The personal records database: for the authorities and for you The Municipal Personal Records Database Everyone m ust notify the m unicipality of a birth,change of address or death. However,what do the authorities actually do with the personal details of the country s citizens? This brochure explains which personal details are stored in the m unicipal personal records databases and what they are used for.w e also list your rights and obligations.in addition,we explain the procedure to be followed when you com e from abroad and intend to stay in the Netherlands for a longer period of tim e. W hyis the Municipal Personal Records Database im portant? The authorities need correct inform ation about the country s citizens,for exam ple when issuing a passport,identity card or driving licence,determ ining who m ay vote in an election,paying social benefits and collecting m unicipal taxes.however,the records are also used by others: organisations such as the Netherlands Taxand Custom Adm inistration, benefits agencies and pension funds also use your personal details to tailor their decisions closely to your situation. W hich personal details are stored in the records? In the Netherlands your personal details are collected in the M unicipal Personal Records Database,abbreviated to the GBA.The database contains personal files for everyone who lives or has lived in the Netherlands.The file contains inform ation including: your fam ily nam e,first nam es,date of birth,place of birth and country of birth; your address; your citizen service num ber; details about your parents; details about your nationality (and,where relevant,your residence perm it); details about your m arriage or registered partnership; details about your children; details about travel docum ents issued to you; details about your right to vote; details about the organisations that m ay receive your personal data. 3

How do the authorities obtain these personal details? You are required to supply som e inform ation,for exam ple on changing address,the birth of a child,m arrying abroad or on the death of a m em ber of your fam ily.however,som e personal details are autom atically added to or changed in the GBA: for exam ple,on your m arriage in the Netherlands the registrar of births,m arriages and deaths will inform the GBA accordingly. Everyone is assigned a unique citizen num ber Your citizen service num ber (BSN)is your personal num ber for contacts with the authorities. This unique num ber helps,for exam ple,to avoid cases of m istaken identity. Everyone registering with a m unicipality for the first tim e is assigned a BSN. Newly-born children are also assigned a BSN on the registration of their birth. Your BSN is stated on your passport,driving licence and identity card. The BSN offers you and the authorities benefits: it sim plifies your contacts with the m unicipality and other governm ent agencies and organisations. On beginning em ploym ent you give your BSN to your em ployer.your em ployer can then com plete a num ber of form alities with,for exam ple,the Netherlands Taxand Custom Adm inistration and your pension fund.the healthcare sector also uses the BSN,and you m ay be asked for your BSN by your general practitioner,hospital,pharm acy or hom ecare provider. Your privacyis guarded carefully The GBA contains personal details that are not m ade available to the public.the authorities look a er your privacy carefully and use your personal details only when the authorities need them to carry out their duties in the appropriate m anner.your personal details are used for other purposes only when you have not objected to their use and,in som e instances,only once you have given perm ission. Your rights W hat are your rights? Everyone registering with the GBA for the first tim e receives a copy of their record. This is issued without charge.you also receive a free copy when you m ove back to the Netherlands a er a period abroad. You are always entitled to inspect your personal details in the GBA.This is free of charge. M ost m unicipalities charge a fee for a copy of your record. You are entitled to use the surnam e of your current or form er spouse or registered 4

partner.this is referred to as the chosen nam e.the GBA issues notification of the chosen nam e to governm ent agencies such as the Netherlands Taxand Custom Adm inistration, pension funds,district water board and the Departm ent of Road Transport (RDW ).Your own surnam e continues to be used on your passport,identity card and driving licence. You can request the m unicipality to correct or supplem ent any personal details that are incorrect or incom plete.the m unicipality will then ask you to furnish the relevant proof. You can ask the m unicipality not to supply your personal details to certain institutions. M ore inform ation is available from your m unicipality. You can ask your m unicipality for a list of the institutions that have received your personal details during the past year.you will receive this list other than in situations in which national security or a crim inal offence play a role.the m unicipality can charge a fee for this list. Adoptive parents can request the deletion of the form er nam e of the child and the personal details of the natural parents in their adopted child s personal file. The natural parents of the adopted child can request the deletion of the personal details of the adopted child in their personal file. Persons who have changed their sexcan request the deletion of their earlier first nam e(s), gender and chosen nam e from their personal file. Your obligations W hat are your obligations as a m em ber ofthe public? You m ust always be able to prove your identity by showing a valid ID. If you m ove to the Netherlands from abroad you m ust notify the m unicipality where you will be staying within 5days of your arrival. If you m ove within the Netherlands you m ust notify your change of address to the m unicipality to which you have m oved within 5days of m oving. If you are staying abroad for a longer tim e m ore than 8 m onths you m ust notify the m unicipality where you live within 5days of the day of your departure. W hen so requested by the m unicipality in which you live you are under the obligation to provide further inform ation about the personal details you supplied that are registered in the GBA. You m ust notify the m unicipality of any changes to your personal details during a stay abroad (such as your m arriage or the birth of your child)on your return to the Netherlands.M ake sure that you can show the original docum ents. 5

W hen you arrive from abroad and wish to stayin the Netherlands Have you com e from abroad,and do you intend to stay in the Netherlands for longer than four m onths? If so,you m ust inform the m unicipality of your stay and your address within 5 days of your arrival in the Netherlands.However,your residence in the Netherlands m ust be legal: for exam ple,you are a Dutch national or a national of one of the European Union s m em ber states. You will not be registered in the GBA following instances: W hen you do not have a valid residence perm it for the Netherlands you will first need to apply a residence perm it from an aliens desk (IND desk).m ore inform ation is available at www.ind.nl. W hen you have applied for asylum and are staying at an asylum seekers centre or a reception centre then the centre will register your stay in the Netherlands for the first sixm onths. However,a er this period or on leaving the centre you m ust register with the GBA in the m unicipality where you will be staying. If you have lived in the Netherlands Antilles or on Aruba you will need to prove that you have had your personal file deleted there.this is necessary to avoid the duplication of records within the Kingdom of the Netherlands. Do you also wish to have your partner and/or children registered in the GBA?If so,theywill need to accom panyyou to the town hall. W hen you com e to register you m ust bring original docum ents with you to prove your identity,civil status and address in the Netherlands as well as,of course,your passport(s) and,where relevant,proof of your legal residence in the Netherlands.In addition,you should also bring birth certificates (yours,and of your children),m arriage certificates (including those of earlier m arriages)and the tenancy or purchase agreem ent for your hom e in the Netherlands. Objections If you think that your personal details are not recorded correctly in the GBA then you can ask your m unicipality for m ore inform ation.your m unicipality can explain why certain personal details are or are not included in your personal file.if necessary,you can ask the m unicipality to m ake additions to or correct the personal details in your personal file. Do you disagree with the m unicipality s decision on your request for the correction,addition or deletion of specific personal details? If so,you can lodge a wri en notice of objection with the m unicipal executive of your m unicipality with sixweeks of receiving the decision. 6
