PARKING RULES AND REGULIONS The Board of Directors publishes the rules and regulations set forth below for information and guidance of all residents in accordance with F.S. Chapters. 713 and 715. These rules are a summary of your governing documents and not meant to serve as a replacement. All rules and regulations covered in the Declaration of Condominium that are not covered herein are still valid and will be enforced. The Board of Directors reserves the right to adopt, amend or rescind the existing Rules and Regulations based on Article VI, Authority of Directors, Section 1 in the Bylaws and as prescribed on page 4 of the Use Restrictions section of the Declarations of The Cottages at OakLeaf Governing Documents. Your cooperation in observing the rules listed below will ensure that our condominium community continues to be a pleasant and attractive place in which to live and maintain the value of your property. ALL UNIT OWNERS MUST INSTRUCT THEIR GUESTS AND TENANTS TO OBEY ALL RULES AND REGULIONS OF THE CONDOMINIUM ASSOCIION, INC. MANAGEMENT OFFICE PHONE NUMBER: 904-449-1038 OPTION 1: REQUESTS A PARKING DECAL, INQUIRE ABOUT A PARKING DECAL, CHECK STUS OF PARKING APPLICION OPTION 2: REGISTER GUEST VEHICLE OPTION 3: ALL OTHER CONDOMINIUM MTERS PARKING GENERAL RULES Residents should use their garage as one parking space and their driveway as a second parking space. Additional parking is designated as overflow parking and is available to residents and their guests on a first-come first-served basis. No long-term parking is permitted in overflow areas. Parking in the mailbox areas is not permitted except briefly to pick up mail. Parking on the street, sidewalk or on the grass is not permitted. (Board approved 3/17/08). NO OVERNIGHT PARKING OF THE FOLLOWING; trailers, commercial vehicles, motor homes or any vehicles which bear any markings visible from outside or any vehicle which carries commercial equipment, tools, ladders, paint cans, or supplies within the bed, with fifth wheel set-up, dual rear wheels, with camper provisions for external hook-up and/or other living accommodations, any pick-up that extends beyond the boundaries of a parking space or overhangs the curb. Pickup trucks that are used as personal transportation shall be permitted. Under no circumstances may a van or other vehicle be lived in overnight. No vehicle, which cannot operate on its own power, shall remain on the condominium property for more than forty-eight (48) hours. No vehicle shall be repaired on the condominium property. Also prohibited are: Boats, motorcycles, water equipment, bicycles, sails, canoes, or rafts stored on or attached to parked cars unless parked in garage. Also, vehicles with raised or lowered suspension that emit excessive noise, fluids, or smoke, no non-operational, unlicensed vehicles or those with expired license may be parked for repair or restoration. Vehicles in violation of the parking policy are subject to towing at the owner s expense. Only Page 1 of 7
representatives of the Association s management company and members of The Cottages Board of Directors are authorized to have vehicles towed. (Board approved 3/17/08). Cars should be washed only in the driveway of the Unit owner owning the car. All garage doors must be closed when not in use. Designated handicap spaces are located in each of the four (4) mailbox areas. Short-term parking in these spaces is available to any resident or guest with a valid handicap tag or license plate. (Board approved 3/17/08). All vehicles must display The Cottages at OakLeaf Parking Decal, as described herein. Vehicles in violation of these rules will be towed or booted at the owner s expense. The speed limit in the community in all areas is 15 mph. Violators are subject to fines. All vehicles being covered while on property need to be reported to the property management company prior to being covered. Parking Decal Assignment THE CONDOMINIUM HOMEOWNER ASSOCIION IS A PARKING BY PERMIT COMMUNITY. 1. If you are a landlord, you must follow the Tenant Screening Procedures prior to moving a tenant onto the property; which includes being current on the assessment fees in order to rent any unit and receive a decal. 2. All residents' vehicles must be registered with the Management Company to receive a vehicle decal (census & copy of vehicle registration). Once registered a YEARLY Decal will be issued for each vehicle registered to the unit. The yearly decal is to be placed on the BACK DRIVERSIDE WINDSHIELD Motorcycles will need to find some means of attachment. 3. All vehicles that remain unregistered and/or not displaying a valid parking decal will be subject to towing without further notice. 4. All vehicles in violation of the parking rules will also be subject to towing and fines without further notice. 5. If your parking decal is damaged and a replacement is needed, please call the Management Company at 904-449-1038. 6. If you purchase a new vehicle or have another vehicle added during the year please contact the Management Company IMMEDIELY. Visitor Parking Policy 1. Visitors parking on association property will be required to be registered by a resident of The Cottages at OakLeaf. 2. Residents can call the Management Company registration line at 904-449-1038 or email the Association Manager. 3. When requesting a visitor s pass; residents must provide the visitor s date of visit, anticipated duration of stay on property, vehicle tag number, vehicle color, resident s name, unit number, vehicle make and model (identical to Census data sheet information request). 4. Vehicles not registered with the Management Company will be subject to towing. 5. Only residents with valid YEARLY decals can register a guest vehicle. Page 2 of 7
6. No visitor s vehicle can be registered for longer than 14 days, after 14 days the resident must reregister their guest. A guest who stays beyond 30 days will be required to purchase a resident decal. 7. Units registering guest must be in compliance with all rules and regulations set forth by The Cottages at Oakleaf Condominium Association, Inc. Enforcement and Towing Policy 1. Visitor vehicles parked on the property AFTER the time period in which the vehicle was registered through the Management Company will be subject to being towed without further warning. 2. Management reserves the right to issue warnings for violations of the Parking Rules and Regulations at their sole discretion. 3. Vehicles in violation of any of the Parking Rules and Regulations are subjected to immobilization and towing without further warning. 4. If a vehicle is in violation of the Parking Rules and Regulation, only Management or its designee can contact the towing company. 5. When towing a vehicle the company must follow the guidelines of the State of Florida (Florida State Statute 715.07 Towing Regulations). The Cottages at OakLeaf Parking Contract It is the responsibility of the Resident/Owner to notify Management of any changes to the information provided in the Census and The Cottages at OakLeaf Condominium Association Parking Permit Form and Emergency Contact Information contained herein as part of this agreement. Parking Guidelines 1. Parker / Residents (owners and tenants) living at The Cottages at OakLeaf need a parking permit to park on the property. The Cottages at OakLeaf is a permit parking condominium community effective February 11, 2014. 2. Permits will not be granted to tenants who have not been through the Tenant Screening Committee (New leases and leases up for renewal are required to go through the committee). TENANTS WHO MOVED INTO THE PROPERTY BEFORE APPROVAL ARE NOT ELIGIBLE FOR PARKING PERMITS. TENANTS ARE RENEWED ANNUALLY AND MAY NOT BE RENEWED IF 3 VIOLIONS HAVE OCCURRED IN ONE YEAR (concurrent with lease terms). SEE NOTES 3. Should a visitor receive a warning ticket, please call the Management office to resolve the matter immediately. Page 3 of 7
4. If a resident vehicle is given a warning tow sticker, please contact the Management office to resolve the matter. 5. Please refer to the condominium s Governing Documents, Rules and Regulations, Page 3, Parking. Vehicles may be towed for any non-compliance per the governing documents of the community and the Board of Directors as they modify the Rules and Regulations of the association. 6. Car repair work or car washing is not allowed in the parking lot. Car parts (tires, car batteries, etc.) should not be left at any dumpster or stored within view on any patio/balcony, etc. The items must be disposed of timely and appropriately. 7. Sports should not be played in the parking lot due to the potential damage to property and injury. Anyone who causes damage to vehicles in the parking lot is responsible for those damages. 8. Condominiums with more than 2 vehicles, and cannot park in their personal driveway, will be asked to park the additional vehicle in areas designated for Owners/Residents in the overflow areas of the community. Owners/Residents are NEVER permitted to park in the designated Visitor parking areas. 9. Overflow Parking Permits will be distinctive from the decals the owners receive for parking in the garage and driveway. This decal will be a different color for easy identification of violators who are illegally parked in the overflow area. Cars with decals specific for parking in the garage or driveway are NOT permitted to park in the overflow area for any reason, or they will be subject to towing. However, overflow parking decal owners ARE permitted to park in the garage or driveway of the unit the vehicle is registered. 10. Cars not designated to park in overflow are subject to towing. Owners/Residents are not permitted to park in the designated visitor parking spaces. Owners/Residents will only park in Owner marked spaces in the overflow areas. Visitors are not permitted to park in the owner designated parking spaces, or they will be towed. Do not park in front of the mail kiosks for any reason except to retrieve your mail. Diagram attached denotes the overflow areas. 11. Parking in the driveway of an empty or vacant unit you do not own is not permitted. 12. Please reference the parking lot map for more details on where to park overflow vehicles. 13. Vehicles towed will be at the owner s expense. Violation Enforcement IF A VIOLION IS RECEIVED RESIDENTS ARE TO CALL 904-449-1038 REGARDLESS OF HAVING A DECAL OR NOT! 1. Violation of any of The Cottages at OakLeaf Parking Rules and Regulations contained herein will Page 4 of 7
Page 5 of 7 result in the towing of the vehicle from The Cottages at OakLeaf Parking Lot, by the contracted towing company at the vehicle owner s sole risk and expense, and/or a hearing will take place before The Cottages at OakLeaf Fining Committee. The results of a hearing before The Cottages at OakLeaf Fining Committee may result in a fine being imposed. 2. Any vehicles parked in The Cottages at OakLeaf parking areas deemed by The Cottages at OakLeaf Board of Directors or Management Company per these rules and regulations is illegal, disabled or unapproved will be subject to towing at the sole risk and expense of the owner of the vehicle. 3. It is the responsibility of unit owners to provide their tenants with The Cottages at OakLeaf Parking Rules and Regulations at the time of the lease signing. Any new resident is expected to have requested parking decals prior to moving in. Failure of unit owners to keep their accounts current will result in a fine to the owner s account, no less than $100.00 and no more than $1,000.00 per violation. 4. It is the responsibility of The Cottages at OakLeaf residents to provide their visitors with The Cottages of OakLeaf Parking Rules and Regulations. 5. All visitors of The Cottages at OakLeaf who will be in the community for at least 24 hours must have a temporary Visitor s decal, which is furnished by the management company. The decal will have a Start and End date, if the visitor needs an extension, the owner of the visited unit must request a new visitor s decal for display in the windshield for the entire visitation period. The maximum time of a visitor s decal is 30 days. Beyond 30 days, the owner must purchase a permanent owner decal for that vehicle. Normal vehicle registration will apply. At which this point, the vehicle cannot park in the designated visitor parking space but must park in an Owner/Resident overflow parking space. 6. Requests for exceptions to The Cottages at OakLeaf Parking Rules and Regulations with an appeal of any action taken as a result of any violations must be submitted in writing to the Board via email or hand delivered to the on-site Manager. 7. Covenant violations or violations of The Cottages at OakLeaf governing documents, including the Cottages at OakLeaf Rules and Regulations, can result in fining on the owner s account. 8. It is the responsibility of The Cottages at Oakleaf residents to register all visitors parking on the property. This agreement is made by and between the unit Owner/Resident and Management. The Parker agrees that no third party shall be held liable for the performance of any of the terms of this agreement except otherwise be provided by law. Failure to follow instructions from Management personnel may result in a fine being imposed to the owner s account. By becoming an Owner or Resident of The Cottages at OakLeaf Condominium Association, Inc. the Parker (Owner/Resident) hereby acknowledges they are in full agreement with their associated responsibilities, and that all information provided in The Cottages at OakLeaf Condominium Association Parking Permit Form and Census Data Information is accurate and complete. Furthermore, the Parker agrees it is their responsibility to disseminate this information to any and all visitors.
This constitutes the entire agreement between the parties and shall be incapable of modification unless mutually agreed to in writing by both parties. Page 6 of 7

The leasing term must be for a period of no less than one (1) month. The tenant screening amendment provides for annual tenant review by the committee. Tenants with violations or owners who stop paying association fees are subject to denial of renewal and or the leasing fee be forwarded to the Association to bring the assessment current. Page 7 of 7
