Indiana Iowa Kansas Kansas doesn t have any private agencies submitting fingerprints via live scan. In all likelihood we would accept live scan fingerprints from any agency that wanted to support such a link to the repository. I do not believe we would need legislation to allow this to happen in our state. We are considering live scan workstations for motor carrier licensing under the U.S. Patriots Act. The Kansas Department of Transportation may install live scan machines at regional offices around the state to fingerprint truck drivers for hazmat certification. Kentucky
Louisiana Maryland Yes, this relates only to the technique used to roll the print. I have nothing to do with the submission. Private agencies use livescan, but submit the livescan cards via U.S. mail Michigan We allow private agencies to submit applicant prints. Minnesota, It is not a question of us not allowing it, but rather a question of us not currently doing it, We do not have an automated workflow for background checks, except for criminal justice employment. Nevada Yes, statute to preclude it. New Hampshire New Mexico
Oklahoma Oregon, We currently do not receive any electronic submissions fro the private sector, simply because no one out there has a livescan or deadscan device and if they did it would have to be compatible with our current technology and standards. We are currently in a position that we have not addressed whether we will allow or prohibit submission. We do receive electronic submission from Indian Tribes relative to Indian Gaming Regulation. Legislation will not be needed to authorize this agency to make these types of decisions. I suppose if we made an unpopular decision the private sector could approach the legislature and move a bill South Carolina, not at this time.
