Rights and Responsibilities

Each student who enrolls at Central Missouri assumes an obligation to abide by the rulesandregulationsoftheuniversityaswellasthelocal,state,andfederallaws.the following policies describe some of the privileges and obligations for student members of the University of Central Missouri community. Each student is held responsible for this information. Central Missouri is required by law to print the following regulations. Disciplinary Philosophy The University views the judicial process as a learning experience which can result in growth in personal understanding of one s responsibilities and privileges within the University environment. To this end, the hearing procedure attempts to balance an understanding and knowledge of students and their needs with the needs of the academic community. There are some actions which cannot be tolerated because they seriously interfere with the basic purposes, necessities, and processes of the academic community, or with the rights essential to other members of that community. By formulating a general code of ethics, rules and regulations, the University does not absolve the students from accepting responsibility for their behavior. Rather, it reaffirms the principle of student freedom that is coupled with an acceptance of full responsibility for individual action and the consequences of such action. In the University community freedom of expression is uncompromisingly protected. It is hoped an atmosphere that fosters a free exchange of diverse opinions will always exist. At the same time, offensive language and actions that reflect on a person s race, color, religion, gender, or national origin are considered in poor taste. Students are not only members of the academic community; they are, additionally, members of the larger society and thus retain the rights, protections, guarantees, and responsibilities which are held by all citizens. Therefore, a student is not immune from prosecution by local, state, or federal enforcement agencies, whether or not the University takes action on the violation. Most matters external to the University environment are considered to be private affairs with which the University will not become involved unless the student s actions may be considered detrimental to the University community. Student Rights and Responsibilities The University of Central Missouri is an academic community in which persons students, faculty, and administration share responsibility for its growth and continued welfare. As members of the University community, students can reasonably expect the following: 1. Students have the right to freedom from discrimination on the basis of race, color, sex, age, religion, creed, national origin, sexual orientation, and marital status. 2. Students shall have the opportunity to participate in the formulation of policy directly affecting students through membership on appropriate committees as determined by the President or other recognized constitutional groups within the University. 3. The University shall not interfere with the rights of students to join associations which promote their common interests as students. 4. Students should have accurate and plainly stated information relating to maintenance of acceptable academic standing, graduation requirements, and individual course objectives and requirements. 5. Student records will be maintained in keeping with the Family Educational RightsandPrivacyActof1974(seepolicystatementonpage147). 6. In all instances of general discipline, academic discipline, and academic evaluation, the student has the right to fair and impartial treatment. 7. Students are free from illegal searches and seizures. 8. Students may engage in peaceful and orderly protest, demonstrations, and picketing which does not disrupt functions of the University. 9. The University of Central Missouri considers freedom of inquiry and discussion essential to a student s educational development. Thus, the University recognizes the right of all students to engage in discussion, to exchange thought and opinion, andtospeak,write,orprintfreelyonanysubject,inaccordancewiththe guarantees of Federal or State constitutions. This principle is the cornerstone of education in a democracy. As members of the University community, students have an obligation to that community and to the preservation of the academic process. As citizens, students have theresponsibilitytoknowandobeythelawsoftheunitedstates,thestateof Missouri, and the local government. Student status in no way exempts them from the requirements of obeying such laws. Students also have an obligation to know and follow the regulations of the University. The following actions are therefore prohibited: I. Action Detrimental to Others, Yourself and the University. A. Assaulting, striking, intimidating, threatening or endangering the well being of another, or sexual contact or sexual intercourse with a person through the use of force or coercion, without consent or when that person is incapacitated. B. Harassing, harrying or repeatedly belittling or deriding another so as to disrupt their academic performance and social interaction at the University. A student who believes they are the victim of sexual harassment should refer to the Sexual Harassment Policy on page 150 for complaint procedures. C. Obstructing or disrupting any University processes, including but not limited to instruction, research, study, administration, meetings, ceremonies, and student activities. D. Eavesdropping, surveilling, or intruding upon the privacy of another person or group by means of bugging devices, concealed recorders, magnifying optics, etc. or knowingly viewing, photographing, or filming another person inastateoffullorpartialnuditywithoutthatperson sknowledgeand consent. E. Creating a fire, safety, or health hazard. F. Using, possessing or distributing controlled substances as described in the Drug Free Schools and Workplace Statement on page 147. G. Possessing or using explosives or other dangerous devices or violating the University policy on firearms(see page 147). H. Hazing, any action taken or situation created, intentionally to produce mental or physical discomfort, embarrassment, harassment, or ridicule. Such activities may include but are not limited to the following: use of alcohol, paddling in any form, creation of excessive fatigue, physical and psychological shocks, quests, treasure hunts, scavenger hunts, road trips or any other such activities, wearing of public apparel which is conspicuous and not normally in good taste, engaging in public stunts and buffoonery, morally degrading or humiliating games and activities. 130

I. Activating a fire or emergency alarm, extinguisher or other safety device without good cause or reasonable justification. J. Rendering inoperable, abusing, or degrading the effectiveness of a fire or emergency alarm, extinguisher or other safety device without good cause or reasonable justification. K. Operating a vehicle or conveyance in violation of traffic rules or to endanger persons or property. L. Trespassing or entering into or upon, or using University facilities including but not limited to access gained by unauthorized or duplicate keys, bugging devices, computer codes or other methods or devices used to afford unauthorized access to restricted areas or information or operation of equipment. M. Creating undue noise, disturbing the peace, disrupting lawful orderly activities of others or rioting. N. Violating University regulations or policies, including but not limited to solicitation(page 152), alcohol(page 147), residence hall policies (pages 132-136) or family housing regulations, A Guide To Family Housing. O. Destroying, damaging or vandalizing property of another. P. Failing to comply with the directions or instructions of University officials, their authorized agents, or law enforcement officials acting in the performance of their duties. A student is required to produce his/her university ID card upon request of an official. Q. Littering. R. Misuse of technology available through telecommunications to create stress and mental anguish to individuals. S. Misuse of computing resources through failure to comply with laws, license agreements, and contracts governing network, software and hardware use. Breach of computer security, harmful access or invasion of privacy are violations. T. Self-injurious or self-endangering behaviors or verbalizations of the same, failure to engage in adequate self-care, and other behaviors or verbalizations that are disruptive to the University environment. II. Dishonesty. A. Stealing any property or services from another person, group or the University. B. Embezzling, defrauding, or procuring any money, goods, services or thing of value under false pretenses, including the issuance of check, draft, money orderoruseofacreditcardknowingthatitwillbedishonoredupon presentation for payment. C. Purchasing, receiving, using or benefiting from any property, money, services orthingofvalueknowingittohavebeenobtainedormadeavailablein violationofii.a.orb.above. D. Lying, deceiving or conveying false information for the purpose of causing another person or official to act or refrain from acting. E. Forging, altering or misusing any document, record or identification or causing any false information to be entered upon any record or presented at any proceeding. III. Criminal Conduct. The violation of local, state or federal statutes shall also constitute a violation of this Code, and subject the perpetrator to disciplinary action, whether or not prosecuted by public officials. IV. Academic Offenses. Academic Honesty Policy(see pages 142-145). V. General Provisions. A.AstudentwhoassistsinviolatinganyprovisionofthisCodemaybecharged as a responsible participant. B. Students are responsible for the actions of their guest(s). C.ThisCodeshallapplytoanyandalllandsownedorleasedbytheUniversity ofcentralmissouri,aswellastoanylocationwhereastudentisengagedin a University activity. Examples of such coverage include, but are not limited to, University teams traveling to events off campus, University clubs engaging in an event or activity off campus, etc. D.AnattempttoviolateanyprovisionofthisCodewillbeconsideredaviolation. E.Itisnotintendedorpossiblefortheforegoingtoconstituteanallinclusive list of acts that will result in disciplinary actions. Students should be aware that acts detrimental to the functioning of the University as an academic community may result in disciplinary action being taken. In addition to the previous prohibitions all students must abide by the Residence Hall policies while they are in any University Housing facility. United Student Housing Association and Hall Councils review and recommend the following: VI. Residence Hall Policies A. Alcohol 1. Drinking or possession of alcoholic beverages is prohibited in first-year communities/floors regardless of age. 2. Possession of alcoholic beverages in upperclass communities is allowed under the following conditions: a.thestudentmustbe21yearsofageorolder.noalcoholisallowedto beconsumedinaroomwhenpersonsundertheageof21arepresent. b.alcoholisnotallowedinanyareaofthebuildingexceptthestudent s room,providedtheoccupantis21yearsofageorolder. c. Alcohol is for individual consumption only; therefore, no kegs, beer balls, beer bongs, mini-kegs, home brewing kits, or mass quantities of alcoholic beverages are allowed. d.nomorethanfourpeopleareallowedinaroomwhilealcoholis being consumed. All people present while alcohol is being consumed mustbe21yearsofageorolder. e. To discourage any party-like atmosphere in the hall when alcohol is being consumed, the room door must be closed. f. Students coming into the residence halls intoxicated and causing a disturbance or violation of policy also face disciplinary action. B. Bathroom Cleaning Cleaning the bathroom is equal responsibility of all persons living in the suite. C. Bicycles and Motorcycles For safety reasons, bicycles, mopeds, skates, skateboards, and motorcycles arenottobeusedintheresidencehalls.bikeracksareprovidedoutside most residence halls. Bicycles can be stored in the room with agreement by roommate. D. Candles/Incense Students are not allowed to burn candles or incense in their rooms. Candles canonlybeusedasdecorations.noburntwicksareallowed. 132

E. Check-Out 1.Studentroomsmustbereturnedtotheorderinwhichtheywereinupon check-in. 2.Studentswhofailtocheck-outproperly,atanytimeduringtheyear,will be charged $50. 3.Attheendofthesemester,studentsshouldvacatethehallwithin24hours aftertheirlastfinalorbyclosingtimeifthestudent slastfinalisonthe last day. F. Cohabitation Onlystudentsassignedtoaroomareallowedtolivethereandkeeptheir belongings in that room. G. Collection of Cans/Bottles Infirst-yearfloorsorroomswhereallresidentsareunder21yearsofagethe collection of any alcohol containers(beer cans, wine bottles, etc.) is not allowed. H. Common Area Damage Residents may be held responsible for common area damages that occur in hallways, stairwells, lounges, entryways, etc. The Student Damage Review Board will recommend who will be held responsible. I. Cooking No cooking outside of the microwave or coffee pot is permitted in student rooms. All unwanted food and supplies should be disposed of in the trash, notthesink,tubdrainsortoilet. J. Electrical Appliances 1.Refrigeratorsarepermittedinthehallsiftheyare4.5cubicfeetor smaller and/or do not use more than 1000 watts of electricity. 2.Halogenlampswithbulbsover100wattsarenotpermittedinthe residence halls. 3. Microwave ovens operating with no more than 1000 watts are permitted. 4. UL(Underwriters Laboratories) electrical appliances(hair dryers, curling irons, toasters, irons, coffee pots, candle warmers, crock pots, etc.) are allowedtobeusedinthestudentroomsaslongassomeoneisinthe roomatalltimeswhileitemsareinuse. 5.Hotplates,toasterovensandspaceheatersarenotallowedinthe residence hall rooms. K. Fire Safety 1. There is a $225 fine for tampering with the smoke alarm/fire protection equipment in addition to other possible sanctions. 2. Students are expected to comply with the directives of University Housing staff during evacuation and must leave the building immediately when a fire alarm has sounded(one long continuous ring). L. Furniture and Equipment 1. All lounge, lobby and common area furniture or University-owned equipment must remain in its designated area. Moving University commonareafurnitureintostudentroomsmayresultina$25perday charge. 2. Student Room Furniture a. All furniture must remain in the room. Students are responsible for the furniture at all times. b. Beds in Nattinger/Bradshaw, Diemer, South Yeater, should not be disassembled due to safety reasons. Rights and Responsibilities 133

3. Room Equipment Tampering with any university equipment in the room or bathroom is prohibited. M. Gambling Gambling, involving an exchange of any money, is not permitted in any University Housing facility. N. Guests 1.Guestsmaystayinthestudentrooms. 2. Roommate permission must be given for all overnight guests. 3.Thehostisresponsibleforthebehavioroftheguestatalltimes. 4.Guestsmaynotstaymorethanthreeconsecutivenightsornomorethan nine nights per month. O. Hazardous Materials& Containers Hazardous materials and containers are prohibited. P. Incense Incense is prohibited in the residence halls. Q. Lock-Out Studentswillreceivethreefreelock-outs;therewillbea$5fineforeach additional lock-out. R. Lofts 1.Onlyapprovedloftsmaybeusedintheresidencehalls.Approvedloft guidelines can be found at www.ucmo.edu/housing. 2. Residents of Diemer and Todd can not construct lofts. S. Keys 1. A lost key should immediately be reported to your community advisor or chapterassistant.theminimumchargeforalockre-coreinallhallsis $90orthecostofrepairs.Thereisa$10chargeforastudentlosingtheir mailbox key. 2. Duplication of University keys is prohibited. 3. Sharing keys is not permitted. T. Needles/Syringes Students using medications which require injections should not dispose of the needles/syringes in the trash cans. A student can obtain a Sharps Container from the University Health Center at no cost. U. Noise Policy 1. Study/Quiet Hours a.nonoiseshouldbeheardinthehallwaysorbyneighborsincluding those above and below the student. b. Students should be able to study or sleep without undue disturbance or noise. c. Students should refrain from distracting behaviors in the hallways. This includes running in the hallway. d. Students should refrain from shouting in the hallways, lounges, and public areas or slamming of doors. e. Study/Quiet Hours: Sunday-Thursday: 9 p.m.- 10 a.m. Friday- Saturday: midnight- 10 a.m. f. During finals week each semester, there will be extended quiet hours. Signs will be posted throughout the residence halls. 2. Courtesy Hours CourtesyHoursareineffect24hoursaday. 134

V. Paint Policy The University Housing Office provides paint and equipment to residents whowanttopainttheirroomsiftheroomhasnotbeenpaintedinthelast three years. Painting applications are available at the area office. W. Painting of Murals 1. Murals may not have alcohol, drug, sexual, or religious connotations. 2.Muralsmaybepaintedonlyincommonareassuchasloungesand hallways and are prohibited in student rooms. X. Personal Property Coverage In case of theft or damages to student s personal belongings, the University assumes no responsibility. Coverage through family homeowners insurance or from an independent insurance agent is highly recommended. Y. Pets 1.Aquariumfisharepermittedintheresidencehalls.Nootherpetsare permitted. 2. Visitors may not bring pets into University Housing facilities. Z. Posting of Information Bulletin boards for official notices which are approved by the Office of University Housing are available in each residence hall. All posting must be delivered to University Housing, Ellis L23. AA. Pranks/Mischief Actions and/or behavior of pranks or mischief directed at another individual or group is not permitted in University Housing. BB. Public Areas 1. Public lounges, dining areas and public walkways should remain clear of obstructions. Conduct in public areas should be conducive to all aspects of the community environment. 2. Room windows facing the exterior of the building are considered public spaceandmustbefreeofoffensivematerialsatalltimes. CC. Public Domain Policy violations found posted on Public Domain sources may lead to disciplinary actions. Students are encouraged to take precaution with personal information on Public Domains(such as Facebook, Blogs, etc.) DD. Roof and Restricted Areas Access to roofs and restricted areas are for authorized personnel only. Studentsfoundonroofsorinrestrictedareaswillbesubjecttothe University conduct process and may be arrested for trespassing. EE. Room Decoration 1.Nonailsorpermanentmountingdevicescanbeusedonwalls,doors,or furniture. Students will be responsible for any damages resulting from decoration of the room. 2. Live trees/cut trees are not permitted. FF. Room Entry 1. Officials of the University of Central Missouri reserve the right to conduct health and maintenance safety inspections of student rooms. 2.UniversityHousingstaffmemberswillinspectallroomsattheendof each semester and prior to breaks. 3.Ifuponentryaviolationisvisible(i.e.stolensigns,alcohol),itwillbe handled through the disciplinary process. GG. Sex Offender Registered sex offenders are not allowed to live in University Housing. Rights and Responsibilities 135

HH. Smoking Areas 1.Smokingisnotallowedinanyresidencehallspace. 2. Smoking must take place outside the building at the designated area and no closer than 25 feet from the building entrance. II. Sports Playing sports(basketball, baseball, golf, etc.) in the hallways, lounges and rooms is not permitted. This includes running in the hallway. JJ. Trash Residents should not throw trash out of windows, sweep trash into the hallways,orputtrashbagsfullofgarbageinthehallwaysorpublicareas. KK. Vandalism Thecostincurredbysuchbehaviorwillbeabsorbedbythestudentor students as recommended by SDRB or the conduct process. LL. Visitation 1. First year visitation hours: Sunday-Thursday, 7:30 a.m. to midnight Friday, 7:30 a.m. to midnight Sunday Holiday weekends, Friday, 7:30 a.m. to midnight Monday 2. Upperclass visitation hours: 24 hours with the guest policy always in effect MM. Waterbeds Waterbeds are only allowed in the residence halls under the following conditions: 1. A formal medical excuse is issued from a physician outlining the medical need for a waterbed. 2. The student writes a letter of appeal to University Housing requesting an exception to the policy on waterbeds. 3.Thestudentisassignedtothelowerflooroftheresidencehallforsafety purposes. NN. Weapons and Ammunition See Explosives and Lethal Weapons on page 147. OO. Window Air Conditioning Units Air conditioning units can not be installed in any student residence hall window. PP. Window and Screen Policy 1. Screens must remain securely fastened to the window frames in the residence halls. Students who remove their screen or window will be subjecttoachargeandcostofrepairs. 2. Stereo speakers should not be placed in the window and residents should notyellorleanoutoftheirwindows. 3. Residents throwing anything out of their windows are subject to disciplinary action. Parental Notification The University of Central Missouri may use parental notification in order to gain assistance from parents when underage students have an alcohol or drug violation which threatens the health or safety of themselves or other students. Incidents with underage students that interfere with a University function or causes damage to University facilities will be additional cause for parental notification. 136
