ADVERTISEMENT FOR BIDS DUCKETT CREEK SANITARY DISTRICT TP1 CLARIFIERS #1 AND #2 REHABILITATION Notice is hereby given that the Duckett Creek Sanitary District will receive sealed proposals at the Duckett Creek Sanitary District Office at 3550 Highway K in O'Fallon, Missouri 63368, Phone No. (636) 441-1244, until 2:00 p.m. local time on Tuesday, August 25, 2015 at which time all bids for the, TP1 clarifier rehabilitation project, will be publicly opened. The Contract work shall include rehabilitation of clarifiers #1 and #2 at Treatment Plant #1 located at 2950 Greens Bottom Road, St. Charles, MO 63303. The bid proposal shall be made on a form of proposal to include equipment, structure and specifications with delivery and installation schedule for complete operational system. Also provide list of subcontractors that will be used for installation and testing. Bid proposal shall be delivered in a sealed envelope clearly marked on the outside TP1 Clarifier Rehabilitation to the Duckett Creek Sanitary District Office on or before the time specified above. No facsimiles will be accepted. The District reserves the right to require the successful bidder to file proof of his ability to properly finance and execute the project together with his record of successful completion of similar projects. The District reserves the right to reject any and all bids, offers, or proposals submitted, or to advertise for new bids. The District reserves the right to defer the acceptance of any proposal and the execution of a contract for a period not exceeding one hundred twenty (120) days after the date of opening of the bids. The successful bidder to whom the contract has been awarded shall sign the contract and performance bond and other required certificates in triplicate and return the signed documents within ten (10) days after the date of their receipt. The successful bidder shall furnish a performance bond and for one hundred (100%) percent of the contract amount and shall file certificates with the District that he has obtained and will continue to carry workmen's compensation insurance, public and private liability, and property damage insurance, and builder's risk insurance in an adequate amount for the duration of the contract. INFORMATION FOR BIDDERS FOR DUCKETT CREEK SANITARY DISTRICT TP1 CLARIFIERS #1 AND #2 REHABILITATION ST. CHARLES COUNTY, MISSOURI 1. OPENING OF BIDS: All bids will be opened publicly at the place designated and at the time set in the Advertisement for Bids. The right to reject any or all bids and to waive defects or technicalities in bids is reserved. Collusion between bidders is sufficient cause to disqualify all bidders so involved. 2. FORM OF PROPOSAL: Bids must be properly signed in ink by the bidder, or by an authorized official or agent when the bidder is a firm or corporation. When the bid is made by a firm, the signature must include the firm name, and the signature of member thereof. When made by a corporation, the signature must contain the name of the corporation followed by the signature of the official or person authorized to bind it in the matter and with proof of his authority. The bid must be enclosed together in a sealed envelope, clearly marked on the outside with the project name, addressed to the Duckett Creek Sanitary District, O Fallon, Missouri. The bidder shall designate on the bid his official address to which all communications can be mailed. No facsimiles will be accepted. 2. INTERPRETATIONS AND ADDENDA: Bidders requiring interpretation or clarification of any conflict, ambiguity, discrepancy, or error which they may discover upon examination of the Bidding Documents or of the site and local conditions shall make a written request for interpretation to the District. All written requests pertaining to questions about the meaning or intent of the Bidding Documents herein received less that ten (10) consecutive calendar days prior to the date for opening of Bids may not be answered. Any interpretation, clarification, correction, or modification to the Bidding Documents will be binding only if given by written Addenda. Interpretations, clarifications, corrections, or modification made orally or by any other manner will not be binding and shall not be relied upon by Bidders. 3. BASIS OF AWARD: Bids will be awarded to the lowest, responsible, responsive Bidder pursuant to the requirements of the Bidding Documents, as determined by District s evaluation of the corresponding Bid Form. In order to be considered the lowest Bidder, that Bidder will have provided the lowest Total Bid Price. 4. AWARD OF CONTRACT: The District will award the contract within a period not exceeding ninety (90) days after the date of opening the bids, or else will reject all bids. The District reserves the right to require the successful bidder to file proof by the contract of their successful completion of similar projects. 5. RIGHT RESERVED TO REJECT BIDS: To the extent permitted by applicable state and federal laws and regulations, District reserves the right to reject any and all Bids, to waive any and all informalities, and to disregard all nonconforming, nonresponsive, or conditional Bids, or to readvertise for Bids. Also, District reserves the right to reject the Bid of any Bidder if District believes that it would not be in the best interest of the Project to make an award to that Bidder, whether because the Bid is not responsive or the Bidder is unqualified or of doubtful financial ability, or is found to lack honesty, integrity or moral integrity or fails to meet any other pertinent standard or criteria established by the intent of the Bidding Documents. 6. EXECUTION OF CONTRACT: The bidder to whom the contract has been awarded shall sign the Purchase and Sale Agreement and performance bond and return them to the District within ten (10) days after receipt of the contract. Failure to execute the contract and bonds and return them to the District within ten (10) days after receipt of the contract shall be cause for the annulment of the contract award. 7. WAGE RATES: Bidders are advised that there shall be paid each employee engaged in the Work, in the applicable trades or occupations, not less than the Wage Rate set for same, namely, the Wage Determination as determined by the Department of Labor and Industrial Relations of Missouri, or Wage Determination by other states in which the Work is located, included in the Bidding Documents. 8. COMPLETION TIME: The Contractor shall commence work within seven (7) days after the date of written notice from the District to begin work, and shall complete all work within the number of days detailed in the Purchase and Sale Agreement after the expiration date of such seven (7) day period. 9. CONTRACTOR'S UNDERSTANDING: It is understood and agreed that the contractor has, by careful examination, satisfied himself as to the nature and location of the work, the general and local conditions, and all other matters which can in any way affect the work under this contract. No official, officer, or agent of the owner is authorized to make any representations as to the materials or workmanship involved, or the conditions to be encountered, and the contractor agrees that no such statement or the evidence of any documents or plans, not a part of this contract, shall constitute any grounds for claim as to conditions encountered. No verbal agreement or conversation with any officer, agent or employee of the owner either before or after the execution of this contract, shall affect or modify any of the terms or obligations herein contained. It is understood and agreed that the contractor has informed themselves fully as to the conditions relating to construction and labor under which the work will be performed, and agrees as far as possible to employ such methods and means in the carrying out of the work as will not cause any interruption or interference with any other contractor. 10. SUBCONTRACTORS, SUPPLIERS, AND OTHERS: Each Bid shall identify the names, addresses and associated information of those Subcontractors, Suppliers or other persons or organizations, including those who are to furnish the principal items of material and equipment, whom Bidder intends to award a Subcontract Purchase Order in an amount in excess of two (2) percent of the Total Bid Price. In addition, if requested by District, each Bidder shall be prepared to submit, within ten (10) consecutive calendar days, a Qualifications Statement List for all Subcontractors, Suppliers, or other persons or organizations so identified. This List shall include the name and address of the Subcontractor, Supplier, or other person or organization and a description of the services, materials, or equipment supplied. 11. CONDITIONS IN BIDDER'S PROPOSAL: The bidder shall not stipulate in their proposals any conditions not contained in the form of proposal contained in the contract documents. 12. CONSTRUCTION COSTS: All units of construction necessary for the completion of the project shall be performed at no additional costs for the District unless specifically listed as a pay item. 13. SAFETY: The contractor is responsible for all job site safety and shall follow all governmental rules and regulations particularly those of the Occupational Safety and Health Administration (OSHA).
