This Guide is designed to provide only an illustration of the exem ptions available within California. The selection of an exemption classification and its application to particular assets is a complex matter, and must be done on an individual basis. The dissem ination of this Guide by this office does not constitute legal advice, nor is it an endorsement of the applicability or desirability of any exemptions for a particular situation. Overview: W ithin a bankruptcy case, an individual or a m arried couple m ay claim certain of assets exempt, and thus free from turn-over to the bankruptcy trustee. The rationale behind exem ptions is to assist the "fresh start" of the bankruptcy discharge by allowing retention of certain assets deemed necessary or desirable to continuing and m aintaining the household. In California, debtors m ay choose one of two exem ption classifications, commonly referred to as the "703" exemptions or the "704" exemptions. Married persons must choose only one exem ption classification, even if they file separate bankruptcy petitions. Exemptions are not available for business entities. 703 Exemptions California Code of Civil Procedure (b) (b)(1) Hom estead Equity in real or personal property actually used as residence. $25, (b)(2) Motor Vehicle Equity in one m otor vehicle. $5, (b)(3) Furnishings, Clothing, Goods, Etc. Household goods, wearing apparel, appliances, books, anim als, crops, or m usical instruments held for personal, fam ily or household use. (value is of any particular item) up to $650 per item (b)(4) Jewelry Total equity value of all personal or fam ily jewelry. $1, (b)(5) W ild Card $1, equity, plus any unused portion of the hom estead exem ption, in any property. $1, to $26, (b)(6) Tools of Trade Equity in tools of trade, books or im plem ents. $7, (b)(7) (b)(8) Life Insurance Contract Any unmatured life insurance contract owned by debtor. Life Insurance Cash Value Value of accrued dividend, interest or loan value. $13, (b)(9) Health Aids Professionally prescribed health aids. No stated lim it (b)(10) (A), (B) & (C) (b)(10)(D) Benefits Rights to receive social security, unem ploym ent, public assistance, veterans', disability, or illness benefits. Dwelling can be: conventional house and land, mobile home, boat or other vessel, condom inium, planned developm ent, stock cooperative, or com m unity apartment project. - see below (a)(1) Unm arried, with no dependents $75, (a)(2) Married & living together, or single with dependents $100, (a)(3) Either debtor or spouse is: (A) 65 or older, (B) Disabled, m entally or physically, or (C) 55 or older with annual income not more than $25,000, or if married, with joint annual income not more than $35,000 $175, Motor Vehicles Equity in one or m ore vehicles. $2, Household Goods & Clothing Furnishings, appliances, provisions, clothes, personal effects, if ordinarily and reasonably necessary to debtor and dependents at principal residence Residence Im provem ent Materials Materials to be used to repair or im prove the residence Jewelry, Heirlooms, Art Total equity in jewelry, heirloom s, and works of art Health Aids Health aids reasonably necessary to work or sustain health of debtor or dependents. $3, $7,625.00
3 BANKRUPTCY EXEMPTION GUIDE - CALIFORNIA Page 3 of Tools of Trade Total equity in tools, im plem ents, instrum ents, materials, uniforms, furnishings, books, equipment, one com m ercial vehicle, one vessel and other property used in the business. Separate exem ption allowed for spouse if trade requires tools. Exem ption lim it is $15,250 if debtor and spouse work in same business. The maximum tool of trade exemption which may be applied to a commercial motor vehicle is $4, per spouse, or $9, if each work in same business Paid Earnings Earnings paid within 30-days of filing, if traceable into cash or bank accounts. 100% exem pt if wages then subject to a wage garnishm ent or wage assignm ent for support. 75% exempt if wages not then subject to garnishment or assignment (b)(1); (3) Deposit Account - Public Benefits Up to $1,525 in a bank account that receives direct deposits of public benefits (other than social security benefits) for a single payee. If the deposit account receives direct deposits on behalf of two or m ore payees, the exemption is up to $2, (b)(2); (4) Deposit Account - Social Security Benefits Up to $3,050 in a bank account which receives direct deposits of social security benefits (including retirem ent, survivor, supplem ent security incom e, coal miners' health, and disability insurance benefits) for a single payee. If the deposit account receives direct deposits on behalf of two or more payees, the exemption is up to $4, (c) Deposit Account - Traceable Benefits W ithout regard to the dollar lim its of (b), all m onies traceable as social security benefits or public benefits which rem ain in the bank account which received direct deposits of such benefits are fully exem pt Deposits of Incarcerated Debtor Inm ate trust funds held by public agency Life Insurance Policies Total loan value of unmatured life policies. If married, the exemption amount is doubled. Unmatured policies fully exempt, without dollar value. Benefits under m atured policies (including annuity) exem pt to extent reasonably necessary for support of debtor, spouse and dependents Public Retirem ent Benefits All am ounts held, controlled or in process of distribution as benefits from state, city, county or other public agency. All am ounts received by debtor from public retirem ent system or from United States federal retirem ent Vacation Credits All vacation credits or paym ents to public em ployee Private Retirem ent Benefits Benefits under private retirem ent plans, union retirem ent plans, profit-sharing plans, Keogh plans, and Individual Retirem ent Accounts are exem pt to the extent necessary to provide for support of debtor, spouse and dependents when the debtor retires, taking into account all resources likely to then be available Unem ployment and Disability Benefits All benefits payable as unemployment and disability by state, employer plan, or union. $7, $1,525 or $2,275 $3,050 or $4,575 $1, $12,200.00

(b) excluding excess contributions. (c) no more than $6,225 of all funds placed in all accounts for a single beneficiary within 365 and 720 days before filing date. no stated limit on funds contributed prior to 720 days before the bankruptcy filing date IRC 529(b)(1) Monies in a qualified State 529 Plan contributed at least 365 days before the filing date, and: (a) only if beneficiary is child, step-child, grandchild or stepgrand child of Debtor.
