SECOND CHAIR LIST ASSISTANT TRIAL COUNSEL IN DEATH PENALTY CASES Texas Code of Criminal Procedure Section 26.052 provides that the presiding judge of the district court in which a capital felony case is filed shall appoint two attorneys, at least one of whom must be named on the Third Region First Chair List, showing that they are qualified as lead counsel. The Third Region Second Chair List consists of attorneys who are qualified and have expressed an interest in appointment as a second chair in the trial of a death penalty case. Appointment from this list, however, is not required under Texas law.
