RESOLUTION APPROVE THE 12/29/2014 END OF YEAR MEETING MINUTES 15-01-50 AND DISPENSE WITH THE READING yes and yes asked that they approve the organizational meeting minutes at the next meeting to give them more time to review them. FISCAL OFFICE: Bank statement for December was signed. Annual Financial Report - Smith indicated that the annual financial report has been completed and has been posted on the bulletin boards and she will give it to Ripple to post on the website. First Amended Certificate Smith stated she has not received the 1 st Amended Certificate of Estimated Resources but received the certificate that states that the total appropriations do not exceed the Official Estimate of Resources, so spending could resume. OLD BUSINESS: Fire Levy & Staffing Updates said they received what they needed from the prosecutor s office and their recommendation was that we pass a resolution declaring it necessary to levy a tax in excess of the ten mil limitation to provide for fire protection and a second resolution which includes all the wording that would go on the ballot. These resolutions needs to go to the Board of Elections by February 4 th and we have another meeting before that so recommended that all three trustees pass that resolution but the first one can be approved tonight. RESOLUTION APPROVE DECLARING IT NECESSARY TO LEVY A TAX IN 15-01-51 EXCESS OF THE TEN MILL LIMITATION TO PROVIDE FOR FIRE PROTECTION BOARD OF TRUSTEES BERLIN TOWNSHIP, DELAWARE COUNTY, OHIO RESOLUTION NO. 15-01-51 RESOLUTION DECLARING IT NECESSARY TO LEVY A TAX IN EXCESS OF THE TEN MILL LIMITATION TO PROVIDE FOR FIRE PROTECTION (R.C. Sections 5705.03, 5705.19, and 5705.192) Renewal Levy for Fire Protection 1

The Board of Trustees of Berlin Township, Delaware County, Ohio (the Board) met in regular open session on January 12, 2015 at 7:00 p.m. at the Berlin Township Hall, 3271 Cheshire Road, Delaware, Ohio 43015, with the following members present: 1. Adam 2. Ron Mr. introduced the following resolution and moved its passage: PREAMBLE WHEREAS, this Board is the taxing authority for Berlin Township, Delaware County, Ohio; and, WHEREAS, there is a current five (5) year levy in Berlin Township for fire protection, approved by the electors of Berlin Township at the primary election held on May 4, 2010. The levy is for two and ninety-eight hundredths (2.98) mills and is set to expire in 2015. WHEREAS, this Board wishes to initiate proceedings for the submission to the electors of Berlin Township, the question of a renewal tax levy for fire protection. NOW, THEREFORE, BE IT RESOLVED by the Board, two-thirds of all of the members elected thereto concurring, that: 1. The amount of taxes that may be raised within the ten-mill limitation will be insufficient to provide for the necessary requirements of Berlin Township. 2. Section 5705.03 of the Revised Code, in conjunction with Section 5705.192 of the Ohio Revised Code, authorize the Board to submit the question of a renewal levy outside the tenmill limitation to the electors of Berlin Township. 3. Pursuant to Section 5705.19(I) of the Ohio Revised Code, it is necessary to levy a tax in excess of the ten-mill limitation for the purpose of providing and maintaining fire apparatus, appliances, buildings, or sites therefor, or sources of water supply and materials therefor, or the establishment and maintenance of lines of fire alarm telegraph, or the payment of permanent, part-time, or volunteer firefighters or firefighting companies to operate the same, including the payment of the firefighter employers contribution required under section 742.34 of the Revised Code, or the purchase of ambulance equipment, or the provision of ambulance, paramedic, or other emergency medical services operated by a fire department or firefighting company. 4. Such levy shall renew the current levy. 5. Such tax levy shall be at a rate not exceeding two and ninety-eight hundredths (2.98) mills for each one dollar of valuation, which amounts to twenty-nine point eight cents ($0.298) for each one hundred dollars of valuation for five (5) years. 6. The Delaware County Auditor is hereby requested to certify the assessed valuation of Berlin Township as of the date of the original audit and the amount to be generated during the first year of collection of a tax for the benefit of Berlin Township at the rate not exceeding two and ninety-eight hundredths (2.98) mills for each one dollar of valuation, which amounts to twenty-nine point eight cents ($0.298) for each one hundred dollars of valuation, for the above stated purpose of fire protection in Berlin Township, for five (5) years, commencing in 2015, first due in calendar year 2016. 7. The Berlin Township Fiscal Officer is hereby authorized and directed to deliver a certified copy of this resolution to the Delaware County Auditor for such purpose. 2

8. The question of such tax levy shall be submitted to the electors of Berlin Township at the election to be held therein on May 5, 2015. 9. Such levy shall be placed upon the tax list and duplicate for the current tax year, commencing in 2015, first due in calendar year 2016, if a majority of the electors voting thereon vote in favor thereof. 10. The form of the ballot to be used at said election shall be substantially as follows: A replacement of a tax for the benefit of Berlin Township for the purpose of providing and maintaining fire apparatus, appliances, buildings, or sites therefor, or sources of water supply and materials therefor, or the establishment and maintenance of lines of fire alarm telegraph, or the payment of permanent, part-time, or volunteer firefighters or firefighting companies to operate the same, including the payment of the firefighter employers contribution required under section 742.34 of the Revised Code, or the purchase of ambulance equipment, or the provision of ambulance, paramedic, or other emergency medical services operated by a fire department or firefighting company at a rate not exceeding two and ninety-eight hundredths (2.98) mills for each one dollar of valuation, which amounts to twenty-nine point eight cents ($0.298) for each one hundred dollars in valuation, for five (5) years, commencing in 2015, first due in calendar year 2016. FOR THE TAX LEVY AGAINST THE TAX LEVY 11. In order to proceed with placing the levy on the ballot, the Berlin Township Fiscal Officer shall and is hereby directed to certify a copy of this Resolution and the certification obtained from the Delaware County Auditor to the Board of Elections of Delaware County, Ohio, not later than February 4, 2015. 12. It is hereby found and determined that all formal actions of this Board concerning and relating to the passage of this resolution were taken in an open meeting of this Board, and that all deliberations of this Board and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Claudia Smith Fiscal Officer of Berlin Township Delaware County, Ohio yes and yes Pichert stated that on February 1st they are going to start taking one day time staff member and having them work 5:00 p.m. to 8:00 a.m. having two firefighters on staff in the evenings. Township Trash Services said he passed out a bid contract that is being discussed by Brown, Troy & Delaware Townships and we could add onto it. Berkshire is also interested in adding on to it so we are making progress. OTARMA Board of Directors RESOLUTION APPROVE VOTING FOR DAVE ANDERSON FOR THE OTARMA 15-01-52 BOARD OF DIRECTORS yes and yes Door Security Codes said Stewart Security was coming out tomorrow to change the codes on the door. Smith stressed that all codes need to be changed and then the new codes need to be given to the appropriate people. CEMETERY: Nothing FIRE DEPARTMENT: Discussed previously ROAD DEPARTMENT: 2015 Road Improvement Program said Irwin submitted the following recommendations for road work for 2015 and recommends that we send the list to the county engineer to give us a quote and then we can decide which roads to do. 1. Full depth repair to Shanahan Rd & South 3B s & K Rd 2. Double chip & seal and onyx coating to: Berrywood Dr, Winding Creek Lane and Clover Plains Drive 3. Double chip & seal to: Heverlo Rd. 4. Onyx coating to: Red Robin Way, Summerwood Crossing, Streamside Dr, Summerwood Ct, Summer Trail Ct, Summerview Pl, Summerview Ct, Summer Ridge Lane, Zoe Ct, Sophie Ct, Summer Leaf Ct, Fox Chase Trail, Summer Crest Dr and Breezewood Lane. 5. He met with Ripple and Heid today and is trying to establish meeting every other week to make sure they are all on the same page and invites any of the BZA or BZC members to attend. said Atlas Butler is getting their quote together for the maintenance contract and for the repairs to the pipe. Smith said the person that was here from Atlas Butler said that the pipe to both furnaces needed to be repaired but the Sunbury quote was only for one pipe. said he would have Sunbury come out again.
