COPY OF REGULATION OF THE MINISTER OF FINANCE NUMBER 54/PMK.011/2011 CONCERNING IMPOSITION OF SAFEGUARD MEASURE IMPORT DUTY ON THE IMPORT OF STEEL WIRE ROPES WITH TARIFF HEADING 7312.10.90.0 BY THE GRACE OF GOD ALMIGHTY THE MINISTER OF FINANCE Considering In View of : a. that based on the results of investigation by Indonesia Trade Safeguard Committee, it has been evidenced that there was a big volume of imports of steel wire ropes with tariff heading 7312.10.90.00, which resulted in serious losses to the domestic industries; b. that in order to follow up the results of the investigation in letter a, the Minister of Trade through the Letter Number : 1907/M- DAG/SD/12/2010 dated December 28, 2010, submitted the proposal on imposition of Safeguard Measure Import Duty on the import of steel wire rope products; c. that under the provisions in Article 21 of Presidential Decree Number 84 of 2002 on Domestic Industry Safeguard Measures as a result of import surges, security measures can still be stipulated in the form of import duty by the Minister of Finance; d. that based on the consideration as referred to in letters a, b, and c, and in order to implement the provision in Article 23D paragraph (2) of Act Number 10 Year 1995 on Customs as amended by Act Number 17 of 2006, it is necessary to establish Regulation of the Minister of Finance concerning the Imposition of Safe Guard Import Duty on the Import of Steel Wire Ropes Products with Tariff Heading 7312.10.90.00; : 1. Act Number 7 of 1994 on Ratification of Agreement Establishing the World Trade Organization (State Gazette of the Republic of Indonesia Year 1994 Number 57, Supplement to State Gazette of the Republic of Indonesia Number 3564); 2. Letter of the Minister of Trade Number: 1907/M-DAG/SD/12/2010 dated December 28, 2010 on Proposal on imposition of Safeguard Measure Import Duty on the import of steel wire ropes products HS Number: 7312.10.90.00 and Letter of the Secretary General of the Ministry of Trade Number: 51/M-DAG/SD/1/2011 dated January 17, 2011 concerning List of Developing Countries Exempted from the Imposition of Safeguard Measure Import Duty (BMTP) on Weave Fabric Products of Cotton, Unbleached and bleached; Concrete Wire; Zinc Wire and Steel Wire Rope; 2. Report of Indonesian Trade Security Committee on Investigation Results for Safeguard Measures on the Import of Steel Wire Ropes HS Number: 7312.10.90.00; DECIDES: : REGULATION OF THE MINISTER OF FINANCE ON THE IMPOSITION OF SAFEGUARD MEASURE IMPORT DUTY ON THE IMPORT OF STEEL WIRE ROPES WITH THE TARIFF HEADING 7312.10.90.00. Article 1 The import of steel wire rope product in the form of twisted wire with a diameter of 3 mm or more, rope and cable of iron or steel, plated or coated or not plated or coated and not isolated, non lock coil, flattened strands and non rotating wire ropes, included in tariff heading 7312.10.90.00, shall be subject to Safeguard Measure Import Duty. Article 2 Safeguard Measure Import Duty as referred to in Article 1 shall be imposed for three (3) years with the following provisions: Safeguard Measure No Period Import Duty 1. 1 st Year, with a period of one year from the date of promulgation of this Regulation of the Rp. 24.080/kg Minister of Finance
2. 2 nd Year, with a period of one year from the date of expiration of the first year period 3. 3 rd Year, with a period of one year from the date of expiration of the second year period Article 3 Rp. 21.464/kg Rp. 18.849/kg Safeguard Measure Import Duty as referred to in Article 1 shall be imposed on the importation from all countries, except on the product of steel wire ropes produced from the countries as listed in Appendix of this Regulation of the Minister of Finance. Article 4 (1) The Imposition of Safeguard Measure Import Duty as referred to in Article 1 shall be: a. Additional general Import Duty (Most Favored Nation); or b. Additional preference import duty based on schemes of international goods trade agreement applicable in the case that the imports are carried out from the countries included in the schemes of international goods trade agreement in question and comply with the provisions in the schemes of international goods trade agreement. (2) In the case that the provisions in the schemes of international goods trade agreement are not fulfilled, the imposition of Safeguard Measure Import Duty on the importation from the countries included in the schemes of international goods trade agreement as referred to in item (1) letter b shall be additional general import duty (Most Favored Nation). Article 5 On the import of product of steel wire ropes originating from countries exempted from the imposition of Safeguard Measure Import Duty as referred to in Article 3 and originating from countries that have trade agreement with Indonesia as referred to in Article 4 item (1) letter b, the importer must submit the Certificate of Origin Article 6 The provisions concerning the imposition of tariff of Safeguard Measure Import Duty as referred to in Article 2 shall be applicable fully on the import of goods of which document of import customs notification has received registration number from the Customs Office of port of entry from the date of enactment of this Regulation of the Minister of Finance.
Article 7 1. This Regulation of the Minister of Finance shall come into force on the date of enactment. 2. Regulation of the Minister of Finance shall be valid for three (3) years from the date of enactment of this Regulation of Minister of Finance. For public cognizance, this Regulation of the Minister of Finance shall be promulgated by placing it in State Gazette of the Republic of Indonesia.
