Maxwell, Administrative Director for the Social Work Licensure Board Ms. Housteau called the meeting to order at 9:05 a.m. A quorum was present. Agreed Order Upon review of the Agreed Order to the Board for Lea LaFluer, L.M.S.W., Mr. Pharris made a motion, seconded by Ms. Gasser, to accept the order as written. The motion carried. Minutes Ms. Horton made a motion, seconded by Mr. Pharris, to approve the February 25, 2010 minutes as amended. The motion carried.

Ms. DeMott made a motion, seconded by Ms. Gasser, to approve the April 15, 2010 minutes as amended. The motion carried. Office of General Counsel Ms. Appelt said Ms. LaFleur accepted an Agreed Order agreeing to the denial of her LCSW application. She will submit a new application upon completion of the two year supervision requirement. The rules have been signed by the Secretary of State and will become effective July 29, 2010. The emergency rules will expire August 1, 2010. There are four new complaints in Investigations and a review is scheduled for June 15, 2010. Agreed Citations Ms. Horton made a motion, seconded by Ms. Axley, to approve the following Agreed Citations: Marvin Ginn, Jr. - Failure to obtain continuing education hours. Melody Miller - Failure to obtain continuing education hours. Shanika Moore - Failure to obtain continuing education hours. Lana Norton - Failure to obtain continuing education hours. Meguel Wade - Failure to obtain continuing education hours. Rebekah Wilson - Failure to obtain continuing education hours. Sarajane Watrous - Failure to renew; working on a lapsed license. The motion carried. Administrative Report There are currently 51 active licensed baccalaureate social workers, 2133 active licensed master social workers, 11 active licensed advanced practice social workers and 2048 active licensed clinical social workers. Between January 2009 through December 2009, 34 LMSW s were audited and 25 were compliant, 48 LCSW s were audited and 38 were compliant. Licensure Levels The Board interpreted Rule 1365-01-.04(a)(7) for the LAPSW applying for LCSW. It was determined that, after the grandfather period, the applicant must submit proof that he or she has worked for not less than 2 years as a licensed master s social worker or temporarily licensed master s social worker under the supervision of a licensed clinical social worker.

Continuing Education The Board discussed continuing education requirements and was given information by Ms. Miller regarding the ACE program through the ASWB which approves continuing education courses for licensees at no cost to members Boards. The consensus of the board was that requiring all courses to be ACE approved would be particularly difficult in rural areas where programs are less available. The Board discussed the fact that Tennessee will require the master s level ASWB National examination beginning January 1, 2011. Alison Cleaves, Chief Deputy Counsel to discuss unpaid student loans Ms. Cleaves discussed T.C.A. 63-1-141 that allows Boards to suspend licensees of practitioners who default on student loans and asked the board for the authority to approve the implementation of the law by Board staff upon notification from TSAC. Ms. DeMott made a motion, seconded by Mr. Pharris, to give authority to implement this law. The motion carried. Other Business The Board expressed concerns about out-of-state applicants applying for licensure in Tennessee who work in another state and do not plan on working in Tennessee. The Board is also concerned about out-of-state persons with a Tennessee license who are disciplined or discharged by their employers. Ms. Appelt said if a Tennessee licensed practitioner is disciplined in another state the Board has the authority to discipline that practitioner. The Board discussed a change to the statute to address the residency requirement. The Board interpreted Rule 1365-01-.03(3) to require no less than one hour of face to face supervision for every 30 hours for a total of 100 hours of face to face supervision for 3,000 hours of supervision. Financial Report For Fiscal Year 2009 the Board had expenditures totaling $224,658.08, revenue totaling $289,568.68 and net of $64,910.60. The financial report is attached hereto (Attachment #1). Newly Licensed Ms. Horton made a motion, seconded by Ms. DeMott, to approve the list of Licensed Baccalaureate Social Workers which is attached to the minutes. Ms. Axley recused herself. The motion carried. (Attachment # 2) Ms. Horton made a motion, seconded by Reverend Dr. Gray, to approve the list of Licensed Master Social Workers which is attached to the minutes. The motion carried. (Attachment #3)

Ms. Horton made a motion, seconded by Reverend Dr. Gray, to approve the list of Licensed Advanced Practice Social Workers which is attached to the minutes. Ms. DeMott recused herself. The motion carried. (Attachment # 4) Ms. Horton made a motion, seconded by Ms. DeMott, to approve the list of Licensed Clinical Social Workers which is attached to the minutes. The motion carried. (Attachment # 5) Ms. DeMott made a motion, seconded by Reverend Dr. Gray to approve the following reinstated Licensed Master Social Workers: Renesa Clemons Susan Elswick Mackaria Williams-Lovett The motion carried. Ms. Williams made a motion, seconded by Reverend Dr. Gray, to approve the following reinstated Licensed Clinical Social Worker: Jane Murphy The motion carried. Correspondence The Board reviewed a memorandum from ASWB with the 2009 examination results. (Attachment #6) The Board reviewed a letter from Leonard Porter, LMSW, requesting a waiver of his 2010 continuing education. Ms. Axley made a motion, seconded by Reverend Dr. Gray, to grant Mr. Porter s request. The motion carried. The Board reviewed a letter from Kimberly Metcalf, LCCSW, requesting a waiver of her 2009 continuing education. Mr. Pharris made a motion, seconded by Ms. Horton, to deny Ms. Metcalf s request. The motion carried. The Board reviewed a letter from Corliss Lawler, LCSW, requesting that the Board accept a transcript of college courses in 2007/2008 for continuing education credit. Ms. DeMott made a motion, seconded by Ms. Horton, to accept the college courses and to require Ms. Lawler to obtain three hours of ethics by December 31, 2010, in addition to the required continuing education hours for 2010. The motion carried.

Application Review Ms. Axley made a motion, seconded by Ms. Horton, to deny the LBSW application for Robin Pilcher as she did not obtain her baccalaureate degree from a Council on Social Worker Education Accredited Program. The motion carried. Ms. Gasser made a motion, seconded by Reverend Dr. Gray, to approve the LMSW application for Elijah Askin. The motion carried. Ms. Williams made a motion, seconded by Ms. Axley, to defer action on the LMSW application for Qiana Jones and request that she attend the next meeting to discuss whether she is selfemployed. The motion carried. Ms. Axley made a motion, seconded by Reverend Dr. Gray, to deny the LAPSW application for Cehondra Jones as she does not have three years of post-masters experience. The motion carried. Ms. DeMott made a motion, seconded by Reverend Dr. Gray, to approve the LAPSW application for Erica Extrom. The motion carried. Mr. Pharris made a motion, seconded by Ms. Horton, to deny the LCSW application for Shelton Baise as he does not have a degree in social work. The motion carried. Ms. DeMott made a motion, seconded by Ms. Axley, to deny the LCSW application for Melissa Cupp as she does not have the required number of supervised hours. The motion carried. Mr. Pharris made a motion, seconded by Ms. DeMott, to approve the LCSW application for Sharon Hibbert. The motion carried. Mr. Pharris made a motion, seconded by Ms. Gasser, to deny the LMSW application for Megan Mitchell as she did not work for not less than two years as a licensed master s social worker, or a temporarily licensed social worker, under the supervision of a licensed clinical social worker. The motion carried. Ms. Williams made a motion, seconded by Mr. Pharris, to deny the LMSW application for William Bradshaw as he did not work for not less than two years as a licensed master s social worker, or a temporarily licensed social worker, under the supervision of a licensed clinical social worker. The motion carried. Ms. DeMott made a motion, seconded by Reverend Dr. Gray, to approve the LAPSW application for Fara Ayo. The motion carried.

May 21, 2010 BOARD MEMBERS PRESENT: Teresa Housteau, LCSW Amy Gasser, BSW Steve Pharris, LMSW Michelle Horton, LMSW Sheryl DeMott, LMSW Reverend Gray, Citizen Member Vicki Williams, MSW Julia Axley, LBSW Investigative Report There are two (2) complaints against LCSW s and two (2) against CMSW s. Disciplinary Report There are currently seven (7) practitioners being monitored. One (1) practitioner is on probation, four (4) are revoked, one (1) is reprimanded and one (1) is for unlicensed practice. Applicant Interviews Jennifer Moore, LMSW applicant, appeared for an interview. Reverend Dr. Gray made a motion, seconded by Ms. DeMott, to approve Ms. Moore for licensure. The motion carried. Kenneth Johnson, LMSW applicant, appeared for an interview. Ms. Horton made a motion, seconded by Reverend Dr. Gray, to approve Mr. Johnson for licensure. The motion carried. Kevin King, LMSW applicant, appeared for an interview. Reverend Dr. Gray made a motion, seconded by Ms. Gasser, to approve Mr. King for licensure. The motion carried. Jesse Snyder, LMSW applicant, appeared for an interview. Ms. DeMott made a motion, seconded by Reverend Dr. Gray, to defer actions on Mr. Snyder s application pending receipt of a letter from Mr. Snyder s physician stating that his medical condition does not pose a threat to the health and safety of his clients. Mr. Pharris made a motion, seconded by Reverend Gray, to have Mr. Snyder submit the results of a mental health assessment. The motion carried. Mr. Pharris made a motion, seconded by Ms. Axley, to have Mr. Snyder submit letters from past employers as to his job performance. The motion carried. Bonnie Chapman, LCSW applicant, appeared for an interview. Ms. DeMott made a motion, seconded by Reverend Dr. Gray, to approve Ms. Chapman for licensure. The motion carried. Arnette Phipps, LMSW applicant, appeared for an interview. Mr. Pharris made a motion, seconded by Reverend Dr. Gray, to approve Mr. Phipps for licensure. The motion carried.

LMSW applicant Gabriel Puente did not attend the meeting, Mr. Pharris made a motion, seconded by Reverend Dr. Gray, to approve Mr. Puente for licensure. The motion carried. Ms. Horton made a motion, seconded by Ms. Axley, to defer action on the LCSW reinstatement application for Mary Pearson and to ask her to appear before the Board at the August 5, 2010 meeting to discuss her license being disciplined in Nevada and California. The motion carried. Mr. Pharris made a motion, seconded by Ms. Horton, to waive the 2009 continuing education hours for Kimberly Metcalf as she has only been living in Tennessee since October 2009 and practiced in another state on a temporary license. Continuing education was not required for a temporary license. The motion carried. With no other Board business to conduct, Ms. DeMott made a motion, seconded by Ms. Axley, to adjourn at 11:05 a.m. The motion carried. Adopted by the Board of Social Worker Licensure on this the 5th day of August 2010
