Each department is responsible for maintaining appropriate staffing on holidays based on operational needs and in accordance with policy guidelines. Reason for Policy To identify the observed holidays and to provide guidelines for the accrual, use and reporting of holiday time for the designated UMMS holidays. Entities Affected By This Policy All employees eligible for benefits with the exception of Residents and certain Correctional Health Employees are covered under separate holiday policies. To clarify if portions of this Policy are covered by a collective bargaining agreement, contact your Consultant. Page 2 of 5 POLICY NO. 06.01.03 Scope A. OBSERVED HOLIDAYS 1. The following holidays are observed annually: New Year s Day Martin Luther King Day President s Day Patriot s Day Memorial Day Independence Day Labor Day Columbus Day Veteran s Day Thanksgiving Day Day after Thanksgiving Day Day before Christmas Day Christmas Day 2. Holidays will be observed on the calendar day on which each falls except holidays occurring on a Saturday or Sunday, which will be observed on Friday or Monday as designated annually by UMMS. B. HOLIDAY PERIOD 1. A holiday begins with the third shift on the eve of the holiday and ends twenty-four hours later. 2. If an employee is scheduled to work on a holiday which falls on a Saturday or Sunday, the employee will be entitled to a compensatory holiday for that Saturday or Sunday. Otherwise, the holiday benefit will accrue on the observed holiday, either Friday or Monday. C. HOLIDAY ACCRUAL 1. A new employee must work the day before a holiday to be paid for the holiday. 2. A full-time employee receives eight hours pay for each holiday. 3. A part-time employee receives a pro-rata number of hours for each holiday based on his/her percentage of scheduled hours. D. WORKING ON A HOLIDAY 1. A department may schedule employees in positions designated as essential to work a holiday. Before a department may schedule an employee to work a holiday in a position not designated as essential the department head must obtain the approval, at least one week prior to the holiday, from the Vice Chancellor of Operations or designee. 2. A nonexempt employee who works a holiday can receive, at the discretion of the department, either payout for the holiday or holiday compensatory time. 3. An exempt employee who works a holiday can only receive holiday compensatory time. 4. An employee on a flexible schedule will be paid for all hours worked and will receive holiday compensatory time based on his/her percentage of time worked. 5. When a non-exempt full-time or part-time employee works Thanksgiving, Christmas or New Years Day, s/he will be paid at one and one-half times his/her regular hourly rate.
Page 3 of 5 POLICY NO. 06.01.03 E. HOLIDAYS NOT WORKED 1. When a holiday occurs on the regularly scheduled workday of a full-time employee, s/he will be eligible to receive his/her regular day's pay for the holiday. 2. A part-time employee will be eligible to receive a pro-rata number of hours for the holiday and can use other accrued time off to receive a regular weekly pay amount unless the employee works the required balance of time on another day within the holiday pay week. 3. When a holiday occurs on an employee's regularly scheduled day off, the employee will receive holiday compensatory time. 4. A full-time employee whose schedule exceeds eight hours on the holiday will receive holiday compensatory time of eight hours. A part-time employee working a flexible schedule will receive a pro-rata number of hours of holiday compensatory time based on his/her percentage of time. F. HOLIDAY COMPENSATORY TIME 1. Holiday compensatory time must be used within 120 calendar days of the holiday or it will be forfeited. 2. All accrued holiday benefits should be taken before an employee transfers to another department. If it cannot be taken, the holiday compensatory time will be transferred with the employee. G. GENERAL GUIDELINES 1. An employee who was not paid for a portion of the last scheduled workday preceding a holiday(s) or the first scheduled workday following a holiday(s) will not be paid for the holiday and will not receive compensatory time for that holiday(s). 2. An employee scheduled to work on a holiday who fails to report as scheduled because of illness will be charged sick time for the holiday and will not be paid for the holiday or be eligible to receive a compensatory day for that holiday. 3. When a holiday occurs during a scheduled vacation, the holiday must be used for payroll purposes instead of the vacation day. 4. An employee wishing to observe a holiday not recognized by the organization may request to use personal time and/or vacation time in accordance with departmental policy. H. LEAVING THE UNIVERSITY, RETIREMENT AND DEATH 1. Unused holiday compensatory time will be paid to the employee upon leaving the University, retirement or upon death.
