INTERNATIONAL PERFORMANCE COMPETITION JAZZ IN THE PARK Cluj- Napoca, Romania, 3-5 OF JULY 2015 I. ABOUT THE COMPETITION Organizer: Asociația Fapte organizes the International Performance Competition Jazz in the Park as part of the Jazz in the Park Festival, Youth Edition, an edition dedicated to the European Youth Capital Cluj- Napoca 2015. The project is financed by a grant offered by Norway, Iceland, Liechtenstein, and the Romanian Government. Goal: The competition aims to encourage and promote the young bands who play pieces from the style generically designed as JAZZ. Competition sections: (1) Performance and (2) Composition Terms of the competition Application for the competition: 16 of March 1 of June 2015 Communication of the pre- selection: until 15 th of June 2015 Live performance competition in front of the Jury: 3-5 of July 2015 Regulations The participants at the contest are bound to comply with the terms and conditions of these Regulations of the Competition (hereinafter referred to as The Regulations ). The Regulations are available for free to any interested person on the competition page on the link www.jazzinthepark.ro/concurs. The Organizer reserves the right to modify the Regulations, with a prior announcement one (1) business day before such modifications are effective. II. APPLICATION FOR THE COMPETITION Eligible participants The International Competition Jazz in the Park (sections Interpretation and Composition) turns to all the bands who perform pieces of the style generically designated as JAZZ (link list with all the genres accepted in competition).

A band is deemed any artistic group composed of at least two instrument players, regardless the type of instruments. Age limit: the contest is opened to all the participants, regardless their nationality, born after 1 st of July 1985. As an exception, one of the band members is allowed to exceed this age limit. Eligible countries The countries of origin of the bands can be only the following: Bulgaria, Cyprus, Czech Republic, Estonia, Greece, Hungary, Iceland, Liechtenstein, Latvia, Lithuania, Malta, Moldova, Norway, Poland, Portugal, Romania, Serbia, Slovakia, Slovenia, Spain, Ukraine. Application for the competition The application for the competition is achieved by filling in the online form available at the link www.jazzinthepark.ro/contest, until 1 st of June 2015. Documents needed for the application: 1. Copy of the identity card/birth certificate of each member 2. Biography of the band 3. Tape record (2 minutes minimum) of at least one representative piece for the band, live played. The demo (live video tape record) must be uploaded on YouTube and reflect the current composition of the band. The technical quality of the record does not represent a criterion for the jury; however the participants are encouraged to present a higher quality of the record in order to avoid any vitiation of the jury evaluation. Also, the circumstances of the record are not important (live concert, rehearsal room, etc.). 4. A recent colour photograph of the band in the current composition 5. The filled- in registration form (band name, composition, description, contact data, etc.). The Organizer has no liability and cannot be involved in any litigation related to the accuracy of the personal data sent by the participants. Observations Adding other members after the registration for the competition is forbidden without the information and consent of the organizers. The replacement of more than one third of the band members is also forbidden without the information and consent of the organizers. The Organizer reserves the right to refuse the participation of a certain band for reasons of non- concordance with the participation conditions. All the members of the attending bands must read and accept the Regulations before filling in the registration form. Failure to comply with the regulations and conditions stipulated in the Regulations carries a penalization or disqualification. By filling in the registration form, you confirm that you have read, understood, and agree with the Regulations. The Candidate must be free of any liabilities during the development of the Competition.

Announcement of the pre- selection results Each candidate shall receive the confirmation or refusal, respectively the official invitation to participate to the competition (where applicable) until the 15 th of June 2015. After the pre- selection, the first 24 bands in the jury classification will be invited to attend the finale in Cluj- Napoca (3-5 of July 2015). III. ATTENDANCE FEE The attendance at the Jazz in the Park Competition is not subject to any fee. IV. COMPETITION SECTIONS The two competition sections are: 1. Music performance: the musical quality of the band in general, their cohesion, stage appearance are judged 2. Composition: the value and originality of the own compositions of each band are judged. Improvisations on the basis of a known theme are not deemed as compositions. All the bands on the board will implicitly attend the music performance section, and in case that they wish to attend the composition section with a piece, they must mention this in the registration form for the finale, before the performance of the piece. V. CONDITIONS TO ATTEND THE COMPETITION Finale Live performance Each selected band will perform in an event (live finale) organized in the days of 3, 4, and 5 of July 2015 in Cluj- Napoca in the Central Park. In the live performance competition, the band shall perform in front of the jury a recital which shall last 20 minutes as a minimum and 30 minutes as a maximum. In case that the band is registered in the competition with their own composition, this detail must be mention to the jury before the performance of such piece. Transport In case that the band is not from Cluj- Napoca, the transport from their residence place to Cluj- Napoca and back shall be discounted by the organizers of the contest within the limit of 250 lei/band. Accommodations During their participation to the Competition, the organizers provide the members of the bands which are not from Cluj- Napoca a free lodging for the duration of one hotel day. The competitors will

be provided a lodging night, at the choice of each particular band, before the day of the competition, or during the day of competition. During their stay in Cluj- Napoca, the participants will be offered the main meals. VI. ORDER OF ENTRY IN THE COMPETITION The order of entry in the competition shall be established by the organizers and announced at least 7 days before the competition day. The announced order can be modified, in case of force majeure, only by the Organizer. VII. REHEARSALS, EQUIPMENT, AND STAGE The sound checks will be organized in the competition day, in the same location, each band having a maximum of 10 minutes before the beginning the competition. Each band has the right to come with their own sound engineer, provided that this aspect is mentioned in the technical rider sent to the organizers prior to the event. All these details must be adverted at least 7 days prior to the day when each band competes. The Organizer will provide a quality sound and light system which will be used for free by all the bands, and will provide all the drums, guitar, bass, and keyboards amplifiers, microphones, monitors and backstage equipment, as well as all the sound and light engineers, including the auxiliary personnel. The band members can use any personal instrument such as guitar, bass, keyed instruments, any effect pedals. Drummers can bring their own premier, bass drum pedal, drum sticks or cymbal. Bands are bound to send at least 7 days before the Competition finale the technical sheet, mentioning if they have special requests beyond those exposed in the present Regulations. All the bands are bound to use the same backline and drums provided by the organizers. Keyed instruments and any other special equipment others than the personal instruments, such as guitars shall be placed on the stage before the beginning of the concerts and shall remain there until the end. In order to minimize the delay of change of the bands, the bands with a left drummer shall perform either at the beginning, or at the end of the show. All the bands must observe strictly the instruction given by the organizers and the delegate stage manager. The use of any pre- recorded sound material is forbidden. All the bands must perform live. The songs or the covers or the rescored songs are admitted.

VIII. THE JURY AND THE SELECTION PROCESS The jury develops their activity in accordance with the Competition Regulations, in compliance with the Statue of the World Federation of International Music Competitions. Pre- selection criteria: quality and originality of the performance. The judgment criteria, final stage, for establishing the winners are: quality of the interpretation, cohesion of the band, originality, stage appearance. Observations The judgment of each band shall be achieved function of the aforementioned criteria. For each criterion, the jury will grant grades from 1 to 10. Marks will be centralized from all the jury members and a classification will be drawn up. In case of evenness, the decision of the president of the jury is final. The jury decides the winners for each section of the Competition. The jury reserves the right to not award prizes. The decisions of the jury are final. During the participation to the competition, the participants are forbidden to contact the jury members. IX. PRIZES The jury decides on the basis of the criteria described in the clause V. Above about the prises to be awarded for each section of the Competition. The jury reserves the right to not award one or more prizes. The prizes awarded for each section of the competition are indivisible. No derogation to this rule is admitted. Value of the prizes (1) Section of Interpretation: 1 st prize: 800 Euro and the invitation to perform a recital in the opening of the Jazz in the Park 2016 Festival, on the main festival stage. 2 nd prize: 400 Euro 3 rd prize: 200 Euro (2) Section of Composition of the Jazz in the Park Competition 2015: Prize for the most valuable composition: 400 Euro Observations: Prizes can be cumulated.

Prizes will be announced after the termination of the final stage of the Competition. The total value of the prizes amounts to 1.800 Euro, out of which the taxes corresponding to these amounts will be held. X. FINAL TERMS The organizers of the Festival and Competition Jazz in the Park reserve their right to broadcast on TV and Radio, photograph, film, and record on audio- video support all the performances in the stage of the Competition, including the final concert. In this case, the candidates do not benefit from honoraries. Audio records can be subject to the record of an audio support to be used in the following editions of the festival. XI. PROTECTION OF THE PERSONAL DATA In accordance with the requests of Law No. 677/2001 regarding the protection of individuals when processing the personal data and free circulation of these data, as amended, and Law No. 506/2004 regarding the protection of the personal data and private life in the electronic communications sector, the Organizer is bound to manage in safe conditions and only for the mentioned purposes the personal data that the participants of the Competition provide about themselves. The refusal by the participant to provide the required personal data lead to their non- registration for the Competition. XII. TERMINATION OF THE COMPETITION BEFORE THE DUE TERM The competition can be terminated before the due term only in case of an event which represents a case of force majeure, including the case of the incapacity of the Organiser for reasons beyond their reach, to continue the Competition. In such situations, the Organizer is not held by any obligation whatsoever taken in the relation with the participants of the Competition, as it is not bound to pay any compensating or similar amount. XIII. LITIGATIONS AND APPLICABLE LAW The possible litigations between the Organizer, on one side, and the Competition participants shall be resolved amicably or, if an amicable solution cannot be reached, the litigations shall be resolved by the competent court, in accordance with the law.
