There being a quorum present, the meeting was called to order by Chairperson Yates at 2:03 p.m. Executive Officer Ferrer introduced Mr. David Lau to the Board and asked Mr. Lau to give the Board some of his background history. Mr. Lau started his career in pest control at Terminix International in 1999 and left his Service Manager position in February 2003. In March 2003, he joined Ecolab Pest Elimination and is currently their District Manager. Chairperson Yates announced that he was taking the agenda out of order to allow DAG Tam to speak to the Board about the role of the Deputy Attorney General.

Page 2 Deputy Attorney General Rodney Tam, Esq.: Executive Session: DAG Tam briefed the Board on his role as the DAG, the Sunshine Law, and addressed the 20-year criminal conviction question on the application. It was moved by Mr. Ono, seconded by Mr. Manago, and unanimously carried to enter into executive session at 2:06 p.m. pursuant to HRS 92-4 and 92-5, to consult with the Board s attorney on questions and issues pertaining to the Board s powers, duties, privileges, immunities and liabilities. EXECUTIVE SESSION At 2:20 p.m., it was moved by Mr. Ono, seconded by Mr. Manago, and unanimously carried to reconvene to the Board s regular order of business. The room was reopened to the public. Chairperson Yates announced that he was resuming the order of the agenda. Election of Vice Chairperson: It was moved by Mr. Ono to nominate Mr. Kobashigawa as Vice Chairperson of the Board. Mr. Kobashigawa declined the nomination and recommended that an industry member be Vice Chairperson. It was moved by Mr. Manago, seconded by Mr. Lau and unanimously carried to nominate Mr. Ono as Vice Chairperson of the Board. There being no other nominations, Mr. Ono was unanimously elected Vice Chairperson. Approval of the Minutes: Chairperson Yates asked if there are any amendments to the open session minutes of the May 18, 2015 meeting. Executive Officer Ferrer stated that the minutes should reflect Chairperson Yates department name change from Department of Entomology to Plant and Environmental Protection Sciences. It was moved by Mr. Manago, seconded by Mr. Ono, and unanimously carried to approve executive session minutes of the May 18, 2015 meeting as amended. Additions & Revisions to the Agenda: None.

Rule Revision Executive Officer Ferrer reported that Executive Officer Tamanaha has completed the letter to the Attorney General and is now waiting for a clean draft of the rules from the Administrative Services Office. The rules will then be sent to the Director s Office for review. Scope: a. Temp Air, Inc. Heat Treatment for Drywood Termites The Board reviewed the June 3, 2015 correspondence from the Department of Agriculture, Pesticides Branch, the May 27, 2015 letter from Mid-Pacific Pest Control, Inc., the March 9, 2011 letter from the Department of Agriculture Pesticides Branch, Plant Industry Division and the May 23, 1994 letter from the Department of Agriculture, Pesticides Program Manager regarding the Thermal Remediation from Temp Air for the efficacy determination on the use of heat to kill drywood termites. Temp Air, Inc. has already received approval for the use of heat treatment for bed bugs and is now seeking approval for the use of heat treatment to kill drywood termites. Chairperson Yates opined that the letter dated May 27, 2015 from Mid- Pacific Pest Control, Inc. is just a testimony based on previous

Page 6 observations that the Temp Air system should be capable of maintaining the temperatures to eradicate drywood termites in structures and asked to see the efficacy data collected by the applicators that supported the use of the Thermal Pest Eradication system. Mr. Kobashigawa replied that the decision is not based on testimony but the ability to maintain the temperature that proved lethal for drywood termites. Mr. Lau stated that if the Board approves this treatment and it does not work, this decision may ruin the reputation of the industry. Ms. Nakasone added that the determination of whether a product works should not fall under the scope of a pest control operator but should be the determination of the consumer as to whether the treatment actually works. It was moved by Mr. Ono, seconded by Mr. Lau and unanimously carried to defer the Department of Agriculture s recommendation of Temp Air s Thermal Remediation use of heat to kill drywood termites until the Board is able to review the compiled efficacy data. Announcements: The Executive Officer reminded the Board members to direct their insurance providers to the online submittal system. The Online Insurance Submittal (surety) system has been updated to allow more submittals by more insurance companies. The web address is http://pvl.ehawaii.gov/inikua.
