ADVERTISEMENT FOR BIDS Tree Clearing for Watson Drive City of Kearney, MO Sealed bids will be received at Kearney City Hall, 100 East Washington, Kearney, MO 64060, on or before 2:00 PM, Friday, February 27, 2015, for the following project. At said place and time, all properly received bids will be publicly opened and read. Project Description: Clear and dispose/remove trees and stumps (approx 7 acres) within the limits of a proposed road extension. Install & remove 2-4 temporary drainage crossings. Obtain a no-cost NWP33 permit from the Corps of Engineers for 2, and up to 4, temporary drainage crossings. City to stake roadway centerline and mark/flag the clearing limits on site. Timeframe: Clearing of trees must be completed before March 31, 2015 Project Location: The project area is located northwest of the 19 th Street and Paddock Drive intersection. Bid Packets: Bid packets are available via the Bid Notices link at www.ci.kearney.mo.us. Provisions: The following provisions are required of the successful contractor and are further described in the bid packet: Bid Security/Bid Bond; City Occupation License (application fee will be waived); Insurance naming City of Kearney as additional insured including products and completed operations as provided by ISO form CG 2010 (11-85) or equivalent, including commercial general liability, commercial auto liability, worker s compensation, commercial umbrella liability, and builders risk property; A copy of the certificate of insurance with the limits and coverage required in the contract shall be emailed to cityofkearney@certificatemanager.net and in the description field of the certificate Services Contract shall be noted along with a description of the project; Prevailing Wage per Clay County Wage Order No. 21, pursuant to RSMo 290.250; Performance Bond for no less than 100% of the cost of project construction or bank letter of credit, for projects in excess of $25,000; Payment Bond for projects in excess of $25,000, pursuant to RSMo 107.170; 10-Hr OSHA Training, pursuant to RSMo 292.675; Proof of participation in a Federal Work Authorization program (E-Verify), pursuant to RSMo 285.530; Proof of Lawful Presence, pursuant to RSMo 208.009; American Products provision, pursuant to RSMo 34.353, if applicable; Transient Employer provision for employers not domiciled in Missouri, pursuant to RSMo 285.230. Each bid shall be accompanied by a bid bond, certified check, or cashier s check, in an amount not less than 5% of the contract price. The bidder certifies that their bid is genuine and is not made in the interest, or on behalf of, any undisclosed person, firm or corporation. Bidder certifies that they have not directly or indirectly induced or solicited any other bidder to put in a false or sham bid, that they have not solicited or induced any person, firm or corporation, to refrain from bidding, and that they have not sought by collusion or other means to obtain any advantage over any other bidder or the owner. Current City Occupation License. The successful contractor, and any and all sub-contractors, shall obtain a current city occupation license prior to beginning construction. Applications are available by contacting City Hall at 903-4728. Electrical contractors must provide proof of a master electrical license as part of their occupation license application. The application fee of will be waived. A copy of the occupation license application also shall be emailed to cityofkearney@certificatemanager.net. Insurance Coverage Naming City of Kearney as additional insured. The successful contractor shall provide the following insurance, naming the City as additional insured including products and completed operations as provided by ISO for CG 2010 (11-85) or equivalent: Commercial General Liability - $1,000,000 per occurrence/$2,000,000 aggregate; Commercial Auto Liability - $1,000,000 Single Limit of Liability; Worker s Compensation - $500,000 Employers Liability Limit; Commercial Umbrella Liability - $2,000,000 per occurrence/$2,000,000 aggregate; Builders Risk Property N/A All insurance coverage must be written by companies that have an A.M. Best s rating of A-VII or better, and are licensed or approved by the State of Missouri to do business in Missouri. A copy of the certificate of insurance with the limits and coverage required in the contract shall be emailed to cityofkearney@certificatemanager.net and in the description field of the certificate Services Contract shall be noted along with a description of the project. Performance and Payment Bonds. Contractor shall obtain a Performance Bond for no less than 100% of the cost of project construction, for projects in excess of $25,000. Contractor shall also obtain a Payment Bond for projects over $25,000. The Payment Bond shall state that if the Contractor

fails to pay prevailing wage the Surety will pay the deficiency and any penalty provided for by law which the contractor incurs by reason of their act or omission, in any amount not exceeding the amount of this obligation together with interest, as provided by law. Contractor further agrees to execute on or before the date of this agreement written verification of the performance bond and written verification of the payment bond in a form acceptable to the City of Kearney, Missouri. Said bonds shall be issued from an insurance or bonding company with A.M. Best s rating of A-VII or better. Contractor agrees to obtain the signature of the surety providing bonds herein upon this agreement as additional verification of said bonds. A bank letter of credit covering these provisions will be accepted in lieu of the performance and payment bonds. Prevailing Wage Provision. Wage rates for the project shall be not less than the prevailing wage rates per Clay County Wage Order No. 21, as determined by the Division of Labor Standards of the State of Missouri, pursuant to RSMo 290.250. The contractor will forfeit a penalty to the contracting public body $100 per day, or portion thereof, for each worker that is paid less than the prevailing rate for any work done under the contract by the contractor or any subcontractor, pursuant to RSMo 290.250. The City is required to notify the Missouri Department of Labor that a prevailing wage project will be constructed, prior to beginning work. OSHA Training Required. The contractor and all subcontractors to the contract must require all onsite employees to complete the ten-hour OSHA safety training program required under RSMo 292.675, if they have not previously completed the program and have documentation of having done so. The contractor will forfeit a penalty to the contracting public body $2,500.00 plus an additional $100.00 for each employee employed by the contractor or subcontractor, for each calendar day, or portion thereof, such employee is employed without the required training, pursuant to RSMo 292.675. The contractor shall provide a copy of proof of the OSHA training prior to beginning work. In addition, the City is required to notify the Department of Labor when work on the project will commence. Federal Work Authorization Program (E-Verify): Pursuant to RSMo 285.530, no business entity or employer shall knowingly employ, hire for employment, or continue to employ an unauthorized alien to perform work within the state of Missouri. The contractor shall provide a signed and notarized affidavit and proof of enrollment affirming said requirement with their bid. Proof of Lawful Presence: RSMo 208.009 requires that contractors provide affirmative proof that the contractor is a citizen or permanent resident of the United States or is lawfully present in the United States. Affirmative proof can be established through a Missouri drivers license; U.S. Birth Certificate certified with an embossed, stamped or raised seal issued by a state or local government (hospital certificates are not acceptable); U.S. Passport (valid or expired); U.S. Certificate of Citizenship, Naturalization or Birth Abroad; U.S. Military Identification Card or Discharge Papers accompanied by a copy of U.S. Birth Certificate issued by a state or local government. American Products: Pursuant to RSMo 34.353, any manufactured good or commodities used or supplied in the performance of the contract or subcontract shall be manufactured or produced in the United States, unless determined to be exempt as provided in the Section. Transient Employers: Every transient employer, employers not domiciled in Missouri, pursuant to RSMo 285.230, must post in a prominent and easily accessible place at the work site a clearly legible copy of the following: 1)The notice of registration for employer withholding issued to such transient employer by the Director of Revenue, 2) Proof of coverage for workers' compensation insurance or self-insurance signed by the transient employer and verified by the Department of Revenue through the records of the division of workers' compensation; and 3) The notice of registration for unemployment insurance issued to such transient employer by the Division of Employment Security. Any transient employer failing to comply with these requirements shall, under RSMo 285.234, be

liable for a penalty of $500.00 per day until the notices required by this section are posted as required by the statute. The City reserves the right to award the contract by sections, to reject any or all bids, and to waive any informalities or irregularities therein. The City will affirmatively ensure that in any Contract entered into pursuant to this advertisement; minority business enterprises will be afforded full opportunity to submit bids without discrimination, regardless of race, color, or national origin, in consideration for any award.
