1 MINA' BENTE OCHO NA LIHESLATURAN GUM-IAN 2005 (FIRST) Regular Session Bill No. (EC) Introduced by: AN ACT TO APPROPRIATE THE SUM OF SIX HUNDRED THOUSAND DOLLARS ($600,000.00) FROM THE HEALTHY FUTURES FUND TO THE DEPARTMENT OF MENTAL HEALTH AND SUBSTANCE ABUSE TO UNDERWRITE GRANTS TO LOCAL NON-GOVERNMENTAL SERVICE PROVIDERS OF RESIDENTIAL IN-PATIENT AND OUT-PATIENT DRUG AND ALCOHOL DETOXIFICATION, REHABILITATION, AND PREVENTION PROGRAMS. BE IT ENACTED BY THE PEOPLE OF GUAM: Section I. Legislative Findings. 1 Liheslaturan Gudhan finds that the 3 Department of Mental Health and Substance Abuse (DMHSA) is mandated to conduct all 4 government programs relative to substance abuse on the island. The "New Beginnings" program was established within DMHSA to fulfill this mandate. Although DMHSA 6 operated the New Beginnings program for several years, the operations of the program 7 were subsequently reduced from a twenty-four (24) hour seven (7) day week program to S a weekday program operated only between the hours of 9:00 AM and 7:00 PM Based on 9 staff shortages and severe budgetary shortfalls, the program was discontinued and as a consequence, DMHSA has abandoned its mandated mission relative to Substance Abuse.

Legislative Findings. 3 1 operations of the program were subsequently reduced from a 24-2 hour 7-day a week program to a weekday program operated only 3 between the hours of 9:00 AM and 7:00 PM. Based on staff shortages 4 and severe budgetary shortfalls, the program was discontinued and 5 as a consequence, DMHSA has abandoned its mandated mission 6 relative to Substance Abuse. 7 In it's absence, several local non-profit organizations began 8 providing Substance Abuse services such as the Salvation Army, 9 which operates the Lighthouse Recovery center for male patients; the 10 Oasis Empowerment Center, which provides services for female 11 patients; and Sanctuary Incorporated, which provides services for 12 adolescents. However, these services are being limited or are at risk 13 of being closed due to a lack of funding for operations, facilities, and 14 facility maintenance. The closure of such programs provides no 15 alternatives for the treatment of substance abuse and the adjudication 16 of criminal cases for substance abuse offenders. 17 Therefore, it is the intent of I Liheslaturan Gudhan to create an 18 annual grant program for local non-profit organizations providing 19 services in the areas of Drug and Alcohol Detoxification, 20 Rehabilitation, and Prevention. 21 Section 2. Appropriation. The Sum of Six Hundred Thousand 22 Dollars ($600,000) is hereby appropriated from the Healthy Futures 23 Fund to the Department of Mental Health & Substance Abuse to fund 24 local non-profit organizations currently providing drug and alcohol 25 detoxification, rehabilitation, and prevention services as follows: 2

4 (a) Two Hundred Thousand Dollars ($200,000) for services to 2 Adolescent patients; 3 (b) Two Hundred Thousand Dollars ($200,000) for services to 4 Female patients; and 5 (c) Two Hundred Thousand Dollars ($200,000) for services to 6 Male patients. 7 Section 3. Guam Drug and Alcohol Detoxification, 8 Rehabilitation, and Prevention Grant Program. There is hereby 9 created a Guam Drug and Alcohol Detoxification, Rehabilitation, and 10 Prevention Grant Program within the Department of Mental Health and Substance Abuse for the purpose of providing annual grants to 12 local non-profit organizations providing drug and alcohol 13 detoxification, rehabilitation, and prevention services. The Grant 14 Program shall be administered by the Director of the Department of 15 Mental Health & Substance Abuse beginning in Fiscal Year All 16 grants shall be approved by the Guam Mental Health Planning 17 Council based on a grant review process to be promulgated by the 18 Director of the Department of Mental Health & Substance Abuse. 19 Section 4. Guam Drug and Alcohol Detoxification, 20 Rehabilitation, and Prevention Grant Program Continuing 21 Appropriation. Beginning with Fiscal Year 2006, the Sum of Six 22 Hundred Thousand Dollars ($600,000) shall be annually appropriated 23 from the Healthy Futures Fund to the Department of Mental Health 24 & Substance Abuse for the Guam Drug and Alcohol Detoxification, 25 Rehabilitation, and Prevention Grant Program as follows: 3
