1 SPECIFICATIONS FOR SANITARY SEWER LINE REPLACEMENT IN PIONEER PARK City of Des Peres, Missouri Manchester Road Des Peres, Missouri Prepared by City Engineer March 2011

2 INVITATION TO BID SANITARY SEWER REPLACEMENT Sealed proposals for replacement of 345 ft. of sanitary sewers in Pioneer Park will be received at the Des Peres City Hall until 2:00 pm on Thursday, April 21, 2011 at which time and place the proposals will be publicly opened and read. The work consists of excavating and installing a new 5 to 6 ft. deep sanitary sewer to replace the old clay line and reconnecting the new line to the existing sewer and MSD main. All pipe shall be new schedule 40 PVC. All areas disturbed shall be jetted and strawed. Copies of the contract documents are available in the Public Works Office at City Hall, Manchester Road. Modifications to the contract documents may be made at any time prior to the receipt of bids and all registered holders of contract documents will be furnished copies of any addenda which may be issued. All bids must be submitted on the proposal form furnished, accompanied by a bid bond or certified check for not less than 10% of the total amount bid. A 100% performance bond will be required from the accepted bidder. The City of Des Peres reserves the right to reject any or all bids to advertise for new bids, to waive technicalities, to award on any bid deemed most advantageous to the City, to retain the bid guarantee for 30 days after the bid opening, and to make such investigations as deemed necessary to determine the ability of the bidder to perform the work. Prevailing wages to all workers shall be at least those determined by the Missouri Department of Labor and Industrial Relations. Douglas J. Harms, Purchasing Agent City of Des Peres

3 GENERAL REQUIREMENTS INSURANCE A copy of the Contractor s Certificate of Insurance and his Drain Layers License shall be attached. At least $1,000,000 worth of insurance shall be provided. BOND A Performance Bond of one-hundred percent (100%) of the total price bid shall be provided by the contractor. A 10% Bid Bond shall be included with the bid. PERMITS A permit from St. Louis County Department of Public Works shall be obtained for this work and satisfactory inspections must be completed. The contractor must be a licensed drain layer. All work shall comply with St. Louis County & MSD standards. TIME The work shall be scheduled and completed during the month of August 2011 and shall take no more than five days to complete. Extensions for poor weather may be allowed. All work must be done in a continuous fashion. PAYMENT The contractor may receive one final payment only with 30 days of satisfactorily completing the project. Payment will be based on the per unit prices as measured upon completion by the City s Public Works Department. Lien Waivers, Affidavit of Compliance with the Minimum Wage Rate, and certified copy of the payroll shall be submitted with the final invoice. GUARANTEE All work shall be guaranteed for at least one year from the final payment date. Any settlement or other problems which occur during that time period shall be removed and replaced by the contractor at his expense. DEFAULT Should the contractor fail to perform the above-mentioned work in the specified time period or perform the work not in accordance with these specifications or perform said work in a poor quality manner, the City reserves the right to cancel the contract upon ten (10) days written notice, to take new bids, and to use the Performance Bond to pay others to satisfactorily complete said work. CHANGES No extra payments will be allowed for any alterations, modifications, or other work not specifically listed in the contract unless agreed upon in writing by both the contractor and the City prior to the commencement of said work. The City reserves the right to include additional work in this contract at the same unit price bid, upon mutual agreement of both parties involved. WAGES Prevailing wages to all workers shall be at least those as determined by the Missouri Department of Industrial Relations.

4 SITE PROTECTION The site is in a public park and the area under construction must be barricaded from public use when workers are not present.

5 WORK DESCRIPTION 1) Locate & verify utilities in the vicinity of the work area 2) Obtain permit from St. Louis County Plumbing Dept. 3) Excavate, expose and remove the old clay pipe. 4) Install a new 6 diameter schedule 40 PVC pipe (average depth 5 to 6 ft.) All fittings, connections, bends, glue, etc. shall be provided. The minimum slope shall be.5%. 5) Install 3 new cleanouts on the new line at intervals of approximately 100 ft. 6) Make final connections to existing MSD sewer by installing new Y on the MSD main (to minimize outage time). 7) Backfill pipe, mounding earth & jetting soil around new pipe. 8) Cover disturbed areas with straw. 9) Clean up entire site NOTE: 1) The new line is in a flat field 2) The excavated trench shall be barricaded to prevent park patrons from danger

8 CONTRACT FOR SANITARY SEWER LINE REPLACEMENT IN PIONEER PARK THIS AGREEMENT, made this day of, 2011, by and between hereinafter called the Contractor, and the City of Des Peres, Missouri, hereinafter called the Owner, WITNESSETH that: WHEREAS, The Contractor has submitted a Bid Proposal dated for replacing 345 ft. of 6 diameter sewer line and restoring the site in the Pioneer Park, at 970 Tallie Rd., and WHEREAS, the Owner accepts said proposal and has awarded the work to the Contractor, NOW THEREFORE, the Contractor and the Owner for mutual considerations stated herein agree as follows: ARTICLE 1. SCOPE OF WORK The Contractor agrees to furnish all the labor, tools, materials and equipment necessary to complete in every detail the above mentioned work in strict accordance with the Contract Documents. ARTICLE 2. TIME OF COMPLETION The Contractor shall commence work when notified in writing to proceed and shall complete the work within the five (5) working days as provided for or pay liquidated damages of $100 per day. It is understood that the rate of progress and time of completion are essential of this contract. ARTICLE 3. ACCEPTANCE AND PAYMENT When the work specified under this contract has been fully completed in accordance with the terms thereof, the City Engineer shall make a final inspection and any defects found shall be remedied by Contractor. After final acceptance of the work by the City Engineer and receipt of the lien waivers, the Contractor shall receive final payment as

9 determined in his bid, by the actual units installed as measured by the City Engineer, less any monies which are due and payable to the Owner as liquidated damages. ARTICLE 4. GUARANTEE The Contractor hereby expressly guarantees the aforesaid work as to workmanship and quality of materials used in connection therewith for a term of one year, commencing on the date of final acceptance of the work or improvements, and binds himself, his successors, or assigns, to make all replacements which may become necessary within that time due to non-conformity with the specifications. Whenever notified by Owner that said replacements are required, the contractor shall at once make the same as directed, and at his own expense. If Contractor does not proceed with such replacements within ten (10) days of receipt of written notice, then Owner shall have the power to cause the same to be made and to charge the cost thereof to Contractor. Nothing in this section is intended as a maintenance guarantee. ARTICLE 5. PERFORMANCE BOND The Contractor furnishes the attached Performance Bond and Payment of Labor and Materials Bond, acceptable to Owner, in the amount of 100% of the total contract price as indicated in the bid. ARTICLE 6. CONTRACT DOCUMENTS The Contract includes this instrument, Notice to Bidders, Bid, Specifications with site plan and details and any addenda or change orders which may be issued. WITNESS WHEREOF, the parties hereto have caused this instrument to be executed in two original counterparts as of the day and year first above written.
