D AN ACT TO AMEND $3111 OF TITLE 5 OF THE GUAM CODE ANNOTATED, TO BROADEN THE QUALIFICATIONS FOR DIRECTOR OF THE DEPARTMENT OF PUBLIC HEALTH AND SOCIAL SERVICES. 1 BE IT ENACTED BY THE PEOPLE OF GUAM: 2 Section 1. Legislative Intent. For an extended period of time, the 3 Department of Public Health and Social Services has not had a Director dedicated 4 solely to the work of that department. The same individual has been filling the 5 positions of Director of the Department of Public Health and Social Services and 6 the Administrator of the Guam Memorial Hospital Authority. In examining the 7 law on the qualifications for Director of the Department of Public Health and

Social Services, it was discovered that there is a lack of parallel language between the paragraphs describing the qualifications. The degree of Masters of Business Administration and Public Administration were included, however, at the Bachelor Degree level, these degree majors were omitted. In order to make the qualifications consistent, the language of the qualifications Section of the Personnel Law on the Director, Department of Public Health and Social Services needs to be amended. Section 2. $3 111 of Title 5 of the Guam Code Annotated is amended to read: "$3111. Department of Public Health and Social Services. There is, within the Executive Branch of the government of Guam, a Department of Public Health and Social Services, the head of which is the Director. The Director of the Department of Public Health and Social Services is appointed by I Maga'lahi [the Governor] with the advice and consent of I Liheslatura [the Legislature]. The Director shall meet the following minimum qualifications: Master's Degree in Health Administration, healthcare service management, human service or a health related field, and five (5) years of experience in the management and administration of a human service, social service, or healthcare service organization of which three (3) years shall have been experienced as an administrator or director in human service, social service, or healthcare service organization; or Master's Degree in Business Administration or Public Administration, and five (5) years of experience in health administration, human service, social service or healthcare service organization of which three (3) years must have

been experienced as an administrator or director in a public health setting, human service, social service or healthcare service organization; or Bachelor's Degree in Business Administration, Public Administration, Health Administration, healthcare service management, human service or health related field, and eight (8) years of experience in health administration or healthcare related field, of whch five (5) years shall have been experienced as an administrator or director in a public health, human service, social service or healthcare service organization."
