The Judicial Dilemma : Uses both theory and case law to argue that originalist jurisprudential principles are not inherently compatible with judicial restraint and that restraint must therefore ultimately rely on the disposition rather than the philosophy of judges. Quantum Constitutionalism : Draws on The Federalist, the ratification debates and other 3

writings of the Framers to argue that the Constitution is designed not to guarantee respect for individual rights in each case but rather to create higher and higher probabilities, growing with time, that majorities will behave reasonably. When Veneration Becomes Excessive (co-authored with Benjamin A. Kleinerman, Michigan State University): Madison s call for constitutional veneration in Federalist 49 has been misinterpreted as setting an unreasonably high bar for constitutional amendments, a device he assumed would be used far more frequently.
