Minutes Dr. Matlock made a motion, seconded by Ms. Philpot, to approve the February 15, 2011 minutes as amended. The motion carried. Dr. Matlock made a motion, seconded by Ms. Philpot, to approve the March 15, 2011 teleconference minutes. The motion carried. Discuss Scope of Practice for Audiologists Dr. Schumeier stated he is an audiologist working with three hundred (300) industrial companies for hearing conservation, manufactures hearing aids and has a large private practice. Dr. Schumeier asked the Board to re-visit the November 2009 minutes in which industrial audiologists, standard threshold shifts and the OSHA 300 law. Many companies are required to

2 perform annual audiometric tests on their employees. If an employee has a standard threshold shift that exceeds 25 db hearing levels the company can re-test that person to see if it is persistent. If it is persistent they can have an evaluation by an audiologist to make a determination if that standard threshold shift is noise related. Insurance rates depend on the number of employees on the OSHA 300 log. In the minutes of the November 2009 meeting, Dr. Dickinson stated that audiologists licensed in Tennessee could determine if there is a hearing loss but not the cause of the loss. TOSHA put that information in their newsletter. Dr. Schumeier stated he started getting calls from clients asking why audiologists can no longer make that determination. Upon discussion, Dr. Ashford made a motion, seconded Ms. Philpot, to ask Mr. Sims to send a letter to TOSHA indicating that utilizing the verbiage from the OSHA letter that Mr. Sims read that industrial audiologists are in compliance with state law, state regulations and with the Board s scope of practice and falls within the OSHA regulations and policies and this has not changed contrary to previous correspondence with the Board. OGC Report There are no open cases in OGC for the CDS Board. There is currently a moratorium on rulemaking in place and there is no legislation to be reported. Investigative Report There are seven (7) open complaints against speech pathologists and four (4) against audiologists. Monitored Practitioners Investigations is currently monitoring three (3) practitioners and one (1) unlicensed person. Financial Report As of March 31, 2011, the Board has direct expenditures of $37, and revenue collections of $91, As of March 31, 2011 the HIS Council has direct expenditures of -$ and revenue collections of $40,920. Administrative Report There are 349 licensed audiologists, 1867 speech pathologists and 51 speech language pathology assistants. Newly Licensed SPEECH

The motion carried. Review Applications Dr. Philpot made a motion, seconded by Dr. Mauldin, to approve the audiology application for Danielle Caperton. The motion carried. Agreed Citations Ms. Philpot made a motion, seconded by Dr. Mauldin, to approve the agreed citation for Ashley Perry, speech pathologists, for failure to timely renew her license. The motion carried. Dr. Matlock made a motion, seconded by Dr. Ashford, to approve the agreed citation for Terri Philpot, speech pathologist, for failure to maintain sufficient continuing credits in Ms. Philpot recused herself. The motion carried. Dr. Matlock made a motion, seconded by Dr. Ashford, to approve the agreed citation for Tori Carraway, speech pathologist, for failure to timely renew her license. The motion carried. Correspondence Keith Page, speech pathologists, submitted a letter to the Board asking if a M.S. CCC-SLP needs a referral to treat a client without a signed doctor s order. The Board determined that the facility where the patient is seen may require a doctor s referral or order but the Board s scope of practice does not require a referral or a doctor s order. Lance Adam Pate, speech pathologist, submitted a letter to the Board stating he failed to obtain the required 2010 continuing education hours and requesting that he be allowed to make up the hours in Dr. Matlock made a motion, seconded by Dr. Mauldin, to grant Mr. Pate s

5 request and give him until the end of 2011 to make up the hours for 2010 and The motion carried. The Board reviewed a letter from Ellen Fagan, Ed, CCC-SLP, from the American Speech Language Hearing Association regarding ASHA continuing education. Christine Zajonc, audiologist, submitted a letter requesting that the Board approve the one (1) hour of continuing education she obtained online and the nine (9) classroom hours she obtained for Ms. Philpot made a motion, seconded by Dr. Matlock, to approve the one (1) online hour and the nine (9) classroom hours. The motion carried. Discuss Telepractice Ms. Harmon stated the committee had one meeting and one teleconference since the last Board meeting regarding telepractice and reviewed other state licensure board s telepractice provisions. Ms. Harmon stated that Texas has detailed guidelines, equipment, limitations and requirements for telepractice. Dr. Ashford stated there is a national organization that proposed model legislation for state and he will obtain that information for the next meeting. Discuss Endoscopic Evaluations Ms. Tarr stated that a modifier can be placed on the licenses of those who have met the requirements to conduct endoscopic evaluations. Dr. Ashford stated that the statute requires speech language pathologists who use rigid and flexible endoscopes obtain written verification from a board certified otolaryngologist that the speech language pathologist is competent in the proper and safe use of an endoscope. The otolaryngologist s determination of competency shall be based on the speech language pathologist s training in the proper use of endoscopes, the successful completion of a university course or other educational program of at least fifteen (15) hours on endoscopy and the successful performance of at least twenty-five (25) endoscopic procedures under the supervision of an otolaryngologist or another speech language pathologist who has successfully performed at least fifty (50) endoscopic procedures and has been approved in writing by a board certified otolaryngologist to provide that supervision. The speech language pathologist shall maintain this written verification on file at all times at the primary practice location of the speech language pathologist. Ms. Harmon asked Dr. Ashford to work with Ms. Tarr to provide a checklist for speech language pathologists who are qualified to perform endoscopic procedures. Dr. Ashford made a motion, seconded by Dr. Mauldin, to create a modifier that will designate speech language pathologists as certified to perform endoscopies in the State of Tennessee. The motion carried.

6 Dr. Mauldin made a motion, seconded by Dr. Ashford, to interpret T.C.A (5)(B)(iv)(a)(b) to prohibit the practice of endoscopy in a home health environment. The motion carried. The Board also requested that a policy statement be prepared regarding the Board s interpretation of this statute. Ms. Tarr asked the Board to appoint a Board member to review application files with issues such as coursework, criminal background checks, etc., to determine whether a temporary license can be issued or must be reviewed by the Board at the next meeting. Ms. Philpot made a motion, seconded by Dr. Mauldin, to appoint Dr. Ashford to review applications. The motion carried. With no other Board business to conduct, Dr. Mauldin made a motion, seconded by Dr. Ashford, to adjourn at 12:30 p.m. The motion carried.
