Village of New Maryland 584 New Maryland Highway, New Maryland, NB E3C IKI Office: (506) 451-8508 Fax: (506) 450-1605 Zoning By-Law No.4 Section 6.14 - Swimming Pool Installations 6.14 Swimming Pools 1) The property owner or contractor will be responsible for obtaining a permit and paying all fees to acquire a Village of New Maryland Building Permit for the installation of above-ground or in-ground swimming pools with a depth of 0.61 metres (2.00 Ft.) or more, or for any major repairs, such as, but not limited to, liner replacement, to existing pools. 2) The homeowner or contractor may not use the Village's municipal system or a private well as a water source for filling pools. The homeowner or contractor will be responsible for providing a cash deposit, money order, or cheque to the Development Officer, prior to being issued a Building Permit. The deposit amounts (does not include the cost of the permit) are as follows: Above-Ground Round Pools $500.00 Above-Ground Oval Pools $750.00 In-Ground Pools $1000.00 3) The applicant will qualify for a full refund of the deposit upon presentation of purchase receipts to the Development Officer, for the delivery of water sufficient to fill or replenish the subject pool. 4) Overhead or underground electrical lines are not permitted immediately above or below a swimming pool and 3 metres (9.84 ft.) of horizontal clearance must be provided between the location of the power line and the edge of the pool. 5) No land shall be used for the purpose of a swimming pool unless the pool is: a) enclosed by a fence or by a wall of a building or structure, or by a combination of walls and fences, at least 1.6 metres (5.25 ft.) in height and meeting the requirements of this section (note: fence must be installed before filling the pool); b) located. no less than 2.5 metres (8.20 ft.) from any side or rear lot line; c) located behind the rear line of the house; and d) located 3.6 metres (11.81 ft.) from the side street lot line when located on a comer lot. 6) Where a portion of a wall of a building forms part of an enclosure mentioned in subsection 6.14(5): a) no main or service entrance to the building shall be located therein; b) any door therein, other than a door to a dwelling or dwelling unit, shall be self closing and equipped with a selflatching device at least 1.3 metres (4.26 ft.) above the bottom of the door; and c) the pool must be located a minimum of 1.25 metres (4.10 ft.) from the wall of the building. 7) An enclosure mentioned in subsection 6.14(5) shall not have rails, bracing or other attachments on the outside thereof that would facilitate climbing. 8) A fence mentioned in subsection 6.14(5) shall: a) be made of chain link construction, with galvanized vinyl or other CSA approved coating, or of wood or of other materials, in the manner prescribed by subsection 6.14(9); b) not be electrified or incorporate barbed wire or other dangerous material; and; c) be located at least: i) 1.25 metres (4.10 ft.) from the edge of the swimming pool; and 1.25 metres (4.10 ft.) from any condition that would facilitate it being climbed from the outside. 9) A fence under this section shall be designed and constructed: a) in the case of a fence made of chain links, with: i) no greater than 3.8 centimetre (1.49 in.) diamond mesh, i steel wire not less than No. 12 gauge, or a minimum No. 14 gauge CSA approved coating forming a total thickness equivalent to No. 12 gauge wire, and at least 3.8 centimeter (1.49 in.) diameter steel posts, set below frost level and spaced not more than 2.5 metres (8.20 ft.) apart, with a top horizontal rail of at least 3.2 centimetre (1.25 in.) diameter steel; b) in the case of a fence made of wood, with: i) vertical boarding, not less than 2.5 centimetres (1.00 in.) by 10 centimetres (3.94 in.) nominal dimensions spaced not more than 4 centimetres (1.57 in.) apart, attached to supporting members and arranged in such manner as not to facilitate climbing on the outside, and supporting wood posts at least 8.9 centimetres (3.50 in.) square or round, set below frost and spaced not more than 2.5 metres (8.2 ft.) apart, with the portion below grade treated with a wood preservative, and with a top horizontal rail having a minimum width of3.8 centimetres (1.49 in.) and a height of 13.9 centimetres (5.47 in.); c) in the case of a fence made of metal and located within 3 metres (9.84 ft.) of an in-ground pool, the fence must be grounded to the electrical panel of the dwelling; and d) in the case of a fence constructed with materials and in a manner other than described in this subsection, in a manner that will ensure rigidity equal to the design and construction prescribed by this subsection. 10) Gates forming part of an enclosure mentioned in subsection 6.14(5) shall: a) be equivalent to the fence in content, manner of construction and height; b) be supported on substantial hinges; c) be self-closing and equipped with a self-latching device on the interior side, at least 1.2 metres (3.93 ft.) above the bottom of the gate; and d) have the bottom of the gate no more than 10 centimetres (3.94 in.) above grade.,,'\hnilti-ino in~npr.t-inn\hnilt1ina npnn.t ~nnl1r.sdinn<::\t;:htnrl~rti'i:\nnnl tpoll1~tinn~ 10 iniv ()7 nor
