Breckenridge Highlands Clubhouse Rental Agreement This agreement is made and entered into this day of, by and between the Breckenridge Common Facilities Area Association (the "Association") and (the Renter") for the purpose of renting the Association's Clubhouse located at 1820 Michael Dr, Pittsburgh, PA 15227 for the following date and time:. By entering into this agreement, the Renter agrees to: 1. (A.) Pay a $75.00 fee for use of the Clubhouse. (B.) Provide a $150.00 security deposit upon the execution of this Agreement. Payment must be with two (2) separate checks made payable to: Breckenridge Common Facility Area. The $150.00 security deposit reserves the date of rental and may be used to off-set any damages occurring during the rental. The $150.00 security deposit will only be cashed if damages are incurred. Otherwise, the security deposit check will be returned. (C) All fees and required documents must be received within 10 days of the reservation, or it will be cancelled. 2. Abide by the Association rules and policies for the Clubhouse, attached as Exhibit A. A Member of the Board of Directors of the Association or another individual designated by the Board will inspect the Clubhouse before and after use including, but not limited to, the furniture, window coverings, flooring, appliances, and the area surrounding the Clubhouse. (See inspection checklist - Exhibit B) Any items not in good, clean condition will be repaired, cleaned, or replaced as necessary. All costs will be deducted from the aforementioned security deposit. If damage fees are in excess of this deposit, the Renter agrees to pay for any cleaning, repairs or replacement and if not promptly paid, the Association shall assess a fine to the Renter for each day the damage fee is delinquent. The damage fee and fines will incur interest pursuant to Association policies. The fine may be collected in the same manner as the monthly Association assessments. 3. The Renter further agrees that no alcoholic beverage of any sort will be served to any minor(s) or intoxicated person(s). The Renter agrees to accept full responsibility for all accidents or claims that may be the result of any accident, injury, or damage to person or property during the time that the Renter has use of the Clubhouse. 4. The Renter hereby releases and shall hold harmless and indemnify the Association property, its board, owners, contractors, agents, affiliates and related entities thereof for all claims, attorney's fees and other costs or liabilities by or asserted against any of the foregoing as a result of the use of the Breckenridge Clubhouse by the Renter renter's guests. 5. Reservation cancellations: All rental fees will be refunded if a cancellation occurs more than 72 hours in advance of the Clubhouse rental. Cancellations occurring between 24 and 72 hours of the approved rental will receive 50% of the rental fee. Cancellations occurring less than 24 hours of the approved rental are not eligible for a refund of the rental fee. 6. Holiday Reservation cancellations: Due to the high demand of these dates, all rental fees will be refunded if a cancellation occurs more than 3 months in advance of the Clubhouse rental. Cancellations occurring less than 3 months of the approved rental are not eligible for a refund of the rental fee. 7. In the event that the Clubhouse is not used in a responsible manner, the Association shall have the right to terminate this Agreement immediately and request that the Clubhouse be vacated immediately. 8. NOTE: Per the fire code, occupancy of the Clubhouse is limited to: fifty-two (52) people. IN WITNESS WHEREOF, the parties, intending to be legally bound, hereby acknowledge that they fully understand, and do voluntarily execute this Agreement. The Renter acknowledges that he/she may forfeit the deposit if anyone of the above terms and conditions are not followed. In addition, the Renter acknowledges that he/she will be personally responsible for any damage that occurs to the Clubhouse or surrounding areas resulting from the rental use of the Clubhouse. FEE: Each Renter using the Breckenridge Common Area Facility Clubhouse (the "Clubhouse") will sign a rental agreement and release prior to renting the Clubhouse. The rental fee and a security deposit must be paid within 10 days of the reservation or it will be cancelled. The reservation is not finalized until all fees, deposits and required signatures are received. 2. ALCOHOLIC BEVRAGES: Alcoholic beverages may not be served to minors or intoxicated persons in the Clubhouse or on any Common Area Facility property. The Renter of any social event or business function where alcoholic beverages are served may be personally liable for any property damage, personal injuries, or loss of life resulting in-whole or in-part from the host's negligence in allowing any intoxicated guest or attendee to be served alcohol. Such liability may include harm to the intoxicated individual himself and also harm to total strangers involved in automobile accidents etc. caused by that intoxicated individual. 3. SMOKING: Smoking is NOT PERMITTED in the Clubhouse at any time. 4. ASSESSMENTS CURRENT: The Clubhouse is not available for rental to any Breckenridge household that is not current with its Association fees and/or fines. 4. RENTER AS HOST: Only (1) owners or (2) tenants may reserve the Clubhouse. The Renter must be present at all times during the function for which the Clubhouse is rented and must be the primary host/hostess of the event. 5. POOL: Use of the pool area is NOT INCLUDED with the Clubhouse rental, nor can the pool be rented separately. Guests at Clubhouse events are prohibited from using the pool area including the concrete surround (pool deck) and pool grass area during Clubhouse rental without explicit written and prior consent from the managing agent or the Breckenridge Common Area Facilities Board of Directors (BCFA). 6. SET-UP & CLEAN-UP: Set-up may occur no more than 2 hours in advance of the approved rental period unless permission is granted otherwise by or the Association Board or the managing agent. The Renter is responsible for cleaning the Clubhouse, including all equipment, carpets, and furniture within 2 hours immediately following the end of the event. 7. DAMAGE: Pre- and post-rental inspection checklists will be completed for each approved rental. The Renter will be responsible for the repair or replacement of any damages to the Clubhouse as determined during the rental inspection(s). 8. UTILITIES: In winter months, the heat must be set to 60 degrees following the event. During summer months, the air conditioning must be set to 80 degrees following the event. All lights must be turned off by the Renter when the function ends. 9. LOCK DOORS: The Renter must lock all doors at the completion of the function, 10. OCCUPANCY LIMIT: Baldwin Borough ordinance limits building occupancy to fifty-two (52) people. 11. VIOLATIONS: Violations of these rules will be determined by the Board of Directors at their sale discretion. Violations will subject the Renter to any corrective or enforcement action authorized by the Association's governing documents or by-laws, and penalties may include, without limitation, the loss of use of rights of the Breckenridge Clubhouse.
