Consultant, spoke on behalf of the Department of Health regarding the new renewal process and verifying continuing education at renewal. This includes modifications to the renewal system that will check the licensees continuing education at the beginning of the renewal process and if continuing education is not yet complete, it will navigate to screens that will allow the licensee to report continuing education before proceeding with renewal. To review the new approach visit: www.ceatrenewal.com. Tab 23 FSBPT Continuing Competence Heidi Herbst-Paakkonen and Susan Layton, FSBPT, addressed the Board. They discussed the FSBPT continuing competence initiative and provided an overview of FSBPT continuing competence tools and services. Time Ended: 11:55a.m. Break 11:55a.m. Reconvene: 12:07p.m. Time Began: 12:07p.m. RULE REVIEW Tab 24 Rule 64B17-8.001 Requirement for Instruction on Human Immunodeficiency Virus and Acquired Immune Deficiency Syndrome Dr. Petraglia discussed Rule 64B17-8.001 and possible revisions. 64B17-8.001 Requirement for Instruction on Human Immunodeficiency Virus and Acquired Immune Deficiency Syndrome. (1) To receive Board approval for biennial renewal, courses on HIV/AIDS shall be one hour and include the following subject areas: (a) Modes of transmission; (b) Infection control procedures; (c) Clinical management; (d) Prevention; (e) Florida law on AIDS and the impact on testing, confidentiality, and treatment. A home study course shall be permitted to fulfill this aspect of the HIV/AIDS education. (2) Each licensee must complete at least one clock hour on HIV/AIDS education no later than upon the licensee s first renewal of licensure. The Board shall accept coursework from schools of physical therapy, provided such coursework was completed no more than five (5) years preceding initial licensure date. (3) Courses approved by any Board within the Division of Medical Quality Assurance of the Department of Health pursuant to Section 456.033, Florida Statutes, are approved by this Board. The Board suggested switching subsections 1 & 2, to provide further clarification in regard to HIV/AIDS being required for the licensee s first renewal; completion of HIV/AIDS for subsequent renewals is optional. Ms. Sapp explained that the Board does not have authority to change the legal requirements of the temporary permit law, however the Board may use discretion when approving monitors for licensees in future disciplinary cases. Dr. Petraglia and Dr. Quillen addressed concerns in regards to holding Board meetings on one day and stated the Board preference is to hold quarterly face to face meetings on 2 days as the Board has done in the past. Tab 27 Executive Director Report Cash Balance Report Board Expenditures Legislative Update Allen Hall discussed HB 413 and SB 536 with the Board. The bills amend Section 486.021(11), Florida Statues, authorizing physical therapists to implement physical therapy treatment plans which are provided by advanced registered nurse practitioners. Mr. Hall informed the Board of HB 1071 which would no longer require CAPTE accreditation for PTA graduates. The board addressed several concerns with the bill and the impact this would have on the physical therapy profession and workforce. Dr. Quillen volunteered to draft an opinion on behalf of Board. Ms. Ellen O Bannan, FPTA, informed the board of their campaign to education the legislature and governor. MOTION: Mr. Lohr made a motion that the Board of PT opposes the amendment, a suggestion for Governor Scott to veto HB 1071 and appointed Dr. Quillen to draft opinion to be submitted to the Legislative Planning office. The motion was seconded by Dr. Petraglia and carried 5/0. NEW BUSINESS Tab 30 FSBPT Annual Meeting Delegates This year, the FSBPT will fund three people from each board to the Annual Meeting in San Antonio, Texas on October 10-12, 2013: One voting delegate, one alternate delegate and one Administrator. The FSBPT Delegate Assembly consists of Delegates elected by its member boards. Each member board is entitled to one Delegate. Each Delegate shall have the right to attend, speak, make motions, nominate, and vote. No Federation officer or director may serve as a Delegate. The Alternate Delegate is elected by the member board to be its representative to the Delegate Assembly in the event that the Delegate cannot or does not attend the meeting. Requirements for Designating Voting and Alternate Delegates The member board must elect its Voting and Alternate Delegates. Voting and Alternate Delegates can be members or administrators of the member board. Credentials for Delegates shall include demographic data, verification of election from the member board and a disclaimer relevant to potential conflict of interest. Currently, staff manually develops an Excel spreadsheet containing all applications approved in the prior quarter. This is done by compiling 24 weekly spreadsheets from four team members. To improve efficiency, staff requested the Board approve the use of a current database report that generates all licenses issued within the specified timeframe. The difference is the proposed report will be one report, opposed to four, that combines all licensees: PT, PTA, Exam, Endorsement, CAPTE trained, and foreign trained. This list will only contain licenses issued, opposed to applications that were approved. MOTION: After discussion, Dr. Quillen made a motion to approve the proposed ratification changes. OLD BUSINESS Tab 35 Therapy Exam Prep, Request for Reconsideration MOTION: Mr. Lohr made a motion to reconsider the request for remedial course approval. The motion was seconded by Dr. Tasso and carried 5/0. An applicant had requested the Board to approve a 3 month webinar program, Therapy Exam Prep (TEP), for remedial purposes at the September 2012 conference call. After review and discussion, the Board voted to deny the course as the provider does not require full participation from the applicant and the course does not focus on the content of the NPTE, but test taking skills in general. Board staff was contacted by the provider for TEP, Miye Fonseca, who requested reconsideration of the course for approval. Ms. Fonseca was present to give an overview of TEP. After discussion, the consensus of the Board is that TEP is not an academic review but an exam prep course. The preparer of the course also lacks an educational/teaching background. MOTION: After discussion, Mr. Lohr made a motion to deny Therapy Exam Prep as an acceptable remedial course for applicants who have failed the NPTE three (3) times. TEP is not an academic course and does not include proper diagnostics. The motion was seconded by Dr. Tasso and carried 5/0.
