TERMS & CONDITIONS CIMB TESCO MasterCard Credit Card Cash Rebate Campaign 1. The CIMB TESCO MasterCard Credit Card Cash Rebate campaign ( Campaign ) is organised by CIMB Bank Berhad (13491-P) ( CIMB ) and will be held from 29 March 2016 until 31 May 2016 (both dates inclusive) ( Campaign Period ). CIMB reserves the right to change the duration and/or the commencement and/or expiry dates of the Campaign Period upon giving prior notice of not less than fourteen (14) calendar days. 2. The Campaign shall be subject to the terms and conditions hereinafter set out and read in conjunction with the Terms and Conditions relating to Rewards available under the CIMB TESCO MasterCard Credit Card and the prevailing Cardholder(s) Terms and Conditions (collectively CIMB Cardholder Agreement ). Words in these terms and conditions used if not specifically defined shall have the same meaning as defined in the CIMB Cardholder Agreement. In the event of any discrepancy or inconsistency between the terms and conditions herein and those contained in the CIMB Cardholder Agreement, the terms and conditions herein governing the Campaign shall prevail in so far as they apply to the Campaign. 3. The Campaign shall offer the following:- New Cardmember Offer The New Cardmember Offer is only available to customers who fulfill the following requirements:- (i) The New Cardmember (hereinafter defined), who is the principal applicant, shall have successfully applied for a CIMB TESCO MasterCard Credit Card ( CIMB TESCO Card ) within the Campaign Period; Once the CIMB TESCO Card is successfully approved, the New Cardmember shall activate the CIMB TESCO Card within thirty (30) days from the card approval date ( Activation Date ). The card approval date can be found in CIMB Tesco Card mailer. The New Cardmember shall within thirty (30) days from the Activation Date make a minimum retail spending*** of Ringgit Malaysia Two Hundred (RM200/-) at TESCO Stores and/or any other places using his/her CIMB TESCO Card. *** The minimum retail spending shall mean any local, overseas and/or online purchase transactions for goods and services incurred for personal consumption and not for business purposes and shall not include the following:- (a) (b) (c) Quasi Cash transactions (example: betting and/or gaming transactions); Monthly instalments under any instalment payment facility provided by CIMB or any other banks; Payment of annual fees or service charges, delivery charges, cash payments, card replacement fee, government service tax, dispute charges, fraud charges or any other fees, charges or penalties whether imposed by CIMB or otherwise; 1

(d) (e) (f) Cash advance/withdrawal/deposit transactions; Transactions made by the New Cardmember with any merchant associated with or controlled by them or their family members (whether as employee, employer, shareholder or director) i.e. transactions by the New Cardmember with any corporation or business entity in which he is and/or any of his family members are employee or employer or works with or has shares or interest in or is a director of; and Qualifying purchase transactions which are subsequently cancelled or refunded, disputed, unauthorised or fraudulent transactions. Any determination by CIMB as to what constitutes eligible spending shall be conclusive and shall not be challenged in any manner whatsoever. 4. New Cardmember shall mean any person who has not held any CIMB TESCO Card for the last six (6) months prior to the commencement date of this Campaign Period. 5. The following categories of persons are not entitled to the New Cardmember Offer:- (i) (iii) Existing CIMB TESCO Cardcardmembers; Supplementary and/or reinstated CIMB TESCO Cardcardmembers; and Permanent and/or temporary staff or employees of CIMB (including its subsidiaries and related companies). 6. Once the New Cardmember fulfils the requirements in Clause 3( Eligible Cardmember ), he/she shall be entitled to the New Cardmember Offer of a cash rebate of Ringgit Malaysia Fifty (RM50/-) only ( Cash Rebate ). 7. The Cash Rebate is only available to Eligible Cardmembers whose CIMB TESCO Card accounts are current, valid, subsisting and who are not in default of any of the terms of the CIMB Cardholder Agreement. 8. The Cash Rebate will be credited into the Eligible Cardmember s CIMB Tesco Card account within four (4) to six (6) weeks after the end of the Campaign Period and the Cash Rebate will be reflected in the Eligible Cardmember s credit card statement as TESCO rebate. In the event the Eligible Cardmember does not utilise the Cash Rebate within sixty (60) days after the Cash Rebate was credited into the Eligible Cardmember s CIMB Tesco Card account, CIMB reserves the right to withdraw and reverse the Cash Rebate. 1,000 Tesco clubcard points to selected existing Tesco Clubcard member 9. In addition to the Cash Rebate, selected existing Tesco Clubcard member ( Tesco Clubcard member ) is entitled to earn 1000 Tesco Clubcard points ( CIMB Clubcard Points Reward ) subject to the following terms and conditions:- (i)the CIMB Clubcard Points Reward shall run from 29 March 2016 to 18 April 2016; 2

The Tesco Clubcard member shall receive a notification regarding the CIMB Clubcard Points Reward via short messaging service ( SMS ) and/or Electronic Direct Mailer (EDM) from Tesco from 29 March 2016 to 18 April 2016; (iii) To be entitled to the CIMB Clubcard Points Reward, the Tesco Clubcard member must apply for the CIMB Tesco Card by 18 April 2016. Upon successful application of the CIMB Tesco Card, the CIMB Clubcard Points Reward will be credited into the Tesco Clubcard member s CIMB Tesco Card within four (4) to six (6) weeks after 18 April 2016. Other Conditions 10. By participating in this Campaign, the New Cardmember is deemed to have read, understood and agreed to be bound by the Terms and Conditions stated herein and agree that any and all decisions made by CIMB in relation to every aspect of this Campaign shall be final and conclusive. 11. CIMB reserves the right upon giving fourteen (14) calendar days prior notice to substitute the Rebate offered under this Campaign with any other item(s) of similar cost. The Rebate is not exchangeable for physical cash or credit of any kind. 12. CIMB shall not be liable to any New Cardmembers or any party for any loss or damage of whatsoever nature suffered (including but not limited to, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising, in relation to the participation or non-participation in this Campaign. 13. CIMB reserves the right to cancel, terminate or suspend this Campaign upon giving fourteen (14) calendar days prior notice. For the avoidance of doubt, cancellation, termination or suspension by CIMB of this Campaign shall not entitle the New Cardmembers or any other persons whatsoever to any claim or compensation against CIMB for any losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension. 14. CIMB reserves the right upon giving twenty-one (21) calendar days prior notice to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) ( Amendment ) any of the Terms and Conditions herein. Notification to the New Cardmembers in respect of the Amendment shall be effected at CIMB s absolute discretion through any one of the following means of communication, namely, by posting a notice regarding the Amendment at each of CIMB s branches or via CIMB s website or by ordinary mail to the New Cardmember s last known address or by effecting an advertisement regarding the Amendment in one newspaper of CIMB s choice, or via electronic mail or via SMS to the New Cardmembers mobile number or by any other means of notice which CIMB Bank may select and the Amendment shall be deemed as binding on the New Cardmembers as from the date of notification of the Amendment or from such other date as may be specified by CIMB Bank in the notification. 15. These Terms and Conditions may be amended from time to time and shall prevail over any provisions or representations contained in any other promotional material advertising the 3

Campaign. The terms and conditions herein shall apply to and be read together with the provisions in the CIMB Cardholder Agreement, subject to the provision in Paragraph 2 above. 16. CIMB may at its sole and absolute discretion disqualify and/or reject any New Cardmember that it determines to be tampering with the process or the operation of the Campaign, or to be acting in breach or potential breach of these Terms and Conditions. 17. CIMB shall not be liable or held responsible to the New Cardmembers in any manner whatsoever if CIMB is unable to perform any of its obligations stipulated herein where such inability is due directly or indirectly to any act of God, industrial dispute, war, strike, riot, technical or system failures or anything beyond CIMB s reasonable control. 18. In the event of any inconsistency(ies), conflict(s), ambiguity(ies) or discrepancy(ies) between the Bahasa Malaysia and English version of the Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned where request has been made by the New Cardmember and noted and acknowledged by CIMB in its records that the Bahasa Malaysia version of the Terms and Conditions shall govern the operation of this Campaign, then the Bahasa Malaysia version of the terms and conditions herein shall prevail. 19. TERMA-TERMA &SYARAT-SYARAT Kempen Rebat Tunai Kad Kredit MasterCard CIMB TESCO 1. Kempen Rebat Tunai Kad Kredit MasterCardCIMB TESCO ( Kempen ) dianjurkan oleh CIMB Bank Berhad (13491-P) ( CIMB ) dan akan berlangsung dari 29 Mac 2016 hingga 31 Mei 2016 (termasuk kedua-dua tarikh) ( Tempoh Kempen ). CIMB menyimpan hak untuk menukarkan jangka masa dan/atau tarikh-tarikh permulaan dan/atau penamatan Tempoh Kempen dengan memberikan notis terdahulu yang tidak kurang daripada empat belas (14) hari kalendar. 2. Kempen akan tertakluk kepada terma-terma dan syarat-syarat yang dinyatakan selepas ini dan dibaca bersama-sama dengan Terma-Terma dan Syarat-Syarat berkenaan dengan Ganjaran yang disediakan di bawah Kad Kredit MasterCardCIMB TESCO dan Terma-Terma dan Syarat- Syarat Pemegang Kad semasa(secara kolektif Perjanjian Pemegang Kad CIMB ). Perkataanperkataan yang digunakan dalam terma-terma dan syarat-syarat ini sekiranya tidak ditakrifkan secara khusus akan mempunyai maksud yang sama seperti yang ditakrifkan dalam Perjanjian Pemegang Kad CIMB. Sekiranya terdapat apa-apa percanggahan atau ketidakselarasan di antara terma-terma dan syarat-syarat di sini dan terma-terma dan syarat-syarat yang terkandung dalam Perjanjian Pemegang Kad CIMB, terma-terma dan syarat-syarat di sini yang mengawal Kempen akan mengatasi yang lain setakat yang ia terpakai bagi Kempen. 3. Kempen akan menawarkan seperti yang berikut:- Tawaran Ahli Kad Baru Tawaran Ahli Kad Baru hanya disediakan kepada pelanggan yang memenuhi keperluan yang berikut:- (i) Ahli Kad Baru (ditakrifkan selepas ini), yang merupakan pemohon utama, mesti berjaya memohon Kad Kredit MasterCard CIMB TESCO ( Kad CIMB TESCO ) dalam Tempoh Kempen; Setelah Kad CIMB TESCO berjaya diluluskan, Ahli Kad Baru akan mengaktifkan Kad CIMB TESCO dalam tiga puluh (30) hari dari tarikh kelulusan kad ( Tarikh Pengaktifan ). Tarikh kelulusan kad boleh didapati dalam kiriman Kad CIMB Tesco. Ahli Kad Baru akan, dalam tiga puluh (30) hari dari Tarikh Pengaktifan,melakukan perbelanjaan runcit minimum*** Ringgit Malaysia Dua Ratus (RM200/-) di Stor TESCO dan/atau mana-mana tempat lain dengan menggunakan kad CIMB TESCO beliau. ***Perbelanjaan runcit minimum akan bermaksud mana-mana transaksi pembelian tempatan, luar negara dan/atau atas talian bagi barangan dan perkhidmatan yang ditanggung untuk kegunaan peribadi dan bukan untuk tujuan perniagaan dan tidak akan termasuk yang berikut:- (a) Transaksi Tunai Kuasi (contoh: transaksi pertaruhan dan/atau perjudian); (b) Ansuran bulanan di bawah mana-mana kemudahan pembayaran ansuran yang disediakan oleh CIMB atau mana-mana bank lain; 5

(ci) (di) (e) (f) Pembayaran fi tahunan atau caj perkhidmatan, caj penghantaran, pembayaran tunai, fi penggantian kad, cukai perkhidmatan kerajaan, caj pertikaian, caj penipuan atau apa-apa fi, caj atau penalti lain sama ada dikenakan oleh CIMB atau selainnya; Transaksi pendahuluan/pengeluaran/deposit tunai; Transaksi yang dilakukan oleh Ahli Kad Baru dengan mana-mana peniaga yang berkaitan dengan atau dikawal oleh mereka atau ahli keluarga mereka (sama ada sebagai pekerja, majikan, pemegang saham atau pengarah) iaitu transaksioleh Ahli Kad Baru dengan mana-mana perbadanan atau entiti perniagaan di mana beliau adalah dan/atau mana-mana ahli keluarganya adalah pekerja atau majikan atau bekerja untuk atau mempunyai saham atau kepentingan dalam atau merupakan pengarahnya; dan Transaksi pembelian yang layak yang kemudiannya dibatalkan atau dipulangkan, dipertikaikan, tanpa kebenaran atau transaksi penipuan. Apa-apa penentuan oleh CIMB berkenaan dengan apa yang merupakan perbelanjaan layak adalah konklusif dan tidak akan dicabar dalam apacara sekalipun. 4. Ahli Kad Baru akan bermaksud siapa-siapa yang tidak memegang sebarang Kad CIMB TESCO bagi enam (6) bulan terdahulu sebelum tarikh permulaan Tempoh Kempen ini. 5. Kategori perseorangan yang berikut tidak layak untuk Tawaran Ahli Kad Baru :- (i) (iii) Ahli Kad Kad CIMB TESCO yang sedia ada; Ahli Kad Kad CIMB TESCO tambahan dan/atau dikembalikan semula; dan Kakitangan atau pekerja CIMB (termasuk subsidiari-subsidiari dan syarikat-syarikat berkenaannya) yang tetap dan/atau sambilan. 6. Setelah Ahli Kad Baru memenuhi keperluan dalam Klausa 3( Ahli Kad Layak ), beliau akan layak untuk Tawaran Ahli Kad Baru bagi rebat tunai Ringgit Malaysia Lima Puluh (RM50/-) sahaja ( Rebat Tunai ). 7. Rebat Tunai hanya disediakan kepada Ahli Kad Layak yang mana akaun Kad CIMB TESCO adalah semasa, sah, kekal dan tidak memungkiri mana-mana terma Perjanjian Pemegang Kad CIMB. 8. Rebat Tunai akan dikreditkan ke dalam akaun Kad CIMB Tesco Ahli Kad Layak dalam empat (4) hingga enam (6) minggu selepas penamatan Tempoh Kempen dan Rebat Tunai akan dicerminkan dalam kenyataan kad kredit Ahli Kad Layak sebagai rebat TESCO. Sekiranya Ahli Kad Layak tidak menggunakan Rebat Tunai dalam enam puluh (60) hari selepas Rebat Tunai dikreditkan ke dalam akaun Kad CIMB Tesco Ahli Kad Layak, CIMB menyimpan hak untuk menarikbalik dan membalikkan Rebat Tunai. 1000 mata Clubcard Tesco untuk ahli Clubcard Tesco sedia ada yang terpilih 6

9. Sebagai tambahan kepada Rebat Tunai, ahli Clubcard Tesco sedia ada yang terpilih ( ahli Clubcard Tesco ) adalah layak untuk memperoleh 1000 mata Clubcard Tesco ( Ganjaran Mata Clubcard CIMB ) tertakluk kepada terma-terma dan syarat-syarat yang berikut:- (i) Ganjaran Mata Clubcard CIMB akan berlangsung dari 29 Mac 2016 hingga 18 April 2016; (iii) Ahli Clubcard Tesco akan menerima pemberitahuan berkenaan dengan Ganjaran Mata Clubcard CIMB melalui khidmat pesanan ringkas ( SMS ) dan/atau Kiriman Langsung Elektronik (EDM) dari Tesco dari 29 Mac 2016 hingga 18 April 2016; Bagi melayakkan diri untuk Ganjaran Mata Clubcard CIMB, ahli Clubcard Tesco mesti memohon Kad CIMB Tesco selewat-lewatnya 18 April 2016. Setelah permohonan Kad CIMB Tesco berjaya, Ganjaran Mata Clubcard CIMB akan dikreditkan ke dalam Kad CIMB Tesco ahli Clubcard Tesco dalam empat (4)hingga enam (6) minggu selepas 18 April 2016. Syarat-Syarat Lain 10. Dengan menyertai Kempen ini, Ahli Kad Baru dianggap telah membaca, memahami dan bersetuju untuk terikat oleh Terma-Terma dan Syarat-Syarat yang dinyatakan di sini dan bersetuju bahawa apa-apa dan semua keputusan yang dibuat oleh CIMB berkenaan dengan setiap aspek Kempen ini adalah muktamad dan konklusif. 11. CIMB menyimpan hak dengan memberi notis terdahulu empat belas (14) hari kalendar untuk mengganti Rebat yang ditawarkan di bawah Kempen ini dengan apa-apa item lain yang mempunyai nilai setara. Rebattidak boleh ditukarkan dengan tunai fizikal atau kredit dalam apa jua jenis. 12. CIMB tidak akan dipertanggungjawabkan kepada mana-mana Ahli Kad Baru atau mana-mana pihak untuk apa-apa kehilangan atau kerugian dalam apa jua sifat yang dialami (termasuk tetapi tidak terhad kepada, kehilangan pendapatan, keuntungan atau nama baik, langsung atau tidak langsung, sampingan, akibat, teladan, punitif atau ganti rugi khas mana-mana pihak) walau bagaimana sekalipun timbul, berkenaan dengan penyertaan atau bukan penyertaan dalam Kempen ini. 13. CIMB menyimpan hak untuk menghentikan, membatalkan atau menggantungkan Kempen ini dengan memberi notis terdahulu empat belas (14) hari kalendar. Bagi mengelakkan keraguan, pemberhentian, pembatalan atau penggantungan Kempen ini oleh CIMB tidak akan melayakkan Ahli Kad Baru atau mana-mana orang lain jua sekalipun untuk apa-apa tuntutan atau pampasan terhadap CIMB bagi apa-apa kerugian atau kerosakkan yang dialami atau ditanggung secara langsung atau tidak langsung akibat daripada tindakan pemberhentian, pembatalan atau penggantungan. 14. CIMB menyimpan hak dengan memberikan notis terdahulu dua puluh satu (21) hari kalendar untuk mengubah (sama ada melalui penambahan, pemotongan, pengubahsuaian, pindaan atau walau apa jua selainnya) ( Pindaan ) mana-mana Terma-Terma dan Syarat-Syarat di sini. 7

Pemberitahuan kepada Ahli Kad Baru berkenaan dengan Pindaan akan dilaksanakan di atas budi bicara mutlak CIMB melalui mana-mana satu kaedah komunikasi berikut, iaitu, dengan mengeposkan notis berkenaan dengan Pindaan di setiap cawangan CIMB atau melalui laman web CIMB atau dengan mel biasa ke alamat terakhir yang diketahui Ahli Kad Baru atau dengan menyiarkan iklan mengenai Pindaan dalam satu akhbar pilihan CIMB, atau melalui mel elektronik atau melalui SMS ke nombor telefon mudah alih Ahli Kad Baru atau dengan apa-apa kaedah notis lain yang boleh dipilih oleh CIMB Bank dan Pindaan tersebut akan dianggap terikat ke atas Ahli Kad Baru dari tarikh pemberitahuan Pindaan atau dari tarikh lain yang mungkin ditentukan oleh CIMB Bank dalam pemberitahuan. 15. Terma-Terma dan Syarat-Syarat ini boleh dipinda dari semasa ke semasa dan akan mengatasi mana-mana peruntukan atau representasi yang terkandung dalam mana-mana bahan promosi lain yang mengiklankan Kempen. Terma-terma dan syarat-syarat di sini akan terpakai kepada dan dibaca bersama-sama dengan peruntukan dalam Perjanjian Pemegang Kad CIMB, tertakluk kepada peruntukan dalam Perenggan 2 di atas. 16. CIMB boleh di atas budi bicara tunggal dan mutlaknya membatalkan dan/atau menolakkan mana-mana Ahli Kad Baru yang ia tentukan sebagai mengganggu proses atau operasi Kempen, atau bertindak memungkiri atau berpotensi memungkiri Terma-Terma dan Syarat-Syarat ini. 17. CIMB tidak akan dipertanggungjawabkan atau bertanggungjawab kepada Ahli Kad Baru dalam apa cara sekalipun sekiranya CIMB tidak dapat melaksanakan apa-apa kewajipannya yang ditetapkan di sini di mana ketidakupayaan tersebut adalah disebabkan secara langsung atau tidak langsung apa-apa bencana alam ( Act of God ), pertikaian industri, peperangan, mogok, rusuhan, kegagalan teknikal atau sistem atau apa-apa yang berada di luar kawalan munasabah CIMB. 18. Sekiranya terdapat apa-apa ketidakselarasan, konflik, kesamaran atau percanggahan antara versi Bahasa Malaysia dan Bahasa Inggeris Terma-Terma dan Syarat-Syarat di sini, versi Bahasa Inggeris Terma-Terma dan Syarat-Syarat ini akan mengatasi yang lain. Walau apa pun yang disebutkan di atas di mana permintaan telah dibuat oleh Ahli Kad Baru dan telah dicatat dan diakui oleh CIMB dalam rekodnya versi Bahasa Malaysia Terma-Terma dan Syarat-Syarat akan mengawal operasikempen ini, maka versi Bahasa Malaysia terma-terma dan syarat-syarat di sini akan mengatasi yang lain. 19.
